R. 4855</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210729">July 29, 2021</action-date><action-desc><sponsor name-id="S000522">Mr. Smith of New Jersey</sponsor> (for himself, <cosponsor name-id="G000583">Mr. Gottheimer</cosponsor>, <cosponsor name-id="V000133">Mr. Van Drew</cosponsor>, and <cosponsor name-id="P000604">Mr. Payne</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HED00">Committee on Education and Labor</committee-name>, and in addition to the Committee on <committee-name committee-id="HIF00">Energy and Commerce</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To establish a commission to prevent exertional heat stroke deaths among high school and collegiate athletes, and for other purposes.</official-title></form><legis-body id="HF9ADE8942C824B9CA73707B871643AD6" style="OLC"><section id="H5F41EF7439CC4F48B484609097498EA0" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Braeden’s Commission: Protect our Athletes from Exertional Heat Stroke</short-title></quote>.</text></section><section id="HB02033F05DAD47F389A73FDFC36A600C"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph id="H50053621F2AE4963ABEAE828FCC85DCA"><enum>(1)</enum><text>Deaths from exertional heat stroke are preventable.</text></paragraph><paragraph id="H00124F11071941BBB2B4C25332678165"><enum>(2)</enum><text>Exertional heat stroke is one of the leading noncontact causes of death of young athletes.</text></paragraph><paragraph id="HF623A19D045045E6B5E2338FF607F2A6"><enum>(3)</enum><text display-inline="yes-display-inline">According to the 2018 National Center for Catastrophic Sport Injury Research’s annual survey of football injuries, since 1995, there have been 64 exertional heat stroke deaths in the sport of football alone, and 60 of these occurred at the high school and collegiate levels.</text></paragraph><paragraph id="H38C2ED328BB34446A10346F2B0CF46A9"><enum>(4)</enum><text display-inline="yes-display-inline">Protective measures such as proper hydration, acclimatization prior to intense physical activity, and rapid recognition, rapid assessment, rapid treatment, and rapid advanced care can prevent exertional heat stroke deaths or hospitalizations provided that the protective measures are implemented immediately when warranted.</text></paragraph></section><section id="HC94BBA05F0AC47F388A33F5BA76B7617"><enum>3.</enum><header>Establishment of commission</header><subsection id="H299CBB84FB3245A496AA313395DEB10E"><enum>(a)</enum><header>Establishment</header><text>There is established the Commission to Prevent Heat Stroke Deaths (in this Act referred to as <quote>Braeden’s Commission</quote>).</text></subsection><subsection id="HB08D2802143A4E6296FACD1CCAC9BE9A"><enum>(b)</enum><header>FACA</header><text display-inline="yes-display-inline">Braeden’s Commission shall be subject to the Federal Advisory Committee Act (5 U.S.C. App.), except as inconsistent with this Act.</text></subsection></section><section display-inline="no-display-inline" id="H06AB14F6911948608EE04B56D44747E5" section-type="subsequent-section"><enum>4.</enum><header>Membership</header><subsection id="H4ABE7F2263AB4771B49E93E139CDE13C"><enum>(a)</enum><header>Number and appointment</header><text display-inline="yes-display-inline">Braeden’s Commission shall be composed of 12 members, consisting of—</text><paragraph id="HB006CCFB76C34BEEAEF8F97EB043BED8"><enum>(1)</enum><text>6 members appointed by the President;</text></paragraph><paragraph id="H1DF16F8A688549FEBB31A0ED7D085874"><enum>(2)</enum><text>2 members appointed by the Speaker of the House of Representatives;</text></paragraph><paragraph id="H8835601E72954C36A7D8F6E1922E5AE4"><enum>(3)</enum><text>1 member appointed by the minority leader of the House of Representatives;</text></paragraph><paragraph id="H74B3D2D9EF884C9D81511BEB9BD11B1D"><enum>(4)</enum><text>2 members appointed by the majority leader of the Senate; and</text></paragraph><paragraph id="H445BCB8F782B4B4E86D5126637D7111A"><enum>(5)</enum><text>1 member appointed by the minority leader of the Senate.</text></paragraph></subsection><subsection id="H7F2B3AB64AC3419A9000ED243D0BDD15"><enum>(b)</enum><header>Qualifications</header><text>Each member appointed pursuant to subsection (a) shall have experience in one or more of the following areas:</text><paragraph id="H490A3DECBAD7469988D5E0422C4C4908"><enum>(1)</enum><text>Sports medicine.</text></paragraph><paragraph id="H773B79D075A448C18EE6EF8D96B0729A"><enum>(2)</enum><text display-inline="yes-display-inline">Exertional heat stroke prevention.</text></paragraph><paragraph id="HFBDF276D28384AFF8F26AA1D51918356"><enum>(3)</enum><text>Student athlete health research.</text></paragraph><paragraph id="H58B5C6D4BF7B4C51BC79473D503EB2A1"><enum>(4)</enum><text>Legislation, including legislation involving sports medicine.</text></paragraph><paragraph id="H8ECCF6BA3FB74F518352A5AB0B229E76"><enum>(5)</enum><text>Emergency medicine.</text></paragraph><paragraph id="HC0550746F9CA44669AAE26F2CA8BD3BF"><enum>(6)</enum><text>Pediatrics.</text></paragraph><paragraph id="HD8DCF97E96534AF4A2F49C61A6821BD1"><enum>(7)</enum><text>Psychology and mental health.</text></paragraph><paragraph id="HD2A38C75D0B44ACEA9DDD2A1A2AF47AD"><enum>(8)</enum><text>Forensic pathology or medical investigation involving injury or fatality.</text></paragraph><paragraph id="HFC1831D8E08543988F164FFF7D830DC3"><enum>(9)</enum><text>Professional experience at an institution of higher education (as defined in section 101(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001(a)</external-xref>), with a focus on one or more of the other areas listed in this subsection.</text></paragraph></subsection><subsection id="H90CA485BACF641B3B92205F7C31D38AD"><enum>(c)</enum><header>Diversity of qualifications</header><text display-inline="yes-display-inline">In making appointments to Braeden’s Commission under subsection (a), the President and the congressional leaders specified in subsection (a) shall strive to select individuals whose qualifications (as described under subsection (b)) are not already represented by other members of Braeden’s Commission.</text></subsection><subsection id="H85B122F7711D4939AB747D8CE3E3837C"><enum>(d)</enum><header>Appointments</header><text display-inline="yes-display-inline">The appointments of the members of Braeden’s Commission shall be made not later than 90 days after the date of enactment of this Act.</text></subsection><subsection id="HCD3C1FA0FB6C420FBFB1EFC5F68F5F60"><enum>(e)</enum><header>Period of appointments; vacancies</header><text display-inline="yes-display-inline">Each member shall be appointed for the life of Braeden’s Commission. Any vacancy in Braeden’s Commission shall not affect its powers and shall be filled in the same manner as the original appointment.</text></subsection><subsection id="HFE1A4F139F0E4B08973BC260E9A5698E"><enum>(f)</enum><header>Chairperson</header><text display-inline="yes-display-inline">The President shall select a Chairperson for Braeden’s Commission from among its members.</text></subsection></section><section id="HF30322AD412B4B578DE78629D45B67C5"><enum>5.</enum><header>Meetings</header><subsection id="H4BA28D9E72E24CE8AD4EEC8B34BEEBF3"><enum>(a)</enum><header>Initial meeting</header><text display-inline="yes-display-inline">Not later than 60 days after the date on which a majority of the members of Braeden’s Commission have been appointed, Braeden’s Commission shall hold its first meeting.</text></subsection><subsection id="H4BAEBA1EEE73452497860458423E44F4"><enum>(b)</enum><header>Timing</header><text display-inline="yes-display-inline">Braeden’s Commission shall meet at the call of the Chairperson.</text></subsection><subsection id="HFA8D471574274D6A9F36896A44268E39"><enum>(c)</enum><header>Quorum</header><text display-inline="yes-display-inline">A majority of the members of Braeden’s Commission shall constitute a quorum.</text></subsection></section><section id="HE334B2902E474242A088E062F7DC6B2E"><enum>6.</enum><header>Study</header><subsection id="HCCA5C17092134E35BE81279E205DD092"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Braeden’s Commission shall conduct a study on exertional heat stroke among student athletes at educational institutions across the United States.</text></subsection><subsection id="H55805D50C6754E30A53FDB32A37407A6"><enum>(b)</enum><header>Matters To be studied</header><text display-inline="yes-display-inline">In conducting the study under subsection (a), Braeden’s Commission shall study—</text><paragraph id="HA9950CEFA5E040EEA561E872F1B97EAA"><enum>(1)</enum><text display-inline="yes-display-inline">best practices for prevention, recognition, and treatment of exertional heat stroke, as regarded by leading experts in sports medicine and as detailed in the 2015 National Athletic Trainers’ Association Position Statement on Exertional Heat Illness;</text></paragraph><paragraph id="H9672303545324EE8A19ABFF78CCA0F9E"><enum>(2)</enum><text display-inline="yes-display-inline">educational institution standards for prevention, recognition, and treatment of exertional heat stroke and related illnesses;</text></paragraph><paragraph id="HB32F3C508ED442859D3CC17D1BBE815B"><enum>(3)</enum><text display-inline="yes-display-inline">whether athletic trainers and coaches have been properly trained to recognize and treat cases of exertional heat stroke;</text></paragraph><paragraph id="H8013CAB9E8BA4EB2A5C67C019087DDAD"><enum>(4)</enum><text display-inline="yes-display-inline">cases involving student athlete deaths and hospitalizations due to exertional heat stroke, including whether best practices were followed in such cases by the educational institution involved;</text></paragraph><paragraph id="HDBC6329955AD469D9225800053701E20"><enum>(5)</enum><text display-inline="yes-display-inline">which organizations currently oversee the implementation of best practices on exertional heat stroke at educational institutions;</text></paragraph><paragraph id="H5BDE73FE750342328DF85C3262E9A55B"><enum>(6)</enum><text display-inline="yes-display-inline">emergency action plans in place at educational institutions and whether such action plans are up-to-date or developed in consultation with local emergency medical staff;</text></paragraph><paragraph id="H1D1151C1CE1043C5A649D3B5D6F72824"><enum>(7)</enum><text display-inline="yes-display-inline">the scope of all incidents of exertional heat stroke among student athletes, including determining which educational institutions are following best practices where such incidents occurred;</text></paragraph><paragraph id="HC61016D02A57459BAC5F328164C72AA7"><enum>(8)</enum><text display-inline="yes-display-inline">the effectiveness of Federal, State, and local policies and systems aimed at collecting accurate data on exertional heat stroke fatalities, including the identification of the most effective and least effective policies and systems;</text></paragraph><paragraph id="H3D1EFCA556A24A82A71FAAD7C06C65F4"><enum>(9)</enum><text display-inline="yes-display-inline">current barriers to preventing fatalities from exertional heat stroke and methods to overcome such barriers among student athletes;</text></paragraph><paragraph id="HE46E6F9C2ECD470DA093F0D8294CDF9E"><enum>(10)</enum><text display-inline="yes-display-inline">demographic trends or specific risk factors that are predictive of or correlated with student athlete exertional heat stroke and related illnesses such as heat exhaustion;</text></paragraph><paragraph id="HD4D1FF7E2E774398B27C7D266926FDE0"><enum>(11)</enum><text display-inline="yes-display-inline">methods for improving data collection related to exertional heat stroke, such as methods to increase interoperability between State and local data systems or other data systems used to collect information that may be related to exertional heat stroke;</text></paragraph><paragraph id="H52CEEC9F8A66426D9C41100086BFD4F1"><enum>(12)</enum><text>current research and documentation, including those currently being conducted by graduate and doctoral students;</text></paragraph><paragraph id="H353D277858A74F6082C301F98979F3BD"><enum>(13)</enum><text>recommendations from the National Athletic Trainers’ Association’s position statements pertaining to heat illnesses and emergency planning in athletics; and</text></paragraph><paragraph id="HC231F2D9CF9445EB8EA6AD075072DF67"><enum>(14)</enum><text display-inline="yes-display-inline">recommendations with respect to best practices for preventing exertional heat stroke from the Inter-Association Task Force for Preventing Sudden Death in Collegiate Conditioning Sessions.</text></paragraph></subsection></section><section id="H81A6F0CA87CA4E5E99B2AE73BB53B480"><enum>7.</enum><header>Recommendations and report</header><subsection id="HFC8437BED86948EFACD306FC3B071D98"><enum>(a)</enum><header>Recommendations</header><text display-inline="yes-display-inline">Based on the study conducted under section 6, Braeden’s Commission shall—</text><paragraph id="H01ECB3C7B4FE4029A51BA818B67F04BD"><enum>(1)</enum><text display-inline="yes-display-inline">develop recommendations for the purpose of reducing fatalities from exertional heat stroke among student athletes, including—</text><subparagraph id="H5B6B52B8AF40427DADD705E76D896623"><enum>(A)</enum><text>a recommendation to implement a comprehensive national strategy for such purpose; and</text></subparagraph><subparagraph id="H7C15434E98BE48409284C8CB0C60E92A"><enum>(B)</enum><text display-inline="yes-display-inline">lessons, solutions, and necessary improvements related to such purpose; and</text></subparagraph></paragraph><paragraph id="HB3D526167F4F4592BFE45C608F0D1175"><enum>(2)</enum><text display-inline="yes-display-inline">develop guidelines for tracking certain types of information to prevent fatalities from exertional heat stroke among student athletes.</text></paragraph></subsection><subsection id="H162B7182FFCB48688865DC7E783C387A"><enum>(b)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 2 years after the date on which a majority of the members of Braeden’s Commission have been appointed, Braeden’s Commission shall submit to the President and Congress a report containing—</text><paragraph id="H48EAC464B30B412095B8E5BD811F09D0"><enum>(1)</enum><text>the recommendations required under subsection (a);</text></paragraph><paragraph id="H599F09880D084EF79E40E064B5BB0D09"><enum>(2)</enum><text display-inline="yes-display-inline">a detailed statement of the findings of Braeden’s Commission related to the study conducted under section 6; and</text></paragraph><paragraph id="H8EB0537032ED48A29D98DFF0C24AFE45"><enum>(3)</enum><text display-inline="yes-display-inline">recommendations for legislation and administrative actions related to exertional heat stroke among student athletes at educational institutions.</text></paragraph></subsection><subsection id="H3C7A4B3AF782414B976EE1D7184F5651"><enum>(c)</enum><header>Extension</header><text display-inline="yes-display-inline">The President may extend the date on which the report required by subsection (b) must be submitted by not more than 1 year.</text></subsection><subsection id="HEEF3F27DA7EF47EFA632959EF33B51DA"><enum>(d)</enum><header>Publication</header><text display-inline="yes-display-inline">In coordination with the Secretary of Health and Human Services, Braeden’s Commission shall make the report under subsection (b) publicly available on the website of the Department of Health and Human Services.</text></subsection></section><section id="H9FBEEF7F089E478CBD4DC779A7E55364"><enum>8.</enum><header>Powers of Braeden’s Commission</header><subsection id="H9442CFE4F1F549F7ADC4C585D291AEC6"><enum>(a)</enum><header>Hearings</header><paragraph id="HAA67B622768A49A78163CC68F64F9A9E"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Braeden’s Commission may, for the purpose of carrying out this Act, hold hearings, sit and act at times and places, take testimony, and receive evidence as Braeden’s Commission considers appropriate. Braeden’s Commission may administer oaths or affirmations to witnesses appearing before it.</text></paragraph><paragraph id="HD7283BF4F2C148379B15D30E70EB38A9"><enum>(2)</enum><header>Location</header><text display-inline="yes-display-inline">The location of hearings under paragraph (1) shall include—</text><subparagraph id="H5511E714A9974D0986EFD4A31EDD5A65"><enum>(A)</enum><text display-inline="yes-display-inline">areas with high fatality rates related to exertional heat stroke among student athletes; and</text></subparagraph><subparagraph id="H2EB96CC138D643FC9FED6CFB217B2C80"><enum>(B)</enum><text display-inline="yes-display-inline">areas that have shown a decrease in fatalities from exertional heat stroke among student athletes.</text></subparagraph></paragraph><paragraph commented="no" id="H3562131269F34BD2ADB40167F0BF1476"><enum>(3)</enum><header>Subject</header><text display-inline="yes-display-inline">Braeden’s Commission shall hold hearings under paragraph (1)—</text><subparagraph commented="no" id="H79EF63F82DA64C9485514844DF0628DD"><enum>(A)</enum><text display-inline="yes-display-inline">to examine the Federal, State, and local policies and available resources that affect fatalities from exertional heat stroke among student athletes; and</text></subparagraph><subparagraph commented="no" id="H528F46931D514AFC96E11DB61D3C5E5B"><enum>(B)</enum><text display-inline="yes-display-inline">to conduct other work related to the study required under section 6.</text></subparagraph></paragraph></subsection><subsection id="H56A3C1997EC440D7BD5239E1C35FBFD3"><enum>(b)</enum><header>Obtaining official data</header><text display-inline="yes-display-inline">Braeden’s Commission may secure directly from any Federal agency or department information necessary to enable it to carry out this Act. Upon request of the Chairperson of Braeden’s Commission, the head of that Federal agency or department shall furnish that information to Braeden’s Commission.</text></subsection><subsection id="H8C54402859274BDCB777331EA071A302"><enum>(c)</enum><header>Mails</header><text display-inline="yes-display-inline">Braeden’s Commission may use the United States mails in the same manner and under the same conditions as other Federal agencies and departments.</text></subsection><subsection commented="no" id="HFE35B17A7B14471BB52DE648D488EB1B"><enum>(d)</enum><header>Gifts, bequests, and devises</header><text display-inline="yes-display-inline">To the extent or in the amounts made available in advance in appropriations Acts, Braeden’s Commission may accept, use, and dispose of gifts, bequests, or devises of services or property, both real and personal, for the purpose of aiding or facilitating the work of Braeden’s Commission.</text></subsection></section><section id="HF997483C29D6432EA695E92D5A4167FA"><enum>9.</enum><header>Commission personnel matters</header><subsection id="H8EF3305801FA42D0B0037D6B86C22C20"><enum>(a)</enum><header>Director and staff of Commission</header><paragraph id="H4569120D9DDA441CA70D9C42CDEC2104"><enum>(1)</enum><header>Executive Director</header><text display-inline="yes-display-inline">Braeden’s Commission shall have an Executive Director who shall be appointed by the Chairperson.</text></paragraph><paragraph id="H142C784CE8D643E89F2D7C9C53BA4413"><enum>(2)</enum><header>Staff</header><text display-inline="yes-display-inline">With the approval of Braeden’s Commission, the Chairperson may appoint additional personnel as the Chairperson considers appropriate.</text></paragraph><paragraph id="H127B4B466FEC4D238A0C1D95F71FBB24"><enum>(3)</enum><header>Termination</header><text display-inline="yes-display-inline">The Chairperson of Braeden’s Commission may, without regard to the civil service laws and regulations, terminate the Executive Director and such other personnel as may be necessary to enable Braeden’s Commission to perform its duties.</text></paragraph><paragraph commented="no" id="H1E1AF63B165048C1AC5EE8B64F896E5F"><enum>(4)</enum><header>Compensation</header><subparagraph commented="no" id="H8388FA30772C47AB8B46C65978B29C04"><enum>(A)</enum><header>Rate of pay for the Executive Director</header><text display-inline="yes-display-inline">The Chairperson of Braeden’s Commission may fix the pay of the Executive Director of Braeden’s Commission without regard to chapter 51 and subchapter III of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/53">chapter 53</external-xref> of title 5, United States Code, relating to classification of positions and General Schedule pay rates, except that the rate of pay for the Executive Director may not exceed the rate payable for level V of the Executive Schedule under section 5316 of such title.</text></subparagraph><subparagraph commented="no" id="H8B80FFB8DBEE4E95A2C25010A149FAFB"><enum>(B)</enum><header>Rate of pay for staff</header><text display-inline="yes-display-inline">The Chairperson of Braeden’s Commission may fix the pay of additional personnel at rates not to exceed the daily equivalent of the maximum annual rate of basic pay for GS–15 of the General Schedule.</text></subparagraph></paragraph></subsection><subsection id="H4FB94F9B3DE44F55BEB5B4C5D0B01E51"><enum>(b)</enum><header>Travel expenses</header><text display-inline="yes-display-inline">The members of Braeden’s Commission shall receive travel expenses, including per diem in lieu of subsistence, in accordance with applicable provisions under subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/57">chapter 57</external-xref> of title 5, United States Code.</text></subsection><subsection id="H3705E74CC37B4020A38FA00F8FB03905"><enum>(c)</enum><header>Staff of Federal agencies</header><text display-inline="yes-display-inline">Upon request of Braeden’s Commission, the head of any Federal agency or department may detail, without reimbursement, any of the personnel of that agency or department to Braeden’s Commission to assist in carrying out this Act. Such detail shall be without interruption or loss of civil service status or privilege.</text></subsection><subsection id="H00D422ACDB844EBA95334E32908625F9"><enum>(d)</enum><header>Experts and consultants</header><text display-inline="yes-display-inline">With the approval of Braeden’s Commission, the Chairperson may procure temporary and intermittent services under section 3109(b) of title 5, United States Code, but at rates not to exceed the daily equivalent of the maximum annual rate of basic pay for GS–15 of the General Schedule.</text></subsection></section><section id="HF4C560F44AA64E9E830D9E4955B51FE5"><enum>10.</enum><header>Termination of Braeden’s Commission</header><text display-inline="no-display-inline">Braeden’s Commission shall terminate on the earlier of—</text><paragraph id="HC26CE5A06BF44201BB5733A646CFB8ED"><enum>(1)</enum><text>30 days after the date on which Braeden’s Commission submits its report pursuant to section 7(b); or</text></paragraph><paragraph id="H29684F4D281444C891DA20A8D08B260F"><enum>(2)</enum><text>the date that is 3 years after the initial meeting under section 5(a).</text></paragraph></section><section id="HA9FBF76292CF48E2B85C3A01EBA63008"><enum>11.</enum><header>Federal agency response</header><text display-inline="no-display-inline">Not later than 6 months after the submission to the President of the report required under section 7(b), any Federal agency or department that is subject to a recommendation described in the report shall submit to Congress a report containing the plans of such agency or department to address the recommendation.</text></section><section commented="no" id="H030AB8CF4A82461CB3720E56DCB3C478"><enum>12.</enum><header>Definition</header><text display-inline="no-display-inline">As used in this Act, the term <term>educational institution</term> means—</text><paragraph commented="no" id="HB0EF0C5FB2BF418698C7597F05031BA7"><enum>(1)</enum><text display-inline="yes-display-inline">a public or private school that serves any of grades 9 through 12; and</text></paragraph><paragraph commented="no" id="H7A348830D70141CE863C002056DF8F18"><enum>(2)</enum><text display-inline="yes-display-inline">an institution of higher education (as defined in section 101(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001(a)</external-xref>).</text></paragraph></section></legis-body></bill>
