R. 4976</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210806">August 6, 2021</action-date><action-desc><sponsor name-id="S001208">Ms. Slotkin</sponsor> (for herself and <cosponsor name-id="K000389">Mr. Khanna</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HAS00">Committee on Armed Services</committee-name>, and in addition to the Committees on <committee-name committee-id="HPW00">Transportation and Infrastructure</committee-name>, and <committee-name committee-id="HIF00">Energy and Commerce</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Secretary of Defense to ensure that removal and remedial actions relating to PFAS contamination result in levels meeting or exceeding certain standards, and for other purposes.</official-title></form><legis-body id="H772C6C12A2D341489138E2808E61DB4E" style="OLC"><section id="HC548D04B1A634E689861A1F732B56759" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Ensuring PFAS Cleanup Meets or Exceeds Stringent Standards Act</short-title></quote>. </text></section><section id="H56E20947CF524F80B82353405F7B5C6B" section-type="subsequent-section"><enum>2.</enum><header>Standards for response actions with respect to PFAS contamination</header><subsection id="H79FD81C7099749608672D249EE6A904E"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">In conducting a response action to address perfluoroalkyl or polyfluoroalkyl substance contamination from Department of Defense or National Guard activities, the Secretary of Defense shall conduct such actions to achieve a level of such substances in the environmental media that meets or exceeds the most stringent of the following standards for each applicable perfluoroalkyl or polyfluoroalkyl substance in any environmental media:</text><paragraph id="HC50E6EFDB1D6440E945DC1DE3AED4001"><enum>(1)</enum><text>A State standard, in effect in the State in which the response action is being conducted, as described in section 121(d)(2)(A)(ii) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9621">42 U.S.C. 9621(d)(2)(A)(ii)</external-xref>).</text></paragraph><paragraph id="H305A82D3A94F4517BB355FED3C2B718F"><enum>(2)</enum><text display-inline="yes-display-inline">A Federal standard, as described in section 121(d)(2)(A)(i) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9621">42 U.S.C. 9621(d)(2)(A)(i)</external-xref>).</text></paragraph><paragraph id="HA629B7C3150E46C4A3C7E58B991186BE"><enum>(3)</enum><text>A health advisory under section 1412(b)(1)(F) of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300g-1">42 U.S.C. 300g–1(b)(1)(F)</external-xref>).</text></paragraph></subsection><subsection id="H60133C7BDF3245BEBD013A6CAF76E253"><enum>(b)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="HF7770BAC9C2A429A9426EC2DD4D732FF" commented="no"><enum>(1)</enum><header>Perfluoroalkyl or polyfluoroalkyl substance</header><text display-inline="yes-display-inline">The term <term>perfluoroalkyl or poly­fluo­ro­al­kyl substance</term> means any man-made chemical with at least one fully fluorinated carbon atom.</text></paragraph><paragraph id="HB517E4EE0B9647B4AF403226382EE1F0"><enum>(2)</enum><header>Response action</header><text>The term <term>response action</term> means an action taken pursuant to section 104 of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9601">42 U.S.C. 9601</external-xref>).</text></paragraph></subsection><subsection id="H91FBB888727841ABA834C3DD37BFD6D9"><enum>(c)</enum><header>Savings clause</header><text>Except with respect to the specific level required to be met under subsection (a), nothing in this section affects the application of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9607">42 U.S.C. 9607</external-xref>).</text></subsection></section></legis-body></bill>
