<official-title display="yes">To amend the Help America Vote Act of 2002 to clarify the requirement that the paper records produced by voting systems used in elections for Federal office shall be used as the official ballots for purposes of audits and recounts conducted with respect to such elections, to prohibit the connection of such systems to the internet, to require States to remove individuals who are ineligible to vote in elections for Federal office in the State from the Statewide voter registration list, and for other purposes.</official-title>

<section id="HFE8B8323C2134412BC7744F8236D1001" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Safe and Certain Elections Act</short-title></quote>.</text></section> <section id="HC4EA4A27001B44B185BFFA3DDA12F62A"><enum>2.</enum><header>Requirements for voting systems used in elections for Federal office</header> <subsection id="H226215D5BD684F28A0E80D030CAFCC5D"><enum>(a)</enum><header>Clarification of use of paper record of votes for audits and recounts</header><text display-inline="yes-display-inline">Section 301(a)(2)(B)(iii) of the Help America Vote Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/52/21081">52 U.S.C. 21081(a)(2)(B)(iii)</external-xref>) is amended by striking <quote>shall be available as an official record for any recount</quote> and inserting <quote>shall be preserved and used as the official ballot for purposes of any recount or audit</quote>.</text></subsection>
<subsection id="HCDBD248335C64131A29D2EC6C66DE57C"><enum>(b)</enum><header>Prohibiting connection of voting systems to internet</header>
<paragraph id="HE0842B4D199E40E795776CE59131AC27"><enum>(1)</enum><header>Prohibition</header><text display-inline="yes-display-inline">Section 301(a) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/52/21081">52 U.S.C. 21081(a)</external-xref>) is amended by adding at the end the following new paragraph:</text> <quoted-block style="OLC" id="H52328DB930E9479786179151BCF92812" display-inline="no-display-inline"> <paragraph id="HE45797CD83864FA09B30A42DE43448D8"><enum>(7)</enum><header>Prohibiting connection of system to the internet</header> <subparagraph id="H61D78B1CCEDD4B37BC02338D9E8B47FB"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">No system or device upon which ballots are programmed or votes are cast or tabulated shall be connected to the public internet at any time.</text></subparagraph>
<subparagraph id="HCE7F1570E68E42DDADC47E5EB9921FD2"><enum>(B)</enum><header>Prohibiting acceptance of ballots transmitted online</header><text display-inline="yes-display-inline">The voting system may not directly tabulate any voted ballot which is transmitted to an election official online.</text></subparagraph> <subparagraph id="H45DC214B8984495FA2C75004669380C5"><enum>(C)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing contained in this paragraph shall be deemed to prohibit the Commission from conducting the studies under section 242 or to conduct other similar studies under any other provision of law in a manner consistent with this paragraph.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph>
<paragraph id="HA3F5D0D3715A46EFAE8F4A99F44477DC"><enum>(2)</enum><header>Effective date</header><text>The amendment made by paragraph (1) shall apply with respect to elections occurring on or after January 1, 2022.</text></paragraph></subsection></section> <section id="H84B4B17275054A7CA9020DA5B59EEFAA"><enum>3.</enum><header>Mandatory removal of ineligible voters from registration list prior to election</header> <subsection id="H1737AE83396547D6894236E3F27AF35D"><enum>(a)</enum><header>Clarification of responsibility of States</header><text display-inline="yes-display-inline">Section 8(c)(2)(A) of the National Voter Registration Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/52/20507">52 U.S.C. 20507(c)(2)(A)</external-xref>) is amended—</text>
<paragraph id="H7765FA170FB54914BCAAC1FD857A91C4"><enum>(1)</enum><text>by striking <quote>shall complete</quote> and inserting <quote>shall carry out and complete</quote>; and</text></paragraph> <paragraph id="H135EF9FEE9FD429EA9E96073EE9E335F"><enum>(2)</enum><text>by striking <quote>any program the purpose of which is to systematically remove the names</quote> and inserting <quote>a program to remove the names</quote>.</text></paragraph></subsection>
<subsection id="H2815A8BA1CFC40278C30A92D99A4A4BC"><enum>(b)</enum><header>Effective date</header><text>The amendments made by subsection (a) shall apply with respect to elections occurring on or after January 1, 2022.</text></subsection></section> <section id="H4C24DED7235D4BC1B4A48FF3788E6BA7"><enum>4.</enum><header>Study of use of blockchain technology to improve security of elections</header> <subsection id="H7C3B6BBFF8E548E89292C08A6078C535"><enum>(a)</enum><header>Study</header><text display-inline="yes-display-inline">The Election Assistance Commission shall conduct a study of the potential uses of blockchain technology to improve the security of elections for Federal office.</text></subsection>
<subsection id="HBECC689F7ACE41078E736AF124B8F1EB"><enum>(b)</enum><header>Report</header><text>Not later than 1 year after the date of the enactment of this Act, the Commission shall submit to Congress a report on the study conducted under subsection (a), and shall include in the report such recommendations as the Commission considers appropriate.</text></subsection></section> </legis-body> </bill>
