Creation and integration of FedAccounts.</toc-entry></toc></section><section display-inline="no-display-inline" id="HCC529C0B4D664A02995DDF7987D0FED4"><enum>3.</enum><header>Secretary defined</header><text display-inline="no-display-inline">In this Act, the term <term>Secretary</term> means the Secretary of Treasury (or the Secretary’s delegate).</text></section><title id="HD484D23B6CED45F38AF307F10A95740F"><enum>I</enum><header>Guaranteed Income Programs</header><section id="H507700DA5658498A9206D3351A6904C3"><enum>101.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text><paragraph id="H6E1CE3BC84194188A2BC70DACB618104"><enum>(1)</enum><header>Community development financial institution</header><text>The term <term>community development financial institution</term> has the meaning given such term in section 103 of the Community Development Banking and Financial Institutions Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/12/4702">12 U.S.C. 4702</external-xref>).</text></paragraph><paragraph id="H9C3DED20B7DF490FAFC9876255CAB8EF"><enum>(2)</enum><header>Director</header><text>The term <term>Director</term> means the Director of the Office of Guaranteed Income Programs established under section 102.</text></paragraph><paragraph id="H7E0E591F3C224464A12C1D208E77F845"><enum>(3)</enum><header>Unit of general local government</header><text>The term <term>unit of general local government</term> has the meaning given such term in section 102 of the Housing and Community Development Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5302">42 U.S.C. 5302</external-xref>).</text></paragraph></section><section id="H6DAAFF699CD74A2694DDDBB819FF4FFA"><enum>102.</enum><header>Office of Guaranteed Income Programs</header><subsection id="H75C76E286A8447589CC0D8D12115A8E2"><enum>(a)</enum><header>Establishment</header><text>There is established an Office of Guaranteed Income Programs (in this section referred to as the <quote>Office</quote>).</text></subsection><subsection id="HDE48E1B3D6074669B3E2C0C9A6B6D9EA"><enum>(b)</enum><header>Director</header><text>The Office shall be headed by a Director, who shall be appointed by the Secretary.</text></subsection><subsection id="HAD5CC81955474E44926569C0C143B804"><enum>(c)</enum><header>Duties</header><text>The Director shall assist the Secretary in—</text><paragraph id="HD603C28CC2EB48ED98ECC364718802EA"><enum>(1)</enum><text>carrying out the pilot program established in section 103; and</text></paragraph><paragraph id="HE15FA362E98540F094F227306B364078" commented="no"><enum>(2)</enum><text>implementing the Federal tax credit established in title II.</text></paragraph></subsection><subsection id="HA9CBCC818E5342EAB009D4959D3E565C"><enum>(d)</enum><header>Partnerships with other Federal agencies</header><paragraph id="HA4A1BB4925054B218D085E50698CCC62"><enum>(1)</enum><header>In general</header><text>The Secretary may consult with Federal agencies to—</text><subparagraph id="H06BDA7EDE9194DBDBA497D9A1E071B5A"><enum>(A)</enum><text>establish the organizational structure and functionality of the Office; and</text></subparagraph><subparagraph id="HDE821DFFB0F341788F2CCAC24E9FC3B5"><enum>(B)</enum><text>meet the purposes of this Act.</text></subparagraph></paragraph><paragraph id="H84903F0F54B14ACBA33F006151877755"><enum>(2)</enum><header>Specific duties of other Federal agencies</header><subparagraph id="HA8DA3980AABC46268452E09B8061289E" commented="no"><enum>(A)</enum><header>Department of Housing and Urban Development</header><text>In order to assist the Secretary the Secretary of Housing and Urban Development shall provide administrative expertise with respect to grantmaking to units of general local government through the community development block grant program under title I of the Housing and Community Development Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5301">42 U.S.C. 5301 et seq.</external-xref>).</text></subparagraph><subparagraph id="H47AE109ED01A467091E93BC0798C32AD"><enum>(B)</enum><header>Department of Health and Human Services</header><text display-inline="yes-display-inline">The Secretary of Health and Human Services shall provide to the Secretary and the Director research consulting from the Office of Planning, Research, and Evaluation and such Office’s experience with the Temporary Assistance for Needy Families Program.</text></subparagraph><subparagraph id="H89F1EC7D6B5749B9BC037B8723927B4D"><enum>(C)</enum><header>Internal Revenue Service</header><text>The Commissioner of Internal Revenue shall provide to the Secretary access to tax records to administer and analyze the program under section 103 and to update the Secretary on changes to the taxable income of an individual under this title and title II.</text></subparagraph><subparagraph id="H0DDE6BC42C924358B8EF3FEB1CDE6350"><enum>(D)</enum><header>Social Security Administration</header><text>The Commissioner of Social Security shall provide to the Secretary access to identifying records and addresses to identify individuals under this title and title II receiving supplemental security income benefits or social security disability insurance benefits.</text></subparagraph></paragraph></subsection><subsection id="H36CCEE5CEF8D4271BCF9055697504A02"><enum>(e)</enum><header>Data sharing</header><text>As determined necessary, the Secretary may work with other relevant Federal agencies for the purposes of sharing and updating personal identification information and consolidating a database of individuals who may receive cash payments under this title and title II.</text></subsection><subsection id="HCC85277A20024F6F9BFECC1FC0AD640E"><enum>(f)</enum><header>National Economic Advisory Council</header><paragraph id="H77C8A98E70934AC9AB85AF37E5317166"><enum>(1)</enum><header>Establishment</header><text>The Director shall establish within the Office a National Economic Advisory Council to make recommendations with respect to improving performance and coordination of basic income pilot programs.</text></paragraph><paragraph id="HF2FD066D88F74BBE895584DFC8693036"><enum>(2)</enum><header>Membership</header><text>The National Economic Advisory Council shall be composed of 10 members as follows:</text><subparagraph id="H186B6EF3BEA7482D8895D7392A14D875"><enum>(A)</enum><text>The Director.</text></subparagraph><subparagraph id="HCC03B09721D543BC8D533165167145B5"><enum>(B)</enum><text>The following members appointed by the Director:</text><clause id="HE09341E420B9494281A60D0F8728FAAB"><enum>(i)</enum><text>One representative from a national nonprofit civil rights organization.</text></clause><clause id="H444A1024DC2649FEB2F42801FBFA2477"><enum>(ii)</enum><text>One representative from a national labor organization.</text></clause><clause id="HD160E442F35143FD9324A4EDEC9ECF0B"><enum>(iii)</enum><text>One representative from an economic research organization with expertise in cash-transfer programs.</text></clause><clause id="H4234C70733A243E993564876D59497B2"><enum>(iv)</enum><text>One representative from a community advocacy organization with expertise in cash-transfer programs.</text></clause><clause id="HCB125A75D7CA4FAC80B9FDE32DBCA54C"><enum>(v)</enum><text>One representative from a community development financial institution.</text></clause><clause id="H113F4DC7047E402385184CC663E05DBF"><enum>(vi)</enum><text>Two individuals eligible for cash payments under this title or title II.</text></clause></subparagraph><subparagraph id="H759FE8955C364F549844C45F7873668E" commented="no"><enum>(C)</enum><text>Two members appointed by the Secretary.</text></subparagraph></paragraph><paragraph id="HB9A18F871E75427D9CD7F5E860920B21"><enum>(3)</enum><header>Recommendations</header><text>The Council shall submit to the Secretary and Congress annual recommendations relating to the policies and regulations of the Office.</text></paragraph></subsection></section><section id="HB28B36C0EA5A44AD96DC89AFED9F79F0"><enum>103.</enum><header>Guaranteed income pilot program</header><subsection id="H108137F5DC19433781F8B1ECF6A4F360"><enum>(a)</enum><header>In general</header><text>The Secretary shall implement a 5-year guaranteed income pilot program (in this section referred to as the <quote>Program</quote>) to provide grants to eligible entities to assist in carrying out a qualifying pilot program.</text></subsection><subsection id="H1BFC2AC8B426440C88818AFD270DA9DF"><enum>(b)</enum><header>Qualifying pilot program defined</header><text display-inline="yes-display-inline">In this section, the term <term>qualifying pilot program</term> means a new or ongoing local basic income pilot program that provides to eligible individuals cash payments that are—</text><paragraph id="HA295BB7410954BEDB3454A9960C0B19E"><enum>(1)</enum><text>not less than $50 per such individual per payment; and</text></paragraph><paragraph id="H05668DC6D4FC4547AA67AFB8787EB554"><enum>(2)</enum><text>made on a bi-weekly, monthly, or quarterly basis.</text></paragraph></subsection><subsection id="H8BAD0062EACE4FBC834CBA611E7E02AF"><enum>(c)</enum><header>Application</header><text>A grant under this section may be made only to an eligible entity that submits to the Secretary an application containing such information as the Secretary may require, including—</text><paragraph id="H1FFDED9C879F419DA94D380A153968D4"><enum>(1)</enum><text>a description of a qualifying pilot program to be carried out using grant amounts; and</text></paragraph><paragraph id="H116F34DEE900488AB8978CCA275DE8A0"><enum>(2)</enum><text>an explanation of the need for such program.</text></paragraph></subsection><subsection id="HFEF2ED3D36C74637AF6E0E0097991EED"><enum>(d)</enum><header>Selection</header><paragraph id="H56840025F5414C39873D5D907EA1C894" commented="no"><enum>(1)</enum><header>In general</header><text>The Secretary, in consultation with the Director, shall select not less than 500 eligible entities to participate in the Program based on criteria that the Secretary shall establish. </text></paragraph><paragraph id="HB18CE5D6A41341EDBE2971DD549BA959"><enum>(2)</enum><header>Priority</header><text>The Secretary, in approving applications under this section, shall give priority to applications submitted by—</text><subparagraph id="HA0AC77D7EFBF47D5ACDFDC1C40F098CC"><enum>(A)</enum><text>units of general local government that have never established or do not have an existing program to provide a basic minimum income for individuals;</text></subparagraph><subparagraph id="HE1551DDF6DD848598839918E1DE1E162"><enum>(B)</enum><text>units of general local government that will carry out a qualifying pilot program in low-income geographic areas or persistent poverty counties;</text></subparagraph><subparagraph id="HA7E120A77C654C7BABAF67FC8D22A849"><enum>(C)</enum><text>community development financial institutions that are minority-owned; and</text></subparagraph><subparagraph id="H77A6301CF7344E83A44DCB37F13ADD89"><enum>(D)</enum><text>community development financial institutions that serve or are based in low-income geographic areas or persistent poverty counties.</text></subparagraph></paragraph></subsection><subsection id="HF2AD03F04F1B4412BDA5AE55FDAB2F21"><enum>(e)</enum><header>Local evaluations</header><text>Eligible entities may use grant amounts to cover the costs of evaluations, similar to the requirements in subsection (g), through working with partners, such as for-profit, nonprofit, public, or quasi-governmental entities, to design, text, and report on their income pilots.</text></subsection><subsection id="H6AE761499B20440AA4C204D47F98DF30" commented="no"><enum>(f)</enum><header>Disregard of cash payments for purposes of all Federal and federally assisted programs</header><text>Notwithstanding any other provision of law, any payment made to a participating individual under this section shall not be taken into account as income or resources for the period of 12 months from receipt, for purposes of determining the eligibility of such individual for benefits or assistance (or the amount or extent of benefits or assistance) under any Federal program or any State or local program financed in whole or in part with Federal funds.</text></subsection><subsection id="HFD2535F9C6FF4200B0046CA35E0A0053"><enum>(g)</enum><header>External partners</header><paragraph id="HBFEBC71DCD36405FB15696D00B2DF840"><enum>(1)</enum><header>Selection</header><text>The Secretary, in consultation with the Director, shall select no more than three external partners to provide assistance with the design, administration, and evaluation of the Program.</text></paragraph><paragraph id="HD65B052F9D0643329F33549E59D1ABEC" commented="no"><enum>(2)</enum><header>Qualifications</header><text>An organization selected to be an external partner shall—</text><subparagraph id="H2E52613725C3405B9A29E6D8C62A69C5"><enum>(A)</enum><text>have demonstrated experience in—</text><clause id="H8465728A13F8403FBF9D2C0D47AFDDAE" commented="no"><enum>(i)</enum><text>studying or implementing cash-transfer programs;</text></clause><clause id="H593EE29ADBEE4E33B236FBBA79771BBF" commented="no"><enum>(ii)</enum><text>executing a mixed-methods study that incorporates an experiment or quasi-experiment design; and</text></clause><clause id="H58D8784557284E15AD5EC61C51ADE398" commented="no"><enum>(iii)</enum><text>holding highly ethical research designs with a consistent track record of approval from institutional review boards; and</text></clause></subparagraph><subparagraph id="HF1F644B3877C4876AA195BC9228DA360" commented="no"><enum>(B)</enum><text>have no campaign activity as a research organization described under <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)(3)</external-xref> of the Internal Revenue Code of 1986.</text></subparagraph></paragraph><paragraph id="H17041871B7494F6CA510E3C84AD8A204"><enum>(3)</enum><header>Confidentiality</header><text>An external partner, and any employee of an external partner, shall be treated as a Federal employee for purposes of <external-xref legal-doc="usc" parsable-cite="usc/26/6103">section 6103</external-xref> of the Internal Revenue Code of 1986.</text></paragraph><paragraph id="HF6FC08066315497EB5CE3DF0C3E202DA"><enum>(4)</enum><header>Data collection</header><text>An external partner shall work with the Director to collect and record data from eligible entities and participating individuals, as necessary, to complete the study and reports required under subsection (g), and to conduct any additional research as the Secretary determines necessary. </text></paragraph></subsection><subsection id="H7DCE7E7E287E4825A4E8872E750DB8A9"><enum>(h)</enum><header>Reporting</header><paragraph id="H6E76A909ECBA4AFFAB342A6831C44EA0"><enum>(1)</enum><header>Task force</header><text>The Secretary, in consultation with the Director and external partners, may establish a task force to study the results of the qualifying pilot programs funded with grants under the Program.</text></paragraph><paragraph id="HC1296037C1AB4C68815F9CEB6E7793E2"><enum>(2)</enum><header>Information gathering</header><text>An eligible entity providing cash payments to an eligible individual through a qualifying pilot program, funded through the Program, shall collect, maintain a record of, and promptly submit such record to the task force the following information:</text><subparagraph id="HB1EDB5F643B1405884D1096558FE9486"><enum>(A)</enum><text>If the eligible entity is a community development financial institution, whether the entity itself is a minority-owned, women-owned, or veteran-owned entity.</text></subparagraph><subparagraph id="H534D9A8AEEF749C099CD8237187AAFED"><enum>(B)</enum><text>Demographic information of participating individuals, including race and ethnicity, gender, disability status, housing status, family composition, and income level.</text></subparagraph></paragraph><paragraph id="H150AB9A33E374B73B6355250A43BB6E8" commented="no"><enum>(3)</enum><header>Evaluation</header><text>Of the amounts made available to carry out this section, the Secretary, acting through the Director, may use such amounts as may be necessary to evaluate the effectiveness of qualifying pilot programs funded through the Program, using a methodology that—</text><subparagraph id="H151AD52FB2524C5A9592134CB1E4F881" commented="no"><enum>(A)</enum><text>includes a random assignment whenever feasible, or other research methods that allow for the strongest possible casual inferences when a random assignment is not feasible; and</text></subparagraph><subparagraph id="H4352BD98933046758C63CF96D5409AAD" commented="no"><enum>(B)</enum><text>generates evidence on the impact of specific qualifying pilot programs and protocols.</text></subparagraph></paragraph><paragraph id="HF242D5E1CB21460E846C1D9234C47EAC"><enum>(4)</enum><header>Interim report</header><text>Not later than 24 months after cash payments are initially made to participating individuals, the Secretary, in consultation with the Director and external partners, shall issue an interim report on the Program to Congress, including the following information:</text><subparagraph id="HAAC3D103FEDE4557A0B4E48A120497DA" commented="no"><enum>(A)</enum><text>For each qualifying pilot program, the total number of participating individuals dis­ag­gre­gated by race and ethnicity, gender, disability status, housing status, family composition, and income and assets (including income level as a percentage of the Federal poverty line).</text></subparagraph><subparagraph id="H1E3021F67F454CAAB5FD13BFD81BC4CF"><enum>(B)</enum><text>With respect to each participating individual, to the extent applicable—</text><clause id="H8BB5EED407774685835F51408D1E11D5"><enum>(i)</enum><text>such individual’s employment type and job status;</text></clause><clause id="H409522B4ED7E41F5A6EDF8166C40E1A7"><enum>(ii)</enum><text>the total amount of cash payments received by such individual; and</text></clause><clause id="H9B549F73D0454B5D90D67935E17B0B9E"><enum>(iii)</enum><text>such individual’s zip code.</text></clause></subparagraph><subparagraph id="H96F222F8047D4DDC9BDCE390A60C7961"><enum>(C)</enum><text>Any other information that the Secretary determines to be necessary.</text></subparagraph></paragraph><paragraph id="H3F42C77BFBCB4E84B609D74E0A024997"><enum>(5)</enum><header>Final report</header><text>Not later than 12 months after the conclusion of the Program, the Secretary, in consultation with the Director and the external partners, shall issue a final report on the Program to Congress, which shall include updated disclosures and calculations of the information provided in the interim report under paragraph (4), and a final assessment comprised of—</text><subparagraph id="HDF5560A53A6344DFA30AF23BC4F110CE"><enum>(A)</enum><text>a quantitative and qualitative analysis of the effects of the income subsidies provided under the qualifying pilot programs on—</text><clause id="H3CCDE6D3D74B4DAFB258B51CBBE42171"><enum>(i)</enum><text>financial outcomes of participating individuals;</text></clause><clause id="HF31D628EC6E749C99D1E548E992B5467"><enum>(ii)</enum><text>the health and economic well-being of participating individuals; and</text></clause><clause id="HB7F842A3065A4974846645D276BD9067"><enum>(iii)</enum><text>the social costs of poverty and income volatility, including connections with income fluctuation and health, education, employment, childcare, and other outcomes as determined appropriate by the Secretary; and</text></clause></subparagraph><subparagraph id="H98C70F17DD584A0EB7D5B5DE95AFC505"><enum>(B)</enum><text>recommendations by the Secretary on the efficacy and operational pathways of expanding local basic income subsidies into a Federal guaranteed income program.</text></subparagraph></paragraph><paragraph id="HAF33992146F64E3285ECC28C43A7EDA7"><enum>(6)</enum><header>Public availability</header><subparagraph id="H5B8826EDC0874C7B9EF8A41D70F822EB"><enum>(A)</enum><header>In general</header><text>As soon as is practicable after issuing each report under paragraphs (4) and (5), the Secretary shall make all the information contained in each such report publicly available.</text></subparagraph><subparagraph id="HF834E5AB083B40348EBB7D323D46C757"><enum>(B)</enum><header>Confidentiality</header><text>In making information publicly available under subparagraph (A), the Secretary shall withhold confidential information.</text></subparagraph></paragraph></subsection><subsection id="H134D5C66414C4E0D91649214DC354D08"><enum>(i)</enum><header>Rules and guidance</header><text>The Secretary, in consultation with the Director, shall issue any rules and guidance that are necessary to carry out this section, including establishing appropriate compliance and reporting requirements in addition to the reporting requirements under subsection (g).</text></subsection><subsection id="HFC9B87DB31AA4928A09FDCFDA42ED35E"><enum>(j)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H352F4C9CA5E046BDA8C9DDEFBD861E52"><enum>(1)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means a unit of general local government or a community development financial institution.</text></paragraph><paragraph id="H8C539AC0B2A94F4887455A53632CFF7F"><enum>(2)</enum><header>Eligible individual</header><text>The term <term>eligible individual</term> means a resident of the United States. </text></paragraph><paragraph id="H555F1BF0569B4AF998118EAA97DA8F6C"><enum>(3)</enum><header>Federal poverty line</header><text>The term <term>Federal poverty line</term> has the meaning given the term <term>poverty line</term> in section 673 of the Omnibus Budget Reconciliation Act of 1981 (<external-xref legal-doc="usc" parsable-cite="usc/42/9902">42 U.S.C. 9902</external-xref>).</text></paragraph><paragraph id="H39F0D9AE68814243B92CD744624B1EBC" commented="no"><enum>(4)</enum><header>Low-income geographic area</header><text>The term <term>low-income geographic area</term> has the meaning given such term in section 351 of the Small Business Investment Act of 1958 (<external-xref legal-doc="usc" parsable-cite="usc/15/689">15 U.S.C. 689</external-xref>).</text></paragraph><paragraph id="HC4DCDCFE2C6148759F23C4702A389871" commented="no"><enum>(5)</enum><header>Minority-owned</header><text>With respect to a community development financial institution, the term <term>minority-owned</term> means a community development financial institution with—</text><subparagraph id="H60B17C9BAA1B41F8B25D591AE540D274" commented="no"><enum>(A)</enum><text>more than 50 percent of the ownership or control held by not less than one minority; and</text></subparagraph><subparagraph id="H9193D94115F446459BF51F0850EBF483" commented="no"><enum>(B)</enum><text>more than 50 percent of the net profit or loss of which accrues to not less than one minority.</text></subparagraph></paragraph><paragraph id="H65E3C96181A64967838F91D34974D8DE"><enum>(6)</enum><header>Minority</header><text>The term <term>minority</term> has the meaning given such term in section 1204(c) of the Financial Institutions Reform, Recovery, and Enforcement Act of 1989 (<external-xref legal-doc="usc" parsable-cite="usc/12/1811">12 U.S.C. 1811</external-xref> note).</text></paragraph><paragraph id="H85FF3A443C4848A3BD0AA0606E27AD60" commented="no"><enum>(7)</enum><header>Participating individual</header><text>The term <term>participating individual</term> means an eligible individual that has received cash payments under a qualifying pilot program funded through a grant from the Program.</text></paragraph><paragraph id="HE909FAB8CB6E486E87E3D690C52FBDF8"><enum>(8)</enum><header>Persistent poverty county</header><text>The term <term>persistent poverty county</term> means any county that has had 20 percent or more of its population living in poverty over the past 30 years, as measured by the most recent decennial census and the most recent Small Area Income and Poverty Estimates of the Bureau of the Census, as of the date of the enactment of this Act.</text></paragraph></subsection><subsection id="H6573846691954EDDB123575DB529E0B0" commented="no"><enum>(k)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this section $500,000,000 for each of the fiscal years 2023 through 2027.</text></subsection></section></title><title id="HC998B78CC0C24E87BD9AAD35A98AB1A6"><enum>II</enum><header>Guaranteed Income Tax Credit</header><section id="H162820745F394F7096DD3471442234CF"><enum>201.</enum><header>Establishment of the guaranteed income tax credit</header><subsection id="H45F8AD394CF44359ABC3E5D884C495B4"><enum>(a)</enum><header>In general</header><text>Subpart C of part IV of subchapter A of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986 is amended by inserting after section 37 the following new section:</text><quoted-block id="HA0C0C2724E094CF4BC06B573A00B0364" style="OLC"><section id="H0A363BB62CC64ADBBB4425F265426C29"><enum>37A.</enum><header>Guaranteed income tax credit</header><subsection id="H1C7AFB8AF51940CCB2D623B525299112"><enum>(a)</enum><header>Allowance of credit</header><text>In the case of an eligible individual, there shall be allowed as a credit against the tax imposed by this subtitle for the taxable year an amount equal to—</text><paragraph id="HEF99B9BAFE6B490A88A57B5FFF51C510"><enum>(1)</enum><text>$14,400, plus</text></paragraph><paragraph id="H602ACC8C10A344D1AE29AEF1315D97C2"><enum>(2)</enum><text>$600 multiplied by the number of dependents (as defined in section 152) under the age of 18 of the taxpayer.</text></paragraph></subsection><subsection id="HC25F1C278BF04145ABDAFD4D95420DC2"><enum>(b)</enum><header>Limitation based on adjusted gross income</header><text display-inline="yes-display-inline">The amount of the credit allowable under subsection (a) shall be reduced (but not below zero) by five percent of so much of the taxpayer's adjusted gross income as exceeds—</text><paragraph id="HBAE57F4E7C744365BBF6B8956786CF79"><enum>(1)</enum><text> $150,000 in the case of a joint return or a surviving spouse (as defined in section 2(a)),</text></paragraph><paragraph id="H59E4570AB650430EA079B20C0DC0D1B6"><enum>(2)</enum><text>$112,500 in the case of a head of household, and</text></paragraph><paragraph id="H212AD25F8195426D8F9790C3371F63BA"><enum>(3)</enum><text>$75,000 in the case of a taxpayer not described in paragraph (1) or (2).</text></paragraph></subsection><subsection id="HA416F7E43B444E70B96B8B7EE4461160"><enum>(c)</enum><header>Inflation adjustments</header><paragraph id="HA52CC453E27642BDB422FD6CB8DFB589"><enum>(1)</enum><header>In general</header><text>In the case of any taxable year beginning after 2028, each of the dollar amounts under subsections (a) and (b) shall be increased by an amount equal to—</text><subparagraph id="H1090B9CDC3B2402FBCE11B3885367D11"><enum>(A)</enum><text>such dollar amount, multiplied by</text></subparagraph><subparagraph id="HAC501BCB221B4B0A867C9DF3AB90BACC"><enum>(B)</enum><text>the cost-of-living adjustment determined under section 1(f)(3) for the calendar year in which the taxable year begins, determined by substituting <quote>calendar year 2027</quote> for <quote>calendar year 2016</quote> in subparagraph (A)(ii) thereof.</text></subparagraph></paragraph><paragraph id="HD802C231A6E54C90B1CF9620C6EDC689"><enum>(2)</enum><header>Rounding</header><text>If any increase determined under paragraph (1) is not a multiple of $50, such increase shall be rounded to the nearest multiple of $50.</text></paragraph></subsection><subsection id="H2BE172B5CE2B435B94A2F1BE47DBC49A"><enum>(d)</enum><header>Eligible individual</header><text>For purposes of this section—</text><paragraph id="HC24FD95AE658493296FF6AEE759A27D2"><enum>(1)</enum><header>In general</header><text>The term <term>eligible individual</term> means an individual—</text><subparagraph id="HD18D06BA70684CEEA6CA740FB6DA4766" commented="no"><enum>(A)</enum><text>who attained 18 years of age before the close of the taxable year,</text></subparagraph><subparagraph id="H01BAABF74A724474A09B89EDD4E90297"><enum>(B)</enum><text>whose principal place of abode was in the United States for more than one-half of the taxable year,</text></subparagraph><subparagraph id="HEC9F4126E7F54A2ABD31CD997305C4E6"><enum>(C)</enum><text>who is not a dependent for whom a deduction is allowable under section 151 to another taxpayer for any taxable year beginning in the same calendar year as such taxable year, and</text></subparagraph><subparagraph id="HBEB77E16F4EF4845ABF50DAD2225D446"><enum>(D)</enum><text>who did not claim the benefits of section 911 for the preceding taxable year.</text></subparagraph></paragraph><paragraph id="H58E915F5953A42EB9AF889278DC345B3"><enum>(2)</enum><header>Limitation on eligibility of nonresident aliens</header><text>The term <term>eligible individual</term> shall not include any individual who is a nonresident alien individual for any portion of the preceding taxable year, unless such individual is treated for such taxable year as a resident of the United States for purposes of this chapter by reason of an election under subsection (g) or (h) of section 6013.</text></paragraph><paragraph id="HA432EB545FFB4373A64F2D74B20ABCE5"><enum>(3)</enum><header>Identification number requirement</header><text>No credit shall be allowed under this section to an eligible individual who does not include on the return of tax for the taxable year—</text><subparagraph id="HA772E44F57A7479BB46A42F01A0D275B"><enum>(A)</enum><text>such individual’s taxpayer identification number, </text></subparagraph><subparagraph id="H26A35C2E21F246D78CB8F097AA102C7F"><enum>(B)</enum><text>if the individual was married during the preceding taxable year (within the meaning of section 7703), the taxpayer identification number of such individual’s spouse, and</text></subparagraph><subparagraph id="H301F22FDF9764AE9BBB5BF58394700A7" commented="no"><enum>(C)</enum><text>taxpayer identification number of such individual’s dependents.</text></subparagraph></paragraph><paragraph id="HA677442B34B94B5DBCB8D8276CBC4764"><enum>(4)</enum><header>Treatment of military personnel stationed outside of the United States</header><text>For purposes of paragraph (1)(B), the principal place of abode of a member of the Armed Forces of the United States shall be treated as in the United States during any period during which such member is stationed outside the United States while serving on extended active duty with the Armed Forces of the United States. For purposes of the preceding sentence, the term <term>extended active duty</term> means any period of active duty pursuant to a call or order to such duty for a period in excess of 90 days or for an indefinite period.</text></paragraph></subsection><subsection id="H17173E211BC74F8495D9482FC394E1F3"><enum>(e)</enum><header>Taxable year must be full taxable year</header><text>Except in the case of a taxable year closed by reason of the death of the taxpayer, no credit shall be allowable under this section in the case of a taxable year covering a period of less than 12 months.</text></subsection><subsection id="H127921BD8C3247328CCF1B098E49F7C0"><enum>(f)</enum><header>Restrictions on taxpayer who improperly claimed credit in prior year</header><text>Rules similar to subsection (k) of section 32 shall apply for purposes of this section.</text></subsection><subsection id="HEB5D99EDC9F0458784F1316B7367E585"><enum>(g)</enum><header>Reconciliation of credit and advance payments</header><text>The amount of the credit allowed under this section for any taxable year shall be reduced (but not below zero) by the aggregate amount of any advance payments of such credit under section 7527B for such taxable year.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H0D790DD1C3DF446889D236AC2F0D827C"><enum>(b)</enum><header>Advance payment of guaranteed income tax credit</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/77">Chapter 77</external-xref> of the Internal Revenue Code of 1986 is amended by inserting after section 7527A the following new section:</text><quoted-block id="H4D8E3217B70C40A381D4098CE5DCB05F" style="OLC"><section id="HFE17DA2E93394E20A024ECA5D2019E83"><enum>7527B.</enum><header>Advance payment of guaranteed income tax credit</header><subsection id="HE86D49A303EC40FC9653FCD997734D69"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall establish a program for making advance payments to eligible taxpayers which equal, in the aggregate during any calendar year, the annual advance amount determined with respect to such taxpayer for such calendar year. The advance payments made to such taxpayer for any calendar year shall be in equal amounts.</text></subsection><subsection id="H735390164F2A4DB789D0843AF1510440"><enum>(b)</enum><header>Eligible taxpayer</header><text>The term <term>eligible taxpayer</term> has the meaning given <quote>eligible individual</quote> in section 37A and such taxpayer has made an election under subsection (d).</text></subsection><subsection id="H760255C9E8A94FEDA5E526FDB3AB41AB" commented="no"><enum>(c)</enum><header>Annual advance amount</header><text>For the purposes of this section, the term <term>annual advance amount</term> means, with respect to an eligible taxpayer for any calendar year, an amount equal to the amount of credit which the Secretary has determined will be allowed to such taxpayer under section 37A for the taxpayer's taxable year beginning in such calendar year.</text></subsection><subsection id="HE8AFC820BEC04549A006644C847A7D16" commented="no"><enum>(d)</enum><header>Election of advance payment</header><paragraph id="HBB589B1EAF4A4F80A6F79149785FFBF5" commented="no"><enum>(1)</enum><header>In general</header><text>A taxpayer may elect to receive an advance payment of the credit allowed under section 37A for any taxable year—</text><subparagraph id="HF380DDB4E6C5439B8B40B778558993C2" commented="no"><enum>(A)</enum><text>by including such election on a timely filed return for the preceding taxable year, or</text></subparagraph><subparagraph id="H36301B2BC83141F19A76BC5267FE1F30" commented="no"><enum>(B)</enum><text>through the online portal established in paragraph (2).</text></subparagraph></paragraph><paragraph id="H6D22641F3E544835B203A3D848C73F29" commented="no"><enum>(2)</enum><header>Online portal</header><text>The Secretary shall establish an online portal which allows non-filing taxpayers to—</text><subparagraph id="H5C217E1ABC4648E18F428F39C797DB00" commented="no"><enum>(A)</enum><text>elect to receive payments under this section, and</text></subparagraph><subparagraph id="HAFF107F08E014FD598278A1F08F8EC77" commented="no"><enum>(B)</enum><text>provide any information the Secretary determines necessary.</text></subparagraph></paragraph></subsection><subsection id="H797C57B8CBAF4A4A860F0F4B4F42C4C9"><enum>(e)</enum><header>Internal revenue service notification</header><text>The Internal Revenue Service shall take such steps as may be appropriate to ensure that taxpayers who are eligible to receive the credit under section 37A are aware of the availability of the advance payment of such credit under this section.</text></subsection><subsection id="HFA526E8D42744EBF9AB3651AFDF6F6B1"><enum>(f)</enum><header>Authority</header><text>The Secretary may prescribe such regulations or other guidance as may be appropriate or necessary for the purposes of carrying out this section.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HC176E436E3604C94B3A7662527DF909E"><enum>(c)</enum><header>Other rules</header><paragraph id="H189BFDD3530F405C9E2226D788EBE82B"><enum>(1)</enum><header>Timing and manner of payments</header><subparagraph id="H3DB0B01E4A8E430D88ED806B4642FF7A"><enum>(A)</enum><header>Timing</header><text>The Secretary shall, subject to the provisions of this title, refund or credit any overpayment attributable to this section as rapidly as possible.</text></subparagraph><subparagraph id="H7D9B597355BE40CB9C01EE4AD75CE7B2"><enum>(B)</enum><header>Alternate information</header><text display-inline="yes-display-inline">For purposes of disbursing refunds payable under this section, if an individual eligible to receive a credit under section 37A (as added by subsection (a)) has not, as of any applicable date, filed a tax return for the applicable taxable year, the Secretary shall—</text><clause id="H4F16AE2C268F441D9B063F17BBBC4CBF"><enum>(i)</enum><text>use return information with respect to such individual for the taxable year preceding such applicable taxable year; or</text></clause><clause id="HC550770E2AAA418FADF809CE25BCC49B"><enum>(ii)</enum><text>in the case of an individual who has not filed a tax return for the applicable year or the taxable year described in clause (i), use any applicable information provided by relevant agencies. </text></clause></subparagraph><subparagraph id="HC59EA006D6AF4744A5B652B2E51A0A63" commented="no"><enum>(C)</enum><header>Coordination and notification</header><text display-inline="yes-display-inline">For purposes of subparagraph (B)(i), the Secretary shall—</text><clause id="H54856C9BD620421B86861E0D0AE85921" commented="no"><enum>(i)</enum><text>coordinate with the heads of relevant Federal agencies to receive applicable information with respect to any individuals who may be eligible to receive a refund payment pursuant to this section; and</text></clause><clause id="H5051D41E44304DAFA6922798A03A1F13" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">establish an online portal that individuals described in paragraph (B) may use to report any information required, as determined by the Secretary, to determine the amount of any refund payments for which such individuals may be eligible, including methods specifically designed to identify and account for foster youth and individuals experiencing homelessness or housing insecurity.</text></clause></subparagraph><subparagraph id="H95181981D84143C9B3E2A8ED394F25F0"><enum>(D)</enum><header>Delivery of payments</header><text>Notwithstanding any other provision of law, the Secretary may certify and disburse refunds immediately payable under this subsection—</text><clause id="H7926441E91FB4B1F811F97869317D390"><enum>(i)</enum><text>electronically to any account to which the payee authorized the delivery of a refund of taxes under this title or of a Federal payment (as defined in section 3332 of title 31, United States Code); or</text></clause><clause id="H33CB257B95A841DF8C2BC161D7DB17FB"><enum>(ii)</enum><text>through such other means as are determined appropriate by the Secretary including through the use of mailed paper checks, stored value cards, and online payment systems including FedAccounts as established under section 301.</text></clause></subparagraph><subparagraph id="HC7AE34EF0EEF4C20BC384E09034DA399"><enum>(E)</enum><header>Waiver of certain rules</header><text>Notwithstanding section 3325 of title 31, United States Code, or any other provision of law, with respect to any payment of a refund under this subsection, a disbursing official in the executive branch of the United States Government may modify payment information received from an officer or employee described in section 3325(a)(1)(B) of such title for the purpose of facilitating the accurate and efficient delivery of such payment. Except in cases of fraud or reckless neglect, no liability under sections 3325, 3527, 3528, or 2529 of title 31, United States Code, shall be imposed with respect to payments made under this subparagraph.</text></subparagraph></paragraph><paragraph id="H2210DDCFB4494789A7D69C3FDFECFAA0"><enum>(2)</enum><header>No interest</header><text>No interest shall be allowed on any overpayment attributable to a payment deemed made under this section.</text></paragraph><paragraph id="H3B07910576B34319AA37ED33D011829F"><enum>(3)</enum><header>Notice to taxpayer</header><text>Not later than 15 days after the date on which the Secretary distributed any payment to a taxpayer pursuant to this section, notice shall be sent by mail to such taxpayer’s last known address. Such notice shall indicate the method by which such payment was made, the amount of such payment, and a phone number or website portal for the appropriate contact at the Internal Revenue Service to report any failure to receive such payment.</text></paragraph><paragraph id="HBA4658B40BD647A1859FBAE03EFA45C8" commented="no"><enum>(4)</enum><header>Treatment of possessions</header><text>Rules similar to the rules of subsection (c) of section 2201 of the CARES Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/136">Public Law 116–136</external-xref>) shall apply for the purposes of section 37A of such Code (as added by subsection (a)).</text></paragraph><paragraph id="H7C8474DC9397445F918C34F96DCB8F6D"><enum>(5)</enum><header>Exception from reduction or offset</header><text>Any credit or refund allowed or made to any individual by reason of <external-xref legal-doc="usc" parsable-cite="usc/26/37A">section 37A</external-xref> of the Internal Revenue Code of 1986 (as added by subsection (a)) or by reason of paragraph (1) of this subsection shall not be—</text><subparagraph id="HAA8B103AF1BA4E178CB83103095DD405"><enum>(A)</enum><text>subject to reduction or offset pursuant to section 3716 or 3720A of title 31, United States Code;</text></subparagraph><subparagraph id="HC3698333A5BE4B08B6984EA32C6496F3"><enum>(B)</enum><text>subject to reduction or offset pursuant to subsection (c), (d), (e), or (f) of <external-xref legal-doc="usc" parsable-cite="usc/26/6402">section 6402</external-xref> of the Internal Revenue Code of 1986; or</text></subparagraph><subparagraph id="H74C6EBFE9AA449168177E56456154B56"><enum>(C)</enum><text>reduced or offset by other assessed Federal taxes that would otherwise be subject to levy or collection.</text></subparagraph></paragraph><paragraph id="H67E2E69A1B2248F986DA576B4F659A98" commented="no"><enum>(6)</enum><header>Prohibition on garnishment</header><subparagraph id="HA168DF4FE1F9407CB70DA62461E86B08" commented="no"><enum>(A)</enum><header>Definitions</header><text>In this paragraph, the terms <term>financial institution</term>, <term>freeze</term>, <term>garnish</term>, and <term>garnishment order</term> have the meanings given the terms in section 212.3 of title 31, Code of Federal Regulations, as in effect on the date of enactment of this Act.</text></subparagraph><subparagraph id="H4E667DC1721B431A88BD9E33E40196F5" commented="no"><enum>(B)</enum><header>Prohibition</header><text>No financial institution may garnish or freeze any portion of a refund made by any debtor by reason of <external-xref legal-doc="usc" parsable-cite="usc/26/37A">section 37A</external-xref> of the Internal Revenue Code of 1986 (as added by subsection (a)) or by reason of paragraph (1) pursuant to a garnishment order.</text></subparagraph></paragraph><paragraph id="H1072D1A4EACD49D7A34391914288A786"><enum>(7)</enum><header>Waiver of fees by insured depository institutions</header><text>No insured depository institution, as defined in section 3 of the Federal Deposit Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1813">12 U.S.C. 1813</external-xref>), may impose a fee on a person for cashing any check for a refund payable under <external-xref legal-doc="usc" parsable-cite="usc/26/37A">section 37A</external-xref> of the Internal Revenue Code of 1986 (as added by subsection (a)).</text></paragraph><paragraph id="HA9AB3D160362462E8B2196A5DD914446" commented="no"><enum>(8)</enum><header>Public awareness campaign</header><text>Rules similar to the rules of subsection (e) of section 2201 of the CARES Act shall apply for the purposes of section 37A of such Code (as added by subsection (a)).</text></paragraph><paragraph id="HE988644D741A4B2DA4C211DE0C075FAF"><enum>(9)</enum><header>Regulations</header><text>The Secretary shall prescribe such regulations or other guidance as may be necessary to carry out the purposes of this section, including any such measures are deemed appropriate to avoid allowing duplicative payments to a taxpayer.</text></paragraph></subsection><subsection id="H85606F12F5D34CC99355376052DC1FE8"><enum>(d)</enum><header>Conforming amendments</header><paragraph id="H05BB687C4FA34AD2BF6FDE20FA813BC7"><enum>(1)</enum><text><external-xref legal-doc="usc" parsable-cite="usc/26/6211">Section 6211(b)(4)(A)</external-xref> of the Internal Revenue Code of 1986 is amended by inserting <quote>37A,</quote> after <quote>36B,</quote>.</text></paragraph><paragraph id="H4E163CB1A0A143A1B8909B5E48E2F349"><enum>(2)</enum><text>Section 6213(g)(2) of such Code is amended—</text><subparagraph id="H1DC8058CDB39454A95ED625C4AE33B7E"><enum>(A)</enum><text>in subparagraph (F), by inserting <quote>or section 37A</quote> after <quote>credit)</quote>;</text></subparagraph><subparagraph id="H6C064E776F844DE48B7D7D5D023956DA"><enum>(B)</enum><text>in subparagraph (G), by inserting <quote>or 37A</quote> after <quote>section 32</quote>;</text></subparagraph><subparagraph id="H1E5624BEFE604738B7A7686E388A264D"><enum>(C)</enum><text>by amending subparagraph (K) to read as follows:</text><quoted-block id="H74EE2933075A436D8ABF8B21433BA233" style="OLC"><subparagraph id="H6E933BC46CD7426C8A2A59E951574726" commented="no"><enum>(K)</enum><text>an omission of information required by section 32(k)(2) or 36(e) or an entry on the return claiming—</text><clause id="H7AC9E8073AF642349DA1A0A922147E60" commented="no"><enum>(i)</enum><text>the credit under section 32 for a taxable year for which the credit is disallowed under subsection (k)(1) thereof, or</text></clause><clause id="H2F3DC6913C6E425B86B23C459DE3E273" commented="no"><enum>(ii)</enum><text>the credit under section 37A for a taxable year for which the credit is disallowed under subsection (d) thereof,</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="H9514D1963B734141B3F10BF272B5C99A"><enum>(D)</enum><text>in subparagraph (L), by <quote>37A,</quote> after <quote>32,</quote>.</text></subparagraph></paragraph><paragraph id="HD831649F3CDC4C6499D9C396D8974E73"><enum>(3)</enum><text>The table of sections for subpart C of part IV of subchapter A of chapter 1 of such Code is amended by inserting after the item relating to section 37 the following:</text><quoted-block id="H5EACB0DD12A64837A8E92BBF2D44FC5D" style="OLC"><toc regeneration="no-regeneration"><toc-entry level="section">Sec. 37A. 2027.</text></subsection></section></title><title id="H7140A4E2329949459335ECB20B985EB9"><enum>III</enum><header>FedAccounts</header><section id="H71C643BB39FC435D9A63B5A70B0CFEF3"><enum>301.</enum><header>Creation and integration of FedAccounts</header><subsection id="HA96D46FF1EC945DABBF9BF7C0D1ABAA7"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H46C19D1E8D0940629D9889915C9DD51B"><enum>(1)</enum><header>Digital dollars</header><text>The term <term>digital dollars</term> means dollar balances consisting of digital ledger entries recorded as liabilities in the accounts of any Federal Reserve bank.</text></paragraph><paragraph id="H181D490CABC244DCB4D71A51FBD6E10B"><enum>(2)</enum><header>FedAccount</header><text>The term <term>FedAccount</term> means a personal, no-fee central bank account supported by a Federal Reserve bank for any eligible individuals or on behalf of any person for the purpose of holding digital dollar balances.</text></paragraph><paragraph id="H9DF3BCF573494AA3AF61ED72E51DFD9C"><enum>(3)</enum><header>Member bank</header><text>The term <term>member bank</term> means any national bank, State bank, or bank or trust company that is a member of a Federal Reserve bank.</text></paragraph><paragraph id="H9F54C6BC9493473E8D5FA9A8EDA1114F"><enum>(4)</enum><header>Pass-through FedAccount</header><text>The term <term>pass-through FedAccount</term> means a FedAccount maintained by a member bank on behalf of any person, entitling that person to a pro rata share of a pooled reserve balance that the member bank maintains at any Federal Reserve bank. </text></paragraph><paragraph id="H502549D9F7404DA1901C77E63A5B46B2"><enum>(5)</enum><header>Postal retail facility</header><text>The term <term>postal retail facility</term>—</text><subparagraph id="HC85D8587D8C54E3782FB86FEFA6E5884"><enum>(A)</enum><text>means a post office, post office branch, post office classified station, or other facility that is operated by the Postal Service, the primary function of which is to provide retail postal services; and</text></subparagraph><subparagraph id="H6FA51048AD06453C9000ACCA47723627"><enum>(B)</enum><text>does not include a contractor-operated facility offering postal services.</text></subparagraph></paragraph><paragraph id="H9A0842B2230D4044926787B9109B8C2B"><enum>(6)</enum><header>Postal service</header><text>The term <term>Postal Service</term> means the United States Postal Service.</text></paragraph></subsection><subsection id="HE5E719EBE2684279A3FB92C9D80BDC20"><enum>(b)</enum><header>Authority and Mandate for Federal Reserve Banks To Establish and Maintain Fed­Accounts for the General Public</header><paragraph id="HF4F1751C747C46B887CC4B781CE722D0"><enum>(1)</enum><header>Authorization</header><text>Subject to restrictions, limitations, and regulations that may be imposed by the Board of Governors of the Federal Reserve System, a Federal Reserve bank shall maintain Fed­Accounts.</text></paragraph><paragraph id="HA4E700CF5AA6479A8714A3CB25B7DBF7"><enum>(2)</enum><header>Mandate</header><text display-inline="yes-display-inline">Not later than January 1, 2027, a Federal Reserve bank shall make available FedAccounts to—</text><subparagraph id="H63CED4EA712946009CC7E9A51DD7FA0F"><enum>(A)</enum><text>residents of the United States; and</text></subparagraph><subparagraph id="HB1C41633F21D4883BA18C14D3357104B"><enum>(B)</enum><text>businesses domiciled in the United States.</text></subparagraph></paragraph><paragraph id="H7ABB1743F599482AA42323F7A5E083DC"><enum>(3)</enum><header>Terms of FedAccounts</header><text>FedAccounts—</text><subparagraph id="H7C778724AC064EDA8C34DEF9E6661118"><enum>(A)</enum><text>shall not be subject to any account fees, minimum balances, or maximum balances, and shall pay interest at a rate not below the greater of the rate of interest on required reserves and the rate of interest on excess reserves;</text></subparagraph><subparagraph id="H80D21186AD3C4D5E9B1C7DF53902D295"><enum>(B)</enum><text>shall provide debit cards, online account access, automatic bill-pay, mobile banking, customer service and other such services as the Board of Governors of the Federal Reserve System determines appropriate in the public interest, provided that FedAccounts shall not include overdraft coverage;</text></subparagraph><subparagraph id="HD1EED01E4F4349619698C4B8DE443187"><enum>(C)</enum><text>shall provide access to automatic teller machines to be maintained on behalf of the Board of Governors of the Postal Service at postal retail facilities;</text></subparagraph><subparagraph id="H84FF58BDBB504227A59E7C8F6073B9C6"><enum>(D)</enum><text>shall be branded in all account statements, marketing materials, and other communications as <quote>FedAccounts</quote> maintained by the Federal Reserve bank on behalf of the United States of America;</text></subparagraph><subparagraph id="H5BB494C63D2F47C889CC88805924FE23"><enum>(E)</enum><text>may not be closed or restricted on the basis of profitability considerations; and</text></subparagraph><subparagraph id="H9181E11A2F0E4584934562854160B019"><enum>(F)</enum><text>shall provide account holders with reasonable protections against losses caused by fraud or security breaches.</text></subparagraph></paragraph><paragraph id="H6270F87E42D94DC1950BCD86680E8D79" commented="no"><enum>(4)</enum><header>Bank Secrecy Act</header><text>In establishing and maintaining FedAccounts, each Federal Reserve shall comply with—</text><subparagraph id="HF0AC651FEA9A4DAF941F5A10C095A608" commented="no"><enum>(A)</enum><text>section 21 of the Federal Deposit Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1829b">12 U.S.C. 1829b</external-xref>);</text></subparagraph><subparagraph id="H98935D272CA44D968DF64B2DC6FC3007" commented="no"><enum>(B)</enum><text>chapter 2 of title I of <external-xref legal-doc="public-law" parsable-cite="pl/91/508">Public Law 91–508</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/12/1951">12 U.S.C. 1951 et seq.</external-xref>); and</text></subparagraph><subparagraph id="H86F99FD9EEF84666AE1582515A54F2B1" commented="no"><enum>(C)</enum><text>subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/31/53">chapter 53</external-xref> of title 31, United States Code.</text></subparagraph></paragraph><paragraph id="HAEB190524648440C813679F64502B81B"><enum>(5)</enum><header>Privacy</header><subparagraph id="H6F18578CE55F40DC8505CF8AE94C6FE8"><enum>(A)</enum><header>FedAccounts</header><text>Section 552a of title 5, United States Code (commonly known as the Privacy Act of 1974), shall apply to Fed­Accounts.</text></subparagraph><subparagraph id="HBD9BBC19BB4A47E1825BBF977ABDDD2E"><enum>(B)</enum><header>Federal Reserve banks</header><text>The privacy obligations applicable to each Federal Reserve bank and its employees, including with respect to criminal and civil penalties, shall mirror those applicable to Federal tax returns under sections 6103, 7213(a)(1), 7213A, and 7431 of the Internal Revenue Code of 1986.</text></subparagraph></paragraph><paragraph id="H692ECED65B004FD6B2EC99B48468FF29" commented="no"><enum>(6)</enum><header>Regulations</header><text>The Board of Governors of the Federal Reserve, in consultation with the Secretary, shall promulgate regulations in order to carry out this subsection. </text></paragraph></subsection><subsection id="HA00559823AC0436F8786EA40BC2B7F7E"><enum>(c)</enum><header>Authority and Mandate for Member Banks, State Nonmember Banks and Credit Unions To Offer and Maintain Pass-Through FedAccounts</header><paragraph id="H008B26BDD801482B89AB621F24C44ADB"><enum>(1)</enum><header>Obligations of member banks</header><subparagraph id="H86A4B95CD53048F5B4625AB1B6085E42"><enum>(A)</enum><header>In general</header><text>Member banks shall open and maintain pass-through FedAccounts for all interested persons who elect to deposit funds into pass-through FedAccounts, including persons eligible to receive guaranteed income tax credit payments from the United States pursuant to section 301 of this Act.</text></subparagraph><subparagraph id="HD9FB2886A53D4B51AE7C4E9C791E6D91"><enum>(B)</enum><header>Maintenance of assets</header><clause id="HDD23E66D53224DAAA983BF58C8C49DB2"><enum>(i)</enum><header>In general</header><text>Each member bank shall establish and maintain a separate legal entity for the exclusive purpose of holding all assets and maintaining all liabilities associated with pass-through Fed­Accounts.</text></clause><clause id="HFEF9B4EC4AA942F09DC9C29188ED3C4E"><enum>(ii)</enum><header>Contents</header><text>The assets of any entity described in clause (i) shall consist exclusively of a balance maintained in a master account at a Federal Reserve bank, and the liabilities or obligations of the entity shall consist exclusively of an equal quantity of balances maintained by holders of pass-through FedAccounts.</text></clause><clause id="HFEB2DD712A8A4A27A450DAA35F44541E"><enum>(iii)</enum><header>Capital or liquidity regulation</header><text>The assets and liabilities of any legal entity described in clause (i) shall not be deemed assets or liabilities of the member bank or its affiliates for the purposes of any capital or liquidity regulation promulgated by Federal or State banking authorities.</text></clause><clause id="HF7BDC5FEDE344BC68ED6AFD9EA8FDDA5" commented="no"><enum>(iv)</enum><header>Online application requirement for large banks</header><text>Member banks with total consolidated assets greater than $10,000,000,000 shall promptly offer application, through online or telephonic means, for pass-through FedAccounts.</text></clause></subparagraph></paragraph><paragraph id="H52B8C7750F324E25A3C880BB64D84505" commented="no"><enum>(2)</enum><header>Terms of pass-through FedAccounts</header><text>Pass-through FedAccounts offered by member banks—</text><subparagraph id="HFC5E564E947845DF902984F21DC83283" commented="no"><enum>(A)</enum><text>shall not be subject to any account fees, minimum balances, or maximum balances, and shall pay interest at a rate not below the greater of the rate of interest on required reserves and the rate of interest on excess reserves;</text></subparagraph><subparagraph id="H09CE90FD26D1463B8C3EB67271D97E3E" commented="no"><enum>(B)</enum><text>shall provide functionality and service levels no less favorable than those that the member bank offers for its existing transaction accounts, including with respect to debit cards, automated teller machines, online account access, automatic bill pay, mobile banking, customer service and such other services as the Board of Governors of the Federal Reserve System determines appropriate in the public interest, provided that FedAccounts shall not include overdraft coverage;</text></subparagraph><subparagraph id="H2F0EE374D34D4C3094B12269E5BE1242" commented="no"><enum>(C)</enum><text>shall be prominently branded in all account statements, marketing materials, and other communications as <quote>pass-through Fed­Accounts</quote> maintained by the member bank on behalf of the Federal Reserve;</text></subparagraph><subparagraph id="H58667CD6A30C4F2A86B0F506448CEA6A" commented="no"><enum>(D)</enum><text>may not be closed or restricted by the bank on the basis of profitability considerations; and</text></subparagraph><subparagraph id="H5AB7EFB8C4794FECBA3239D43749C935" commented="no"><enum>(E)</enum><text>shall provide account holders with reasonable protection against losses caused by fraud or security breaches.</text></subparagraph></paragraph><paragraph id="HF8846F5FBCCF4CA7B8963F1DAB4E0D2F"><enum>(3)</enum><header>Reimbursement for costs at member banks</header><subparagraph id="HB2A078933B384FFFBD3CABAC4EFCC929"><enum>(A)</enum><header>In general</header><text>Each member bank with total consolidated assets of not greater than $10,000,000,000 shall be reimbursed each calendar quarter by the relevant Federal Reserve bank for the operational costs incurred by the member bank in offering pass-through FedAccounts.</text></subparagraph><subparagraph id="H801E57EA00BE4DE8B594A17E75368D6B"><enum>(B)</enum><header>Regulations</header><text>The Board of Governors of the Federal Reserve System shall promulgate such regulations as necessary to carry out this subsection.</text></subparagraph></paragraph><paragraph id="H97A0F90B33B948F5B31CFA767636B2AB"><enum>(4)</enum><header>Obligations of State nonmember banks and credit unions</header><subparagraph id="HC9A7FE268BD7413C8F8F1125E57DD457"><enum>(A)</enum><header>In general</header><text>The Federal Reserve banks shall permit State nonmember banks and credit unions to open master accounts for the exclusive purpose of offering pass-through FedAccounts with the separate entity structure described in paragraph (1), if the pass-through FedAccount complies with the terms set forth in paragraph (2).</text></subparagraph><subparagraph id="HE002FD85F1AA4FC4B5D8B69A54BC2523"><enum>(B)</enum><header>Reimbursement</header><text>Each State nonmember bank or credit union electing to offer pass-through FedAccounts shall be entitled to cost reimbursement in accordance with paragraph (3).</text></subparagraph></paragraph><paragraph id="H6289552B22BD492EA1625C961A8EC4CB" commented="no"><enum>(5)</enum><header>Authority of the board</header><text>Member banks shall be subject to such regulations and obligations as may be imposed by the Board of Governors of the Federal Reserve System in connection with maintaining pass-through FedAccounts.</text></paragraph></subsection><subsection id="H2E191E88B9C2432285BB60D7B225C5DA"><enum>(d)</enum><header>Limited branches</header><text display-inline="yes-display-inline">In areas where access to physical member bank branches is limited, including in low- or moderate-income geographies, designated disaster areas, distressed or underserved non-metropolitan middle-income geographies, as designated by the Federal Financial Institutions Examination Council, Federal Reserve banks may partner with postal retail facilities to ensure access and availability to application and account services for all residents and citizens of the United States and to businesses domiciled in the United States.</text></subsection><subsection id="H9D5A34A6C9D845FBA2FCFF771D332D39"><enum>(e)</enum><header>Coordination of FedAccounts and postal banking</header><text display-inline="yes-display-inline">The Board of Governors of the Federal Reserve System, after consultation with the Postermaster General, shall work to improve public banking options to all individuals, and specifically making sure that payments from the guaranteed income tax credit are able to reach the most people in a timely manner by expanding such financial services to the unbanked and underbanked.</text></subsection><subsection id="H1F90758E889B490399374B1FB880E852"><enum>(f)</enum><header>Annual reporting</header><text>The Comptroller General of the United States, in consultation with the Secretary, shall submit to Congress an annual report that includes the demographics, number of participants, and average balances and uses for all the new products and services established under this section.</text></subsection></section></title></legis-body></bill>
