which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name>, and in addition to the Committee on <committee-name committee-id="HWM00">Ways and Means</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title XVIII of the Social Security Act to improve the accuracy of geographic adjustment factors under the Medicare program and to permanently extend certain adjustments to such factors for certain localities, and for other purposes.</official-title></form><legis-body id="H68946B9D79624A358B29E7AC9FCEBEBA" style="OLC"><section id="HE1A932ED70E3490EBA414DA5974D5D74" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Keep Physicians Serving Patients Act of 2021</short-title></quote>.</text></section><section id="H9CEF547B841C4906B1AB4B8EDF050CBD" section-type="subsequent-section"><enum>2.</enum><header>Improving the accuracy of geographic adjustment factors</header><text display-inline="no-display-inline">Section 1848(e)(1)(D) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-4">42 U.S.C. 1395w–4(e)(1)(D)</external-xref>) is amended to read as follows:</text><quoted-block display-inline="no-display-inline" id="H204CEB45D97E47A8814EEA968C5B56CD" style="OLC"><subparagraph id="HBA637C69937D4694998219F884C6C0C3"><enum>(D)</enum><header>Use of accurate data</header><clause id="H075DDC08AA8345528AA7F404636BA796"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">In establishing indices and index values under this paragraph, the Secretary shall use the most recent data available relating to practice expenses, malpractice expenses, and physician work effort in each fee schedule area.</text></clause><clause id="HA57C4FA5A70B489ABDAC5FBE1F6CE041"><enum>(ii)</enum><header>Practice expense and work indices</header><text>In establishing indices and index values under clause (i) or (iii) of subparagraph (A), the Secretary shall—</text><subclause id="H553433B739594CAB80A843427E8310F0"><enum>(I)</enum><text>use the most recent market data available on physician wages, or if available, actual cost data for physician labor; and</text></subclause><subclause id="HFF577B2303D74F29B3A7CC804FEC0E59"><enum>(II)</enum><text>not use nonphysician professional wage data as a proxy for physician wage data.</text></subclause></clause><clause id="H0348A841449D4817845EE62D8C71D12A"><enum>(iii)</enum><header>Practice expense calculation</header><text display-inline="yes-display-inline">In calculating index values under clause (i) of subparagraph (A), the Secretary shall use the most recent office rent data available or data from Federally qualified health centers (as defined in section 1861(aa)(4)) expense reports.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HDD8C900235D14E6D9C6350E45441D621"><enum>3.</enum><header>Floor for work and practice expense geographic indices</header><subsection id="H6070BE47E2C94289B7AE0721538E5E4A"><enum>(a)</enum><header>Work geographic index</header><text display-inline="yes-display-inline">Section 1848(e)(1)(E) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-4">42 U.S.C. 1395w–4(e)(1)(E)</external-xref>) is amended—</text><paragraph id="HD6F73801A9FA43F7BF2CD00DB77917B5"><enum>(1)</enum><text>by striking <quote>and before January 1, 2024,</quote>; and</text></paragraph><paragraph id="H3D229A7649B54A98B1BA0304FCD2A98F"><enum>(2)</enum><text>by adding at the end the following: <quote>Any such increase made for purposes of payment for services furnished on or after January 1, 2022, shall not be applied in a budget neutral manner.</quote>.</text></paragraph></subsection><subsection id="H3D7E06BA88FC429895E69CAA2C7917D7"><enum>(b)</enum><header>Practice expense geographic indices</header><text display-inline="yes-display-inline">Section 1848(e)(1)(I) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-4">42 U.S.C. 1395w–4(e)(1)(I)</external-xref>) is amended—</text><paragraph id="HC0AF30A10944450A9EB22A7922550BCD"><enum>(1)</enum><text>in the header, by striking <quote><header-in-text level="subparagraph" style="OLC">for services furnished in frontier states</header-in-text></quote>;</text></paragraph><paragraph id="H537AB62199134FE09503712DFC90E5F0"><enum>(2)</enum><text>in clause (i), by inserting <quote>and for purposes of payment for services furnished in any State on or after January 1, 2022,</quote> after <quote>2011,</quote>; and</text></paragraph><paragraph id="HFD69C935E4BB41DB83D15F3D4AB47D36"><enum>(3)</enum><text>in clause (ii), by inserting <quote>before January 1, 2022,</quote> after <quote>furnished</quote>.</text></paragraph></subsection></section></legis-body></bill>
