which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name>, and in addition to the Committee on <committee-name committee-id="HWM00">Ways and Means</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend titles XVIII and XIX of the Social Security Act to reduce cost-sharing, align income and resource eligibility tests, simplify enrollment, and provide for other program improvements for low-income Medicare beneficiaries.</official-title></form><legis-body id="H81A61D8586AE4886B73665BAC08DDC3C" style="OLC"><section id="H68758582C08944CDB4D1900C5891A609" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Helping Seniors Afford Health Care Act</short-title></quote>.</text></section><section id="H32CBE88AEE184E02BCAC9D9E91779AE1"><enum>2.</enum><header>Reducing cost-sharing, aligning income and resource eligibility tests, simplifying enrollment, and other program improvements for low-income beneficiaries</header><subsection id="H62B30CEF054E4CE2BC7917A117B4064D"><enum>(a)</enum><header>Increase in income eligibility to 135 percent of FPL for qualified Medicare beneficiaries</header><paragraph id="HE8E9805B251B4AB585F302A7AB0AC7E8"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1905(p)(2)(A) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396d">42 U.S.C. 1396d(p)(2)(A)</external-xref>) is amended by striking <quote>shall be at least the percent provided under subparagraph (B) (but not more than 100 percent) of the official poverty line</quote> and all that follows through the period at the end and inserting the following:</text><quoted-block display-inline="yes-display-inline" id="H82071D16E53441789B86CE67E48B52C5" style="OLC"><text>shall be—</text><clause id="HB15BFAFA4F464C2790DF8DB884EFA0AF"><enum>(i)</enum><text display-inline="yes-display-inline">before January 1, 2022, at least the percent provided under subparagraph (B) (but not more than 100 percent) of the official poverty line (as defined by the Office of Management and Budget, and revised annually in accordance with section 673(2) of the Omnibus Budget Reconciliation Act of 1981) applicable to a family of the size involved; and</text></clause><clause id="H945C5EBCF65C42AD9C92B7C18613FD02"><enum>(ii)</enum><text>on or after January 1, 2022, equal to 135 percent of the official poverty line (as so defined and revised) applicable to a family of the size involved.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H4965EE3889F247319C1198B1E584B66D"><enum>(2)</enum><header>Not counting in-kind support and maintenance as income</header><text display-inline="yes-display-inline">Section 1905(p)(2)(D) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396d">42 U.S.C. 1396d(p)(2)(D)</external-xref>) is amended by adding at the end the following new clause:</text><quoted-block display-inline="no-display-inline" id="H789D53BABAAC4ADABEADE0C38840112E" style="OLC"><clause id="HCDD079D23A924DD5A00DAAF77C880A4B" indent="up2"><enum>(iii)</enum><text display-inline="yes-display-inline">In determining income under this subsection, support and maintenance furnished in kind shall not be counted as income.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection display-inline="no-display-inline" id="H53C6EA96D84C4A5A9B1332A5181108D0"><enum>(b)</enum><header>Increase in income eligibility to 200 percent of FPL for specified low-Income Medicare beneficiaries</header><paragraph id="H94DEDA27BC3746E880A30A074753A430"><enum>(1)</enum><header>Eligibility of individuals with incomes below 150 percent of FPL</header><text>Section 1902(a)(10)(E) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a(a)(10)(E)</external-xref>) is amended—</text><subparagraph id="H473E5B1FCCA140D184F6908A5E9ED349"><enum>(A)</enum><text>by adding <quote>and</quote> at the end of clause (ii);</text></subparagraph><subparagraph id="H370F686474E84E0BB2264DC87FE67D6D"><enum>(B)</enum><text>in clause (iii)—</text><clause id="H0DAC3A119FFB44F59B993FF94B994F8A"><enum>(i)</enum><text>by striking <quote>and 120 percent in 1995 and years thereafter</quote> and inserting <quote>120 percent in 1995 and years thereafter before 2022, and 200 percent in 2022 and years thereafter</quote>; and</text></clause><clause id="H79DBB6BA3F7A4393A766DF737EBEB474"><enum>(ii)</enum><text>by striking <quote>and</quote> at the end; and</text></clause></subparagraph><subparagraph id="H429B2840A20741F79A7F9A8F56EC4190"><enum>(C)</enum><text>by striking clause (iv).</text></subparagraph></paragraph><paragraph id="HFE34B87615E248DA87ACBBA195F6887D"><enum>(2)</enum><header>References</header><text>Section 1905(p)(1) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396d">42 U.S.C. 1396d(p)(1)</external-xref>) is amended by adding at and below subparagraph (C) the following flush sentence:</text><quoted-block display-inline="no-display-inline" id="HCB718DD5899B4010A4FCC76561224406" style="OLC"><quoted-block-continuation-text quoted-block-continuation-text-level="subsection">The term <term>specified low-income medicare beneficiary</term> means an individual described in section 1902(a)(10)(E)(iii).</quoted-block-continuation-text><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="HC133D54A3964400CB0DF9CA0B2229AF3"><enum>(3)</enum><header>Conforming amendments</header><subparagraph id="H928C6BC4EB38481D8E00418C26B11955"><enum>(A)</enum><text display-inline="yes-display-inline">The first sentence of section 1905(b) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396d">42 U.S.C. 1396d(b)</external-xref>) is amended by striking “and section 1933(d)”.</text></subparagraph><subparagraph id="HDFEA13B22DD346ECA02728BCE1848708"><enum>(B)</enum><text display-inline="yes-display-inline">Section 1933 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396u-3">42 U.S.C. 1396u–3</external-xref>) is repealed.</text></subparagraph></paragraph></subsection><subsection id="H61FB8D90EB6D4BE295D3C4579A36181D"><enum>(c)</enum><header>100 percent FMAP</header><text>Section 1905 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396d">42 U.S.C. 1396d</external-xref>) is amended by adding at the end the following new subsection:</text><quoted-block display-inline="no-display-inline" id="HFD401C5AB54844DA892587326EE17CC7" style="OLC"><subsection id="H7FBC787F83F04ED188C723A3499FF6D6"><enum>(jj)</enum><header>Increased FMAP for expanded medicare cost-Sharing populations</header><paragraph commented="no" display-inline="no-display-inline" id="H06090996F2F843C0B6AAAD4F01ED5EB1"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding subsection (b), with respect to expenditures described in paragraph (2) the Federal medical assistance percentage shall be equal to 100 percent.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC574BB8F389E4F7EA1B1ECF8A457C051"><enum>(2)</enum><header>Expenditures described</header><text>The expenditures described in this paragraph are expenditures made on or after January 1, 2022, for medical assistance for medicare cost-sharing provided to any individual under clause (i), (ii), or (iii) of section 1902(a)(10)(E) who would not have been eligible for medicare cost-sharing under any such clause under the income or resource eligibility standards in effect on October 1, 2018.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" id="HEB98BD79C19C4E1BB04954AAFC856846"><enum>(d)</enum><header>Consolidation of low-Income subsidy resource eligibility tests</header><paragraph commented="no" id="H9E046537D524475D99AC003F026E027B"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1860D–14(a)(3) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-114">42 U.S.C. 1395w–114(a)(3)</external-xref>) is amended—</text><subparagraph commented="no" id="HE52D4BC46FF140A2B4D3D669A4D94FD6"><enum>(A)</enum><text>by striking subparagraph (D);</text></subparagraph><subparagraph commented="no" id="HA0C54D9EC288488088D75C9386B64E9B"><enum>(B)</enum><text>by redesignating subparagraphs (E) through (G) as subparagraphs (D) through (F), respectively; and</text></subparagraph><subparagraph commented="no" id="HD035758B985F4B6097D1E70B189376E4"><enum>(C)</enum><text>in the heading of subparagraph (D), as so redesignated, by striking <quote><header-in-text level="subparagraph" style="traditional">Alternative</header-in-text></quote>.</text></subparagraph></paragraph><paragraph id="H49D6C3FED4934436831FEFF2A3F0E7BA"><enum>(2)</enum><header>Clarification of certain rules relating to income and resource determinations</header><text display-inline="yes-display-inline">Section 1860D–14(a)(3) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-114">42 U.S.C. 1395w–114(a)(3)</external-xref>), as amended by paragraph (1), is amended by striking subparagraph (F) and inserting the following new subparagraphs:</text><quoted-block act-name="" id="H325BF1BC0E7649F6BFBF271F79E4E37E" style="traditional"><subparagraph commented="no" id="H913B90D1AC7C4BE3A1912EC272D906CC"><enum>(F)</enum><header>Resource exclusions</header><text>In determining the resources of an individual (and the eligible spouse of the individual, if any) under section 1613 for purposes of subparagraph (D)—</text><clause commented="no" id="H8CD0B504AF544395B335BC61640619ED"><enum>(i)</enum><text>no part of the value of any life insurance policy shall be taken into account;</text></clause><clause commented="no" id="H50A24409C74A407E8022AAA6A5584244"><enum>(ii)</enum><text>no part of the value of any vehicle shall be taken into account;</text></clause><clause commented="no" id="H65A8ADBB8B794B2CADDE2901B75F4C59"><enum>(iii)</enum><text>there shall be excluded an amount equal to $1,500 each with respect to any individual or eligible spouse of an individual who attests that some of the resources of such individual or spouse will be used to meet the burial and related expenses of such individual or spouse; and</text></clause><clause commented="no" id="H23BEBFB5B7464E518D9EB3F75798DC29"><enum>(iv)</enum><text display-inline="yes-display-inline">no balance in, or benefits received under, an employee pension benefit plan (as defined in section 3 of the Employee Retirement Income Security Act of 1974) shall be taken into account.</text></clause></subparagraph><subparagraph commented="no" id="HA012CD27042A48E6894D59DDB20D07E7"><enum>(G)</enum><header>Family size</header><text>In determining the size of the family of an individual for purposes of determining the income eligibility of such individual under this section, an individual's family shall consist of—</text><clause commented="no" id="H427CF008455441C582BF6FABE3787038"><enum>(i)</enum><text>the individual;</text></clause><clause commented="no" id="H4339C932F525443A80C2CC043B236A3B"><enum>(ii)</enum><text>the individual's spouse who lives in the same household as the individual (if any); and</text></clause><clause commented="no" id="HFF2FA7A65F7041F89DE76A2615AA624B"><enum>(iii)</enum><text>any other individuals who—</text><subclause commented="no" id="H06C5122C1AEA4D7193BCC0E21975ECA8"><enum>(I)</enum><text>are related to the individual whose income eligibility is in question or such individual's spouse who lives in the same household;</text></subclause><subclause commented="no" id="H47CF3C0385CB4363B369D89B1A0BBBA9"><enum>(II)</enum><text>are living in the same household as such individual; and</text></subclause><subclause commented="no" id="H69264393645F4F57A9A7F838800902AA"><enum>(III)</enum><text>are dependent on such individual or such individual's spouse who is living in the same household for at least one-half of their financial support.</text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph commented="no" id="H4E651A661F244C0F8C10D96AA36F5289"><enum>(3)</enum><header>Conforming amendments</header><text>Section 1860D–14(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-114">42 U.S.C. 1395w–114(a)</external-xref>) is amended—</text><subparagraph commented="no" id="H6776419FB25B4791BD24079A3741F77C"><enum>(A)</enum><text>in paragraph (1), in the matter preceding subparagraph (A), by inserting <quote>(as determined under paragraph (3)(G))</quote> after <quote>family of the size involved</quote>; and</text></subparagraph><subparagraph commented="no" id="H95ECA3455E4049089A8ECC68ACF7EB2C"><enum>(B)</enum><text>in paragraph (3), as amended by paragraphs (1) and (2)—</text><clause commented="no" id="H6A45A2B676564C3DB124F18BEFFBAE3C"><enum>(i)</enum><text>in subparagraph (A), in the matter preceding clause (i), by striking <quote>subparagraph (F)</quote> and inserting <quote>subparagraph (E)</quote>;</text></clause><clause commented="no" id="H0C9EEDC711BA4EEC976838C20143DA64"><enum>(ii)</enum><text>in subparagraph (A)(ii), by inserting <quote>(as determined under subparagraph (G))</quote> after <quote>family of the size involved</quote>;</text></clause><clause commented="no" id="HA70F3B03D6E1448D8D657530758B11DB"><enum>(iii)</enum><text>in subparagraph (A)(iii), by striking <quote>or (E)</quote>;</text></clause><clause commented="no" id="HED03229D99144192AA67F372BF91F3D9"><enum>(iv)</enum><text>in subparagraph (B)(v), in the matter preceding subclause (I), by striking <quote>subparagraph (F)</quote> and inserting <quote>subparagraph (E)</quote>; and</text></clause><clause commented="no" display-inline="no-display-inline" id="HEA5514EECF044D30AB1902B49EC72E49"><enum>(v)</enum><text>in subparagraph (D)(i), in the matter preceding subclause (I), by striking <quote>subject to the life insurance policy exclusion provided under subparagraph (G)</quote> and inserting <quote>subject to the resource exclusions provided under subparagraph (F)</quote>.</text></clause></subparagraph></paragraph></subsection><subsection commented="no" id="H9BB49B06352C499EB217225A0345220F"><enum>(e)</enum><header>Alignment of low-Income subsidy and medicare savings program income and resource eligibility tests</header><paragraph commented="no" id="HC11964AF574541C7B30FF00879D71A16"><enum>(1)</enum><header>Application of Medicaid spousal impoverishment resource allowance to MSP and LIS resource eligibility</header><text display-inline="yes-display-inline">Section 1905(p)(1)(C) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396d">42 U.S.C. 1396d(p)(1)(C)</external-xref>) is amended to read as follows:</text><quoted-block display-inline="no-display-inline" id="H62250D07DA4B49FF871666AF6629918E" style="OLC"><subparagraph commented="no" display-inline="no-display-inline" id="HCAB491B08A34416C96B9A263653843F4" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">whose resources (as determined under section 1613 for purposes of the supplemental security income program subject to the resource exclusions under subparagraph (G) of section 1860D–14(a)(3)) do not exceed—</text><clause commented="no" display-inline="no-display-inline" id="HCF51D8977007493AAC601F6A3D2F5B3C"><enum>(i)</enum><text display-inline="yes-display-inline">in the case of an individual with a spouse, an amount equal to the sum of the first amount specified in subsection (f)(2)(A)(i) of section 1924 (as adjusted under subsection (g) of such section) and the amount specified in subsection (f)(2)(A)(ii)(II) of such section (as so adjusted); or</text></clause><clause commented="no" display-inline="no-display-inline" id="HFEC8D17E0D544827B5E98A2D9876C65C"><enum>(ii)</enum><text display-inline="yes-display-inline">in the case of an individual who does not have a spouse, an amount equal to <fraction>½</fraction> of the amount described in clause (i).</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph commented="no" id="HBC6491422B684EBEA1E5EAD968864E87"><enum>(2)</enum><header>Application to QDWIs</header><text>Section 1905(s)(3) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396d">42 U.S.C. 1396d(s)(3)</external-xref>) is amended to read as follows:</text><quoted-block display-inline="no-display-inline" id="H6952F3067A18484BB66FF6D01BEBB796" style="OLC"><paragraph commented="no" id="H3890677E4FC64EB19DD558167BCDFE4D"><enum>(3)</enum><text>whose resources (as determined under section 1613 for purposes of the supplemental security income program subject to the resource exclusions under subparagraph (G) of section 1860D–14(a)(3)) do not exceed—</text><subparagraph commented="no" id="H7F0F1D7B4F6949269AE7405C28DB973B"><enum>(A)</enum><text>in the case of an individual with a spouse, the amount in effect for the year under clause (i) of subsection (p)(1)(C); and</text></subparagraph><subparagraph commented="no" id="H36E43B72BB6E4AE896F6609C209F0E6B"><enum>(B)</enum><text>in the case of an individual who does not have a spouse, the amount in effect for the year under clause (ii) of subsection (p)(1)(C); and</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph commented="no" id="H73FD594C4A114B39949681E02138A5C9"><enum>(3)</enum><header>Application to LIS</header><text display-inline="yes-display-inline">Clause (i) of section 1860D–14(a)(3)(D) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-114">42 U.S.C. 1395w–114(a)(3)(D)</external-xref>), as redesignated and amended by subsection (d)(1), is amended to read as follows:</text><quoted-block act-name="" id="H71409EFE48574034A1B14AE2F989D438" style="OLC"><clause id="HC81B221973894385A7B7AC134548294E"><enum>(i)</enum><header>In general</header><text>The resources requirement of this subparagraph is that an individual's resources (as determined under section 1613 for purposes of the supplemental security income program subject to the resource exclusions provided under subparagraph (G)) do not exceed the amount in effect for the year under section 1905(p)(1)(C)(ii).</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H584B2BDEA76B48EBB12510216F2802A9"><enum>(f)</enum><header>Enrollment simplifications</header><paragraph id="H95D339EBA52F49AD9CFCC0148BAA7F8B"><enum>(1)</enum><header>Application of 3-month retroactive eligibility to QMBs</header><subparagraph id="H8786043557324619B1D259DF26CA6216"><enum>(A)</enum><header>In general</header><text>Section 1902(e)(8) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a(e)(8)</external-xref>) is amended by striking <quote>after the end of the month in which the determination first occurs</quote> and inserting <quote>in or after the third month before the month in which the individual makes application for assistance</quote>.</text></subparagraph><subparagraph commented="no" id="H2A9F5D19F2F447D8AA0C1308BAAF2884"><enum>(B)</enum><header>Process for submitting claims during retroactive eligibility period</header><text display-inline="yes-display-inline">Section 1902(e)(8) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a(e)(8)</external-xref>) is further amended by adding at the end the following: <quote>The Secretary shall provide for a process under which claims for medical assistance under the State plan may be submitted for services furnished to such an individual during such 3-month period before the month in which the individual made application for assistance.</quote>.</text></subparagraph><subparagraph id="H3BAF470F54BD4FD199745485D8AD477B"><enum>(C)</enum><header>Conforming amendment</header><text>Section 1905(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396d">42 U.S.C. 1396d(a)</external-xref>) is amended, in the matter preceding paragraph (1), by striking <quote>or, in the case of medicare cost-sharing with respect to a qualified medicare beneficiary described in subsection (p)(1), if provided after the month in which the individual becomes such a beneficiary</quote>.</text></subparagraph></paragraph><paragraph commented="no" id="HB5DC398D09044EFBA758FB169E24326C"><enum>(2)</enum><header>State option for 12-month continuous eligibility for SLMBs and QWDIs</header><text display-inline="yes-display-inline">Section 1902(e)(12) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a(e)(12)</external-xref>) is amended—</text><subparagraph commented="no" display-inline="no-display-inline" id="H2995D3C84E2E4EE59DDA17337EFFD6FD"><enum>(A)</enum><text>by redesignating subparagraphs (A) and (B) as clauses (i) and (ii), respectively;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HB946E11DBDDD40F9A3CB270F6C2BF2A3"><enum>(B)</enum><text>by inserting <quote>(A)</quote> after <quote>(12)</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H93B98175EB93415B862881D870B532E0"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HCD2901678861467DB73E113CDB1DA2B8" style="OLC"><subparagraph commented="no" display-inline="no-display-inline" id="H811B6DC20AFE4959AB5F80479735228D" indent="up2"><enum>(B)</enum><text>At the option of the State, the plan may provide that an individual who is determined to be eligible for benefits under a State plan approved under this title under any of the following eligibility categories, or who is redetermined to be eligible for such benefits under any of such categories, shall be considered to meet the eligibility requirements met on the date of application and shall remain eligible for those benefits until the end of the 12-month period following the date of the determination or redetermination of eligibility, except that a State may provide for such determinations more frequently, but not more frequently than once every 6 months for an individual:</text><clause commented="no" display-inline="no-display-inline" id="H72FABFEA64284175BE00E71D88B88D04"><enum>(i)</enum><text>A specified low-income medicare beneficiary described in subsection (a)(10)(E)(iii) of this section who is determined eligible for medicare cost sharing described in section 1905(p)(3)(A)(ii).</text></clause><clause commented="no" display-inline="no-display-inline" id="H30D2B389FC214A21B2F2A209FD173327"><enum>(ii)</enum><text display-inline="yes-display-inline">A qualified disabled and working individual described in section 1905(s) who is determined eligible for medicare cost-sharing described in section 1905(p)(3)(A)(i).</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H69C1C525E1CA42CC8E64A860DBD4D239"><enum>(3)</enum><header>State option to use Express Lane eligibility for the Medicare Savings Program</header><text display-inline="yes-display-inline">Section 1902(e)(13)(A) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a(e)(13)(A)</external-xref>) is amended by adding at the end the following new clause:</text><quoted-block display-inline="no-display-inline" id="H7C93200600314252BDBFD6FF3A55C9E9" style="OLC"><clause commented="no" id="H4D255C24FC47430CBDB19044A77C9366" indent="up1"><enum>(iii)</enum><header>State option to extend express lane eligibility to other populations</header><subclause commented="no" id="HE01D42B9D9F34BE5976498D5B8AFB1E1"><enum>(I)</enum><header>In general</header><text display-inline="yes-display-inline">At the option of the State, the State may apply the provisions of this paragraph with respect to determining eligibility under this title for an eligible individual (as defined in subclause (II)). In applying this paragraph in the case of a State making such an option, any reference in this paragraph to a child with respect to this title (other than a reference to child health assistance) shall be deemed to be a reference to an eligible individual.</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H6E81A3A046974E3EAE72CA56E1C54FB7"><enum>(II)</enum><header>Eligible individual defined</header><text display-inline="yes-display-inline">In this clause, the term <term>eligible individual</term> means any of the following:</text><item commented="no" display-inline="no-display-inline" id="H1E90EF544D8E4DEFB2E38FF565210231"><enum>(aa)</enum><text display-inline="yes-display-inline">A qualified medicare beneficiary described in section 1905(p)(1) for purposes of determining eligibility for medicare cost-sharing (as defined in section 1905(p)(3)).</text></item><item commented="no" display-inline="no-display-inline" id="HB0EE232868A243019B2EAFF35A88546D"><enum>(bb)</enum><text display-inline="yes-display-inline">A specified low-income medicare beneficiary described in subsection (a)(10)(E)(iii) of this section for purposes of determining eligibility for medicare cost-sharing described in section 1905(p)(3)(A)(ii).</text></item><item commented="no" display-inline="no-display-inline" id="H4386ADA5BC784E97B599CB004EBBA018"><enum>(cc)</enum><text display-inline="yes-display-inline">A qualified disabled and working individual described in section 1905(s) for purposes of determining eligibility for medicare cost-sharing described in section 1905(p)(3)(A)(i).</text></item></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H3859998F51C543078A98D24F596712B5"><enum>(g)</enum><header>Medicaid treatment of certain Medicare providers</header><text>Section 1902(n) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a(n)</external-xref>) is amended by adding at the end the following new paragraph:</text><quoted-block id="HD9616C5A8DD146F49DB2491402E300D7" style="OLC"><paragraph id="H73B3C4D22C65476C9C67DBD29740023D" indent="up1"><enum>(4)</enum><text display-inline="yes-display-inline">A State plan shall not deny a claim from a provider or supplier with respect to medicare cost-sharing described in subparagraph (B), (C), or (D) of section 1905(p)(3) for an item or service which is eligible for payment under title XVIII on the basis that the provider or supplier does not have a provider agreement in effect under this title or does not otherwise serve all individuals entitled to medical assistance under this title. The State shall create a mechanism through which provider or suppliers that do not otherwise have provider agreements with the State can bill the State for medicare cost-sharing for qualified medicare beneficiaries.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HE54F04A5E8F24E64AC1962A9916A29DD"><enum>(h)</enum><header>Eligibility for other programs</header><text display-inline="yes-display-inline">Section 1905(p) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396d">42 U.S.C. 1396d(p)</external-xref>) is amended by adding at the end the following new paragraph:</text><quoted-block id="H4011089FE945458CA730014F0DD9B39D" style="OLC"><paragraph id="H7AFD3ACAB6E44C73AC0B68FCEB844514" indent="up1"><enum>(7)</enum><text display-inline="yes-display-inline">Notwithstanding any other provision of law, any medical assistance for some or all medicare cost-sharing under this title shall not be considered income or resources in determining eligibility for, or the amount of assistance or benefits provided under, any other public benefit provided under Federal law or the law of any State or political subdivision thereof.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H21CCB6C8BAB94B38B4BB2E38F25D3701"><enum>(i)</enum><header>Treatment of qualified Medicare beneficiaries, specified low-Income Medicare beneficiaries, and other dual eligibles as medicare beneficiaries</header><text>Section 1862 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395y">42 U.S.C. 1395y</external-xref>) is amended by adding at the end the following new subsection:</text><quoted-block id="H1E431518926C4A778FB13AB15DF83B22" style="OLC"><subsection id="HE5DDB8E35B434D15A449EBE0E813797F"><enum>(p)</enum><header>Treatment of Qualified Medicare Beneficiaries (QMBs), Specified Low-Income Medicare Beneficiaries (SLMBs), and Other Dual Eligibles</header><text>Nothing in this title shall be construed as authorizing a provider of services or supplier to discriminate (through a private contractual arrangement or otherwise) against an individual who is otherwise entitled to services under this title on the basis that the individual is a qualified medicare beneficiary (as defined in section 1905(p)(1)), a specified low-income medicare beneficiary, or is otherwise eligible for medical assistance for medicare cost-sharing or other benefits under title XIX.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H5229EF6943FD4BB7A1403A9FAF508934"><enum>(j)</enum><header>Additional Funding for State Health Insurance Assistance Programs</header><paragraph id="H554284594D354F7DA04C8C26DD59C81B"><enum>(1)</enum><header>Grants</header><subparagraph id="H4031A82304BB42FFAF75C3AC801BEBFD"><enum>(A)</enum><header>In general</header><text>The Secretary of Health and Human Services (in this subsection referred to as the <quote>Secretary</quote>) shall use amounts made available under subparagraph (B) to make grants to States for State health insurance assistance programs receiving assistance under section 4360 of the Omnibus Budget Reconciliation Act of 1990.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HDDBFFD904B94476782F98EABEE498CDA"><enum>(B)</enum><header display-inline="yes-display-inline">Funding</header><text display-inline="yes-display-inline">For purposes of making grants under this subsection, the Secretary shall provide for the transfer, from the Federal Hospital Insurance Trust Fund under section 1817 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395i">42 U.S.C. 1395i</external-xref>) and the Federal Supplementary Medical Insurance Trust Fund under section 1841 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395t">42 U.S.C. 1395t</external-xref>), in the same proportion as the Secretary determines under section 1853(f) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-23">42 U.S.C. 1395w–23(f)</external-xref>), of $50,000,000 to the Centers for Medicare &amp; Medicaid Services Program Management Account for each of the fiscal years 2022 through 2026, to remain available until expended.</text></subparagraph></paragraph><paragraph id="HC4A96AE0F8874F22B70329ECECF6A71F"><enum>(2)</enum><header>Amount of grants</header><text>The amount of a grant to a State under this subsection from the total amount made available under paragraph (1) shall be equal to the sum of the amount allocated to the State under paragraph (3)(A) and the amount allocated to the State under subparagraph (3)(B).</text></paragraph><paragraph id="HBE75C0DA9D8840CD8C1AD6FB00E92B63"><enum>(3)</enum><header>Allocation to States</header><subparagraph id="H82920B96C4734D59AE01EB9132FC1C52"><enum>(A)</enum><header>Allocation based on percentage of low-income beneficiaries</header><text>The amount allocated to a State under this subparagraph from <fraction>2/3</fraction> of the total amount made available under paragraph (1) shall be based on the number of individuals who meet the requirement under subsection (a)(3)(A)(ii) of section 1860D–14 of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-114">42 U.S.C. 1395w–114</external-xref>) but who have not enrolled to receive a subsidy under such section 1860D–14 relative to the total number of individuals who meet the requirement under such subsection (a)(3)(A)(ii) in each State, as estimated by the Secretary.</text></subparagraph><subparagraph id="H35A45DE31E4D40AD85FFA030C49CFAFB"><enum>(B)</enum><header>Allocation based on percentage of rural beneficiaries</header><text>The amount allocated to a State under this subparagraph from <fraction>1/3</fraction> of the total amount made available under paragraph (1) shall be based on the number of part D eligible individuals (as defined in section 1860D–1(a)(3)(A) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-101">42 U.S.C. 1395w–101(a)(3)(A)</external-xref>)) residing in a rural area relative to the total number of such individuals in each State, as estimated by the Secretary.</text></subparagraph></paragraph><paragraph id="H247CAA3950A34DD3862D90E14B45E634"><enum>(4)</enum><header>Portion of grant based on percentage of low-income beneficiaries to be used to provide outreach to individuals who may be subsidy eligible individuals or eligible for the Medicare Savings Program</header><text display-inline="yes-display-inline">Each grant awarded under this subsection with respect to amounts allocated under paragraph (3)(A) shall be used to provide outreach to individuals who may be subsidy eligible individuals (as defined in section 1860D–14(a)(3)(A) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-114">42 U.S.C. 1395w–114(a)(3)(A)</external-xref>)) or eligible for the program of medical assistance for payment of the cost of medicare cost-sharing under the Medicaid program pursuant to sections 1902(a)(10)(E) and 1933 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a(a)(10)(E)</external-xref>, 1396u–3).</text></paragraph></subsection><subsection commented="no" id="H5D970FAA14E34227BDE127D8119E7384"><enum>(k)</enum><header>Effective date</header><paragraph commented="no" display-inline="no-display-inline" id="H878CC199807246FBA5C3DAAC0248234D"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in paragraph (2), the amendments and repeal made by this section take effect on January 1, 2022, and, with respect to title XIX of the Social Security Act, apply to calendar quarters beginning on or after January 1, 2022.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF5247A2CB493412296E1C0D4078AE6E1"><enum>(2)</enum><header>Exception for State legislation</header><text>In the case of a State plan for medical assistance under title XIX of the Social Security Act which the Secretary of Health and Human Services determines requires State legislation (other than legislation appropriating funds) in order for the plan to meet the additional requirements imposed by the amendments and repeal made by this section, the State plan shall not be regarded as failing to comply with the requirements of such title solely on the basis of its failure to meet these additional requirements before the first day of the first calendar quarter beginning after the close of the first regular session of the State legislature that begins after the date of the enactment of this Act. For purposes of the previous sentence, in the case of a State that has a 2-year legislative session, each year of such session shall be deemed to be a separate regular session of the State legislature.</text></paragraph></subsection></section></legis-body></bill>
