which was referred to the <committee-name committee-id="HED00">Committee on Education and Labor</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Secretary of Labor, in consultation with the Chairperson of the National Endowment for the Arts, to award grants for arts and creative workforce programs.</official-title></form><legis-body id="HF3BB4955683A4832A0C32358BFA63A77" style="OLC"><section id="HEC2F3FB1735C419D86498C1923F81989" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Creative Economy Revitalization Act</short-title></quote>.</text></section><section id="H0D0599CD5FCE4D3EAB8BAE2582338E02"><enum>2.</enum><header>National grants for arts and creative workforce programs</header><text display-inline="no-display-inline">Subtitle D of title I of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3221">29 U.S.C. 3221 et seq.</external-xref>) is amended—</text><paragraph id="H47645FD66DB74CA683B3013D66590514"><enum>(1)</enum><text>by redesignating section 172 (<external-xref legal-doc="usc" parsable-cite="usc/29/3227">29 U.S.C. 3227</external-xref>) as section 173; and</text></paragraph><paragraph id="H124DF011E6C04398A2984496D0FA864D"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after section 171 (<external-xref legal-doc="usc" parsable-cite="usc/29/3226">29 U.S.C. 3226</external-xref>) the following:</text><quoted-block style="OLC" id="H872763D967604DBB854C6305AC5E8834" display-inline="no-display-inline"><section id="HEECEE43CD9304D8CB99948B9C9BD9AF9"><enum>172.</enum><header>National grants for arts and creative workforce programs</header><subsection id="H34ED50C2D6784DCD8E87A3D6D371C785"><enum>(a)</enum><header>Program authorized</header><text display-inline="yes-display-inline">From the amounts appropriated under subsection (f), Secretary, in consultation with the Chairperson of the National Endowment for the Arts, shall award grants, on a competitive basis, to eligible entities to carry out the arts and creative workforce programs described in subsection (c)(1).</text></subsection><subsection id="HAC1CB792B5454A108B3134174D594AE7"><enum>(b)</enum><header>Application</header><text display-inline="yes-display-inline">To be eligible to receive a grant under this section, an eligible entity shall submit to the Secretary and the Chairperson an application at such time, in such manner, and containing such information as the Secretary and the Chairperson may require, which shall include—</text><paragraph id="H707747C265AB46D3861B16C0F4DAFC81"><enum>(1)</enum><text>a description of the arts and creative workforce program the eligible entity plans to carry out with the grant, including—</text><subparagraph id="H266AF99698B642C4988BF80EA59B9EA9"><enum>(A)</enum><text>cost estimates;</text></subparagraph><subparagraph id="H09E5A3559AE24293BB850909EBC93C55"><enum>(B)</enum><text>timelines;</text></subparagraph><subparagraph id="H7F6F3AFE351B4C1E8ACAFFABA5633227"><enum>(C)</enum><text>a description of the final product and how such product will be made accessible to the public; </text></subparagraph><subparagraph id="H708C079A672E46D597E3271C7AFA597E"><enum>(D)</enum><text display-inline="yes-display-inline">the proposed number of employees the program will employ, including a description of the creative workers the program will employ;</text></subparagraph><subparagraph id="H9328D80E9C0A4841ACC966BB8C0194BA"><enum>(E)</enum><text display-inline="yes-display-inline">the number of such proposed employees who have barriers to employment and a description of such barriers; and</text></subparagraph><subparagraph id="H8140F6D7C4124DF08394FE0C04FC7271"><enum>(F)</enum><text display-inline="yes-display-inline">whether the eligible entity will be working in coordination with a State board or a local board to employ individuals under the program, and a description of such coordination; and</text></subparagraph></paragraph><paragraph id="H2EE26AACB5FE43D6A55B36FE4AB19572"><enum>(2)</enum><text>a good-faith certification that—</text><subparagraph id="H3ED7321C8A814D4592F459C29877C681"><enum>(A)</enum><text>during the grant period and during the 2-year period beginning after the such grant period—</text><clause id="HBE008B7823E44527897F582031AE9B4D"><enum>(i)</enum><text display-inline="yes-display-inline">the eligible entity will not outsource or offshore jobs for the arts and creative workforce program carried out with the grant; and</text></clause><clause id="H1E3F21E6DED8441D92C28CEC9C6E7C31"><enum>(ii)</enum><text>the eligible entity will not abrogate existing collective bargaining agreements of employees of such program; and</text></clause></subparagraph><subparagraph id="H41EB1711EBA546488ABE1FFEBD60445A"><enum>(B)</enum><text>the eligible entity will remain neutral in any union organizing effort by the employees of such program during the grant period; and</text></subparagraph><subparagraph id="HADB332BE2859488B8346F5731FC8F3A6"><enum>(C)</enum><text>in carrying out such program, the eligible entity will comply with the wage and safety standards described in subsections (n) and (m) of section 5 of the National Foundation on the Arts and the Humanities Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/954">20 U.S.C. 954</external-xref>).</text></subparagraph></paragraph></subsection><subsection id="H8E921704EF8D40D79F3825AF834D14D4"><enum>(c)</enum><header>Uses of funds</header><paragraph id="H3FCA1EB23DFF417CB4AF766A60C3897F"><enum>(1)</enum><header>Arts and creative workforce programs</header><text display-inline="yes-display-inline">An eligible entity that receives a grant under this section shall use such grant to carry out an arts and creative workforce program that—</text><subparagraph id="H0F7FF9ABC98446789245664E67A8F1FF"><enum>(A)</enum><text>shall—</text><clause id="H49DD5A6BBE4A4C30ACB0C65F3E2A74DB"><enum>(i)</enum><text display-inline="yes-display-inline">provide art or arts programming that is publicly available and accessible to other individuals by the eligible entity; and</text></clause><clause id="H8F063BB2320A4BCAA90A7AC7EECF9471"><enum>(ii)</enum><text display-inline="yes-display-inline">employ individuals in the labor market area served by the eligible entity, which may include the use of such grant to cover the cost of wages for such individuals; and</text></clause></subparagraph><subparagraph id="H33054C4F8A9E41AE9BC093666EBCB405"><enum>(B)</enum><text>may include—</text><clause id="HA1928197A5BB4A42BF383C6CDB7D5FEB"><enum>(i)</enum><text display-inline="yes-display-inline">outdoor events for the community (such as concerts, street fairs, art fairs, community arts events, performances, live music, or other arts-based activities);</text></clause><clause id="HECFBF427182740BBB981AD676A841D47" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">interviews and written stories that capture and document the history of the United States—</text><subclause id="H49DC840380224EFBBD785F7C7C6823F8"><enum>(I)</enum><text>through photographs, narratives, storytelling, murals, films, plays, and other media; and</text></subclause><subclause id="H07A6A49C9A774F34BDD033E3971697CA"><enum>(II)</enum><text display-inline="yes-display-inline">that illuminate narratives of first responders during the COVID–19 pandemic, or marginalized narratives and histories of all individuals, regardless of income, age, race, religion, legal status, sexual orientation, or gender identity;</text></subclause></clause><clause id="HB3BACA2C128E458BBFEB85FBA0FFD1A6"><enum>(iii)</enum><text display-inline="yes-display-inline">temporary or permanent visual, literary, or performative public artworks celebrating community identity, such as—</text><subclause id="H5079D25BBB9549619332E38B1BE03C68"><enum>(I)</enum><text>two- and three-dimensional visual artworks such as murals, painted benches, sculptures, and statues;</text></subclause><subclause id="HA24F1BB58A024A13A181695DD29CFF59"><enum>(II)</enum><text>interactive or sound-based artworks; and</text></subclause><subclause id="H3F887021D1C4453594B3B337572F2D11"><enum>(III)</enum><text>performative artworks like concerts, readings, festivals, or displays of dance or theater;</text></subclause></clause><clause id="H22E0005FC26646648F25CEC65333B8BC"><enum>(iv)</enum><text display-inline="yes-display-inline">poetry, writing, photography, theater, visual or media arts, or dance exhibitions; and</text></clause><clause id="H89738BB2D308490F96087F31541BDE21"><enum>(v)</enum><text display-inline="yes-display-inline">programs and works that support the arts in both schools and community cultural spaces (including arts-integrated teaching, place-based arts and cultural practice, intergenerational education, oral histories, and the preservation of folk traditions that elevate a community’s history and culture, including on Tribal land).</text></clause></subparagraph></paragraph><paragraph id="HB6B9D83D648847428543FEA82B376EF6"><enum>(2)</enum><header>Limitation on administrative costs</header><text>Not more than 5 percent of the funds appropriated under subsection (f) for a fiscal year may be used for administrative costs by the Secretary.</text></paragraph></subsection><subsection id="HD6DBCD44A1644386947A65F0CAA42422"><enum>(d)</enum><header>Report</header><text>Not later than 1 year after the first grant is awarded under this section, and each year thereafter, the Secretary shall report to Congress on the outcomes of the programs funded under this section for the preceding year, including—</text><paragraph id="HFEA555AEC6684BC69E19636E3B8685B6"><enum>(1)</enum><text display-inline="yes-display-inline">the number of grants awarded for such year to eligible entities, disaggregated by the type of eligible entity listed in subsection (g)(2); and</text></paragraph><paragraph id="H2F38B759FFA24F4A850FE84B1D7CE7F6"><enum>(2)</enum><text>a description of each program assisted with such a grant, including—</text><subparagraph id="HA2254FEF9C094173BCB4E7BA6146B03D"><enum>(A)</enum><text>the geographic location of the program;</text></subparagraph><subparagraph id="H017F1C56B97B444DA8A3A5EDFA3A5C24"><enum>(B)</enum><text>the length of employment of an individual who is employed by the program;</text></subparagraph><subparagraph id="H99493F7A130348AEA09EA3B6BBFA29DD"><enum>(C)</enum><text>the percentage of such individuals who are in unsubsidized employment during the second quarter after exit from the program;</text></subparagraph><subparagraph id="HA6DC3B39116C420C853A3C05B9312754"><enum>(D)</enum><text>the percentage of such individuals who are in unsubsidized employment during the fourth quarter after exit from the program; and</text></subparagraph><subparagraph id="H7ECE0DD9128A463FA7988B2092106062"><enum>(E)</enum><text>the median earnings of such individuals who are in unsubsidized employment during the second quarter after exit from the program.</text></subparagraph></paragraph></subsection><subsection id="H50B107EE66724AE5954B66B8FE07AABB"><enum>(e)</enum><header>Copyright ownership</header><text display-inline="yes-display-inline">In accordance with section 200.315 of title 2, Code of Federal Regulations, and notwithstanding section 2900.13 of such title, an author of a copyrightable work created under any program funded under this section retains the right of ownership under title 17, United States Code. The Federal Government may—</text><paragraph id="H295EC502A16F4007A37238448F96D917"><enum>(1)</enum><text>obtain, reproduce, publish, or otherwise use the work produced under this section; and</text></paragraph><paragraph id="HF42AF9C97B684591957E1BE78A519B3B"><enum>(2)</enum><text>authorize another to receive, reproduce, publish, or otherwise use the work for a Federal purpose.</text></paragraph></subsection><subsection id="HCAAF38A306D74F7F9D44B291DCAE5B9D"><enum>(f)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There are authorized to be appropriated $300,000,000 to carry out this section for fiscal years 2022 through 2024. </text></subsection><subsection id="H2B40941C9F8544DF92750B254B5EB96F"><enum>(g)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HCB31250D8DDA4CFDA318EABD268FA7A6"><enum>(1)</enum><header>Creative worker</header><text display-inline="yes-display-inline">The term <term>creative worker</term>—</text><subparagraph id="H6EA5985A55A44DE79D51E5059DFD65AA"><enum>(A)</enum><text>means any individual who earns (or previously earned) income through creative, cultural, or artistic-based pursuits to produce ideas, content, goods, and services, without regard to whether such income is earned through employment as an independent contractor or as an employee for an employer; and</text></subparagraph><subparagraph id="H45F6061180C242DAACBB569641C3F139"><enum>(B)</enum><text>may include an art director, artist, animator, sculptor, writer, author, poet, photographer, musician, singer, producer, director, actor, announcer, storyteller, comedian, dancer, architect, designer, programmer, choreographer, or a technician, backstage or behind-the-scenes staff, curator, or other support staff who make creative work possible.</text></subparagraph></paragraph><paragraph id="H3C9419FD267E477AA7B1DA13B58545EF" commented="no"><enum>(2)</enum><header>Eligible entity</header><text display-inline="yes-display-inline">The term <term>eligible entity</term> means—</text><subparagraph id="HBE367720D4104B5FAECC8B7A925BBC04"><enum>(A)</enum><text>a State;</text></subparagraph><subparagraph id="HB3B8D00B4A0042B3A39BA59E4CF66423"><enum>(B)</enum><text>a local area (or local board);</text></subparagraph><subparagraph id="H85A4F567ECEF4F2F91EDC4BA625A0F60"><enum>(C)</enum><text>an entity described in section 166(c);</text></subparagraph><subparagraph id="HD0E575540FC246C2BD4B67F8D027D00C"><enum>(D)</enum><text>a public or private nonprofit agency or organization (including a consortium of such agencies or organizations) that employs, or supports the employment of, creative workers; or</text></subparagraph><subparagraph id="H37610F4FDD9A496781036E38E48BAD7D"><enum>(E)</enum><text display-inline="yes-display-inline">a State workforce agency.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="HCEED2DB8708E4EA09D3EA933C7CD8FB0"><enum>3.</enum><header>Authorization of funds for the NEA</header><text display-inline="no-display-inline">There are authorized to be appropriated to the Chairperson of the National Endowment for the Arts such sums as may be necessary for such Chairperson to provide the consultation required under section 172 of the Workforce Innovation and Opportunity Act, as amended by section 2.</text></section><section id="H77EC2211E66A41EC858801391BBB29DD"><enum>4.</enum><header>Table of contents</header><text display-inline="no-display-inline">The table of contents of the Workforce Innovation and Opportunity Act is amended by striking the item relating to section 172 and inserting the following: </text><quoted-block style="OLC" id="HB434FEF944F7494EACC64EA59DC33E0C" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">172.
