which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require the Secretary of Transportation to establish a grant program to increase the availability of electric vehicle charging infrastructure in environmental justice communities, and for other purposes.</official-title></form><legis-body id="H0AD4F8644C2745E4A25F1F95AB75CDA3" style="OLC"><section id="H999926B6FE794C099DEBC4A34F753C89" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Community Vehicle Charging Act of 2021</short-title></quote>.</text></section><section id="HDB21297381AE420EB652EB1BB4D066F9"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text><paragraph id="H576D59B59AF040D0AA67C912E6D6D871"><enum>(1)</enum><text>the transportation sector is the highest emitting sector of greenhouse gases in the United States;</text></paragraph><paragraph id="HC47A008BABE94368801AE6762A861169"><enum>(2)</enum><text>transportation is a significant source of toxic air pollutants;</text></paragraph><paragraph id="HB26F9C61707E4B3AAC4A7EEE7971C0AD"><enum>(3)</enum><text>electrification is considered 1 of the most feasible and affordable opportunities to decarbonize transportation in the near-term, and thus reduce pollutants harmful to public health;</text></paragraph><paragraph id="H4E24C5771C1C4B1C905DF478D7E1E3F7"><enum>(4)</enum><text>the adoption of electric vehicles is dependent on adequate access to electric vehicle charging infrastructure;</text></paragraph><paragraph id="H1B5FC20F23934B5AACC17E6A028FECE8"><enum>(5)</enum><text>publicly available electric vehicle charging infrastructure has been distributed inequitably, and not all people of the United States have the ability to access electric vehicle charging infrastructure at home or at work; </text></paragraph><paragraph id="HB5809605CAAC443DB18A3F29834918ED"><enum>(6)</enum><text>range anxiety and a lack of access to electric vehicle charging infrastructure are significant barriers to the widespread adoption of electric vehicles;</text></paragraph><paragraph id="HA0319933E7C3450BAE9FA0430C1FF055"><enum>(7)</enum><text>access to electric vehicle charging infrastructure differs from proximity to electric vehicle charging infrastructure;</text></paragraph><paragraph id="H5CA8A2F2625646479ED6AA6F790A3EEE"><enum>(8)</enum><text>environmental justice communities face several barriers to accessing electric vehicles, electric vehicle charging infrastructure, and funding programs to install electric vehicle charging infrastructure, including—</text><subparagraph id="H08D7C880CBD44B6CB9CFBA74EF7D1190"><enum>(A)</enum><text>the high cost of, and a lack of knowledge about, electric vehicles;</text></subparagraph><subparagraph id="H36577F9DBA1F49F4A195BDAF6A294F28"><enum>(B)</enum><text>the high cost of—</text><clause id="HDB7E262E912B4D388048E5F14B185735"><enum>(i)</enum><text>level 2 electric vehicle charging infrastructure; and </text></clause><clause id="H84D9121317584F69A462F560FBDB2FE4"><enum>(ii)</enum><text>fast charging electric vehicle charging infrastructure;</text></clause></subparagraph><subparagraph id="HB568690B1C874A1BBB9169271BCEE530"><enum>(C)</enum><text>a lack of awareness of the availability of—</text><clause id="HB0A4A3EAE74049D6B18320B240A14738"><enum>(i)</enum><text>electric vehicle charging infrastructure; and</text></clause><clause id="H9751390E7E8240F8B9E447B84F3EFD63"><enum>(ii)</enum><text>funding programs to install electric vehicle charging infrastructure;</text></clause></subparagraph><subparagraph id="H88CA7319A54A4CC28D66349CCABDF083"><enum>(D)</enum><text>a lack of technical support and up-front funding for the installation of electric vehicle charging infrastructure;</text></subparagraph><subparagraph id="HF79CDC426F6E4753A976E06CA4D5AE42"><enum>(E)</enum><text>a low level of homeownership in environmental justice communities;</text></subparagraph><subparagraph id="H53EE31EFBEF6400ABDBB0AF7313EA33E"><enum>(F)</enum><text>the high percentage of individuals and families in environmental justice communities who reside in multi-unit dwellings;</text></subparagraph><subparagraph id="H3DF1A1511DF14746BE7AAE25CE0D90C8"><enum>(G)</enum><text>linguistic isolation; and</text></subparagraph><subparagraph id="H69E86AC5738148AE8960ED73CD46428D"><enum>(H)</enum><text>the short timelines for electric vehicle charging infrastructure projects; and</text></subparagraph></paragraph><paragraph id="H2C224614DF2248D18096DC1935C04683"><enum>(9)</enum><text>effective programs for environmental justice communities to access electric vehicle charging infrastructure and funding programs for the installation of electric vehicle charging infrastructure need to be targeted to overcome the barriers described in paragraph (8).</text></paragraph></section><section id="H57CBE9CF97BA456AA6FEEA3970538531"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="H48D9BC9C33C840EFADC863F350BFF158"><enum>(1)</enum><header>Community benefit agreement</header><text>The term <term>community benefit agreement</term> means a contract between 1 or more community-based organizations representing residents of an environmental justice community and an eligible entity carrying out an eligible project to ensure that the eligible project creates—</text><subparagraph id="H24AAE784AE7341C9B29BA62308553A61"><enum>(A)</enum><text>employment opportunities for local workers in the environmental justice community; and</text></subparagraph><subparagraph id="HDB0483B72E354C0E95C3AEFA497E2E6D"><enum>(B)</enum><text>other opportunities or benefits for the residents of the environmental justice community.</text></subparagraph></paragraph><paragraph id="H2655FE205A434860B18EA27B3273AB0A"><enum>(2)</enum><header>Electric vehicle</header><text>The term <term>electric vehicle</term> means a vehicle that is powered primarily by an electric motor drawing current from rechargeable batteries, including battery electric vehicles and plug-in hybrid vehicles.</text></paragraph><paragraph id="HAC0A634AA2CF4EBDB3BDCC571E82411B"><enum>(3)</enum><header>Electric vehicle make-ready infrastructure</header><text>The term <term>electric vehicle make-ready infrastructure</term> means the electrical infrastructure needed to connect and serve electric vehicle charging infrastructure, including—</text><subparagraph id="H6B5C0FB3C4E84D619116A61A31012155"><enum>(A)</enum><text>raceway or conduit;</text></subparagraph><subparagraph id="H67D01627403543B2938FC2C67968B4AC"><enum>(B)</enum><text>sufficient electrical panel service capacity;</text></subparagraph><subparagraph id="H81E61D447634473C87AF99912602BFE5"><enum>(C)</enum><text>overcurrent protection;</text></subparagraph><subparagraph id="H126A803BC76147479402ED8E3004C565"><enum>(D)</enum><text>devices;</text></subparagraph><subparagraph id="HBE05ED074B61480593B2029761441D13"><enum>(E)</enum><text>wire; and</text></subparagraph><subparagraph id="HDF73336A21E44076A0FD8FA476C97BE8"><enum>(F)</enum><text>suitable termination points, such as a junction box with a service loop.</text></subparagraph></paragraph><paragraph id="H0FB4B5FE3F604D9B8317906A0E122975"><enum>(4)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means each of the following:</text><subparagraph id="HF3E9C5CCF404440A92AEE60DFC506F50"><enum>(A)</enum><text>A community-based organization.</text></subparagraph><subparagraph id="HA72E6B03C04E4733B7C24475E282A29D"><enum>(B)</enum><text>A nonprofit organization.</text></subparagraph><subparagraph id="HA3605E881CB54837A93E138C63ACED2E"><enum>(C)</enum><text>A local, regional, State, or Tribal government.</text></subparagraph><subparagraph id="HBB449C68DB404FA298DF5F4355A85049"><enum>(D)</enum><text>A metropolitan planning organization.</text></subparagraph><subparagraph id="H5E56E38E85CD437487ABB00DB3B5999C"><enum>(E)</enum><text>Any other entity responsible for local transportation planning and transportation projects.</text></subparagraph></paragraph><paragraph id="HAD5225D671954AC7B054FBFDCD94A752"><enum>(5)</enum><header>Eligible project</header><text>The term <term>eligible project</term> means a project described in section 4(d) that is carried out in, and addresses the electric vehicle charging infrastructure needs of, an environmental justice community.</text></paragraph><paragraph id="H4A975F3224F2437095FBBFBF46EF97A3"><enum>(6)</enum><header>Environmental justice community</header><text>The term <term>environmental justice community</term> means a community consisting primarily of minority, low-income, or Tribal populations that experience, or are at risk of experiencing, higher or more adverse human health or environmental effects as compared to other populations.</text></paragraph><paragraph id="HE31BD0F519294F38A6A767D7322DA3AF"><enum>(7)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Transportation.</text></paragraph></section><section id="H58451269669247A0A201C1FA095D00E9"><enum>4.</enum><header>Electric vehicle charging infrastructure grant program</header><subsection id="H1A405DC846BF4B1C979920B3EF040C50"><enum>(a)</enum><header>Establishment</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary shall establish a grant program to provide grants to eligible entities for projects that address barriers to access to electric vehicle charging infrastructure faced by environmental justice communities.</text></subsection><subsection id="HB57FDB95777545D4BAC745AF8669CB03" commented="no"><enum>(b)</enum><header>Applications</header><text>An eligible entity desiring a grant under this section shall submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary may require.</text></subsection><subsection id="HBCBA22D820B0430F8D3232F1044DE34D"><enum>(c)</enum><header>Requirements</header><text>In carrying out the grant program established under subsection (a), the Secretary shall—</text><paragraph id="HF81D0DC7D70547EFA5FEA5926837ECC1"><enum>(1)</enum><text>use a public process to identify known barriers to access to electric vehicle charging infrastructure faced by environmental justice communities, including the barriers described in section 2(8);</text></paragraph><paragraph id="H29E0803D0C424F0D8D009E4B870BE586"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HE74C280267ED4ED899F9FB7CAA1DFA37"><enum>(A)</enum><text>perform meaningful stakeholder outreach with community-based organizations, environmental justice groups, or other community members—</text><clause id="HB81C0EEA146F4328883F849CFBAD9FA0" indent="up1"><enum>(i)</enum><text>to identify or design eligible projects; and</text></clause><clause indent="up1" id="H6094D72CA2F44E48B8AFAB1D9238342F"><enum>(ii)</enum><text>to identify eligible entities to carry out those eligible projects through the use of a grant under this section; and</text></clause></subparagraph><subparagraph indent="up1" id="H0A019903F0C043588F42C7F0CBB8B629"><enum>(B)</enum><text>compensate the community-based organizations, environmental justice groups, and other community members that respond to that outreach and assist or otherwise participate in an activity described in clause (i) or (ii) of subparagraph (A);</text></subparagraph></paragraph><paragraph id="H84CBA8CFAD354DE7824060ACBA643998"><enum>(3)</enum><text>provide to eligible entities in the application process and in project execution, including with respect to identifying private and utility partnerships—</text><subparagraph id="HE0D7B7C144014BD5B1737CC3B7CEBA56"><enum>(A)</enum><text>resources to conduct community-needs assessments; </text></subparagraph><subparagraph id="HF0AC458B70664551B5D550170DAE3B5C"><enum>(B)</enum><text>resources for planning; </text></subparagraph><subparagraph id="H8C89ABB91DFD4633846B49783040E573"><enum>(C)</enum><text>technical support; and</text></subparagraph><subparagraph id="HBE13B950086143558A840AD8AF47F348"><enum>(D)</enum><text>case management guidance;</text></subparagraph></paragraph><paragraph id="HA70FD05819AB489582EC072E08325B87"><enum>(4)</enum><text>design project timelines that—</text><subparagraph id="HD1EAE38E98104492B2CCEA52EF953901"><enum>(A)</enum><text>take into account stakeholder input; and</text></subparagraph><subparagraph id="H63927CF6ECBE4ACDB4F72770B88C3DA3"><enum>(B)</enum><text>account for the additional time needed to complete eligible projects in environmental justice communities;</text></subparagraph></paragraph><paragraph id="HCC2EC76CAC5049EDB8663F965DE69EC4"><enum>(5)</enum><text>adopt project criteria—</text><subparagraph id="H2CA6C1D9DFBF455D9BF4CF5735AC37E0"><enum>(A)</enum><text>to reduce the risk of gentrification of, and displacement of individuals in, environmental justice communities as a result of an eligible project carried out using a grant provided under this section;</text></subparagraph><subparagraph id="H11A81479D65D4E25B1FD0DF5C834E696"><enum>(B)</enum><text>to increase community engagement throughout the duration of an eligible project;</text></subparagraph><subparagraph id="HE20360CC4A924502AB40FD36E36083AA"><enum>(C)</enum><text>to increase the involvement of community-based organizations and unionized labor, where possible, in selecting, designing, and carrying out eligible projects;</text></subparagraph><subparagraph id="H5FD86860E65645D5902D9B87310795FE"><enum>(D)</enum><text>to prioritize investments directly into environmental justice communities;</text></subparagraph><subparagraph id="H63F8F762FA0E4714BAC49A1EB4E19CEB"><enum>(E)</enum><text>to reduce air pollution and other impacts from vehicles with internal combustion engines in environmental justice communities; and</text></subparagraph><subparagraph id="H7A021CF72ECC4BC7B7AA01822F947EDB"><enum>(F)</enum><text>to encourage partnerships with utility or private electric vehicle make-ready infrastructure programs, as applicable;</text></subparagraph></paragraph><paragraph id="H64EEC1B4FD2946A0A4369E4EFFADADC6"><enum>(6)</enum><text>aim to increase wealth in environmental justice communities—</text><subparagraph id="HE9D3DE765F384F8590D3887893CA3D07"><enum>(A)</enum><text>through community or public ownership of any assets of a completed eligible project that are installed or developed in carrying out that eligible project;</text></subparagraph><subparagraph id="H75ACB5A558DB4962A706B65BA73B6197"><enum>(B)</enum><text>through the creation of employment opportunities for local workers in environmental justice communities;</text></subparagraph><subparagraph id="HC12693EFEA2A40AC9A77E87072D68AAB"><enum>(C)</enum><text>by encouraging eligible entities receiving a grant under this section to enter into community benefit agreements; and</text></subparagraph><subparagraph id="HCA6638B013E04255AA158F6EF01D126F"><enum>(D)</enum><text>by encouraging participation by local small businesses, particularly minority- and women-owned small businesses; and</text></subparagraph></paragraph><paragraph id="H3C560A85D67941F38E88D8A4F759C137"><enum>(7)</enum><text>provide grant funds at the time of infrastructure purchase to each eligible entity that receives a grant under this section.</text></paragraph></subsection><subsection id="HA9EE4281F0154D7FA573ACB0797E13A9"><enum>(d)</enum><header>Eligible projects</header><text>An eligible entity that receives a grant under this section may use the grant funds for—</text><paragraph id="H7BA7D7617B4044379D53A3971D09AF4D"><enum>(1)</enum><text>projects that develop or implement a plan to install publicly available electric vehicle charging infrastructure, including—</text><subparagraph id="H262372E3D4FA4006B5E31C0E90F3C894"><enum>(A)</enum><text>projects for the planning for, or installation of—</text><clause id="H251D954880B7493BBC442E27F67FE84A"><enum>(i)</enum><text>electric vehicle charging infrastructure at grocery stores, convenience stores, markets, other retail establishments, existing fueling stations, local government facilities, or office buildings or other workplaces;</text></clause><clause id="H0561D7C73B224AF8AD223D94E53072F6"><enum>(ii)</enum><text>fast charging hubs;</text></clause><clause id="HF60B0FF5518D450F9F2DE8DF901702ED"><enum>(iii)</enum><text>on-street chargers;</text></clause><clause id="H84B47DB9E5754EA6B1577579B548A1EE"><enum>(iv)</enum><text>electric vehicle charging infrastructure at community land trust locations; and</text></clause><clause id="HB1E954B447B94EC29E5D4F2480FB042C" commented="no" display-inline="no-display-inline"><enum>(v)</enum><text>electric vehicle charging infrastructure at public schools and parks; </text></clause></subparagraph><subparagraph id="H09985372E55B4D32A02559C98DBF19F2"><enum>(B)</enum><text>projects for the incorporation of electric vehicle charging infrastructure or electric vehicle make-ready infrastructure into the construction of new buildings or other infrastructure;</text></subparagraph><subparagraph id="HC09B284F73504BA6AB3A9CC6F4712F0F"><enum>(C)</enum><text>projects to retrofit existing buildings, especially multi-unit dwellings, with electric vehicle charging infrastructure or electric vehicle make-ready infrastructure;</text></subparagraph></paragraph><paragraph id="H38EDF6FF8B5F41499CF09C0EA4A66594"><enum>(2)</enum><text>projects to support shared electric mobility and micromobility options, such as electric car, bike, and scooter share;</text></paragraph><paragraph id="H2503D1AE865243638DE425327F3F4342"><enum>(3)</enum><text>projects or rebate programs to provide an electric vehicle charger and funds for the installation of, and technical assistance relating to, that charger to any resident of an environmental justice community who—</text><subparagraph id="HFE604C9E9F2B454F9D866E4CBED94CE0"><enum>(A)</enum><text>purchases an electric vehicle; and</text></subparagraph><subparagraph id="H8472A82D0E144A48AB480FA79B02D72E"><enum>(B)</enum><text>has the ability to use residential electric vehicle charging infrastructure;</text></subparagraph></paragraph><paragraph id="HF3B3BD6323C34ABCA74A0ECBE430CD66"><enum>(4)</enum><text>projects to develop and implement education programs that emphasize the economic, environmental, and public health advantages of using an electric vehicle, including—</text><subparagraph id="H98907EDAFFC54194B15D343E056672A1"><enum>(A)</enum><text>by providing information to residents of an environmental justice community on the usefulness of electric vehicles and electric car share systems via ride and drive events;</text></subparagraph><subparagraph id="H5DF19861882E46999EDFB9E8CC2B8F8C"><enum>(B)</enum><text>by developing electric vehicle dealership education programs;</text></subparagraph><subparagraph id="H6F847FFE19A64359B2815ABD707716E7"><enum>(C)</enum><text>by developing an electric vehicle educational curriculum for schools; and</text></subparagraph><subparagraph id="H7FB7E1F5E38B4403BE6422B9EEF7778C"><enum>(D)</enum><text>by creating an electric vehicle information website and printed materials for distribution to individuals who lack internet access that may include—</text><clause id="H7D099303DB7B40379F1FC0D7D79BEA1B"><enum>(i)</enum><text>a guide to the makes and models of electric vehicles in multiple languages;</text></clause><clause id="HD4B2FB3FAF734584A80A510FE37555C4"><enum>(ii)</enum><text>information about the locations of publicly available electric vehicle charging infrastructure and directions to those locations; and</text></clause><clause id="H4D6A0B41BF5B4123852DE47089145E0D"><enum>(iii)</enum><text>free consulting services for potential buyers of an electric vehicle;</text></clause></subparagraph></paragraph><paragraph id="H8AAB0504CF8247529F1A6D0083905D8D"><enum>(5)</enum><text>projects to transition existing vehicle fleets of States and units of regional and local government that are in use in environmental justice communities to electric vehicles;</text></paragraph><paragraph id="H3AF3F9CE89B3468A97DCE495008AF21F"><enum>(6)</enum><text>projects to train the staff of municipalities and other units of regional and local government, including inspectors, on the use of electric vehicle charging infrastructure; and</text></paragraph><paragraph id="HFEFE4BD6FF794F7DA9005E67BEF0FA0D"><enum>(7)</enum><text>any other project that, in the determination of the Secretary—</text><subparagraph id="H20FE62E3E0424CB69C2B4338701E0681"><enum>(A)</enum><text>addresses known barriers to access to electric vehicle charging infrastructure faced by environmental justice communities, including the barriers described in section 2(4); and</text></subparagraph><subparagraph id="HA6DCFACA7C72400CA47F7A6BCDD55642"><enum>(B)</enum><text>satisfies any other applicable requirement that the Secretary determines to be appropriate and consistent with the requirements described in subsection (c).</text></subparagraph></paragraph></subsection><subsection id="H7547A6C6A26A418588EB41A334EB2D50"><enum>(e)</enum><header>Report</header><text>Not later than 1 year after the date on which the grant program under subsection (a) is established, and annually thereafter through fiscal year 2026, the Secretary shall submit to the Committees on Commerce, Science, and Transportation and Environment and Public Works of the Senate and the Committees on Energy and Commerce and Transportation and Infrastructure of the House of Representatives, and make publicly available on the website of the Department of Transportation, a report describing the eligible projects that received funding under the grant program and the outcomes of, and any issues encountered in carrying out, those eligible projects, including—</text><paragraph id="HDC6746CC00FD470F9752292FCDB8B1CB"><enum>(1)</enum><text>the barriers identified pursuant to the public process described in subsection (c)(1);</text></paragraph><paragraph id="HFF9561A6FB0047EDB90D347E1452C0BA"><enum>(2)</enum><text>the successes and failures of anti-displacement measures in those eligible projects;</text></paragraph><paragraph id="H659FE516F1414D1CB461A44B28BCC20B"><enum>(3)</enum><text>the types of projects that achieved success based on established grant program metrics;</text></paragraph><paragraph id="H7F3588BE11D9430EAD98530BEE180011"><enum>(4)</enum><text>the types of projects that were most frequently pursued by eligible entities;</text></paragraph><paragraph id="H374EB262546F470CA089DC75B6D66C8D"><enum>(5)</enum><text>best practices and lessons learned from serving an environmental justice community;</text></paragraph><paragraph id="HB74C13AAD8BA42CBB50EDBA314066668"><enum>(6)</enum><text>a breakdown of grant funds used by—</text><subparagraph id="HF86C83F5C1554599B87240613D16783A"><enum>(A)</enum><text>project type; and</text></subparagraph><subparagraph id="H0FC90F06166D48588763FB498E340143"><enum>(B)</enum><text>environmental justice community served;</text></subparagraph></paragraph><paragraph id="HE689E8730C824F278243E3ECE96C428F"><enum>(7)</enum><text>the quantity of electric vehicle charging infrastructure installed in environmental justice communities using funds made available under the grant program;</text></paragraph><paragraph id="H5DF0985636B7427EADC99E8C6B000738"><enum>(8)</enum><text>the frequency of use of publicly available electric vehicle charging infrastructure installed using funds made available under the grant program;</text></paragraph><paragraph id="HCC7A88B724A1431C9D608A38F277E246"><enum>(9)</enum><text>the number of electric vehicles purchased by residents of environmental justice communities in which electric vehicle charging infrastructure is installed using a grant provided under the grant program;</text></paragraph><paragraph id="HD7BB571B441E4498990AC3579C3902B9"><enum>(10)</enum><text>additional barriers to accessing electric vehicle charging infrastructure for residents of environmental justice communities;</text></paragraph><paragraph id="H14A054F884E94FD09B3C563B434E9328"><enum>(11)</enum><text>any needed adjustments to project timelines to facilitate greater project success in environmental justice communities;</text></paragraph><paragraph id="HAF15E6A1DEC848778B943CAD2C2D3050"><enum>(12)</enum><text>the number of jobs created and number of community members employed by eligible projects; and</text></paragraph><paragraph id="H37E76923D233453294D5E417B827990E"><enum>(13)</enum><text>any local air quality changes over time in communities where eligible projects are carried out.</text></paragraph></subsection><subsection id="HD308C60A3A2B4E3CA2FF9D4D22E8A85E"><enum>(f)</enum><header>Data collection</header><paragraph id="HF1D318C06A884A2786F254AAF4128892"><enum>(1)</enum><header>In general</header><text>The Secretary shall work with the Secretary of Energy and the Administrator of the Energy Information Administration to collect data on the access to electric vehicle charging infrastructure in environmental justice communities, including—</text><subparagraph id="H7081171B92BB4F98A40D300EB3E86F49"><enum>(A)</enum><text>the distance from an average household in an environmental justice community to publicly available electric vehicle charging infrastructure;</text></subparagraph><subparagraph id="H6F2E5797BA974A668C4E55F23125D41E"><enum>(B)</enum><text>the number and percentage of residents of each environmental justice community in which an eligible project was carried out using a grant provided under this section who have access to, and use, electric vehicle charging infrastructure that was installed in that environmental justice community using funds provided under the grant program;</text></subparagraph><subparagraph id="H0480B199E893419C80B221F73D755D91"><enum>(C)</enum><text>to the maximum extent practicable, the number and percentage of residents of each environmental justice community described in subparagraph (B) who have access to, and use, electric vehicle charging infrastructure that—</text><clause id="H6BE4065B64AC4AC097D0B84C81028DC3"><enum>(i)</enum><text>is located in the environmental justice community but was not installed using funds provided under the grant program; or</text></clause><clause id="HC6202EC841CC4E98818C6BC309518D41"><enum>(ii)</enum><text>is located in another community; and</text></clause></subparagraph><subparagraph id="H15D95335133E4BB5B4BF6CAD8A3FC70C"><enum>(D)</enum><text>to the maximum extent practicable, the number and percentage of residents of all environmental justice communities who have access to, and use, electric vehicle charging infrastructure that—</text><clause id="H0412FB27FE3E4FC884A797D93B78A461"><enum>(i)</enum><text>is located in an environmental justice community and was installed using funds provided under the grant program;</text></clause><clause id="H13AC665EFB92452981C9870713D78145"><enum>(ii)</enum><text>is located in an environmental justice community but was not installed using funds provided under the grant program; or</text></clause><clause id="HFB365864720D42E798A3969AD5DDDDC5"><enum>(iii)</enum><text>is located in another community.</text></clause></subparagraph></paragraph><paragraph id="H941444EF78F04236BA08CC76EB29D2CA"><enum>(2)</enum><header>Public availability</header><text>The data collected under paragraph (1) shall be made publicly available on the website of the Department of Transportation.</text></paragraph><paragraph id="H35F2D9B168704E91B042D8BBFC4EB32D"><enum>(3)</enum><header>Report</header><text>Not later than 1 year after the date on which the grant program under subsection (a) is established, and annually thereafter, the Secretary shall submit to the Committee on Environment and Public Works of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives a report describing the data collection efforts under paragraph (1), the data collected under that paragraph, and any patterns, trends, or changes identified by the Secretary.</text></paragraph></subsection><subsection id="H51A241872ED649F8BDCA4BCB4CB1339E"><enum>(g)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Secretary to carry out this section, including for any administrative costs, $75,000,000 for each of fiscal years 2022 through 2026.</text></subsection></section></legis-body></bill>
