which was referred to the <committee-name committee-id="HSY00">Committee on Science, Space, and Technology</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To establish the Foundation for Energy Security and Innovation, and for other purposes.</official-title></form><legis-body id="H89C473C13AA6460391B8723A1DCEB567" style="OLC"><section id="HE97FC540FA404B2B8176C603D8ECDC52" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Partnerships for Energy Security and Innovation Act</short-title></quote>.</text></section><section id="H055B5143882D48E592AEF0B6C6D18C8B"><enum>2.</enum><header>Foundation for Energy Security and Innovation</header><subsection id="H7927B792C52D41B189A2EAB1F3240753"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H0E9ADBED74BA4A789E3C09038BB00BC4"><enum>(1)</enum><header>Board</header><text>The term <quote>Board</quote> means the Board of Directors described in subsection (b)(2)(A).</text></paragraph><paragraph id="H5ACDFD6A5FD64D668891D11BAE3EEE80"><enum>(2)</enum><header>Department</header><text>The term <quote>Department</quote> means the Department of Energy.</text></paragraph><paragraph id="HAE24D903A78F46ED883C0E4F710F370A"><enum>(3)</enum><header>Executive director</header><text>The term <quote>Executive Director</quote> means the Executive Director described in subsection (b)(5)(A).</text></paragraph><paragraph id="H2212D0A254EF46DF81761A1646BA6D69"><enum>(4)</enum><header>Foundation</header><text>The term <quote>Foundation</quote> means the Foundation for Energy Security and Innovation established under subsection (b)(1).</text></paragraph><paragraph id="H9D8F66D0CF1440ACB7D5CD9B509E2967"><enum>(5)</enum><header>Historically black college and university</header><text>The term <quote>historically Black college and university</quote> has the meaning given the term <quote>part B institution</quote> in section 322 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1061">20 U.S.C. 1061</external-xref>).</text></paragraph><paragraph id="H09109918D0C64749880F1E9DB14EF281"><enum>(6)</enum><header>Individual laboratory-associated foundation</header><text>The term <quote>Individual Laboratory-Associated Foundation</quote> means a Laboratory Foundation established by an operating contractor of a National Laboratory.</text></paragraph><paragraph id="H77DD32F6A23340098DA0B761AAF6AB81"><enum>(7)</enum><header>Minority serving institution</header><text>The term <quote>minority serving institution</quote> includes the entities described in any of the paragraphs (1) through (7) of section 371(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1067q">20 U.S.C. 1067q(a)</external-xref>).</text></paragraph><paragraph id="H2A042C3AB0F140AFB24BCD809FA08062"><enum>(8)</enum><header>National laboratory</header><text>The term <quote>National Laboratory</quote> has the meaning given the term in section 2 of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/15801">42 U.S.C. 15801</external-xref>).</text></paragraph><paragraph id="HF70FB0663A6B417BB9ED49D9B45A21E5"><enum>(9)</enum><header>Secretary</header><text>The term <quote>Secretary</quote> means the Secretary of Energy.</text></paragraph><paragraph id="H98DBFF5875B34F9BA2B106513A1F6F2E"><enum>(10)</enum><header>Tribal college and university</header><text>The term <quote>Tribal College and University</quote> has the meaning given in section 316 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1059c">20 U.S.C. 1059c</external-xref>).</text></paragraph></subsection><subsection id="HCB9471B2BFD94E5C9156A9BFB07B7494"><enum>(b)</enum><header>Foundation for energy security and innovation</header><paragraph id="HA76CC62CB03543F8996685CCF96B8FFD"><enum>(1)</enum><header>Establishment</header><subparagraph id="HFBC63C9A4F0B46979211A1CF9D2DC849"><enum>(A)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary shall establish a nonprofit corporation to be known as the <quote>Foundation for Energy Security and Innovation</quote>.</text></subparagraph><subparagraph id="H7B5BE21D60884AADA0F8F9687A709618"><enum>(B)</enum><header>Mission</header><text>The mission of the Foundation shall be—</text><clause id="H89F9905543D54B52B709ADC88177ED15"><enum>(i)</enum><text>to support the mission of the Department; and</text></clause><clause id="HABDDC21C95C74EB7ACCD7B3D0625D01B"><enum>(ii)</enum><text>to advance collaboration with energy researchers, institutions of higher education, industry, and nonprofit and philanthropic organizations to enable the commercialization of energy technologies.</text></clause></subparagraph><subparagraph id="H31A518FF4D5F43BEBB30D8FF98E93AC3"><enum>(C)</enum><header>Limitation</header><text>The Foundation shall not be an agency or instrumentality of the Federal Government.</text></subparagraph><subparagraph id="HC75738CE4570425F80E7242C37333F0A"><enum>(D)</enum><header>Tax-exempt status</header><text>The Board shall take all necessary and appropriate steps to ensure that the Foundation is an organization that is described in <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)</external-xref> of the Internal Revenue Code of 1986 and exempt from taxation under section 501(a) of that Code.</text></subparagraph><subparagraph id="H62BEB28A0B6C4F099C4F2BB93A52C32D"><enum>(E)</enum><header>Collaboration with existing organizations</header><text>The Secretary may collaborate with 1 or more organizations to establish the Foundation and carry out the activities of the Foundation.</text></subparagraph></paragraph><paragraph id="HB4188B5713B44FD98927546A7A7B7995"><enum>(2)</enum><header>Board of directors</header><subparagraph id="HB7A20442920C4E19892EEAD500A45D9C"><enum>(A)</enum><header>Establishment</header><text>The Foundation shall be governed by a Board of Directors.</text></subparagraph><subparagraph id="H4EB29A91DD564911B4E03E7FB14E94EB"><enum>(B)</enum><header>Composition</header><clause id="H290A28DE1BCD465F9619DA07642B8DD1"><enum>(i)</enum><header>In general</header><text>The Board shall be composed of the ex officio nonvoting members described in clause (ii) and the appointed voting members described in clause (iii).</text></clause><clause id="H2DF446B7E4ED47FF90E9BEFFC2CE8CC7"><enum>(ii)</enum><header>Ex officio members</header><text>The ex officio members of the Board shall be the following individuals or designees of those individuals:</text><subclause id="HB023A602D787471E8E71E929D6010288"><enum>(I)</enum><text>The Secretary.</text></subclause><subclause id="HE330AC99875A4609A393B9EE6265D77D"><enum>(II)</enum><text>The Under Secretary for Science and Energy.</text></subclause><subclause id="H4C7D5A30DA6641B7B2D680672089249A"><enum>(III)</enum><text>The Under Secretary for Nuclear Security.</text></subclause><subclause id="HD1BE29CEE7E443CF878435C9AC21CC79"><enum>(IV)</enum><text>The Chief Commercialization Officer.</text></subclause></clause><clause id="H62AE477FC197450BB0E8519791EF1D90"><enum>(iii)</enum><header>Appointed members</header><subclause id="HF6F24E2D983549C4943BF943C51070D4"><enum>(I)</enum><header>Initial members</header><text>The Secretary and the other ex officio members of the Board shall—</text><item id="H88EB10325BAD4D81816A24FBB4E40436"><enum>(aa)</enum><text>seek to enter into an agreement with the National Academies of Sciences, Engineering, and Medicine to develop a list of individuals to serve as members of the Board who are well-qualified and will meet the requirements of subclauses (II) and (III); and</text></item><item id="HF7D81CD745D947D993CFE5EDBB0164B2"><enum>(bb)</enum><text>appoint the initial members of the Board from that list, if applicable, in consultation with the National Academies of Sciences, Engineering, and Medicine.</text></item></subclause><subclause id="H9A300389C2894647BC496908B0A6B342"><enum>(II)</enum><header>Representation</header><text>The appointed members of the Board shall reflect a broad cross-section of stakeholders from academia, National Laboratories, industry, nonprofit organizations, State or local governments, the investment community, and the philanthropic community.</text></subclause><subclause id="HF90C2C2B4F4B47A692DD7913487CEA5A"><enum>(III)</enum><header>Experience</header><text>The Secretary shall ensure that a majority of the appointed members of the Board—</text><item id="HB13513CAA67A4A1095BFE00692CBC497"><enum>(aa)</enum><subitem commented="no" display-inline="yes-display-inline" id="H0AE072272EEF4CFEA20CC1853C28F425"><enum>(AA)</enum><text>has experience in the energy sector;</text></subitem><subitem id="H6EEEFEE6D1BC4E80A67D559DB194B31B" indent="up1"><enum>(BB)</enum><text>has research experience in the energy field; or</text></subitem><subitem id="HD224A8092A4A413EADB4670A702C65DB" indent="up1"><enum>(CC)</enum><text>has experience in technology commercialization or foundation operations; and</text></subitem></item><item id="H88D6FFF0405C4202819F8F4A36FB353D"><enum>(bb)</enum><text>to the extent practicable, represents diverse regions, sectors, and communities.</text></item></subclause></clause></subparagraph><subparagraph id="H51A67C59141348019951603DE6F3C895"><enum>(C)</enum><header>Chair and vice chair</header><clause id="H68471F48A84D47E582B60D29CD700F24"><enum>(i)</enum><header>In general</header><text>The Board shall designate from among the members of the Board—</text><subclause id="H1A618E580E174F0083C8B4536F53502F"><enum>(I)</enum><text>an individual to serve as Chair of the Board; and</text></subclause><subclause id="HAEA1C1B301AF44CCBBEB1100538889DB"><enum>(II)</enum><text>an individual to serve as Vice Chair of the Board.</text></subclause></clause><clause id="H3D98BAE8B56643F2A89D26DD8C80DA79"><enum>(ii)</enum><header>Terms</header><text>The term of service of the Chair and Vice Chair of the Board shall end on the earlier of—</text><subclause id="HBD147F371E184F1DBDD5673F3E582C2F"><enum>(I)</enum><text>the date that is 3 years after the date on which the Chair or Vice Chair of the Board, as applicable, is designated for the position; and</text></subclause><subclause id="H531F32817CE14AB5BEFEC6B5AC5E9C73"><enum>(II)</enum><text>the last day of the term of service of the member, as determined under subparagraph (D)(i), who is designated to be Chair or Vice Chair of the Board, as applicable.</text></subclause></clause><clause id="HE79CB82AE39A4D28A4D268464A8828FE"><enum>(iii)</enum><header>Representation</header><text>The Chair and Vice Chair of the Board—</text><subclause id="H76DB623C485148BD8E892F5C73FDED8C"><enum>(I)</enum><text>shall not be representatives of the same area of subject matter expertise, or entity, as applicable, under subparagraph (B)(iii)(II); and</text></subclause><subclause id="H95316BD2835044FE82BF19AC9E80DD4F"><enum>(II)</enum><text>shall not be representatives of any area of subject matter expertise, or entity, as applicable, represented by the immediately preceding Chair and Vice Chair of the Board.</text></subclause></clause></subparagraph><subparagraph id="H83E49CF1E220408A98B2D979973136DB"><enum>(D)</enum><header>Terms and vacancies</header><clause id="HBE61220486374217A01EBFEA206E21E6"><enum>(i)</enum><header>Terms</header><subclause id="H76C9482D8A164B9E8308FAD6E07CBFBA"><enum>(I)</enum><header>In general</header><text>The term of service of each appointed member of the Board shall be not more than 5 years.</text></subclause><subclause id="H45E2006625524A63BB5386BF9CA0D2CD"><enum>(II)</enum><header>Initial appointed members</header><text>Of the initial members of the Board appointed under subparagraph (B)(iii)(I), half of the members shall serve for 4 years and half of the members shall serve for 5 years, as determined by the Chair of the Board.</text></subclause></clause><clause id="H3E3DBAC4DE94416A825752BB804DF2BB"><enum>(ii)</enum><header>Vacancies</header><text>Any vacancy in the membership of the appointed members of the Board—</text><subclause id="H92531508D8E0480C903F6CAC3E809EA9"><enum>(I)</enum><text>shall be filled in accordance with the bylaws of the Foundation by an individual capable of representing the same area or entity, as applicable, as represented by the vacating board member under subparagraph (B)(iii)(II);</text></subclause><subclause id="HDD410BDF7CEC40AF8FC4A04F566B0E04"><enum>(II)</enum><text>shall not affect the power of the remaining appointed members to execute the duties of the Board; and</text></subclause><subclause id="H81FB4941F413413984A12D9ED8E4A9E2"><enum>(III)</enum><text>shall be filled by an individual selected by the Board.</text></subclause></clause></subparagraph><subparagraph id="HF79E99C5559142A88C7CBF5766F4B532"><enum>(E)</enum><header>Meetings; quorum</header><clause id="HBAFE17D22E8142769EDA1BD32024B3D8"><enum>(i)</enum><header>Initial meeting</header><text>Not later than 60 days after the Board is established, the Secretary shall convene a meeting of the ex officio and appointed members of the Board to incorporate the Foundation.</text></clause><clause id="HA8514FA6698B40F3932ADDBD5A1B3AAD"><enum>(ii)</enum><header>Quorum</header><text>A majority of the appointed members of the Board shall constitute a quorum for purposes of conducting the business of the Board.</text></clause></subparagraph><subparagraph id="H780150AFF4CD4B4796A3B2B7D750C9EE"><enum>(F)</enum><header>Duties</header><text>The Board shall—</text><clause id="HC654D4F9DFF8442B8133183310C1E4D1"><enum>(i)</enum><text>establish bylaws for the Foundation in accordance with subparagraph (G);</text></clause><clause id="H2AA96CC940AC411C80DE069F21E52052"><enum>(ii)</enum><text>provide overall direction for the activities of the Foundation and establish priority activities;</text></clause><clause id="HF955EFD710AD4EE6BDBC93CEA7852E2B"><enum>(iii)</enum><text>carry out any other necessary activities of the Foundation;</text></clause><clause id="H5DAF4B1D15D846E1A63306186776B44C"><enum>(iv)</enum><text>evaluate the performance of the Executive Director; and</text></clause><clause id="H49827C991E6348C2911F1A30277F48EB"><enum>(v)</enum><text>actively solicit and accept funds, gifts, grants, devises, or bequests of real or personal property to the Foundation, including from private entities.</text></clause></subparagraph><subparagraph id="HDB8A1EBD460F4BBD98C9E795702A4C7B"><enum>(G)</enum><header>Bylaws</header><clause id="H51FE50028E4449B48529C08431876E13"><enum>(i)</enum><header>In general</header><text>The bylaws established under subparagraph (F)(i) may include—</text><subclause id="HF3A3770AC87744F393EC74D9BEC2A6AD"><enum>(I)</enum><text>policies for the selection of Board members, officers, employees, agents, and contractors of the Foundation;</text></subclause><subclause id="H6792A07C267547DA88DB4EC2C4C4E748"><enum>(II)</enum><text>policies, including ethical standards, for—</text><item id="H96ECFAEBCC504D50B954C0411DEB4CF6"><enum>(aa)</enum><text>the acceptance, solicitation, and disposition of donations and grants to the Foundation, including appropriate limits on the ability of donors to designate, by stipulation or restriction, the use or recipient of donated funds; and</text></item><item id="H3346DE25211143AFB973D7543716B5B4"><enum>(bb)</enum><text>the disposition of assets of the Foundation;</text></item></subclause><subclause id="H93EC66A812A543C9B9ABBF2DC9556C45"><enum>(III)</enum><text>policies that subject all employees, fellows, trainees, and other agents of the Foundation (including ex officio and appointed members of the Board) to conflict of interest standards; and</text></subclause><subclause id="H7A59BE3FAFBB4553BEDCC9764BDE81A8"><enum>(IV)</enum><text>the specific duties of the Executive Director.</text></subclause></clause><clause id="H77A00601929240859F762A1232E4BC4B"><enum>(ii)</enum><header>Requirements</header><text>The Board shall ensure that the bylaws of the Foundation and the activities carried out under those bylaws shall not—</text><subclause id="HF3F6C2E8A13044A8A8B30B2CF18DD31A"><enum>(I)</enum><text>reflect unfavorably on the ability of the Foundation to carry out activities in a fair and objective manner; or</text></subclause><subclause id="HB2E4329F036F4F90A2D7DD9D78704A2A"><enum>(II)</enum><text>compromise, or appear to compromise, the integrity of any governmental agency or program, or any officer or employee employed by, or involved in, a governmental agency or program.</text></subclause></clause></subparagraph><subparagraph id="HB19816C7F04F488C8B15D2511782A672"><enum>(H)</enum><header>Compensation</header><clause id="H4B2E23B3BEAC41179DCB2BA3E4B8CA8B"><enum>(i)</enum><header>In general</header><text>No member of the Board shall receive compensation for serving on the Board.</text></clause><clause id="H501F212949604DE5B994E74186E38771"><enum>(ii)</enum><header>Certain expenses</header><text>In accordance with the bylaws of the Foundation, members of the Board may be reimbursed for travel expenses, including per diem in lieu of subsistence, and other necessary expenses incurred in carrying out the duties of the Board.</text></clause></subparagraph><subparagraph id="H97122E6433714DBBA6036D18FBFDD0A7"><enum>(I)</enum><header>Restriction on membership</header><text>No employee of the Department shall be appointed as a member of the Board of Directors.</text></subparagraph></paragraph><paragraph id="H9DB4B1B28F3D4D96A09BC6D734B1A6AC"><enum>(3)</enum><header>Purposes</header><text>The purposes of the Foundation are—</text><subparagraph id="H7708AE6A562B4B03B6754FB86116EC6A"><enum>(A)</enum><text>to support the Department in carrying out the mission of the Department to ensure the security and prosperity of the United States by addressing civilian energy and environmental challenges through transformative science and technology solutions; and</text></subparagraph><subparagraph id="H2B20F20D183D4804B3760B843C48F0CC"><enum>(B)</enum><text>to increase private and philanthropic sector investments that support efforts to create, characterize, develop, test, validate, and commercialize innovative technologies that address crosscutting national energy challenges, including those affecting minority, rural, and other underserved communities, by methods that include—</text><clause id="H4CC6BBB01F4043B4AA5FA9E8155B916B"><enum>(i)</enum><text>fostering collaboration and partnerships with researchers from the Federal Government, State governments, institutions of higher education, including historically Black colleges and universities, Tribal Colleges or Universities, and minority-serving institutions, federally funded research and development centers, industry, and nonprofit organizations for the research, development, or commercialization of transformative energy and associated technologies;</text></clause><clause id="H624C7487EE8841B39C72F4DEFAE932C7"><enum>(ii)</enum><text>strengthening and sharing best practices relating to regional economic development through scientific and energy innovation, including in partnership with an Individual Laboratory-Associated Foundation;</text></clause><clause id="H6E5B7EBF63EB45B48D0517F6EA8798B8"><enum>(iii)</enum><text>promoting new product development that supports job creation;</text></clause><clause id="H841A22A02715418F9DFEC5D7B04A42E4"><enum>(iv)</enum><text>administering prize competitions—</text><subclause id="HCA229444BEBA4DBA99DA2FF534C8EFDE"><enum>(I)</enum><text>to accelerate private sector competition and investment; and</text></subclause><subclause id="H3AFD162D1C894BABBCF36A002B07113D"><enum>(II)</enum><text>that complement the use of prize authority by the Department;</text></subclause></clause><clause id="H4689E75F109045E89250255A772D4A62"><enum>(v)</enum><text>supporting programs that advance technology maturation, especially where there may be gaps in Federal or private funding in the commercialization of a prototype technology;</text></clause><clause id="H64218F9E7E434FA9B26570BD0D746BDA"><enum>(vi)</enum><text>supporting efforts to broaden participation in energy technology development among individuals from historically underrepresented groups or regions; and</text></clause><clause id="HEBA188875E624C5E907ABF555751BE24"><enum>(vii)</enum><text>facilitating access to Department facilities, equipment, and expertise to assist in tackling national challenges.</text></clause></subparagraph></paragraph><paragraph id="HA66B525B387C4FC59901A174C2E23C2B"><enum>(4)</enum><header>Activities</header><subparagraph id="HFC12D799A3B546E39DD7A28AA9ED27BE"><enum>(A)</enum><header>Studies, competitions, and projects</header><text>The Foundation may conduct and support studies, competitions, projects, and other activities that further the purposes of the Foundation described in paragraph (3).</text></subparagraph><subparagraph id="HCC54DC9290FE47129CA11A8C982D7F62"><enum>(B)</enum><header>Fellowships and grants</header><clause id="H6A9E778121AD45A4B80D7C675F0DF4B8"><enum>(i)</enum><header>In general</header><text>The Foundation may award fellowships and grants for activities relating to research, development, demonstration, or commercialization of energy and other Department-supported technologies.</text></clause><clause id="H6C1A0283CAC14F4CBF186AB621988D0C"><enum>(ii)</enum><header>Form of award</header><text>A fellowship or grant under clause (i) may consist of a stipend, health insurance benefits, funds for travel, and funds for other appropriate expenses.</text></clause><clause id="H2C28AB5B2658488AB2C4904DB8028E9B"><enum>(iii)</enum><header>Selection</header><text>In selecting a recipient for a fellowship or grant under clause (i), the Foundation—</text><subclause id="H3D3B7BC6670340E8A2B93BB0556B498D"><enum>(I)</enum><text>shall make the selection based on the technical and commercialization merits of the proposed project of the potential recipient; and</text></subclause><subclause id="H3C5102F9737048F8951B6A2EAEEF1C21"><enum>(II)</enum><text>may consult with a potential recipient regarding the ability of the potential recipient to carry out various projects that would further the purposes of the Foundation described in paragraph (3).</text></subclause></clause><clause id="HC675DA86AD6F440EBCD64B3D0A825AA9"><enum>(iv)</enum><header>National laboratories</header><text display-inline="yes-display-inline">A National Laboratory that applies for or accepts an award under clause (i) shall not be considered to be engaging in a competitive process.</text></clause></subparagraph><subparagraph id="H399E72EA2C094B688964354241541F25"><enum>(C)</enum><header>Accessing facilities and expertise</header><text>The Foundation may work with the Department—</text><clause id="HAC3C02E323884EB6A617482EA1A22D98"><enum>(i)</enum><text>to leverage the capabilities and facilities of National Laboratories to commercialize technology; and</text></clause><clause id="H0867922BA13E40D8B3796BD73AA9DB2C"><enum>(ii)</enum><text>to assist with resources, including by providing information on the assets of each National Laboratory that may enable the commercialization of technology.</text></clause></subparagraph><subparagraph id="H875B2ADDA43A47FBB673A5D25513490F"><enum>(D)</enum><header>Training and education</header><text>The Foundation may support programs that provide training to researchers, scientists, other relevant personnel at National Laboratories and institutions of higher education, and previous or current recipients of or applicants for Department funding to help research, develop, demonstrate, and commercialize federally funded technology.</text></subparagraph><subparagraph id="H185CD6ECA0F6437ABF40EDE83F25A3C7"><enum>(E)</enum><header>Maturation funding</header><text>The Foundation shall support programs that provide maturation funding to researchers to advance the technology of those researchers for the purpose of moving products from a prototype stage to a commercial stage.</text></subparagraph><subparagraph id="H6A66CF58E5964BF7912499C47DDE662D"><enum>(F)</enum><header>Stakeholder engagement</header><text>The Foundation shall convene, and may consult with, representatives from the Department, institutions of higher education, National Laboratories, the private sector, and commercialization organizations to develop programs for the purposes of the Foundation described in paragraph (3) and to advance the activities of the Foundation.</text></subparagraph><subparagraph id="HB49354B0207B44F5932EB0B1E4FB8947"><enum>(G)</enum><header>Individual and federal laboratory-associated foundations</header><clause id="HF509EF40AC334FA4AE2A0332B1F50A27"><enum>(i)</enum><header>Definition of covered foundation</header><text>In this subparagraph, the term <quote>covered foundation</quote> means each of the following:</text><subclause id="HDE1330D59A3D4D6B8182BCB6C15E7ECC"><enum>(I)</enum><text>An Individual Laboratory-Associated Foundation.</text></subclause><subclause id="H85B41537E02842BDBFA19543FB0C32E9"><enum>(II)</enum><text>A Federal Laboratory-Associated Foundation established pursuant to subsection (c)(1).</text></subclause></clause><clause id="H87A4F798EE56476C83AE34721D551FA0"><enum>(ii)</enum><header>Support</header><text>The Foundation shall provide support to and collaborate with covered foundations.</text></clause><clause id="H2227F09A3AD04C97898CC1E4E7173DAA"><enum>(iii)</enum><header>Guidelines and templates</header><text>For the purpose of providing support under clause (ii), the Secretary shall establish suggested guidelines and templates for covered foundations, including—</text><subclause id="H2D0AFE00B0C64344BE9FDD6B49590C20"><enum>(I)</enum><text>a standard adaptable organizational design for responsible management;</text></subclause><subclause id="HD5448EAEEC0A4D74AC41D5C4C33E9C54"><enum>(II)</enum><text>standard and legally tenable bylaws and money-handling procedures; and</text></subclause><subclause id="HD8F5719FA3344F28B1B6DDB246E5ED9A"><enum>(III)</enum><text>a standard training curriculum to orient and expand the operating expertise of personnel employed by covered foundations.</text></subclause></clause><clause id="H2659C79D00FE445BA66C902CBD50A0DF"><enum>(iv)</enum><header>Affiliations</header><text>Nothing in this subparagraph requires—</text><subclause id="H83B5ABFECFB741D39FCC4BF3E7CB7362"><enum>(I)</enum><text>an existing Individual Laboratory-Associated Foundation to modify current practices or affiliate with the Foundation; or</text></subclause><subclause id="HE30CE934860B4E74A2D60A2F7CA41B90"><enum>(II)</enum><text>a covered foundation to be bound by charter or corporate bylaws as permanently affiliated with the Foundation.</text></subclause></clause></subparagraph><subparagraph id="HBF92DF7A3FE9467299770DCC7A448343"><enum>(H)</enum><header>Supplemental programs</header><text>The Foundation may carry out supplemental programs—</text><clause id="HAE5BA09BB8434B61B202150E32611369"><enum>(i)</enum><text>to conduct and support forums, meetings, conferences, courses, and training workshops consistent with the purposes of the Foundation described in paragraph (3);</text></clause><clause id="H4456080AF04645B190FF342B4B558A50"><enum>(ii)</enum><text>to support and encourage the understanding and development of data that promotes the translation of technologies from the research stage, through the development and maturation stage, and ending in the market stage;</text></clause><clause id="HFDACDB6FF0BD41239D00DCA22646234C"><enum>(iii)</enum><text>for writing, editing, printing, publishing, and vending books and other materials relating to research carried out under the Foundation and the Department; and</text></clause><clause id="HFCCE7EB3061441A4A4C16DE7D6A605B7"><enum>(iv)</enum><text>to conduct other activities to carry out and support the purposes of the Foundation described in paragraph (3).</text></clause></subparagraph><subparagraph id="HA60224867A384970938925E568F6BACF"><enum>(I)</enum><header>Evaluations</header><text>The Foundation shall support the development of an evaluation methodology, to be used as part of any program supported by the Foundation, that shall—</text><clause id="H1B967CFD89AD4CE282311A15B6835B7F"><enum>(i)</enum><text>consist of qualitative and quantitative metrics; and</text></clause><clause id="H290488E5B4CA40DD80C17FBD2AEF6928"><enum>(ii)</enum><text>include periodic third-party evaluation of those programs and other activities of the Foundation.</text></clause></subparagraph><subparagraph id="HF168F58393AD4EAB992E74BBFA9D6C24"><enum>(J)</enum><header>Communications</header><text>The Foundation shall develop an expertise in communications to promote the work of grant and fellowship recipients under subparagraph (B), the commercialization successes of the Foundation, opportunities for partnership with the Foundation, and other activities.</text></subparagraph><subparagraph id="H74A42871890B40CE93DC7BB925F92E76"><enum>(K)</enum><header>Solicitation and use of funds</header><text>The Foundation may solicit and accept gifts, grants, and other donations, establish accounts, and invest and expend funds in support of the activities and programs of the Foundation.</text></subparagraph><subparagraph id="HA0FB3AD6A91545D8BFC2F55959F9FCEC"><enum>(L)</enum><header>Authority of foundation</header><text>The Foundation shall be the sole entity responsible for carrying out the activities described in this paragraph.</text></subparagraph></paragraph><paragraph id="HFA943B6408384AE9B9D795A68C5C397D"><enum>(5)</enum><header>Administration</header><subparagraph id="H9B1D1B05554848F4BF10C048D4E99185"><enum>(A)</enum><header>Executive director</header><text>The Board shall hire an Executive Director of the Foundation, who shall serve at the pleasure of the Board. Subject to the compliance with the policies and bylaws established by the Board pursuant to paragraph (2)(G), the Executive Director shall be responsible for the daily operations of the Foundation in carrying out the activities of the Foundation described in paragraph (4).</text></subparagraph><subparagraph id="H707B338B8989449E97FABF65FE6CDD05"><enum>(B)</enum><header>Administrative control</header><text>No member of the Board, officer or employee of the Foundation or of any program established by the Foundation, or participant in a program established by the Foundation, shall exercise administrative control over any Federal employee.</text></subparagraph><subparagraph id="H271B476C43574158B7E2E89EDD8E75BA"><enum>(C)</enum><header>Strategic plan</header><text>Not later than 1 year after the date of enactment of this Act, the Foundation shall submit to the Committee on Energy and Natural Resources of the Senate and the Committee on Science, Space, and Technology of the House of Representatives a strategic plan that contains—</text><clause id="H9A6AC2ECADDA4553BAB66103339F54A9"><enum>(i)</enum><text>a plan for the Foundation to become financially self-sustaining in fiscal year 2023 and thereafter (except for the amounts provided each fiscal year under paragraph (12)(A)(iii));</text></clause><clause id="H0E9B4FB5812C49E594EC93F7246248DB"><enum>(ii)</enum><text>a forecast of major crosscutting energy challenge opportunities, including short- and long-term objectives, identified by the Board, with input from communities representing the entities and areas of subject matter expertise, as applicable, described in paragraph (2)(B)(iii)(II);</text></clause><clause id="HB93A20C05B8E4B2185423E9906468B23"><enum>(iii)</enum><text>a description of the efforts that the Foundation will take to be transparent in the processes of the Foundation, including processes relating to—</text><subclause id="H177E4A0C984B48D78AE7A7176227E918"><enum>(I)</enum><text>grant awards, including selection, review, and notification;</text></subclause><subclause id="H56786D63906349799BE0BCE21B9FF97D"><enum>(II)</enum><text>communication of past, current, and future research priorities; and</text></subclause><subclause id="H176D9675431B49308935B3958888CBA3"><enum>(III)</enum><text>solicitation of and response to public input on the opportunities identified under clause (ii);</text></subclause></clause><clause id="H1E553F4C16AC432D96911736DB77DF49"><enum>(iv)</enum><text>a description of the financial goals and benchmarks of the Foundation for the following 10 years;</text></clause><clause id="H4B7FAFEB3C7541BF90EF3D1D177D9C07"><enum>(v)</enum><text>a description of the efforts undertaken by the Foundation to engage historically underrepresented groups or regions, including through collaborations with historically Black colleges and universities, Tribal Colleges and Universities, minority-serving institutions, and minority-owned and women-owned businesses; and</text></clause><clause id="H6BCA1D16B230413299DC18A5B8D2D9CD"><enum>(vi)</enum><text>a description of the efforts undertaken by the Foundation to ensure maximum complementarity and minimum redundancy with investments made by the Department.</text></clause></subparagraph><subparagraph id="H0994BFE59F7748739EF8A59AF97A971C"><enum>(D)</enum><header>Annual report</header><text>Not later than 1 year after the date on which the Foundation is established, and every 2 years thereafter, the Foundation shall submit to the Committee on Energy and Natural Resources of the Senate, the Committee on Science, Space, and Technology of the House of Representatives, and the Secretary a report that, for the year covered by the report—</text><clause id="H04F1EF16240A429EA839B658E0B23FC3"><enum>(i)</enum><text>describes the activities of the Foundation and the progress of the Foundation in furthering the purposes of the Foundation described in paragraph (3);</text></clause><clause id="H19E0686F70A848AB8D51DA28220E3C15"><enum>(ii)</enum><text>provides a specific accounting of the source and use of all funds made available to the Foundation to carry out those activities to ensure transparency in the alignment of Department missions and policies with national security;</text></clause><clause id="H55CE5AC616CA4B56AAF4A276A88C8B46"><enum>(iii)</enum><text>describes how the results of the activities of the Foundation could be incorporated into the procurement processes of the General Services Administration; and</text></clause><clause id="H3CA66385A4C14454BEE9F85A8D6D8E50"><enum>(iv)</enum><text>includes a summary of each evaluation conducted using the evaluation methodology described in paragraph (4)(I).</text></clause></subparagraph><subparagraph id="H710D0B696B3C4FCD8A0725427344BD18"><enum>(E)</enum><header>Evaluation by comptroller general</header><text>Not later than 5 years after the date on which the Foundation is established, the Comptroller General of the United States shall submit to the Committee on Energy and Natural Resources of the Senate and the Committee on Science, Space, and Technology of the House of Representatives—</text><clause id="H90C5F567511F42E5A7B21221E1997889"><enum>(i)</enum><text>an evaluation of—</text><subclause id="HB1410BEA53B6441F8587B82778EAB924"><enum>(I)</enum><text>the extent to which the Foundation is achieving the mission of the Foundation; and</text></subclause><subclause id="HAC6511EE45FD4584A009A319B2C8938A"><enum>(II)</enum><text>the operation of the Foundation; and</text></subclause></clause><clause id="HD8AA564900324C2F9876C19554D99FDB"><enum>(ii)</enum><text>any recommendations on how the Foundation may be improved.</text></clause></subparagraph><subparagraph id="H1BB283A42DDA488C971A1E59567B0A72"><enum>(F)</enum><header>Audits</header><text>The Foundation shall—</text><clause id="HE9DD2119617D44ADB566C7EBAB73CFF2"><enum>(i)</enum><text>provide for annual audits of the financial condition of the Foundation; and</text></clause><clause id="H8D118E1811B045B2BD35F4AF13B6E8E9"><enum>(ii)</enum><text>make the audits, and all other records, documents, and papers of the Foundation, available to the Secretary and the Comptroller General of the United States for examination or audit.</text></clause></subparagraph><subparagraph id="HD0EBCFDDE9484A94A319EBECF742DB36"><enum>(G)</enum><header>Separate fund accounts</header><text>The Board shall ensure that any funds received under paragraph (12)(A) are held in a separate account from any other funds received by the Foundation.</text></subparagraph><subparagraph id="HEC191EEAF4734F639CB76EC4A5307D36"><enum>(H)</enum><header>Integrity</header><clause id="HD160B8B0565D4AFCA6AF23461B197E19"><enum>(i)</enum><header>In general</header><text>To ensure integrity in the operations of the Foundation, the Board shall develop and enforce procedures relating to standards of conduct, financial disclosure statements, conflicts of interest (including recusal and waiver rules), audits, and any other matters determined appropriate by the Board.</text></clause><clause id="HFBBDBBC3E3184895981E7424C0E0B310"><enum>(ii)</enum><header>Financial conflicts of interest</header><text>To mitigate conflicts of interest and risks from malign foreign influence, any individual who is an officer, employee, or member of the Board is prohibited from any participation in deliberations by the Foundation of a matter that would directly or predictably affect any financial interest of—</text><subclause id="H23CD9D5EAFB54569B1DCF0185B53DE8C"><enum>(I)</enum><text>the individual;</text></subclause><subclause id="H990CE8E235434209AFA0BFA4FC5B2BA3"><enum>(II)</enum><text>a relative (as defined in <external-xref legal-doc="usc-act" parsable-cite="usc-act/Ethics in Government Act of 1978 /109">section 109</external-xref> of the Ethics in Government Act of 1978 (5 U.S.C. App.)) of that individual; or</text></subclause><subclause id="H35158F1ABD3645B28681D3EDE077CC34"><enum>(III)</enum><text>a business organization or other entity in which the individual has an interest, including an organization or other entity with which the individual is negotiating employment.</text></subclause></clause></subparagraph><subparagraph id="H7A174472F34D4F378CF116FDCA183421"><enum>(I)</enum><header>Intellectual property</header><text>The Board shall adopt written standards to govern the ownership and licensing of any intellectual property rights developed by the Foundation or derived from the collaborative efforts of the Foundation.</text></subparagraph><subparagraph id="HEA4644CE0AEC468690265AACBED3504D"><enum>(J)</enum><header>Liability</header><clause id="HC398D94065F041DD8D54F1C8974FA0BA"><enum>(i)</enum><header>In general</header><text>The United States shall not be liable for any debts, defaults, acts, or omissions of—</text><subclause id="HDB5E23CD461F42AB9D6F78771806657D"><enum>(I)</enum><text>the Foundation;</text></subclause><subclause id="HCC7A3FDF1C7147258DA0D425212D0CEB"><enum>(II)</enum><text>a Federal entity with respect to an agreement of that Federal entity with the Foundation; or</text></subclause><subclause id="HD7D5B6371F064512BA7F67A0304ACB95"><enum>(III)</enum><text>an Individual Laboratory-Associated Foundation with respect to an agreement of that Federal entity with the Foundation.</text></subclause></clause><clause id="HEC1BE1CDB4BF43DC8C84B5E64164C987"><enum>(ii)</enum><header>Full faith and credit</header><text>The full faith and credit of the United States shall not extend to any obligations of the Foundation.</text></clause></subparagraph><subparagraph id="HAA0415538DE242AAB5BD7E4772E87979"><enum>(K)</enum><header>Nonapplicability of faca</header><text>The Federal Advisory Committee Act (5 U.S.C. App.) shall not apply to the Foundation or an Individual Laboratory-Associated Foundation.</text></subparagraph></paragraph><paragraph id="H914410DCCC8F462F82461DBA6094E519"><enum>(6)</enum><header>Department collaboration</header><subparagraph id="HF1A2E3F49C3A411B877340EDB85B77E2"><enum>(A)</enum><header>National laboratories</header><text>The Secretary shall collaborate with the Foundation to develop a process to ensure collaboration and coordination between the Department, the Foundation, and National Laboratories—</text><clause id="HD961B16757FD421CA881359D65D311F9"><enum>(i)</enum><text>to streamline contracting processes between National Laboratories and the Foundation, including by—</text><subclause id="H3AB25D5EAC344972AFEBCFD964AC627E"><enum>(I)</enum><text>streamlining the ability of the Foundation to transfer equipment and funds to National Laboratories;</text></subclause><subclause id="H95A3F5CB4EDC41F2A5DBD20D14B8B54E"><enum>(II)</enum><text>standardizing contract mechanisms to be used by the Foundation in engaging with National Laboratories; and</text></subclause><subclause id="H6F59BF26DB1445A38BF79997C8C1881B"><enum>(III)</enum><text>streamlining the ability of the Foundation to fund endowed positions at National Laboratories;</text></subclause></clause><clause id="H7279423256654F59BDE78F1C1BBA1E84"><enum>(ii)</enum><text>to allow a National Laboratory or site of a National Laboratory—</text><subclause id="H5517DA013D6B48EC84846E22F7794930"><enum>(I)</enum><text>to accept and perform work for the Foundation, consistent with provided resources, notwithstanding any other provision of law governing the administration, mission, use, or operations of the National Laboratory or site, as applicable; and</text></subclause><subclause id="H8B16FE08ABD14423B9B559FD68FF47A8"><enum>(II)</enum><text>to perform that work on a basis equal to other missions at the National Laboratory; and</text></subclause></clause><clause id="H9CEB4D6FF0124A85817B791AD6253854"><enum>(iii)</enum><text>to permit the director of any National Laboratory or site of a National Laboratory to enter into a cooperative research and development agreement or negotiate a licensing agreement with the Foundation pursuant to section 12 of the Stevenson-Wydler Technology Innovation Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/15/3710a">15 U.S.C. 3710a</external-xref>).</text></clause></subparagraph><subparagraph id="HFF2DF1EDAA3F44F6B021D0B5238280CD"><enum>(B)</enum><header>Department liaisons</header><text>The Secretary shall appoint liaisons from across the Department to collaborate and coordinate with the Foundation, including not less than 1 liaison from the Office of Technology Transitions, who shall ensure that the Foundation works in conjunction with and does not duplicate existing activities and programs carried out by the Department including the Technology Commercialization Fund.</text></subparagraph><subparagraph id="H744CDDD5A2BB4762B337E7E22701C383"><enum>(C)</enum><header>Administration</header><text>The Secretary shall leverage appropriate arrangements, contracts, and directives to carry out the process developed under subparagraph (A).</text></subparagraph></paragraph><paragraph id="H7BA31C9ADC4847589DC4A0EE1DD1CD34"><enum>(7)</enum><header>National security</header><text>Nothing in this subsection exempts the Foundation from any national security policy of the Department.</text></paragraph><paragraph id="H9A7EB90ADC084A4C91C3C7830D9D0A81"><enum>(8)</enum><header>Support services</header><text>The Secretary may provide facilities, utilities, and support services to the Foundation if it is determined by the Secretary to be advantageous to the research programs of the Department.</text></paragraph><paragraph id="H7512100A32754C0AB000F8798E4997D1"><enum>(9)</enum><header>Anti-deficiency act</header><text>Subsection (a)(1) of section 1341 of title 31, United States Code (commonly referred to as the <quote>Anti-Deficiency Act</quote>), shall not apply to any Federal officer or employee carrying out any activity of the Foundation using funds of the Foundation.</text></paragraph><paragraph id="HD9FAC8BFE16244DEBD97D8491E3A179F"><enum>(10)</enum><header>Preemption of authority</header><text>This subsection shall not preempt any authority or responsibility of the Secretary under any other provision of law.</text></paragraph><paragraph id="H1BD87C8B5C1F48BB985C24AE496EDF38"><enum>(11)</enum><header>Transfer funds</header><text>The Foundation may transfer funds to the Department, which shall be subject to all applicable Federal limitations relating to federally funded research.</text></paragraph><paragraph id="H8F16A411E74C4C31AA16EE42CEE3767C"><enum>(12)</enum><header>Authorization of appropriations</header><subparagraph id="H9D414CA1BC774C99AD367A75364BC6BA"><enum>(A)</enum><header>In general</header><text>There is authorized to be appropriated—</text><clause id="HBAE4F803A25543AC8F869C825D94F836"><enum>(i)</enum><text>not less than $1,500,000 for the Secretary for fiscal year 2022 to establish the Foundation;</text></clause><clause id="HFEC60DADA9624346B7B677ABADB030A2"><enum>(ii)</enum><text>not less than $30,000,000 for the Foundation for fiscal year 2023 to carry out the activities of the Foundation; and</text></clause><clause id="HC46EF2673AAD4BEEB795F5AD563B65DA"><enum>(iii)</enum><text>not less than $3,000,000 for the Foundation for each of the fiscal years 2024 through 2026, for administrative and operational costs.</text></clause></subparagraph><subparagraph id="HB85D422A5B6A4C838F2BE9FF521D3BF9"><enum>(B)</enum><header>Cost share</header><text>Funds made available under subparagraph (A)(ii) shall be required to be cost-shared by a partner of the Foundation other than the Department or a National Laboratory.</text></subparagraph></paragraph></subsection><subsection id="H03E0D7DF46F54F5698EF1F9752514A87"><enum>(c)</enum><header>National energy technology laboratory-Associated foundation</header><paragraph id="HC5036BFF16A840A8909111655E17B6EC"><enum>(1)</enum><header>Establishment</header><subparagraph id="H3F9AB57D97BF4E998EFD91FC9D64D218"><enum>(A)</enum><header>In general</header><text>Notwithstanding any other provision of law, the National Energy Technology Laboratory may establish, or enter into an agreement with a nonprofit organization to establish, a Federal Laboratory-Associated Foundation (referred to in this subsection as a <quote>Laboratory Foundation</quote>) to support the mission of the National Energy Technology Laboratory.</text></subparagraph><subparagraph id="H8D61D5D01A664DEDA5A94B8AC3779290"><enum>(B)</enum><header>Not agency or instrumentality</header><text>A Laboratory Foundation shall not be an agency or instrumentality of the Federal Government.</text></subparagraph><subparagraph id="H2993BDAA8D8642A3A8709B14A8105569"><enum>(C)</enum><header>Governance structure</header><text>A Laboratory Foundation established under subparagraph (A) shall have a separate governance structure from, and shall be managed independently of, the National Energy Technology Laboratory.</text></subparagraph></paragraph><paragraph id="HC717F78429DF464BA637E5BD4967DB91"><enum>(2)</enum><header>Activities</header><text>Activities of a Laboratory Foundation may include—</text><subparagraph id="HF9266A66D18549E596E85033DC8C2304"><enum>(A)</enum><text>conducting support studies, competitions, projects, research, and other activities that further the purpose of the Laboratory Foundation;</text></subparagraph><subparagraph id="H5A6FEA3A50C7434CB9B836684F34B558"><enum>(B)</enum><text>carrying out programs to foster collaboration and partnership among researchers from the Federal Government, State governments, institutions of higher education, federally funded research and development centers, and industry and nonprofit organizations relating to the research, development, and commercialization of federally supported technologies;</text></subparagraph><subparagraph id="HB4371483AAC14C7BA0C297F546542EBE"><enum>(C)</enum><text>carrying out programs to leverage technologies to support new product development that supports regional economic development;</text></subparagraph><subparagraph id="H20121E9B8B3341EABD9C3865AE5888D9"><enum>(D)</enum><text>administering prize competitions—</text><clause id="HF1C728B7B6D142329F203999E5068523"><enum>(i)</enum><text>to accelerate private sector competition and investment; and</text></clause><clause id="H21DFFC153DEE403BA06B95FFE9AC004E"><enum>(ii)</enum><text>that complement the use of prize authority by the Department;</text></clause></subparagraph><subparagraph id="H7A68CF67D68E452B978701A856E83B28"><enum>(E)</enum><text>providing fellowships and grants to research and development personnel at, or affiliated with, federally funded centers, in accordance with paragraph (3);</text></subparagraph><subparagraph id="H539F4F6E80A943C38120BF1E39BD8EC0"><enum>(F)</enum><text>carrying out programs—</text><clause id="HE286BBA6DB8442948C93613814512AEF"><enum>(i)</enum><text>that allow scientists from foreign countries to serve in research capacities in the United States or other countries in association with the National Energy Technology Laboratory;</text></clause><clause id="H6EDEA6B942E042B4BC9D13E2E65BD7A6"><enum>(ii)</enum><text>that provide opportunities for employees of the National Energy Technology Laboratory to serve in research capacities in foreign countries;</text></clause><clause id="H71DF737CC9AD44B983355CD47E6BA80F"><enum>(iii)</enum><text>to conduct studies, projects, or research in collaboration with national and international nonprofit and for-profit organizations, which may include the provision of stipends, travel, and other support for personnel;</text></clause><clause id="H6F50C62E5E544323A47E04BDD2438201"><enum>(iv)</enum><subclause commented="no" display-inline="yes-display-inline" id="HE33273AC39AC41EA972988B2BBD0CAF7"><enum>(I)</enum><text>to hold forums, meetings, conferences, courses, and training workshops that may include undergraduate, graduate, post-graduate, and post-doctoral accredited courses; and</text></subclause><subclause id="HC19C75DDD834446D8752ED6552B007D5" indent="up1"><enum>(II)</enum><text>for the accreditation of those courses by the Laboratory Foundation at the State and national level for college degrees or continuing education credits;</text></subclause></clause><clause id="HC2278AE0F42E466FB4165E365A070DED"><enum>(v)</enum><text>to support and encourage teachers and students of science at all levels of education;</text></clause><clause id="H115595273AA54481B817954F854C215C"><enum>(vi)</enum><text>to promote an understanding of science amongst the general public;</text></clause><clause id="H65FBDE8C0BF14F00A503DC792AE9B6D7"><enum>(vii)</enum><text>for writing, editing, printing, publishing, and vending of relevant books and other materials; and</text></clause><clause id="HAB1EA795E8C6495DB694289F986A4348"><enum>(viii)</enum><text>for the conduct of other activities to carry out and support the purpose of the Laboratory Foundation; and</text></clause></subparagraph><subparagraph id="H376CFB1030644BA48369F69741613096"><enum>(G)</enum><text>receiving, administering, soliciting, accepting, and using funds, gifts, devises, or bequests, either absolutely or in trust of real or personal property or any income therefrom, or other interest or equity therein for the benefit of, or in connection with, the mission of the applicable Federal laboratory, in accordance with paragraph (4).</text></subparagraph></paragraph><paragraph id="HA99A889202A84C72A95E4A72A9DAFFC1"><enum>(3)</enum><header>Fellowships and grants</header><subparagraph id="H41FDCD2844B24C5D833152A0329EAEFF"><enum>(A)</enum><header>Selection</header><text>Recipients of fellowships and grants described in paragraph (2)(E) shall be selected—</text><clause id="H7225380027D24E7DA5FE646126EAD6B9"><enum>(i)</enum><text>by a Laboratory Foundation and the donors to a Laboratory Foundation;</text></clause><clause id="H28DA7C7797CD4918BE968EFED81E8D55"><enum>(ii)</enum><text>subject to the agreement of the head of the agency the mission of which is supported by a Laboratory Foundation; and</text></clause><clause id="HFDEE40887287458685052780C4822572"><enum>(iii)</enum><text>in the case of a fellowship, based on the recommendation of the employees of the National Energy Technology Laboratory at which the fellow would serve.</text></clause></subparagraph><subparagraph id="H5105A93EBD1542CFB5C86BF633B63F87"><enum>(B)</enum><header>Expenses</header><text>Fellowships and grants described in paragraph (2)(E) may include stipends, travel, health insurance, benefits, and other appropriate expenses.</text></subparagraph></paragraph><paragraph id="H38701DD2FCAF4B18913C944624408062"><enum>(4)</enum><header>Gifts</header><text>An amount of funds, a gift, a devise, or a bequest described in paragraph (2)(G) may be accepted by a Laboratory Foundation regardless of whether it is encumbered, restricted, or subject to a beneficial interest of a private person if any current or future interest of the funds, gift, devise, or bequest is for the benefit of the research and development activities of the National Energy Technology Laboratory.</text></paragraph><paragraph id="HEFDC4823D3FE47EC8A13709CB6FD9DE0"><enum>(5)</enum><header>Ownership by federal government</header><text>A contribution, gift, or any other transfer made to or for the use of a Laboratory Foundation shall be regarded as a contribution, gift, or transfer to or for the use of the Federal Government.</text></paragraph><paragraph id="H63047D8409E14323B3A301800243FD3C"><enum>(6)</enum><header>Liability</header><text>The United States shall not be liable for any debts, defaults, acts, or omissions of a Laboratory Foundation.</text></paragraph><paragraph id="H3BB110E8F69F4006AD6FD0B16A055EEE"><enum>(7)</enum><header>Transfer of funds</header><text>Notwithstanding any other provision of law, a Laboratory Foundation may transfer funds to the National Energy Technology Laboratory and the National Energy Technology Laboratory may accept that transfer of funds.</text></paragraph><paragraph id="H76489CFF182F4CB781D82AE4E7721147"><enum>(8)</enum><header>Other laws</header><text>This subsection shall not alter or supersede any other provision of law governing the authority, scope, establishment, or use of nonprofit organizations by a Federal agency.</text></paragraph></subsection></section></legis-body></bill>
