which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 18, United States Code, to increase the age at which a rifle or shotgun may be acquired from a federally licensed firearms dealer, and for other purposes.</official-title></form><legis-body id="HA3DF6D6CE6454FAAA070D9D21FAC7F6E" style="OLC"><section id="H28E31086CCB14B27B89C45248DE887E9" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>21 to Buy Act</short-title></quote>.</text></section><section id="H9243E03E3FF94B638E68876474A71813"><enum>2.</enum><header>Increase in age at which a rifle or shotgun may be acquired from a Federally licensed firearms dealer</header><subsection id="HD1E5523A2F8046E3B9BFE2219A37C659"><enum>(a)</enum><header>In general</header><text>Section 922(b) of title 18, United States Code, is amended—</text><paragraph id="HB34982F724D143D3B75301CB738FD773"><enum>(1)</enum><text>by striking paragraph (1) and inserting the following:</text><quoted-block display-inline="no-display-inline" id="H5C935D9EA4B9444888BA3B75B005C94C" style="OLC"><paragraph id="H0AEDAF880FD34184BEFE7B99DAD1A9DF"><enum>(1)</enum><text display-inline="yes-display-inline">any firearm or ammunition to any individual who the licensee knows or has reasonable cause to believe has not attained 21 years of age, unless the individual is—</text><subparagraph id="HD1E1671D806C479BA7B9E0C27FC3D47A"><enum>(A)</enum><text>a law enforcement officer;</text></subparagraph><subparagraph id="HCD2FC62EB6A84EAF8DD96F05D13AED77"><enum>(B)</enum><text>a correctional officer;</text></subparagraph><subparagraph id="HD5FB02D01D11483FA3972B2971CC3449"><enum>(C)</enum><text>on active duty in the Armed Forces of the United States, or full-time duty in the National Guard; or</text></subparagraph><subparagraph id="HA5D88EFFA9164ED99128D79D8EE4CFF6"><enum>(D)</enum><text>a member of the Armed Forces of the United States or the National Guard who possesses or is armed with a firearm in the line of duty;</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HE480DCAF78FA44C9ADB5E7F62151E7A2"><enum>(b)</enum><header>Conforming amendment</header><text>Section 922(c)(1) of such title is amended by striking <quote>, or that, in the case of a shotgun or a rifle, I am eighteen years or more of age</quote> and inserting <quote>or am a law enforcement officer, a correctional officer, on active duty in the Armed Forces of the United States or full-time duty in the National Guard, or a member of the Armed Forces of the United States or the National Guard who possesses or is armed with a firearm in the line of duty</quote>.</text></subsection><subsection id="HFC18CFC8D0E94DFD8C87517EF54338BA"><enum>(c)</enum><header>Definitions</header><text>Section 921(a) of such title is amended by inserting after paragraph (29) the following:</text><quoted-block display-inline="no-display-inline" id="HEB859E746FBD4F58A2B0E003D3C0629A" style="OLC"><paragraph id="HD64833697FCD41DEB9670D834952C58B" indent="up1"><enum>(30)</enum><text display-inline="yes-display-inline">The term <term>law enforcement officer</term> means a person—</text><subparagraph id="HC84261E8239D439590970EA558F7F229"><enum>(A)</enum><text>who is elected, appointed, or employed by the Federal Government or by a State or political subdivision thereof;</text></subparagraph><subparagraph id="H7F1FC220AF784288B0A73B787C0D8DB1"><enum>(B)</enum><text>who is vested with authority to bear arms and make arrests; and</text></subparagraph><subparagraph id="H100FFFE9F5B64336A54CAA0B4E1C098D"><enum>(C)</enum><text>whose primary responsibility is the prevention and detection of crime or the enforcement of the penal, criminal, traffic, or highway laws,</text></subparagraph><continuation-text continuation-text-level="paragraph">including any supervisory or command personnel whose duties include the supervision, training, guidance, or management of any such person. </continuation-text></paragraph><paragraph id="H96C9F670FEDF4D169C1F043F1095477C" indent="up1"><enum>(31)</enum><text display-inline="yes-display-inline">The term <term>correctional officer</term> means a person—</text><subparagraph id="H1C22618EEC59443F9B08E6EB3F21E20A"><enum>(A)</enum><text>who is appointed or employed by the Federal Government or by a State or political subdivision thereof, and whose primary responsibility is the supervision, protection, care, custody, and control, or investigation, of inmates of a correctional institution; or</text></subparagraph><subparagraph id="H4E309B14CFB6464A9DA344224B36A79A"><enum>(B)</enum><text>who is employed by any private entity that has contracted with the Federal Government or a State or political subdivision thereof, and who has such a primary responsibility.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H210E929F2EAD48A4BEA54948E52F51CC"><enum>(d)</enum><header>Effective date</header><text>The amendments made by this section shall apply to conduct engaged in after the 6-month period that begins with the date of enactment of this Act.</text></subsection></section></legis-body></bill>
