<official-title display="yes">To amend the Higher Education Act of 1965 to increase transparency and reporting on campus sexual violence, and for other purposes.</official-title>

<section id="H69C0A62379094508AA7535B45AB59EA6" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Hold Accountable and Lend Transparency on Campus Sexual Violence Act of 2021</short-title></quote> or the <quote><short-title>HALT Campus Sexual Violence Act of 2021</short-title></quote>.</text></section> <section id="H97CEB6024B4745079888E3F269808118"><enum>2.</enum><header>Disclosure of enforcement actions</header> <subsection id="H21AEECE6749540BAA6C7E77CEFB629D2"><enum>(a)</enum><header>Disclosure of program reviews and open investigations</header><text>The Department of Education Organization Act (<external-xref legal-doc="usc" parsable-cite="usc/20/3401">20 U.S.C. 3401 et seq.</external-xref>) is amended—</text>
<paragraph id="HC19F8E5432E0400EA58940E6C1674332"><enum>(1)</enum><text>in section 203(b) (<external-xref legal-doc="usc" parsable-cite="usc/20/3413">20 U.S.C. 3413(b)</external-xref>), by adding at the end the following new paragraphs:</text> <quoted-block id="H43E37CB6BCA843BCABACC761E3E60491" style="OLC"> <paragraph id="H29C9DA75C81A4E36A3F6F00C6E99E23B" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">The Assistant Secretary for Civil Rights shall make publicly available on the Department’s website a list of each institution under investigation for a possible violation of title IX of the Education Amendments of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/20/1681">20 U.S.C. 1681 et seq.</external-xref>) or title IV of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000c">42 U.S.C. 2000c et seq.</external-xref>), the sanctions (if any) or findings issued pursuant to such investigation, and a copy of final program reviews and resolution agreements, including voluntary resolution agreements, entered into by such institution with the Secretary or Attorney General under title IX of the Education Amendments of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/20/1681">20 U.S.C. 1681 et seq.</external-xref>) or title IV of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000c">42 U.S.C. 2000c et seq.</external-xref>).</text></paragraph>
<paragraph id="H92E83C2C34F94A1F87A78086AB8A071A" indent="up1"><enum>(4)</enum><text>Not later than 30 days after the termination of any resolution agreement described in paragraph (3), the Assistant Secretary for Civil Rights shall transmit to the President and the Congress, and make publicly available on the Department’s website, the letter terminating the Department of Education’s monitoring of such agreement. </text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> <paragraph id="H72EBEEEF333E42B99CC16EEC49A2873D"><enum>(2)</enum><text>in section 205 (<external-xref legal-doc="usc" parsable-cite="usc/20/3415">20 U.S.C. 3415</external-xref>), by adding at the end the following new subsection:</text>

<subsection id="H18F31E5794AC4757BEC2C947A2D32288"><enum>(c)</enum><text display-inline="yes-display-inline">The Assistant Secretary for Postsecondary Education shall make publicly available on the Department’s website a list of each institution under investigation for a possible violation of section 485(f) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1092">20 U.S.C. 1092(f)</external-xref>), the sanctions (if any) or findings issued pursuant to such investigation, and a copy of program reviews and resolution agreements entered into by such institution with the Secretary or Attorney General under such section 485(f) (<external-xref legal-doc="usc" parsable-cite="usc/20/1092">20 U.S.C. 1092(f)</external-xref>).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="H9372827939BB45089BAB20862AE2DF6A"><enum>(b)</enum><header>Inspector general</header><text>Not later than one year after the date of enactment of this Act, the Inspector General of the Department of Education shall submit to Congress and make publicly available a report reviewing compliance with paragraphs (3) and (4) of section 203(b) of the Department of Education Organization Act (<external-xref legal-doc="usc" parsable-cite="usc/20/3413">20 U.S.C. 3413(b)</external-xref>) and section 205(c) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/20/3415">20 U.S.C. 3415</external-xref>), as added by subsection (a).</text></subsection></section>
<section id="H322CB2448DA8499A9A7A51B09F1466E3"><enum>3.</enum><header>Disclosures of requests for exemptions under title IX</header><text display-inline="no-display-inline">Section 203(b) of the Department of Education Organization Act (<external-xref legal-doc="usc" parsable-cite="usc/20/3413">20 U.S.C. 3413(b)</external-xref>) is further amended by adding at the end the following new paragraph:</text> <quoted-block id="HCC88DEE5FC0F426F8A6455DA39605E5E" style="OLC"> <paragraph id="HEE4B8410A5DC40E3A942267B3439BD22" indent="up1"><enum>(5)</enum><text>The Assistant Secretary for Civil Rights shall make publicly available and easily accessible on the Department’s website a list of each institution that has requested to be exempt from title IX of the Education Amendments of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/20/1681">20 U.S.C. 1681 et seq.</external-xref>).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section>
<section id="H4417743A9F6E44919421E928D711DF25"><enum>4.</enum><header>Authority to levy fines</header><text display-inline="no-display-inline">Section 203(c) of the Department of Education Organization Act (<external-xref legal-doc="usc" parsable-cite="usc/20/3413">20 U.S.C. 3413</external-xref>) is amended—</text> <paragraph id="H329D8140D2AD4F1088ECC22C557C7320"><enum>(1)</enum><text>by striking <quote>and</quote> at the end of paragraph (3);</text></paragraph>
<paragraph id="H6D88641E3A7F4821A73011D90C93FE2E"><enum>(2)</enum><text>by striking the period at the end of paragraph (4) and inserting <quote>; and</quote>; and</text></paragraph> <paragraph id="H9EE99A279F594BADAC5EF992282E64AD"><enum>(3)</enum><text>by adding at the end the following new paragraph:</text>

<paragraph id="H537AC9DDB2B44AF78AAB357732CEAABC"><enum>(5)</enum><text>to impose a civil penalty to be paid by an institution that has violated a law under the jurisdiction of the Office for Civil Rights, the amount of which shall be determined by the gravity of the violation, and the imposition of which shall not preclude other remedies available under Federal law.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> <section id="HD38087F9C1E7466F87C31BCCF0D416A0"><enum>5.</enum><header>Climate surveys</header><text display-inline="no-display-inline">Section 485(f) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1092f">20 U.S.C. 1092f</external-xref>) is amended—</text>
<paragraph id="H42D730E69839430FB9907430F6359F97"><enum>(1)</enum><text>by redesignating paragraph (18) as paragraph (19); and</text></paragraph> <paragraph id="H458013BED54B4BFAA502F187164D6F32"><enum>(2)</enum><text>by inserting after paragraph (17) the following: </text>

<paragraph id="H5A4B2CE9C3B04581B183BEA6C894E801" indent="up1"><enum>(18)</enum><header>Online survey tool for campus safety</header>
<subparagraph id="H9E27F06D5BC1447180611144F8C6149D"><enum>(A)</enum><header>In general</header><text>The Secretary shall, in consultation with the Attorney General, Director of the Centers for Disease Control, and the Secretary of the Department of Health and Human Services and experts in domestic violence, dating violence, sexual assault, sexual harassment, and stalking, develop, design, and make available through a secure and accessible online portal, a standardized online survey tool regarding student experiences with domestic violence, dating violence, sexual assault, sexual harassment, and stalking.</text></subparagraph> <subparagraph id="H189F1C43FCF04B85AD8C8C9025350AA2"><enum>(B)</enum><header>Development of survey tool</header><text>In developing the survey tool required under subparagraph (A), the Secretary shall—</text>
<clause id="H46A48050136D4819AE3C95D8A51EFE80"><enum>(i)</enum><text>use best practices from peer-reviewed research measuring domestic violence, dating violence, sexual assault, sexual harassment, and stalking;</text></clause> <clause id="HCC4C7E85E7094B3D9A42FC028C65692E"><enum>(ii)</enum><text>consult with the higher education community, experts in survey research related to domestic violence, dating violence, sexual assault, sexual harassment, and stalking, and organizations engaged in the prevention of and response to, and advocacy on behalf of victims of, domestic violence, dating violence, sexual assault, sexual harassment, and stalking regarding the development and design of such survey tool and the methodology for administration of such survey tool; and</text></clause>
<clause id="HDD66D9DDF23A42EB9108402737C86800"><enum>(iii)</enum><text>ensure that the survey tool is readily accessible to and usable by individuals with disabilities.</text></clause></subparagraph> <subparagraph id="HAB6F437A6FA745498019900C94AAFF46"><enum>(C)</enum><header>Elements</header> <clause id="H907CA0AAB6664B57A33FE34D074C9E2C"><enum>(i)</enum><header>In general</header><text>The survey tool developed pursuant to this paragraph shall be fair and unbiased, scientifically valid and reliable, and meet the highest standards of survey research.</text></clause>
<clause id="HAB006FC9A5534B7C95B74012A366AA1C"><enum>(ii)</enum><header>Survey questions</header><text>Survey questions included in the survey tool developed pursuant to this paragraph shall—</text> <subclause id="HEDC05B1F86B942B38E329A31C67CCC33"><enum>(I)</enum><text>be designed to gather information on student experiences with domestic violence, dating violence, sexual assault, sexual harassment, and stalking, including the experiences of victims of such incidents;</text></subclause>
<subclause id="H685C95F40A824BC6947D6264EFBB9020"><enum>(II)</enum><text>use trauma-informed language to prevent retraumatization; and</text></subclause> <subclause id="HC2269F3D05C441758CD255130D91DDBB"><enum>(III)</enum><text>include—</text>
<item id="HE885795DE0D64535927F23B850714B92"><enum>(aa)</enum><text>questions that give students the option to report their demographic information;</text></item> <item id="H9F3991D1ED4F44DE96587125550F8810"><enum>(bb)</enum><text>questions designed to determine the incidence and prevalence of domestic violence, dating violence, sexual assault, sexual harassment, and stalking whether the incident occurred on or off campus, and whether carried out in whole or in part through the use of electronic messaging services, commercial mobile services, electronic communications, or other technology;</text></item>
<item id="H9781A3E32C014B28B9B7D36FA2A75751"><enum>(cc)</enum><text>questions regarding whether students know about institutional policies and procedures related to domestic violence, dating violence, sexual assault, sexual harassment, and stalking;</text></item> <item id="HC9501FDA6192452788B77B2D5F797858"><enum>(dd)</enum><text>questions designed to determine, if victims reported domestic violence, dating violence, sexual assault, sexual harassment, or stalking—</text>
<subitem id="H19ADAB0F82DB4C90B28A68744B6F6B49"><enum>(AA)</enum><text>to whom the incident was reported and what response the victim may have received;</text></subitem> <subitem id="HCA20B943C6BB421BADC79F334A4181BF"><enum>(BB)</enum><text>whether the victim was informed of, or referred to, national, State, local, or on-campus resources; and</text></subitem>
<subitem id="HD45349BC461C4E6B97BE7FB17B763683"><enum>(CC)</enum><text>whether the entity to whom the victim reported the incident conducted an investigation and the duration and final resolution of such an investigation;</text></subitem></item> <item id="HEBDD96C5D128491E8D983CEC77A3778A"><enum>(ee)</enum><text>questions regarding contextual factors, such as whether force, incapacitation, or coercion was involved;</text></item>
<item id="HCB848295A1B14A0A89B32A3D46A6011C"><enum>(ff)</enum><text>questions to determine whether an accused individual was a student at the institution;</text></item> <item id="H9F7A44B9A49D487792C85CF051EB68C1"><enum>(gg)</enum><text>questions to determine whether a victim reported an incident to State, local, or campus law enforcement;</text></item>
<item id="HB6873D6B72064FB5A2FC4DB316D75313"><enum>(hh)</enum><text>questions to determine why the victim chose to report or not report an incident to the institution of higher education or State, local, or campus law enforcement;</text></item> <item id="H55FFBDEBEE9448BDB239CC10A8CDF671"><enum>(ii)</enum><text display-inline="yes-display-inline">questions to determine the impact of domestic violence, dating violence, sexual assault, sexual harassment, and stalking on the victim’s education, including diminished grades, dropped classes, leaves of absence, and negative financial consequences (such as costs associated with loss in paid tuition due to leaves of absence, loss in scholarship awards due to diminished grades, and cost associated with counseling, medical services, or housing changes);</text></item>
<item id="H1F14BB98E071407D872843CA7493400B"><enum>(jj)</enum><text>questions to determine the impact and effectiveness of prevention and awareness programs and complaints processes for the overall student body and different student populations that identify as—</text> <subitem id="H3A79A006883E40A3BB982AF8BF8131AF"><enum>(AA)</enum><text>students of color;</text></subitem>
<subitem id="H436963A1EF764844B048FF8B67986E9C"><enum>(BB)</enum><text>LGBTQ students;</text></subitem> <subitem id="HB10E7917CC464DE3862625A8864C43B0"><enum>(CC)</enum><text>immigrant students;</text></subitem>
<subitem id="H6AA1FFEBCAD84D1388940A6A8102833E"><enum>(DD)</enum><text>pregnant, expectant, or parenting students; or</text></subitem> <subitem id="HA0357947AE394B4C96FAD36C5B964946"><enum>(EE)</enum><text>students with disabilities;</text></subitem></item>
<item id="HE54BAD1D9E2C40DA8BE3A9391510EC1B"><enum>(kk)</enum><text>questions to determine attitudes toward sexual violence and harassment, including the willingness of individuals to intervene as a bystander of sex-based (including sexual orientation-based and gender identity-based), race-based, national origin-based, and disability-based discrimination, harassment, assault, domestic violence, dating violence, sexual assault, sexual harassment, and stalking; and</text></item> <item id="H37A225017CD54605A067730A3905C0E7"><enum>(ll)</enum><text display-inline="yes-display-inline">other questions, as determined by the Secretary.</text></item></subclause></clause>
<clause id="H0921FE2C0434451EBD1698CDC604D03F"><enum>(iii)</enum><header>Additional elements</header><text>In addition to the standardized questions developed by the Secretary under clause (ii), an institution may request additional information from students that would increase the understanding of the institution of school climate factors unique to their campuses.</text></clause> <clause id="H4725EDF100054839A959E3B9B2EF01FC"><enum>(iv)</enum><header>Responses</header><text>The responses to the survey questions described in clause (ii) shall—</text>
<subclause id="HB88423DBD00C41129B535B5419A551AD"><enum>(I)</enum><text>be submitted confidentially;</text></subclause> <subclause id="HD0186397BC8245EA8EFCA8B35E12CA24"><enum>(II)</enum><text>not be included in crime statistics; and</text></subclause>
<subclause id="HF380763CC1534724AE6B217325270B01"><enum>(III)</enum><text>in the case of such responses being included in a report, shall not include personally identifiable information.</text></subclause></clause></subparagraph> <subparagraph id="H27A73EB4886E4161B017D76E1E232544"><enum>(D)</enum><header>Administration of survey</header> <clause id="HDFD1F36A57434A9D8C4E09D86010716F"><enum>(i)</enum><header>Federal administration</header><text>The Secretary, in consultation with the Attorney General, Director of the Centers for Disease Control, and Secretary of the Department of Health and Human Services, shall develop a mechanism by which institutions of higher education may, with respect to the survey tool developed pursuant to this paragraph—</text>
<subclause id="HF84878C2279548EFB387282D55604792"><enum>(I)</enum><text>administer such survey tool; and</text></subclause> <subclause id="H3A4463B6DF8B4CCDB910B42CD3926136"><enum>(II)</enum><text>modify such survey tool to include additional elements or requirements, as determined by the institution.</text></subclause></clause>
<clause id="H2E25C3637392421399C4C80D497B840C"><enum>(ii)</enum><header>Costs</header><text>The Secretary may not require an institution of higher education to pay to modify the survey tool in accordance with clause (i)(II).</text></clause> <clause id="H574E1F54D7744A9E832D6E7388969426"><enum>(iii)</enum><header>Accessibility</header><text>The Secretary shall ensure that the survey tool is administered in such a way as to be readily accessible to and usable by individuals with disabilities.</text></clause>
<clause id="H368C3BC63F0844A6B1A70E6A958343EC"><enum>(iv)</enum><header>Institutional administration</header><text>Beginning not later than one year after the date on which the Secretary makes available to institutions of higher education the mechanism described in clause (i), and every two years thereafter, each institution of higher education shall administer the survey tool developed pursuant to this paragraph.</text></clause></subparagraph> <subparagraph id="H3E6B9C8EBEA74587BCD774F0A3F8DB92"><enum>(E)</enum><header>Completed surveys</header><text>The Secretary shall require each institution of higher education participating in any program under this title to ensure, to the maximum extent practicable, that an adequate, random, and representative sample size of students (as determined by the Secretary) enrolled at the institution of higher education complete the survey tool developed pursuant to this paragraph.</text></subparagraph>
<subparagraph id="H30F803C11E9F4B4388F6D28E1C43F059" commented="no"><enum>(F)</enum><header>Report</header><text>Beginning not later than two years after the date of enactment of the <short-title>HALT Campus Sexual Violence Act of 2021</short-title>, and every 2 years thereafter, the Secretary shall—</text> <clause id="H4B52B5DEC08047C38E5B3C877DB64EE8" commented="no"><enum>(i)</enum><text>prepare a biennial report on the information gained from the standardized elements of the survey under this paragraph, which shall include campus-level data for each institution of higher education and attributed by name of each campus in a manner that permits comparisons across institutions of higher education and campuses; </text></clause>
<clause id="H42D3E0ED1D004179A843B648D0A7CCA7" commented="no"><enum>(ii)</enum><text>publish such report in an accessible format on the website of the Department; and</text></clause> <clause id="H13223FA25FD24491B2003A59D55A9100" commented="no"><enum>(iii)</enum><text>submit to Congress such report. </text></clause></subparagraph>
<subparagraph id="H32ADF705B9AF40798D2BC37385DA689E"><enum>(G)</enum><header>Publication</header><text>Each institution shall publish, in a manner that is readily accessible and usable by individuals, including individuals with disabilities—</text> <clause id="HF0C2B3FDD5454340A247DE433AEB798E"><enum>(i)</enum><text>the campus-level results of the standardized elements of the survey under this paragraph on the website of the institution and in the annual security report required under paragraph (1) for the campuses affiliated with the institution; and</text></clause>
<clause id="HF55957E08AE645159F26715D0F37CB7B"><enum>(ii)</enum><text>the campus-level results of the additional elements modifying the survey by the institution of higher education, if any, on the website of the institution.</text></clause></subparagraph> <subparagraph id="H97A8444EC17C4693BFDF46045BC0E0E8"><enum>(H)</enum><header>Violation</header><text>Upon a determination pursuant to section 487(c)(3)(B) that an institution of higher education has violated or failed to carry out any provision under this subsection, the Secretary shall impose a civil penalty upon the institution pursuant to the same procedures as a civil penalty is imposed under section 487(c)(3)(B), except that such section shall be applied by substituting <quote>$100,000</quote> for <quote>$25,000</quote>.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>
<section id="H15DCB1C004C94BBAB2D3D55949C96AE4" commented="no"><enum>6.</enum><header>Creation of a private right of action</header><text display-inline="no-display-inline">Section 485(f)(14) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1092">20 U.S.C. 1092(f)(14)</external-xref>) is amended to read as follows:</text> <quoted-block id="HECFD8E3ACC2B498E8755BE003EA55B06" style="OLC"> <paragraph id="H4664F1CEE8B44906A0C12CA9BB0A5899" indent="up1" commented="no"><enum>(14)</enum> <subparagraph commented="no" display-inline="yes-display-inline" id="H12B2E725A1B6404B83A023021A95C62A"><enum>(A)</enum><text display-inline="yes-display-inline">An individual may bring an action against an institution of higher education for a violation of this subsection in an appropriate district court of the United States. In a proceeding under this paragraph, a court may award a plaintiff who has suffered or may suffer damages as a result of noncompliance with this subsection all appropriate relief, including equitable relief, compensatory damages, cost of the action, and remedial action. </text></subparagraph>
<subparagraph id="H02A3D315BEC04137B715CC79E61B28A8" indent="up1" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">This paragraph shall not be construed to preclude an individual from obtaining any other remedy that is available under any other provision of law or to require such individual to exhaust any administrative complaint process or notice-of-claim requirement before seeking redress under this paragraph. </text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section> <section id="H93A51CAF212A47819D2E7AD2290406A2"><enum>7.</enum><header>Increase of Clery Act penalties</header><text display-inline="no-display-inline">Section 485(f)(13) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1092">20 U.S.C. 1092(f)(13)</external-xref>) is amended—</text>
<paragraph id="HE304E7A1D8F14864974DB984539EE10D"><enum>(1)</enum><text>by striking <quote>in the same amount and</quote>; and</text></paragraph> <paragraph id="H19546435DAF643F5A5C5DADCB8B64554"><enum>(2)</enum><text>by inserting before the period at the end the following: <quote>, except that such section shall be applied by substituting <quote>$100,000</quote> for <quote>$25,000</quote></quote>.</text></paragraph></section>
<section id="H2A2B77737B48497E821CB777A4E5A528"><enum>8.</enum><header>Notification of policies aimed at prevention of sex-based harassment and violence</header>
<subsection id="H76A72C55508642B4AB3165DDA656A10B"><enum>(a)</enum><header>In general</header><text>Paragraph (8) of section 485(f) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1092">20 U.S.C. 1092(f)</external-xref>) is amended by adding at the end the following new subparagraphs:</text> <quoted-block id="HF0D58099D8C14AA0B914C96349D96BDA" style="OLC"> <subparagraph id="HADA38CF7C4C247299C2A2E57363DA359" indent="up2"><enum>(D)</enum><text>The statement of policy described in subparagraph (A) shall be—</text>
<clause id="H3A4B722623AA4924B551EA64356E33BD"><enum>(i)</enum><text>written using simple and understandable language and clear formatting; and</text></clause> <clause id="H09282924A7A840B98B15DE7C1FAD2EB6"><enum>(ii)</enum><text>made widely available and posted on the institution’s public website in a manner that is readily accessible to and usable by individuals, including individuals with disabilities.</text></clause></subparagraph>
<subparagraph id="H716DAC5208B94743898067376AA9490C" indent="up2"><enum>(E)</enum><text>The statement of policy described in subparagraph (A) shall be provided, on an annual basis, to each student group, student team, or student organization which is part of such institution, is recognized by the institution, or permitted by the institution to use its name or facilities or is known by the institution to act as an unaffiliated student group, student team, or student organization, and each institution of higher education described in subparagraph (A) shall require that each such group, team, or organization distributes a copy of such policy to each of its members as well as each of its applicants for membership, including plebes, pledges, or similar applicants.</text></subparagraph> <subparagraph id="HD5AA9AA306EC4B579170C95AB71E0B00" indent="up2"><enum>(F)</enum><text>An institution’s compliance with subparagraph (E) with respect to an unaffiliated student group, student team, or student organization shall not constitute evidence of the institution’s recognition or endorsement of such unaffiliated group, team, or organization.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection id="H71AE847F8CDE4602BDF9D1A2D86B1EE9"><enum>(b)</enum><header>Comptroller general review</header><text>Not later than August 1, 2022, the Comptroller General shall report to the Committee on Education and Labor of the House of Representatives and the Committee on Health, Education, Labor, and Pensions of the Senate on—</text> <paragraph id="H72B212BF659145B2B8B9FFE3F4F58028"><enum>(1)</enum><text>the implementation of section 485(f)(8) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1092">20 U.S.C. 1092(f)(8)</external-xref>), as amended by subsection (a), including—</text>
<subparagraph id="H5D73DFFA12184C6A9EFBFE667295BD6D"><enum>(A)</enum><text>the extent to which institutions of higher education have developed the statement of policy required under subparagraph (A) of such section;</text></subparagraph> <subparagraph id="H3755ED325FF64ADDA4249593211D160F"><enum>(B)</enum><text>how institutions of higher education are—</text>
<clause id="H3189E798ACAC447399B45DDCA5218620"><enum>(i)</enum><text>distributing such statement of policy; and</text></clause> <clause id="H2D8B9CF4E72642349B8C5BFF072C784B"><enum>(ii)</enum><text>determining whether the policy is received and understood by students; and</text></clause></subparagraph>
<subparagraph id="H7B0DB0A0B60F4E6EA32686C7C3B92049"><enum>(C)</enum><text>the Secretary of Education’s oversight of the compliance of institutions of higher education with respect to the statement of policy requirements under such section, including efforts, in consultation with the Attorney General, to provide technical assistance to institutions of higher education in complying with such requirements; and</text></subparagraph></paragraph> <paragraph id="HB4443868050043CA9A4206EBEBDC034E"><enum>(2)</enum><text>any changes in the numbers of dating violence, domestic violence, sexual assault, or stalking incidents reported to campus security authorities or local police agencies as indicated by the annual security reports distributed under section 485(f)(1) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1092">20 U.S.C. 1092(f)(1)</external-xref>), as amended by this Act, or the climate surveys under section 485(f)(18) of such Act, as amended by section 5 of this Act.</text></paragraph></subsection></section>
<section id="H320821985E8F4E45A1833F698D41C740"><enum>9</enum><header>Task Force on Sex-Based Harassment and Violence in Education</header>
<subsection id="H3A277840DD074606B67D330005C501FC"><enum>(a)</enum><header>Task Force on Sex-Based Harassment and Violence in Education</header><text>Not later than September 1, 2022, the Secretary of Education, the Secretary of Health and Human Services, and the Attorney General shall establish a joint interagency task force to be known as the <quote>Task Force on Sex-Based Harassment and Violence in Education</quote> that shall—</text> <paragraph id="H75FF769FD4464263BD923709FA1426DB"><enum>(1)</enum><text>provide pertinent information to the Secretary of Education, Attorney General, Congress, and the public with respect to prevention of, investigation of, and responses to domestic violence, dating violence, sexual harassment, sexual assault, and stalking at institutions of higher education;</text></paragraph>
<paragraph id="H58AEDB4D079F45E7BCBD5DCAD4E33903"><enum>(2)</enum><text>provide recommendations to educational institutions for establishing prevention and response teams for domestic violence, dating violence, sexual harassment, sexual assault, and stalking;</text></paragraph> <paragraph id="HA899DBB692D743FE9C6CFB167F553B76"><enum>(3)</enum><text>develop recommendations for educational institutions on providing victim resources, including health care, sexual assault kits, sexual assault nurse examiners, culturally responsive and inclusive standards of care, trauma-informed services, and access to confidential advocacy and support services;</text></paragraph>
<paragraph id="HD98FD3C8AF2A4AFE993C9217F505DCA7"><enum>(4)</enum><text>provide recommendations for educational institutions for research-based education programs or other training for students shown to be effective to prevent domestic violence, dating violence, sexual harassment, sexual assault, and stalking;</text></paragraph> <paragraph id="H680CFEA83CCF49C9989BEF182264594D"><enum>(5)</enum><text>develop recommendations in conjunction with student groups at greater statistical risk of perpetuating rape culture such as fraternities and athletic departments for best practices for prevention of and response to domestic violence, dating violence, sexual harassment, sexual assault, and stalking at educational institutions, taking into consideration an institution’s size and resources;</text></paragraph>
<paragraph id="H71132948458C4DF382751C8711239AD7"><enum>(6)</enum><text>develop recommendations for educational institutions on sex education, as appropriate, training for school staff, and various equitable discipline models;</text></paragraph> <paragraph id="H0C562364FD0C43C9B1BED09C0588F212"><enum>(7)</enum><text>develop recommendations on culturally responsive and inclusive approaches to supporting victims, which include consideration of race, ethnicity, national origin, immigrant status, gender identity, sexual orientation, ability, disability, socioeconomic status, exposure to trauma, and other compounding factors;</text></paragraph>
<paragraph id="H73FDE90E0DEC48E3A02F024EB51E4BDA"><enum>(8)</enum><text>solicit periodic input from a diverse group of victims, trauma specialists, advocates from national, State, and local organizations that combat domestic violence, dating violence, sexual harassment, sexual assault, and stalking, educational institutions, and other public stakeholders;</text></paragraph> <paragraph id="H8DBB6CE71BE1429F808940651D180BD8"><enum>(9)</enum><text>assess the Department of Education’s ability under section 902 of the Education Amendments of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/20/1682">20 U.S.C. 1682</external-xref>) to levy intermediate fines for noncompliance with title IX of the Education Amendments of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/20/1681">20 U.S.C. 1681 et seq.</external-xref>) and the advisability of additional remedies for such noncompliance, in addition to the remedies already available under Federal law; and</text></paragraph>
<paragraph id="H031553D257584E948D095F5D6DFFBE6E"><enum>(10)</enum><text>create a plan described in subsection (c).</text></paragraph></subsection> <subsection id="HF8ADA1892EFD44B09AE1368D6CB45059"><enum>(b)</enum><header>Personnel details</header> <paragraph id="H0E86213CBD844E3980B1047D383AB76A"><enum>(1)</enum><header>Authority to detail</header><text>Notwithstanding any other provision of law, the head of a component of any Federal agency that is funded under the Violence Against Women Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/42/13925">42 U.S.C. 13925 et seq.</external-xref>) may detail an officer or employee of such component to the Task Force on Sex-Based Harassment and Violence in Education or to the Secretary of Education to assist the Task Force with the duties described in subsection (a), as jointly agreed to by the head of such component and the Task Force.</text></paragraph>
<paragraph id="H153920E108D34D26B0EDB9E09D62E279"><enum>(2)</enum><header>Basis for detail</header><text>A personnel detail made under paragraph (1) may be made—</text> <subparagraph id="HEC1DE9B9C9644FBDB3660CD27C4FD9E5"><enum>(A)</enum><text>for a period of not more than 3 years; and</text></subparagraph>
<subparagraph id="H1F4322A1A219482DABFF72B31C9062A1"><enum>(B)</enum><text>on a reimbursable or nonreimbursable basis.</text></subparagraph></paragraph></subsection> <subsection id="HF4ABFD24C51E40689130B97AE93620D0"><enum>(c)</enum><header>Additional plan</header><text>Not later than 90 days after the date on which the Task Force on Sex-Based Harassment and Violence in Education is established under subsection (a), the Task Force shall submit to Congress recommendations for recruiting, retaining, and training a highly qualified workforce employed by the Department of Education to carry out investigation of complaints alleging a violation of title IX of the Education Amendments of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/20/1681">20 U.S.C. 1681 et seq.</external-xref>) or section 485(f) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1092">20 U.S.C. 1092(f)</external-xref>), and enforcement of such title IX (<external-xref legal-doc="usc" parsable-cite="usc/20/1681">20 U.S.C. 1681 et seq.</external-xref>) or such section 485(f) (<external-xref legal-doc="usc" parsable-cite="usc/20/1092">20 U.S.C. 1092(f)</external-xref>), with respect to domestic violence, dating violence, sexual harassment, sexual assault, and stalking in education. Such plan shall include—</text>
<paragraph id="H2417989A38EB4860A1DEADA19D477AF9"><enum>(1)</enum><text>an assessment to identify current gaps or challenges carrying out such investigation and enforcement, which may include surveying current investigative workforce to solicit feedback on areas in need of improvement;</text></paragraph> <paragraph id="H27D5CADA845E452ABBE4D12F78E05B83"><enum>(2)</enum><text>an examination of issues of recruiting, retention, and the professional development of such workforce, including the possibility of providing retention bonuses or other forms of compensation for the purpose of ensuring the Department of Education has the capacity, in both personnel and skills, needed to properly perform its mission and provide adequate oversight of educational institutions;</text></paragraph>
<paragraph id="H66D4C845F1D0427EB0ED2373C937E67B"><enum>(3)</enum><text>an assessment of the benefits of outreach and training with both law enforcement agencies and educational institutions with respect to such workforce;</text></paragraph> <paragraph id="H6CCFC34A910940418509D47DFBE9D87C"><enum>(4)</enum><text>an examination of best practices for making educational institutions aware of the most effective prevention, investigation, and response practices relating to domestic violence, dating violence, sexual harassment, sexual assault, and stalking and identifying areas where more research should be conducted; and</text></paragraph>
<paragraph id="H4AA471E696A8432D9DFC7ECD6E2C93E2"><enum>(5)</enum><text>strategies for addressing such other matters as the Secretary of Education considers necessary to prevention of, investigation of, and responses to domestic violence, dating violence, sexual harassment, sexual assault, and stalking.</text></paragraph></subsection> <subsection id="HF781C53714D34E4D892F5BC45496EDDB"><enum>(d)</enum><header>Annual report</header><text>The Task Force on Sex-Based Harassment and Violence in Education shall report to Congress on an annual basis, and make publicly available, a report of its activities and any update of the plan required under subsection (c), including the number of complaints received regarding domestic violence, dating violence, sexual harassment, sexual assault, and stalking (including such incidents on the basis of sexual orientation and gender identity), the number of open investigations, the number of complaints that continued to resolution, the number of complaints resolved using informal resolution, the average time to complete an investigation, the number of investigations initiated based on complaints, and the number of investigations initiated by the Department of Education.</text></subsection>
<subsection id="H5D0B57128B294D4C9DFDE06973184713"><enum>(e)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="HFF1DC88730824CEBA8CAE92C33B7401B"><enum>(1)</enum><text>The term <term>educational institution</term> includes an institution of higher education, an elementary school, or a secondary school.</text></paragraph>
<paragraph id="HD04BEAB872944EB3916ECB60A218FA38"><enum>(2)</enum><text>The terms <term>elementary school</term> and <term>secondary school</term> have the meanings given the terms in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>).</text></paragraph> <paragraph id="H7C613794F2454968B4D49CD6244D83F4"><enum>(3)</enum><text>The term <term>institution of higher education</term> has the meaning given the term in section 102 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1002">20 U.S.C. 1002</external-xref>).</text></paragraph>
<paragraph id="H4BF651709BB846718C763C6A3FA76BF6" commented="no"><enum>(4)</enum><text>The terms <term>domestic violence</term>, <term>dating violence</term>, <term>sexual assault</term>, and <term>stalking</term> have the meanings given the terms in section 487(f) of the Higher Education of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1092">20 U.S.C. 1092(f)</external-xref>), as amended by this Act.</text></paragraph> <paragraph id="H316D6E4FC27C4DF2BCD5A0A7F707383E"><enum>(5)</enum><text>The term <term>sexual harassment</term> means any unwelcome conduct of a sexual nature, regardless of whether it is direct or indirect, or verbal or nonverbal (including conduct that is undertaken in whole or in part, through the use of electronic messaging services, commercial mobile services, electronic communications, or other technology), that unreasonably alters an individual’s terms, conditions, benefits, or privileges of an educational program or activity, including by creating an intimidating, hostile, or offensive environment, which takes the form of—</text>
<subparagraph id="H8FA0E9F93DDE4D019F5173D98C7D4C1F"><enum>(A)</enum><text>a sexual advance;</text></subparagraph> <subparagraph id="H51EF2F5065CE465BA8C7EF3EB918EA28"><enum>(B)</enum><text>a request for sexual favors;</text></subparagraph>
<subparagraph id="H590C2D23E6D942B7A1A4E15703443996"><enum>(C)</enum><text>a sexual act, where such submission is made either explicitly or implicitly a term or condition of a program or activity at a school or school activity, regardless of a student’s submission to or rejection of such sexual act;</text></subparagraph> <subparagraph id="H70385101B0C744A192A67740CE15CDDD"><enum>(D)</enum><text>a sexual act, where such submission or rejection is used as the basis for a decision affecting a term or condition of a program or activity at a school or school activity, regardless of a student’s submission to or rejection of such sexual act;</text></subparagraph>
<subparagraph id="H86F3AC4FFA434EDD9F04100EB53CA56E"><enum>(E)</enum><text>other conduct of a sexual nature; or</text></subparagraph> <subparagraph id="H44232CE1DC7E4EDAACD60D3804580FB8"><enum>(F)</enum><text>domestic violence, intimate partner violence (dating violence), and sex-based stalking.</text></subparagraph></paragraph></subsection></section>
<section id="H28D1F7D19F484270AD344DE43CFEF12C"><enum>10.</enum><header>Conforming amendments</header><text display-inline="no-display-inline">Section 485(f) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1092">20 U.S.C. 1092(f)</external-xref>) is amended—</text> <paragraph id="H6774099698D841508EA3AD44273C8B17"><enum>(1)</enum><text>in paragraph (1)(F)(i)(II), by striking <quote>sex offenses, forcible or nonforcible</quote> and inserting <quote>sexual assault</quote>; and</text></paragraph>
<paragraph id="HF758B5B4A3DF4F3CBEDE6736687DD18A"><enum>(2)</enum><text>by amending paragraph (6)(A)(v) to read as follows:</text> <quoted-block id="HAA908FA1C35D4106A354113C59552B5D" style="OLC"> <clause id="HCDBECD6C24B347BDBF67AE1C61314898" indent="up2"><enum>(v)</enum><text display-inline="yes-display-inline">The term ‘sexual assault’ has the meaning of an offense classified as a sex offense under the Uniform Crime Report of the Federal Bureau of Investigation.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>
