Scott Franklin of Florida</sponsor> (for himself, <cosponsor name-id="M001166">Mr. McNerney</cosponsor>, <cosponsor name-id="O000019">Mr. Obernolte</cosponsor>, and <cosponsor name-id="C001121">Mr. Crow</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HSM00">Committee on Small Business</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To establish a program to support the participation of small businesses in meetings and proceedings of global standards organizations, and for other purposes.</official-title></form><legis-body id="H5D8231D91D4E40F19CD3B78F409820EC" style="OLC"><section id="H2F5EE0A0164F4AA98303F927FA3E471F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Leadership in Global Tech Standards Act of 2021</short-title></quote>. </text></section><section id="HFC0D2ACB68354D6AB98CDB54A29F36A9"><enum>2.</enum><header>Support for industry participation in global standards organizations</header><subsection id="H928535BA6DBF44B295E6B42383F35D6C"><enum>(a)</enum><header>Definition</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="HF21DC0475551405E80F8C1B3B52B1910"><enum>(1)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of the Small Business Administration.</text></paragraph><paragraph id="H3345392850E741FFB7094B10BAF583A2"><enum>(2)</enum><header>Appropriate congressional committees</header><text>The term <term>appropriate congressional committees</term> means the following:</text><subparagraph id="H784CD20777DC4E9E80D985849F01C97D"><enum>(A)</enum><text>The Committee on Science, Space, and Technology of the House of Representatives.</text></subparagraph><subparagraph id="HD5B721D357E0483DB47C75384C7466D1"><enum>(B)</enum><text>The Committee on Commerce, Science, and Transportation of the Senate.</text></subparagraph><subparagraph id="HCE516AC217D34F1C9776D149F7096A86"><enum>(C)</enum><text>The Committee on Energy and Commerce of the House of Representatives.</text></subparagraph><subparagraph id="H536B9A8654BF4879A85BBF85376CB2FC"><enum>(D)</enum><text>The Committee on Energy and Natural Resources of the Senate.</text></subparagraph><subparagraph id="HF5628783FF564F06AA1EA6859B3844FD"><enum>(E)</enum><text>The Committee on Small Business of the House of Representatives.</text></subparagraph><subparagraph id="H59D8D1BD28EF4898ACE4785E471F23B9"><enum>(F)</enum><text>The Committee on Small Business and Entrepreneurship of the Senate.</text></subparagraph></paragraph><paragraph id="H8D4CEB64E3554691BF8AD71C43991072" display-inline="no-display-inline"><enum>(3)</enum><header>Artificial intelligence</header><text>The term <term>artificial intelligence</term> has the meaning given the term in section 238(g) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (<external-xref legal-doc="usc" parsable-cite="usc/10/2358">10 U.S.C. 2358</external-xref> note). </text></paragraph><paragraph id="H80B2D488573A49B6968C04999416A495"><enum>(4)</enum><header>Covered entity</header><text>The term <term>covered entity</term> means a small business concern that is incorporated and maintains a primary place of business in the United States.</text></paragraph><paragraph id="HE24E294C9E884956A73CD82418BDF127" commented="no" display-inline="no-display-inline"><enum>(5)</enum><header>Small business concern</header><text>The term <term>small business concern</term> has the meaning given the term in section 3 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/632">15 U.S.C. 632</external-xref>). </text></paragraph></subsection><subsection id="H42674E798A254D48AA1E2D392E3A29D1"><enum>(b)</enum><header>Establishment</header><text>Not later than 180 days after the date of enactment of this Act, the Administrator shall establish a program to support participation by covered entities in meetings and proceedings of standards development organizations in the development of voluntary technical standards.</text></subsection><subsection id="H856D0D4717CF4EC08F4DE07CB78E30EA"><enum>(c)</enum><header>Activities</header><text>In carrying out the program established under subsection (a), the Administrator shall award competitive, merit-reviewed grants to covered entities to cover the reasonable costs, up to a specified ceiling, of participation of employees of those covered entities in meetings and proceedings of standards development organizations, including—</text><paragraph id="HE04379075DD24267B4D719127ADC9232"><enum>(1)</enum><text>regularly attending meetings;</text></paragraph><paragraph id="HEAF1E9E9B633491097D75759F9F7F741"><enum>(2)</enum><text>contributing expertise and research;</text></paragraph><paragraph id="HDBE45F79B0CC40A9B1656163569DA488"><enum>(3)</enum><text>proposing new work items; and</text></paragraph><paragraph id="H42D75809571F4DF9A18BD8D0D34ECCDA"><enum>(4)</enum><text>volunteering for leadership roles such as a convener or editor.</text></paragraph></subsection><subsection id="HF87F29671C174E7FA56A52E4492367D5"><enum>(d)</enum><header>Award criteria</header><text>The Administrator may only provide a grant under this section to a covered entity that—</text><paragraph id="H5028E4D54E4E46BA969456DEDB869A30"><enum>(1)</enum><text>demonstrates deep technical expertise in key emerging technologies and technical standards, including artificial intelligence and related technologies;</text></paragraph><paragraph id="H4A36BEF250B1414F89EFAA9732C6D363"><enum>(2)</enum><text>commits personnel with such expertise to regular participation in global bodies responsible for developing standards for such technologies over the period of the grant;</text></paragraph><paragraph id="HA369B1F49C3649C68BBD5D6D46927200"><enum>(3)</enum><text>agrees to participate in efforts to coordinate between the Federal Government and industry to ensure protection of national security interests in the setting of global standards so long as such standards are not dictated by the Federal Government; and</text></paragraph><paragraph id="HE78B94D8CE334B369A76C69A08B02973" commented="no"><enum>(4)</enum><text>provides a plan to the Administrator that details the relationship between the activities described in paragraphs (1), (2), and (3) and the proposed standards to be adopted.</text></paragraph></subsection><subsection id="H6D6F4AC2A9BB4E8DAE2667E6CCB93F42"><enum>(e)</enum><header>No matching contribution</header><text>A recipient of an award under this section shall not be required to provide a matching contribution.</text></subsection><subsection id="HAA49D92386EC475996A66AAF603D5F1B"><enum>(f)</enum><header>Evaluation</header><paragraph id="H67E9B31CA5E74FCBA82D473A531C11AC"><enum>(1)</enum><header>In general</header><text>In making awards under this section, the Administrator shall coordinate with the Director of the National Institute of Standards and Technology, who shall provide support in the assessment of technical expertise in emerging technologies and standards setting needs.</text></paragraph><paragraph id="H4D85667930A846CDB82515CADC9C5BB0"><enum>(2)</enum><header>Panel ranking</header><text display-inline="yes-display-inline">In carrying out the requirements under paragraph (1), the Administrator and the Director shall jointly establish a panel of experts to rank the proposed standards, based on merit and relevance, to be composed of experts from—</text><subparagraph id="HAA1A3FB6ED0E4102BB170A45B8098550"><enum>(A)</enum><text>private industry;</text></subparagraph><subparagraph id="HBAD8BBF386114890AB0B5C4E644A4533"><enum>(B)</enum><text>non-profit institutions;</text></subparagraph><subparagraph id="HB97950809D954BF980C57E756B57BE07"><enum>(C)</enum><text>non-profit standards development organizations;</text></subparagraph><subparagraph id="HA0C5B04E85C8467AADFDC90BB68B7F7C"><enum>(D)</enum><text>academia; and </text></subparagraph><subparagraph id="H324B91B3B5434356B0BD8FD68341C534"><enum>(E)</enum><text>the Federal Government.</text></subparagraph></paragraph></subsection><subsection id="HB00E3765435946DEA4AC1D38AC001553"><enum>(g)</enum><header>Report</header><text>Not less than annually, the Administrator shall submit to the appropriate congressional committees a report on—</text><paragraph id="H5F91EA1A7A0F41FFADF6715569F798AD"><enum>(1)</enum><text>the efficacy of the program;</text></paragraph><paragraph id="HBCE8DDBCBD664B3CAB46D56DB393BC97"><enum>(2)</enum><text>an explanation of any standard adopted as a result of the program;</text></paragraph><paragraph id="H35E140A71DAD46D99703476507AAED9B"><enum>(3)</enum><text>any challenges faced in carrying out the program; and</text></paragraph><paragraph id="HFD628A5EA40F475CA8A5C2DFEC285520"><enum>(4)</enum><text>proposed solutions to the challenges identified in paragraph (3).</text></paragraph></subsection><subsection id="H236304184B1D4C08959BB3777925924F"><enum>(h)</enum><header>Authorization of appropriation</header><text>There is authorized to be appropriated for fiscal year 2022 and each fiscal year thereafter $1,000,000 to carry out the program established under this section.</text></subsection></section></legis-body></bill>
