which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To prohibit a State or local government from using highway safety program funds for traffic control or traffic enforcement if such State or local government defunds the police, and for other purposes.</official-title></form><legis-body id="HBE6C58D7D6EC4F8EBC5058DA566A5500" style="OLC"><section id="H057EB229D73B4C87AB10F5F35CE0088A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Blocking Lawlessness from Undermining Enforcement Act</short-title></quote> or the <quote><short-title>BLUE Act</short-title></quote>.</text></section><section id="H41796D2421E94BA391F4BAF7EC2D65DE" section-type="subsequent-section"><enum>2.</enum><header>Prohibition on use of funds</header><subsection id="H74ABA38C436D449186A494FB94B0D79E"><enum>(a)</enum><header>Highway safety programs</header><text display-inline="yes-display-inline">Section 402(c) of title 23, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" id="HD965FE8221B04581ABD2B47EF6C4FDF2" display-inline="no-display-inline"><paragraph id="HD5CDBCAFDDC1474D9F6FAE3C332EFAA7"><enum>(5)</enum><header>Traffic control or traffic enforcement</header><subparagraph id="H1577A8FA1B0A4D079AF5E2B380BC0148"><enum>(A)</enum><header>Prohibition</header><text display-inline="yes-display-inline">A State, local government, or political subdivision of a State, may not expend funds apportioned to such State under this section, including funds transferred pursuant to section 405(a)(8), for traffic control or traffic enforcement if such State, local government, or political subdivision defunds the police.</text></subparagraph><subparagraph id="H71C5A70730D64D3288347BD1CC9F6B98"><enum>(B)</enum><header>Exemption</header><clause id="H8090236D0C1B4450AE7609E365B94787"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary may grant an exemption from the requirements under subparagraph (A) if the State, local government, or political subdivision that defunds the police submits a written request to the Secretary and the Secretary approves such request.</text></clause><clause id="H743360DEC56340A28AEAE18756BDC3B0"><enum>(ii)</enum><header>Contents</header><text>A request submitted under clause (i) shall include—</text><subclause id="HCCD1ACADE31E4C6E8437274D851162B5"><enum>(I)</enum><text>the justification for the requested exemption from the requirements of subparagraph (A); and</text></subclause><subclause id="H916B99256F984D92905CE9E72084F851"><enum>(II)</enum><text>a description of amount of funds a State, local government, or political subdivision intends to use for traffic control or traffic enforcement.</text></subclause></clause></subparagraph><subparagraph id="HE6EC4A9AA0D64C60AA791C24DBE816F4"><enum>(C)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing in this paragraph may be construed to result in a reduction in the amount of funding a State may receive under this section.</text></subparagraph><subparagraph id="H5E92C4D33CCA4D7BB0F8B862D873326B"><enum>(D)</enum><header>Definitions</header><text>In this paragraph:</text><clause id="HADDB4668E8C6484FBF8689FB53C6A0A1"><enum>(i)</enum><header>Defund the police</header><subclause id="HF978455A96D54211B6A16CFDE2279D45"><enum>(I)</enum><header>In general</header><text display-inline="yes-display-inline">The term <quote>defund the police</quote> means a situation in which—</text><item id="H48F1BD98C56D483FB7E270113D09EAA0"><enum>(aa)</enum><text display-inline="yes-display-inline">a State, local government, or political subdivision of a State has a police budget for—</text><subitem id="H85DEDDD12DB94B54BA6B2FD13F50FBF4"><enum>(AA)</enum><text display-inline="yes-display-inline">the fiscal year during which this paragraph is enacted that is lower in amount than such police budget for the fiscal year that includes January 1, 2000; or</text></subitem><subitem id="H95DE5A9B569F4754864C7276D6FE4E59"><enum>(BB)</enum><text display-inline="yes-display-inline">any fiscal year following the fiscal year during which this paragraph is enacted that is lower in amount than such police budget for the previous fiscal year; and</text></subitem></item><item id="HE74A78AB7739400CA3352D6FD359BB09"><enum>(bb)</enum><text display-inline="yes-display-inline">such State, local government, or political subdivision has reallocated such police budget funds to other government agencies, evidenced by public statements, press releases, budget justifications, budget documentation, or any other materials. </text></item></subclause><subclause id="H19E785305F484CBEAFCD8880852C8C7C"><enum>(II)</enum><header>Exclusions</header><text>The term <quote>defund the police</quote> does not include a situation in which—</text><item id="H14AFC0736DA34156BBCADB40B0F9AE55"><enum>(aa)</enum><text>a State, local government, or political subdivision of a State reduces funding for a police department if the reduction of such funding is part of an overall budget reduction; or</text></item><item id="H89724543C981412EB32F4F2BAC088417"><enum>(bb)</enum><text display-inline="yes-display-inline">a police chief of a police department has decided to reallocate funds made available to such police department to psychological and mental health programs.</text></item></subclause></clause><clause id="H0F0CA5181AAF4795BAFDFE8CD11927E0"><enum>(ii)</enum><header>Traffic control or traffic enforcement</header><text>The term <quote>traffic control or traffic enforcement</quote> means a service provided by law enforcement officers in a State, local government, or political subdivision of a State that includes directing traffic, addressing traffic infractions on roadways, or serving in a traffic or roads policing unit enforcing rules of the road.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HD894DC6535C04E3F9024EBB55A35B029"><enum>(b)</enum><header>National priority safety programs</header><text>Section 405(a) of title 23, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" id="HB43EC918BE284B268C1B9DBAFDE06214" display-inline="no-display-inline"><paragraph id="HD6EDA63BF29947EDAE3400EEAAFE8D84"><enum>(11)</enum><header>Use of funds</header><subparagraph id="HE0FE96952A0844599E7623F368E1C601"><enum>(A)</enum><header>In general</header><text>Notwithstanding any other provision of law, a State, local government, or political subdivision of a State receiving a grant under this section may not use such grant for traffic control or traffic enforcement (as such term is defined in section 402(c)(5)(D)) if such State, local government, or political subdivision defunds the police (as such term is defined in section 402(c)(5)(D)).</text></subparagraph><subparagraph id="H366B76BCD76B459FA868BBE062B2F571"><enum>(B)</enum><header>Exemption</header><clause id="HDAD311EC870547D88FDE0554C730FB7C"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary may grant an exemption from the requirements under subparagraph (A) if the State, local government, or political subdivision that defunds the police submits a written request to the Secretary and the Secretary approves such request.</text></clause><clause id="HFF92E4DD32A44318A3C1B0085605EEDD"><enum>(ii)</enum><header>Contents</header><text>A request submitted under clause (i) shall include—</text><subclause id="H5F5F1CBF08744EA1A7B9E8600E82C003"><enum>(I)</enum><text>the justification for the requested exemption from the requirements of subparagraph (A); and</text></subclause><subclause id="HC7189356829E44B0A954DF6DD0CAAEB1"><enum>(II)</enum><text>a description of amount of funds a State, local government, or political subdivision intends to use for traffic control or traffic enforcement.</text></subclause></clause></subparagraph><subparagraph id="H75BA8ABC9EDF4BB19C086617C0FC9C3F"><enum>(C)</enum><header>Rule of construction</header><text>Nothing in this paragraph may be construed to result in a reduction in the amount of funding a State may receive under this section.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H830C5858625A442C96C5A97A1899430B"><enum>(c)</enum><header>Report</header><text>Not later than 18 months after the date of enactment of this Act, the Comptroller General of the United States shall submit to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a report describing the implementation of, and compliance with, the amendments made by this Act. </text></subsection></section></legis-body></bill>
