R. 4867</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210730">July 30, 2021</action-date><action-desc><sponsor name-id="C001118">Mr. Cline</sponsor> (for himself and <cosponsor name-id="P000616">Mr. Phillips</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HGO00">Committee on Oversight and Reform</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the chief information officer of each agency to increase efforts to manage data centers, and for other purposes.</official-title></form><legis-body id="HF1D95A62668246E1A1BCC802F4D08BEC" style="OLC"><section id="H68C19CB446ED46DFBB73D3006230F013" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Data Centers and Government Records Oversight Act</short-title></quote>. </text></section><section id="H00F670B1BED0445B807EB107F22A8DDB"><enum>2.</enum><header>Increased management of data centers</header><subsection id="H39F9E089DB684CD7BFD0BB2B04D60B9E" display-inline="no-display-inline"><enum>(a)</enum><header>Data center consolidation and optimization</header><paragraph id="H4AA4E77D39D445A487E5C27735B35992"><enum>(1)</enum><header>Strategic plan</header><text display-inline="yes-display-inline">Not later than 6 months after the date of the enactment of this Act, the chief information officer of each agency shall develop and publish a strategic plan to consolidate and optimize data centers at the agency. The strategic plan shall include the following:</text><subparagraph id="HD72B1E7A46714915BD6B6FF81D5C2511"><enum>(A)</enum><text display-inline="yes-display-inline">Metrics to consolidate and optimize data center locations or transition to the cloud.</text></subparagraph><subparagraph id="H2486DA470A7D43A7B7FD209ED606D873"><enum>(B)</enum><text>An estimation of the annual costs related to the development and operation of data centers at the agency.</text></subparagraph><subparagraph id="H32A41753BF7C495B8F0A9DD28D1EC8E0"><enum>(C)</enum><text>An estimation of the annual savings related to implementing the strategic plan.</text></subparagraph></paragraph><paragraph id="HAE093C73063344579E1DD45903595C37" commented="no"><enum>(2)</enum><header>Two year update</header><text display-inline="yes-display-inline">Not later than 2 years after the date on which the plan is published pursuant to paragraph (1), the chief information officer of each agency shall update such plan. </text></paragraph><paragraph id="HB6A1FE12CC15491D8191886B4813912D"><enum>(3)</enum><header>Certification</header><text display-inline="yes-display-inline">Not later than 9 months after the date of the enactment of this Act, and 2 years thereafter, the inspector general of each agency shall submit to Congress a certification that describes whether the agency has taken action to achieve the annual metrics described in paragraph (1)(A).</text></paragraph><paragraph id="H84C4756EB7C34119B99B77F5DCE12FA4"><enum>(4)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 2 years after the date of the enactment of this Act, and 2 years thereafter, the head of each agency shall submit to Congress and the Director of the Office of Management and Budget a report that includes—</text><subparagraph id="HF669D3DC0EF945CFA9199AB7B4339E2E"><enum>(A)</enum><text>the certification described in paragraph (3);</text></subparagraph><subparagraph id="H0656BBA47BAE4419AEDAD6AE718AF732"><enum>(B)</enum><text>if applicable, the reason that an annual metric under paragraph (1)(A) was not previously met;</text></subparagraph><subparagraph id="H7DA642B24EF3447E871CD55948100307"><enum>(C)</enum><text display-inline="yes-display-inline">the costs related to the development and operation of data centers at each agency, including any cost related to implementing the strategic plan described in paragraph (1); and</text></subparagraph><subparagraph id="H0986D43B52DF4FA29B3AA76F8D72AFC6"><enum>(D)</enum><text>the savings related to implementing the strategic plan.</text></subparagraph></paragraph></subsection><subsection id="HF7A272435A724AFAB1351039F9FE040E" display-inline="no-display-inline" commented="no"><enum>(b)</enum><header>Compliance</header><paragraph id="H0D5D4232E7934E76B2C1D1F8221CA3C9" commented="no"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, including section 5318 of title 5, United States Code, any chief information officer of an agency that does not meet the requirements under paragraph (1) or (2) of subsection (a) may not receive any increase in the rate of pay until such requirements are met.</text></paragraph><paragraph id="H5C7F5BE5371C4F04A72B141F35C032AC" commented="no"><enum>(2)</enum><header>Enforcement</header><text>The head of the applicable agency shall ensure that the chief information officer described in paragraph (1) meets the provisions under this subsection.</text></paragraph></subsection><subsection id="H0781B52BCBB24F009890A984DE06217E"><enum>(c)</enum><header>Agency defined</header><text>In this section, the term <term>agency</term> has the meaning given to that term under section 3502 of title 44, United States Code.</text></subsection></section><section id="HBE38AE37E950470F97EE91339A7E0973"><enum>3.</enum><header>Records management by Federal agencies</header><subsection id="H2D576FFAC60A431AAE2C16B700EA295D"><enum>(a)</enum><header>Transfer of records</header><text display-inline="yes-display-inline">Section 3103 of title 44, United States Code, is amended—</text><paragraph id="H20162662862A449B8DB3BEE1354FDF40"><enum>(1)</enum><text>by striking <quote>When</quote> and inserting <quote><header-in-text level="subsection" style="USC">(a) In general.</header-in-text> When</quote>; and</text></paragraph><paragraph id="H028FFAAE25134087ABF2853FD4E50D84"><enum>(2)</enum><text>by adding at the end the following new subsections:</text><quoted-block style="USC" id="H563F668A49874051955C19406627FB96" display-inline="no-display-inline"><subsection id="HF3807BC998574656B809BCED6A5B701A" commented="no"><enum>(b)</enum><header>Transfer</header><paragraph id="H76C3D023C9F34394BBFBDB2F0DC47C95" commented="no"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The head of each Federal agency, in coordination with the Archivist of the United States, shall, to the extent practicable and in accordance with this section—</text><subparagraph id="H93D972C202374D829FB35D4C7D0F2A9B" commented="no"><enum>(A)</enum><text>create copies of all records controlled by the Federal agency; and</text></subparagraph><subparagraph id="H8A34206555B241D0B944D43A76E28528" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">transfer such copies to a records center maintained and operated by the Archivist.</text></subparagraph></paragraph><paragraph id="HBF7648C198F449588ACB74FA8B8BD37C" commented="no"><enum>(2)</enum><header>Standards and guidelines</header><text>Not later than 3 months after the date of the enactment of this subsection, the Archivist shall—</text><subparagraph id="H0A3EC48D43654336B845FBA7D3E31774" commented="no"><enum>(A)</enum><text>develop standards for the heads of each Federal agency to create copies of records under paragraph (1)(A), including standards with respect to determining whether the record from which the copy was created is inactive, temporary, or permanent;</text></subparagraph><subparagraph id="H2EC23E7F1C9E45D1973114123D9F67D5" commented="no"><enum>(B)</enum><text>develop guidelines for the heads of each Federal agency to—</text><clause id="HB342F3012A82470083B55A461E24887A" commented="no"><enum>(i)</enum><text display-inline="yes-display-inline">store metadata with respect to copies of records under paragraph (1)(A); and</text></clause><clause id="H103CAF6000E14AECABF4CE999416B8D5" commented="no"><enum>(ii)</enum><text>transfer such copies pursuant to paragraph (1)(B); and</text></clause></subparagraph><subparagraph id="HBD535263A531480A814012FF0562CEA0" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">make exemptions to the standards developed pursuant to subparagraph (A), taking into consideration—</text><clause id="HA8A22F882EBA45E485865EDBD5E5FDC1" commented="no"><enum>(i)</enum><text>any burden to the public;</text></clause><clause id="HE50ECDA32A0C4752B0894B416E74649E" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">costs; and</text></clause><clause id="H29ABE94EEADA4EEBB2772FED94A57E7A" commented="no"><enum>(iii)</enum><text>statutory, regulatory, and policy barriers.</text></clause></subparagraph></paragraph><paragraph id="H0EFEA6FC1EC544B89A79F4AD6E44B258" commented="no"><enum>(3)</enum><header>Initial phase</header><subparagraph id="H37A111F0CCD24A059C8C7638C99944CE" commented="no"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 6 months after the date of the enactment of this Act, the head of each Federal agency shall begin to transfer electronic copies of records, including any metadata related to a record, pursuant to paragraph (1)(B).</text></subparagraph><subparagraph id="H560B7529368B4B95B2165DCC9F236218" commented="no"><enum>(B)</enum><header>Analog format deadline</header><text display-inline="yes-display-inline">After the date on which the records have begun to be transferred pursuant to subparagraph (A) the head of each Federal agency may not transfer a copy of a record that is in an analog format to a records center maintained and operated by the Archivist.</text></subparagraph></paragraph><paragraph id="H45BA3678FFB04F64867593E0E90E7AB2" commented="no"><enum>(4)</enum><header>Second phase</header><text display-inline="yes-display-inline">Not later than 2 years after the date on which the records have begun to be transferred pursuant to subparagraph (A), the head of each Federal agency shall transfer—</text><subparagraph id="HB955EDE4AFBA412A90B057DB9B9351E5" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">all copies of records to a records center maintained and operated by the Archivist; and</text></subparagraph><subparagraph id="HA1FF604BE9B8443C8E73855DAE4FBACE" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">all copies of inactive and temporary records exempt under paragraph (2)(C) to a Federal records center or a commercial record storage facility.</text></subparagraph></paragraph></subsection><subsection id="H37DC5517559847A881E8C6EF180320BF" commented="no"><enum>(c)</enum><header>Penalty to Federal agencies</header><text display-inline="yes-display-inline">If, during any fiscal year, a Federal agency is not in compliance with the requirements of this section, during the corresponding period in the following fiscal year, the Federal agency may not obligate discretionary appropriations at a rate higher than the rate of obligation for the applicable appropriations accounts during the period of noncompliance in the previous fiscal year.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HAF75FA506E814599933117DE0DD344D2"><enum>(b)</enum><header>Designation of record management official</header><paragraph id="HFFD54F1BF6F447CA8818994C25C5A978"><enum>(1)</enum><header>Amendments</header><text display-inline="yes-display-inline">Section 3101 of title 44, United States Code, is amended—</text><subparagraph id="H73C6ACED49D04F04A6993F4913B798EC"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>The head</quote> and inserting <quote><header-in-text level="subsection" style="USC">(a) In general.</header-in-text> The head</quote>; and</text></subparagraph><subparagraph id="H461886ED82FB41159C08BEE10A0A1BD4"><enum>(B)</enum><text>by adding at the end the following new subsections:</text><quoted-block style="USC" id="HC1BF8BEB5CCD441EADC247189C70C53A" display-inline="no-display-inline"><subsection id="HD2B3176E102846AFB1C74BA3608D07EC"><enum>(b)</enum><header>Designation of record management official</header><text display-inline="yes-display-inline">To carry out subsection (a), the head of each Federal agency shall designate a senior official—</text><paragraph id="H471CCC0F21494F0384E0B40D47E664EF"><enum>(1)</enum><text>whose position is at the Assistant Secretary-level or equivalent;</text></paragraph><paragraph id="HBBBA6AE5E4F940688AE463B0DCB4CADD"><enum>(2)</enum><text>who shall carry out the duties under subsection (c); and</text></paragraph><paragraph id="HF07A600F62A442F1AC17D4FD31DDF4C6"><enum>(3)</enum><text>who has training in records management certified by the Archivist to assist the official in carrying out the duties under this subsection.</text></paragraph></subsection><subsection id="H51FA3255CF8D499EA2CB2809B1E481C5"><enum>(c)</enum><header>Duties of record management official</header><text>The duties of the senior official under subsection (b) shall include the following:</text><paragraph id="HE2E4F46AAD8546DC952821FFC94FF741"><enum>(1)</enum><text>Train employees of the Federal agency on an annual basis on—</text><subparagraph id="H31AA385A8F3A4416ACC4808ED29D99F1"><enum>(A)</enum><text>the responsibilities of each such employee with respect to the management of a record; and</text></subparagraph><subparagraph id="HB1B801AB33394A878F54CE9FE60E1162"><enum>(B)</enum><text>the laws, regulations, and policies of the agency with respect to the management of a record.</text></subparagraph></paragraph><paragraph id="H816CC9B9DD574217B8246AF2D5B00060"><enum>(2)</enum><text display-inline="yes-display-inline">Ensure records under the control of such agency are covered by a general records schedule that is approved by the Archivist.</text></paragraph><paragraph id="H2464C0E68F884AC3B437FA6EC773A388"><enum>(3)</enum><text display-inline="yes-display-inline">Ensure that each copy of a record transferred to a records center maintained and operated by the Archivist is transferred in accordance with any standard developed by the Archivist.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H2A09A5DAEE8E4951B123AB2AC96EDD09" commented="no"><enum>(2)</enum><header>Applicability</header><text>The amendments made by this subsection shall take effect 6 months after the date of the enactment of this Act. </text></paragraph></subsection></section></legis-body></bill>
