which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Federal Communications Commission to promulgate regulations to collect regulatory fees from large technology platforms.</official-title></form><legis-body id="HDCFE7F2DAA744AC480EEF32095439810" style="OLC"><section id="HF8E83D5112EA47D39EEB4C581C463E5D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Big Tech Accountability for Broadband Act</short-title></quote>.</text></section><section id="H07F28EB3081742718C634624DD1BEFD1"><enum>2.</enum><header>Collection of regulatory fees from large technology platforms</header><subsection id="H02116CCB34B94CD5958C68957C04FA03"><enum>(a)</enum><header>Regulations</header><paragraph id="HB02D050E28A84FCD9E5410C609588E59"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after the date of the enactment of this Act, the Commission shall, notwithstanding subsection (d) of section 254 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/254">47 U.S.C. 254</external-xref>), promulgate regulations to require covered businesses to contribute to the Federal universal service support mechanism under such section.</text></paragraph><paragraph id="H88B53A738386497883A605C4AF16F8EB"><enum>(2)</enum><header>Fee structure</header><text>Such regulations shall include a fee structure to be assessed on covered businesses.</text></paragraph></subsection><subsection id="H39AB99004A1D4C3FB94ACB8BF35ABC25" commented="no"><enum>(b)</enum><header>Considerations</header><text display-inline="yes-display-inline">In promulgating regulations under subsection (a), the Commission shall consider including in such regulations a mechanism to prohibit a telecommunications carrier from levying on a customer of such carrier charges relating to the required contributions of such carriers to Federal universal service support mechanism under section 254(d) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/254">47 U.S.C. 254</external-xref>), if such customer is considered by the Commission to be unserved or underserved with respect to broadband internet access service. </text></subsection><subsection id="HA3D84446512E4C16ABD116D7EB6B217E"><enum>(c)</enum><header>Definitions</header><text>In this Act:</text><paragraph id="HBAF13BD776A54FE98C8453BE74E5BE66"><enum>(1)</enum><header>Broadband internet access service</header><text display-inline="yes-display-inline">The term <term>broadband internet access service</term> has the meaning of that term under section 8.1(b) of title 47, Code of Federal Regulations.</text></paragraph><paragraph id="HAAFB41B71D8B44A5B21905FCA5539D5A"><enum>(2)</enum><header>Commission</header><text>The term <term>Commission</term> means the Federal Communications Commission.</text></paragraph><paragraph id="H4E21CE00574C4F519CE33D520DAB5E0A"><enum>(3)</enum><header>Covered business</header><text>The term <term>covered business</term>—</text><subparagraph id="HED9E7439917B4023966BD3AA0C3CF5F0"><enum>(A)</enum><text>means a business offering an online platform which—</text><clause id="HFDC0534B7F544393BFFAF77DD88239FB"><enum>(i)</enum><text>in any month during the most recently completed 12-month period—</text><subclause id="HBE83EBAB031042CE98A6D79CB5488247"><enum>(I)</enum><text>more than 30,000,000 users in the United States accessed, without regard to the means by which the users accessed the service; or</text></subclause><subclause id="H3A3B2D26A0E14D8CA8D9F5201AF8F08E"><enum>(II)</enum><text>more than 300,000,000 users worldwide accessed, without regard to the means by which the users accessed the service; and</text></subclause></clause><clause id="H38A5FA062191452B8AD0AE3F8DF92452"><enum>(ii)</enum><text>during the most recently completed taxable year, had more than $10,000,000,000 in global revenue; and</text></clause></subparagraph><subparagraph id="H424FFA6CC67D4EF6A757174AD180A6F6"><enum>(B)</enum><text>does not include an organization described in <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)</external-xref> of the Internal Revenue Code of 1986 that is exempt from taxation under section 501(a) of such Code.</text></subparagraph></paragraph><paragraph id="H777419CCD0B34687BE98CB5E91A0F6B3"><enum>(4)</enum><header>Online platform</header><text>The term <term>online platform</term> means a website, online or mobile application, mobile operating system, digital assistant, or online service that is designed primarily to—</text><subparagraph id="H6521377FA6A149C5A5551D958BCB2903"><enum>(A)</enum><text>enable a user to generate content that can be viewed by other users on the platform or to interact with other content on the platform;</text></subparagraph><subparagraph id="HE92E6BBCEABD463F8C0BCDE2686F36B5"><enum>(B)</enum><text>facilitate the offering, sale, purchase, payment, or shipping of products or services, including software applications, between and among consumers or businesses not controlled by the platform operator; or</text></subparagraph><subparagraph id="HC3BD16970394445DB1BCBB1F9A4313D5"><enum>(C)</enum><text>enable user searches or queries that access or display a large volume of information.</text></subparagraph></paragraph></subsection></section></legis-body></bill>
