R. 4844</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210729">July 29, 2021</action-date><action-desc><sponsor name-id="N000192">Ms. Newman</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HSM00">Committee on Small Business</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Small Business Investment Act of 1958 to allow the Administrator of the Small Business Administration the authority to increase amount of commitments to qualified State or local development companies, and for other purposes.</official-title></form><legis-body id="H64126DA56BA94509830FBB5062B68F4B" style="OLC"><section id="H2F00FCE5EB6B447980E34F6595D216D0" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>504 Program Level Flexibility Act</short-title></quote>.</text></section><section id="HAC2A4413A4354EAFA6CEFA87B98E89CE" section-type="subsequent-section"><enum>2.</enum><header>Authority to increase amount of commitments to qualified State or local development companies</header><text display-inline="no-display-inline">Section 503 of the Small Business Investment Act of 1958 (<external-xref legal-doc="usc" parsable-cite="usc/15/697">15 U.S.C. 697</external-xref>) is amended by adding at the end the following new subsection: </text><quoted-block style="OLC" id="H3FA3215DEF194C76A39E762D88F78E7A" display-inline="no-display-inline"><subsection id="H35B506DA558942159C6E4E97281E5751"><enum>(j)</enum><header>Authority To increase amount of commitments to qualified State or local development companies</header><paragraph id="H7E23FAB33C0D489BB772E83931FF202B"><enum>(1)</enum><header>In general</header><text>Subject to paragraphs (2) and (3) and with respect to fiscal year 2021 and each fiscal year thereafter, if the Administrator determines that the amount of commitments by the Administrator to guarantee loans authorized under this section for a fiscal year could exceed the limit on the total amount of commitments the Administrator may make for those loans under this Act, an appropriations Act, or any other provision of law, the Administrator may make commitments for those loans for that fiscal year in an aggregate amount equal to not more than 115 percent of that limit.</text></paragraph><paragraph id="HB7C892FCE9BB4B33A7770E20C971A940"><enum>(2)</enum><header>Notice required before exercising authority</header><subparagraph id="H9820076848F7484CAB88699848883CA7"><enum>(A)</enum><header>In general</header><text>Not later than 30 days before the date on which the Administrator intends to exercise the authority under paragraph (1), the Administrator shall submit notice of intent to exercise the authority to—</text><clause id="H89D119F5403B45BE91EAD53AF10F5657"><enum>(i)</enum><text>the Committee on Small Business and Entrepreneurship and the Subcommittee on Financial Services and General Government of the Committee on Appropriations of the Senate; and</text></clause><clause id="H59991FAA30634494A47E10D6118715A5"><enum>(ii)</enum><text>the Committee on Small Business and the Subcommittee on Financial Services and General Government of the Committee on Appropriations of the House of Representatives.</text></clause></subparagraph><subparagraph id="H853635891B80415B978F154505A53F8F"><enum>(B)</enum><header>Exception</header><text>Subparagraph (A) shall not apply with respect to fiscal year 2021.</text></subparagraph></paragraph><paragraph id="H97860C1E69AA47F2838C4A1A21746ADC"><enum>(3)</enum><header>Limitation</header><text>The Administrator shall not exercise the authority under paragraph (1) more than once during any fiscal year.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
