R. 4861</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210729">July 29, 2021</action-date><action-desc><sponsor name-id="W000804">Mr. Wittman</sponsor> (for himself and <cosponsor name-id="H001067">Mr. Hudson</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HED00">Committee on Education and Labor</committee-name>, and in addition to the Committee on <committee-name committee-id="HAS00">Armed Services</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require that commanders of military installations verify the reporting of eligible federally connected children for purposes of Federal impact aid programs.</official-title></form><legis-body id="HBB087EE7C8B64A84BC6AF898EEC29F9C" style="OLC"><section id="H7C21278DB1424F97B1DAD466DD37E5A5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Counting Overlooked Base Impact Aid Act</short-title></quote> or the <quote><short-title>COBIA Act</short-title></quote>. </text></section><section id="H45CA52926F6B4B7B9BFBA5C3ADD4D7E3" section-type="subsequent-section"><enum>2.</enum><header>Verification of reporting of eligible federally connected children for purposes of Federal impact aid programs</header><subsection id="H0EA435ED434744D3BA680C5F6FCBEE88"><enum>(a)</enum><header>Certification</header><text display-inline="yes-display-inline">On an annual basis, each commander of a military installation under the jurisdiction of the Secretary of a military department shall submit to such Secretary a written certification verifying whether the commander has confirmed the information contained in all impact aid source check forms received from local educational agencies as of the date of such certification.</text></subsection><subsection id="HB6E504CC4CBE4246A749671BC3F3A3FB"><enum>(b)</enum><header>Report</header><text>Not later June 30 of each year, each Secretary of a military department shall submit to the congressional defense committees a report, based on the information received under subsection (a), that identifies—</text><paragraph id="H09A3308EC3404B7BBB550A62280C037B"><enum>(1)</enum><text display-inline="yes-display-inline">each military installation under the jurisdiction of such Secretary that has confirmed the information contained in all impact aid source check forms received from local educational agencies as of the date of the report; and</text></paragraph><paragraph id="HCBC887DB21E4488C9CFB5658416427DD"><enum>(2)</enum><text display-inline="yes-display-inline">each military installation that has not confirmed the information contained in such forms as of such date.</text></paragraph></subsection><subsection id="H9993CA8586BD40AB83D5B022C18326D3"><enum>(c)</enum><header>Definitions</header><text>In this Act:</text><paragraph id="H8B11FE9DE2494A3583969971C9B28D0B"><enum>(1)</enum><text display-inline="yes-display-inline">Term <quote>congressional defense committees</quote> has the meaning given that term in section 101(a)(16) of title 10, United States Code.</text></paragraph><paragraph id="H84FA528819824C839CA6B961C0ADE232"><enum>(2)</enum><text>The term <term>impact aid source check form</term> means a form submitted to a military installation by a local educational agency to confirm the number and identity of children eligible to be counted for purposes of the Federal impact aid program under section 7003(a) of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7703">20 U.S.C. 7703(a)</external-xref>).</text></paragraph><paragraph id="H687ABE108EC946649BAA5F99D8537F92"><enum>(3)</enum><text display-inline="yes-display-inline">The term <term>local educational agency</term> has the meaning given that term in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>).</text></paragraph></subsection></section></legis-body></bill>
