R. 4925</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210803">August 3, 2021</action-date><action-desc><sponsor name-id="S001175">Ms. Speier</sponsor> (for herself, <cosponsor name-id="P000613">Mr. Panetta</cosponsor>, <cosponsor name-id="E000215">Ms. Eshoo</cosponsor>, <cosponsor name-id="S000344">Mr. Sherman</cosponsor>, <cosponsor name-id="N000147">Ms. Norton</cosponsor>, <cosponsor name-id="Q000023">Mr. Quigley</cosponsor>, <cosponsor name-id="K000389">Mr. Khanna</cosponsor>, <cosponsor name-id="L000551">Ms. Lee of California</cosponsor>, <cosponsor name-id="S000510">Mr. Smith of Washington</cosponsor>, and <cosponsor name-id="R000606">Mr. Raskin</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 49, United States Code, to expand the priorities of the Administrator of the Federal Aviation Administration in developing plans and policy for the use of the navigable airspace.</official-title></form><legis-body id="HC06727F6FCF2479585B46D815BE16370" style="OLC"><section id="HB2A0444117414E35B2E430CF70E2EF9D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fairness in Airspace Includes Residents Act</short-title></quote> or the <quote><short-title>F-AIR Act</short-title></quote>.</text></section><section id="HE30441E0D05B4272B17763014D4D5EA7" section-type="subsequent-section"><enum>2.</enum><header>Sovereignty and use of airspace</header><subsection id="HB5D81896B3CA4B28A16D279EB2D30B96"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 40103(b)(1) of title 49, United States Code, is amended to read as follows:</text><quoted-block display-inline="no-display-inline" id="HC1D21238E719478CA8DC90F5AED61AFE" style="USC"><paragraph id="HF86E2B5EB09F4BFDB395DE7867C9C7AE" indent="up1"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H08B9AC8F5FFD4AAC92D59C7646C98237"><enum>(A)</enum><text display-inline="yes-display-inline">The Administrator of the Federal Aviation Administration shall develop plans and policy for the use of the navigable airspace and assign by regulation or order the use of the airspace necessary to ensure—</text><clause id="HDC3B812971F14026A0CFF4F8897FC25B" indent="up1"><enum>(i)</enum><text>as a primary priority, the safety of aircraft; and</text></clause><clause id="H83C2D771A49F4691ACB428D51EF84F06" indent="up1"><enum>(ii)</enum><text>as secondary co-equal priorities—</text><subclause id="H3A1D56BF48144420A0AC7A3CB4957568"><enum>(I)</enum><text>the efficient use of airspace; and</text></subclause><subclause id="H97FCDE2672B84F9AA978E06AF49D4A54"><enum>(II)</enum><text>the minimization of the impact of aviation noise, and other health impacts, on residents and communities, and other impacts of the use of airspace on the environment.</text></subclause></clause></subparagraph><subparagraph id="H0C5E2828FAD74EB8B7557A7CA2490050" indent="up1"><enum>(B)</enum><text>The Administrator may modify or revoke an assignment when required in the public interest.</text></subparagraph></paragraph><after-quoted-block>. </after-quoted-block></quoted-block></subsection><subsection id="H105D5282E24841CEAB12E15C59F5B582"><enum>(b)</enum><header>Updates to FAA priorities</header><text display-inline="yes-display-inline">Not later than 12 months after the date of enactment of this Act, the Administrator of the Federal Aviation Administration shall—</text><paragraph id="H7FD8AC6D1E2541B0BCE74260B3A9B8A6"><enum>(1)</enum><text display-inline="yes-display-inline">review the regulations, policies, procedures, and processes of the Administration and modify them as necessary to reflect the priorities in clauses (i) and (ii) of section 40103(b)(1)(A) of title 49, United States Code, as added by subsection (a); and</text></paragraph><paragraph id="H884640290E20487391FCB4944BA9FDA5"><enum>(2)</enum><text display-inline="yes-display-inline">update the mission statement of the Administration to reflect such priorities.</text></paragraph></subsection></section></legis-body></bill>
