which was referred to the <committee-name committee-id="HWM00">Committee on Ways and Means</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Internal Revenue Code of 1986 to provide an additional deduction for the cost of certain materials purchased directly from a domestic smelter or processor.</official-title></form><legis-body id="HEFD47890C7004A11BC0CA04093081740" style="OLC"><section id="H2AC3FC66BA4F414A83B7AFD4B0C2BF46" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Manufacturing America’s Mineral Security Act</short-title></quote>.</text></section><section id="H46BDB4FAEBFE460B85838EDEE00F947D"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph id="H77241FE067864054B990A5747FD51F03"><enum>(1)</enum><text display-inline="yes-display-inline">It is in America’s best interest to ensure a robust and secure domestic supply chain for U.S. manufacturers. </text></paragraph><paragraph id="HD0B5190BDA654BAA80ABB9F51684C300"><enum>(2)</enum><text>The United States increasing reliance on foreign sources of metals and minerals threatens our economic and national security while providing our geopolitical rivals, such as China and Russia, leverage over our economy.</text></paragraph><paragraph id="H2BAD06BB57CB41FAA24880934B07DDDE"><enum>(3)</enum><text>Incentivizing domestic mineral and metal production and the purchase of these materials will make our Nation’s supply chains more secure and resilient.</text></paragraph></section><section id="HB45E70BCD1A146A9A23D31075378A1FB"><enum>3.</enum><header>Additional deduction for cost of certain materials purchased directly from a domestic smelter or processor</header><subsection id="H724AFBB565234430BEA444C6B7B30B1C"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Part VI of subchapter B of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986 is amended by inserting after section 181 the following new section:</text><quoted-block style="OLC" id="HCA9C161F7EB1484F92E0F08C30A65362" display-inline="no-display-inline"><section id="H14B48A4C5A5C40CBAB1717F136BE61DC"><enum>182.</enum><header>Additional deduction for cost of certain materials purchased directly from a domestic smelter or processor</header><subsection id="H9BB17592C5B44228AC48BFD3FC139A07"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">There shall be allowed as a deduction (in addition to any other deduction allowed under this chapter for the cost of specified domestically produced materials) an amount equal to 10 percent of the cost of specified domestically produced materials if such materials are acquired by the taxpayer directly from the domestic smelter or processor of such material.</text></subsection><subsection id="H9F5EC9A7A871465AAE20DD1BB5DA9C71"><enum>(b)</enum><header>Specified domestically Produced materials</header><text display-inline="yes-display-inline">For purposes of this section—</text><paragraph id="HDAA7D45D7886481EBDBB06235BD33C57"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The term <quote>specified domestically-produced materials</quote> means any specified material if such material is—</text><subparagraph id="HBE3004DDF96D42D091C21F38FEFEA80F"><enum>(A)</enum><text>in the case of a mine product, smelted or processed in the United States by direct smelting of ore;</text></subparagraph><subparagraph id="H0E5612FB86E74042A61DFC911D755032"><enum>(B)</enum><text>in the case of a mine tailings product, beneficiated in the United States; </text></subparagraph><subparagraph id="HA416A56856934974A1B4F53DAFE1EC4F"><enum>(C)</enum><text>in the case of metal or metal compound production—</text><clause id="HFEE08725552646E1A93039D18456D791"><enum>(i)</enum><text>reprocessed from slags or residues in the United States; or</text></clause><clause id="HC1A06BA0EA134C5BB48A1CA78E19CCF0"><enum>(ii)</enum><text>melted, sputtered, or otherwise produced in the United States;</text></clause></subparagraph><subparagraph id="HC1DF69686D664CBBB1DD9F83B6336F66"><enum>(D)</enum><text>in the case of alloy production, produced by melting together metals in the United States to form an alloy; and </text></subparagraph><subparagraph id="HEB5F685B301C412CA451FD4DD6133836"><enum>(E)</enum><text>in the case of magnet production, sintered or bonded and magnetized in the United States.</text></subparagraph></paragraph><paragraph id="H4AD5AC7ABAED4DF1AEB90842C2085BFB"><enum>(2)</enum><header>Specified material</header><subparagraph id="H1DA2FDA7D4FE49B1B565431782CBD207"><enum>(A)</enum><header>In general</header><text>The term <term>specified material</term> means minerals that are necessary—</text><clause id="HE76BB191383E4B258A48BCBC7C91FA4D"><enum>(i)</enum><text>for the energy infrastructure of the United States, including—</text><subclause id="H9236E3C9367F44B9823EF140DA6D36E3"><enum>(I)</enum><text>pipelines;</text></subclause><subclause id="H43184AB12EC849CC9BA6B6A4A83149AF"><enum>(II)</enum><text>refining capacity;</text></subclause><subclause id="HD929BB59714E4BAD8F45965C6B52EE9A"><enum>(III)</enum><text>electrical power generation and transmission; and</text></subclause><subclause id="H93C14F97F6B44147A01D06F70A62A31D"><enum>(IV)</enum><text>renewable energy production;</text></subclause></clause><clause id="HEAF8DC77F1194512BA83DEF2C8324AB2"><enum>(ii)</enum><text display-inline="yes-display-inline">for community resiliency, coastal restoration, and ecological sustainability for the coastal United States;</text></clause><clause id="HFA6E941D3B3949AB8B75ABA79AF12CE2"><enum>(iii)</enum><text>to support domestic manufacturing, agriculture, housing, telecommunications, healthcare, and transportation infrastructure; or</text></clause><clause id="H683A8DBEB56D4ED09B4890E851BE215D" commented="no" display-inline="no-display-inline"><enum>(iv)</enum><text>for the economic security of, and balance of trade in, the United States.</text></clause></subparagraph><subparagraph id="H83C33808EA8E460EB88B31C687AC42F2"><enum>(B)</enum><header>Materials needed for national defense</header><text display-inline="yes-display-inline">The term <quote>specified material</quote> shall include all Materials of Interest listed by the Defense Logistics Agency.</text></subparagraph><subparagraph id="H487690635CFD472087689D5B9393F052"><enum>(C)</enum><header>Exceptions</header><text display-inline="yes-display-inline">The term <quote>specified material</quote> shall not include—</text><clause id="HE09590B8C5B347CD8084F76D946CB977"><enum>(i)</enum><text>fuel minerals, including oil, natural gas, or any other fossil fuels; </text></clause><clause id="HEC694A859AD74E1F9FA4E8D2D91E8D38"><enum>(ii)</enum><text>water, ice, or snow; or</text></clause><clause id="HF71166E9658A445A813B140DDAD897CB"><enum>(iii)</enum><text>sand, stone, gravel, pumice, pumicite, cinders, or clay.</text></clause></subparagraph></paragraph></subsection><subsection id="HE8293A22340449508137E7641C985B3C"><enum>(c)</enum><header>Domestic smelter or processor</header><text display-inline="yes-display-inline">For purposes of this section, the term <quote>domestic smelter or processor</quote> means, with respect to any specified material, the person performing the activity described in subsection (b)(1) with respect to such material.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H933B8CFB040540ACA276A7E17A4B64BA"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of sections for part VI of subchapter B of chapter 1 of such Code is amended by inserting after the item relating to section 181 the following new item:</text><quoted-block style="OLC" id="H6EE571C3FF774D6EA32F1297D3DCF26A" display-inline="no-display-inline"><toc container-level="quoted-block-container" quoted-block="no-quoted-block" lowest-level="section" idref="HCA9C161F7EB1484F92E0F08C30A65362" regeneration="yes-regeneration" lowest-bolded-level="division-lowest-bolded"><toc-entry idref="H14B48A4C5A5C40CBAB1717F136BE61DC" level="section">Sec. 182. Additional deduction for cost of certain materials purchased directly from a domestic smelter or processor.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HD19ED2159D0D431E9D31DBDDE798F83F"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall apply to taxable years beginning after the date of the enactment of this Act.</text></subsection></section></legis-body></bill>
