R. 4884</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210730">July 30, 2021</action-date><action-desc><sponsor name-id="H001077">Mr. Higgins of Louisiana</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HED00">Committee on Education and Labor</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To restrict employers from requiring an employee or an applicant for employment with such employer to undertake a medical procedure, including a vaccine, and for other purposes.</official-title></form><legis-body id="H8B4475AB926248408B0011049DBAADA6" style="OLC"><section id="HCDD4D4C308A840C382A6218F42D21B16" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Employee Rights and Freedoms Act</short-title></quote>.</text></section><section id="H695186A6D88E44428B4CE866E66132BB"><enum>2.</enum><header>Restriction on mandatory medical procedures</header><subsection id="H75930A9DAB9D49E3AD8C8F438656B099" commented="no"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">It shall be an unlawful employment practice for an employer to require an employee, or an applicant for employment with such employer, to undertake a medical procedure, including a vaccine.</text></subsection><subsection id="H5E32E6996376422EA39F6D6D48C7F4CB" commented="no"><enum>(b)</enum><header>Exemption</header><text display-inline="yes-display-inline">An employee, or an applicant for employment, required to undertake a medical procedure, including a vaccine, shall be exempted from such procedure because of such employee’s firmly held belief.</text></subsection><subsection id="HA8DF21374291405F9B54C1CB78F1DF56"><enum>(c)</enum><header>Accommodations</header><text display-inline="yes-display-inline">An employer with an employee, or an applicant for employment, exempted under subsection (b) shall provide such employee or applicant with reasonable accommodations to enable such employee or applicant to continue to perform the essential functions of the employment position that such employee or applicant holds or desires.</text></subsection><subsection id="HF0BAA7CAED3F40CFB5464EF6D452E77E"><enum>(d)</enum><header>Private right of action</header><text>An individual who is aggrieved by a violation of this section may bring a civil action in an appropriate Federal district court of competent jurisdiction.</text></subsection></section></legis-body></bill>
