which was referred to the <committee-name committee-id="HBA00">Committee on Financial Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To provide for a moratorium on evictions from and foreclosures on residences during a major disaster or emergency, and for other purposes.</official-title></form><legis-body id="H953AA98FA87245B48BCFDF48F2188DFC" style="OLC"><section id="H918DAF46E14640E5A6D06EEDA0076FFB" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Federal Disaster Housing Stability Act of 2021</short-title></quote>.</text></section><section id="H798EB063573B4316856F355ED1A1B794"><enum>2.</enum><header>Eviction moratorium</header><subsection id="H2EF1294CD45B465A81D4E4AE3CC754B9"><enum>(a)</enum><header>Moratorium</header><text display-inline="yes-display-inline">In the case of any disaster, the lessor of a covered dwelling that is located within the disaster area with respect to such disaster may not, during the eviction moratorium period with respect to such area—</text><paragraph id="H36F036471B414D3C8BF7A7815CF1E4DF"><enum>(1)</enum><text>make, or cause to be made, any filing with the court of jurisdiction to initiate a legal action to recover possession of the covered dwelling from the tenant for nonpayment of rent or other fees or charges;</text></paragraph><paragraph id="HA6595C54B498471B84A4552AD6F99D14"><enum>(2)</enum><text>charge fees, penalties, or other charges to the tenant related to such nonpayment of rent;</text></paragraph><paragraph id="H1C85842E14FB45C1BCFB6A256BB12C4A"><enum>(3)</enum><text display-inline="yes-display-inline">increase the amount charged for rental of the dwelling unit, including by recouping such increased rent through fees or charges after the conclusion of such period;</text></paragraph><paragraph id="HFC5C840B24454B349CB2C27BE7D682CE"><enum>(4)</enum><text display-inline="yes-display-inline">in any manner prevent the tenant of the dwelling unit, if such tenant has temporarily relocated, from returning to the dwelling unit and re-establishing occupancy or require the tenant to be re-screened to determine any eligibility for such occupancy; or</text></paragraph><paragraph id="HFA1C52A13A3C4AB6A796A9F755847556"><enum>(5)</enum><text display-inline="yes-display-inline">otherwise terminate a lease or fail to renew a lease.</text></paragraph></subsection><subsection id="H7B9D310BF2B340CD937CC36C6DEECBA9"><enum>(b)</enum><header>Notice To vacate</header><text display-inline="yes-display-inline">In the case of any disaster, the lessor of a covered dwelling unit that is located within the disaster area with respect to such disaster may not—</text><paragraph id="H1D7A662C8FD9431BBC70F9B6D4169F4D"><enum>(1)</enum><text>require the tenant to vacate the covered dwelling unit before the date that is 30 days after the date on which the lessor provides the tenant with a notice to vacate; and</text></paragraph><paragraph id="H1FA225214B874A57901C37DC88A1F610"><enum>(2)</enum><text>issue a notice to vacate under paragraph (1) until after the expiration of the eviction moratorium period with respect to such area.</text></paragraph></subsection><subsection id="H90E62E9749F9453A9BF803ED290763BC"><enum>(c)</enum><header>Notice of assistance</header><text display-inline="yes-display-inline">Each lessor of a covered dwelling unit that is located within a disaster area with respect to a disaster shall notify the lessee of such unit—</text><paragraph id="H6E268AC8177C4D3D998E7BF68808A868"><enum>(1)</enum><text>as soon as possible after the declaration of the disaster of—</text><subparagraph id="H3A8E4E315C364766B88AB6CFF83D21A3"><enum>(A)</enum><text>the damage assessment status of the dwelling unit, with respect to disaster assistance from the Federal Emergency Management Agency and the Small Business Administration;</text></subparagraph><subparagraph id="HF96912DD368E4EF3841852C77639E55C"><enum>(B)</enum><text display-inline="yes-display-inline">disaster assistance from the Federal Emergency Management Agency and the Small Business Administration for which the lessee may be eligible, with respect to such dwelling unit; and</text></subparagraph><subparagraph id="H49D50CE231A94BEEB1B29AB532D17F0F"><enum>(C)</enum><text display-inline="yes-display-inline">disaster assistance from the Federal Emergency Management Agency and the Small Business Administration for which the lessor may be eligible, with respect to such dwelling unit; and</text></subparagraph></paragraph><paragraph id="H6E213E3202D741CDAAAE181CF206CF67"><enum>(2)</enum><text>in the case of assistance referred to in paragraph (1)(C) applied for by the lessor—</text><subparagraph id="HCE0C84BE2631447F81D3A40F208A27E7"><enum>(A)</enum><text>that such assistance has been applied for, upon such application; and</text></subparagraph><subparagraph id="HC6F008ABD5CC4A5F8DD191CABC7E3333"><enum>(B)</enum><text>that such assistance has been received, upon such receipt.</text></subparagraph></paragraph></subsection></section><section id="HBDBE41F6613540FCB15E05B18B650601"><enum>3.</enum><header>Foreclosure moratorium</header><text display-inline="no-display-inline">Except with respect to a vacant or abandoned property, in the case of any disaster, a servicer of a Federally backed mortgage loan on a property located within the disaster area with respect to such disaster may not, during the foreclosure moratorium period with respect to such area, initiate any judicial or non-judicial foreclosure process, move for a foreclosure judgment or order of sale, or execute a foreclosure-related eviction or foreclosure sale.</text></section><section id="H23979D416B7B48FBB3D3CDC23FCDA67D"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">For purposes of this Act, the following definitions shall apply:</text><paragraph id="HAAE12A1A592B48DB8B7C08D922D2782E"><enum>(1)</enum><header>Covered dwelling</header><text display-inline="yes-display-inline">The term <quote>covered dwelling</quote> means a dwelling that is occupied by a tenant—</text><subparagraph id="H3F4C711EBD5E4373ADA27FE4BD863251"><enum>(A)</enum><text>pursuant to a residential lease; or</text></subparagraph><subparagraph id="H747DA60C062A4EAFBBA66CE227B39863"><enum>(B)</enum><text>without a lease or with a lease terminable under State law; and</text></subparagraph></paragraph><paragraph id="H0B502331A70F49F09604E8D026A3B82C"><enum>(2)</enum><header>Disaster</header><text display-inline="yes-display-inline">The term <quote>disaster</quote> means—</text><subparagraph id="H4C6BC7896BBA4B98A8563053CE22E612"><enum>(A)</enum><text>any national emergency declared by the President under the National Emergencies Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1601">50 U.S.C. 1601 et seq.</external-xref>); or</text></subparagraph><subparagraph id="H0C8FDAB6013E4B71BF55B14160B4E926"><enum>(B)</enum><text>any major disaster or emergency declared by the President under the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/4121">42 U.S.C. 4121 et seq.</external-xref>).</text></subparagraph></paragraph><paragraph id="H940AECE130E14AE1A47216DFAF47C0F5"><enum>(3)</enum><header>Disaster area</header><text>The term <quote>disaster area</quote> means, with respect to a disaster, any area that at any time is subject to the declaration of such disaster. </text></paragraph><paragraph id="HDA592CE30D7B4E48B499170B0128EB05"><enum>(4)</enum><header>Dwelling</header><text>The term <quote>dwelling</quote>—</text><subparagraph id="HF5BE20E95C754BD19B1ED18BA69164C2"><enum>(A)</enum><text>has the meaning given the term in section 802 of the Fair Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/42/3602">42 U.S.C. 3602</external-xref>); and</text></subparagraph><subparagraph id="HD7C0D1F125654270B910F3C9678648F4"><enum>(B)</enum><text>includes houses and dwellings described in section 803(b) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/3603">42 U.S.C. 3603(b)</external-xref>).</text></subparagraph></paragraph><paragraph id="HAA6EA3B6F74644D58756DD52E1FD37B7" display-inline="no-display-inline"><enum>(5)</enum><header>Eviction moratorium period</header><text>The term <quote>eviction moratorium period</quote> means, with respect to a disaster area, the 90-day period that begins upon—</text><subparagraph id="HE4EEA9A02B56481CBAB7D7DE3090DD6D"><enum>(A)</enum><text display-inline="yes-display-inline">in the case of a covered dwelling unit that is eligible for assistance under the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5121">42 U.S.C. 5121 et seq.</external-xref>) or disaster loan assistance from the Small Business Administration, with respect to such disaster, the sooner of—</text><clause id="HE9298E9D440841E68D51AC5A4C0FA3F8"><enum>(i)</enum><text>receipt by the owner of the dwelling unit of all or part of such assistance; or</text></clause><clause id="H0842556958434A9CBFB70D686D8EAB50"><enum>(ii)</enum><text>the expiration of the period of eligibility for assistance under such Act for such dwelling unit with respect to such disaster; or</text></clause></subparagraph><subparagraph id="H4D5ED38CA6C54BF3B5DB0C28FEEEB2C1"><enum>(B)</enum><text display-inline="yes-display-inline">in the case of a covered dwelling unit that is not eligible for assistance referred to in subparagraph (A) with respect to such disaster, the declaration of the disaster for which such declaration was made.</text></subparagraph></paragraph><paragraph id="H18FC30A6ED514F25B9420DF0721FC714"><enum>(6)</enum><header>Federally backed mortgage loan</header><text>The term <quote>Federally backed mortgage loan</quote> includes any loan (other than temporary financing such as a construction loan) that—</text><subparagraph id="HF7399B68F07B4D448F36A8B12DF45FF4"><enum>(A)</enum><text>is secured by a first or subordinate lien on residential real property (including individual units of condominiums and cooperatives) designed principally for the occupancy of from 1 to 4 families, including any such secured loan, the proceeds of which are used to prepay or pay off an existing loan secured by the same property; and</text></subparagraph><subparagraph id="HB17738608C2E47F583DDE1088CC229A2"><enum>(B)</enum><text>is made in whole or in part, or insured, guaranteed, supplemented, or assisted in any way, by any officer or agency of the Federal Government or under or in connection with a housing or urban development program administered by the Secretary of Housing and Urban Development or a housing or related program administered by any other such officer or agency, or is purchased or securitized by the Federal Home Loan Mortgage Corporation or the Federal National Mortgage Association.</text></subparagraph></paragraph><paragraph id="H6D74D457D92843618CE003D3C810A25F"><enum>(7)</enum><header>Foreclosure moratorium period</header><text>The term <quote>foreclosure moratorium period</quote> means, with respect to a disaster area, the 6-month period that begins upon the declaration of the disaster for which such declaration was made.</text></paragraph></section><section id="HF3C6E16DFEF84235BEC4B4D3DC6EF8BC"><enum>5.</enum><header>Applicability</header><text display-inline="no-display-inline">This Act shall apply with respect to any disaster for which the declaration of the disaster is in effect on the date of the enactment of this Act and any disaster for which such declaration is made after such date of enactment.</text></section></legis-body></bill>
