which was referred to the <committee-name committee-id="HII00">Committee on Natural Resources</committee-name>, and in addition to the Committee on <committee-name committee-id="HAG00">Agriculture</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require the Secretary of Agriculture, acting through the Chief of the Forest Service, and the Secretary of the Interior, acting through the Director of the Bureau of Land Management, to take actions to mitigate tree spiking devices on certain Federal land, and for other purposes.</official-title></form><legis-body id="H892DF2C23CC1401B8709C3F3143F22BB" style="OLC"><section id="HA20AE2077E0E4D9DAA3F124D2F74C371" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Tree Spiking Mitigation Act of 2021</short-title></quote>.</text></section><section id="HA2CFD0DCDA794ADFACC74F9F7F5DB244"><enum>2.</enum><header>Detection, identification, and mitigation of tree spiking devices on federal land</header><subsection id="HA480872E13D546199C0F4837659F1D66"><enum>(a)</enum><header>In general</header><text>The Secretaries, acting in coordination, shall take necessary actions to ensure the detection, identification, and, as the Secretaries determine to be appropriate, mitigation of tree spiking devices located on Federal land.</text></subsection><subsection id="HA17C0E9930EF4623AAC47653C2ED6AF6"><enum>(b)</enum><header>Prioritization</header><text>For purposes of carrying out activities under subsection (a), the Secretaries shall prioritize areas in which—</text><paragraph id="HE622185A5A764E8997D1B60BF47A2138"><enum>(1)</enum><text>incidences of tree spiking devices have occurred; or</text></paragraph><paragraph id="H1A90611C398342AD9934650E6B8F52BA"><enum>(2)</enum><text>the Secretaries suspect that there are tree spike devices.</text></paragraph></subsection><subsection id="HA70DB428D1704504A2F69D6EF86B05FD"><enum>(c)</enum><header>Memoranda of understanding</header><text>The Secretaries may enter into memoranda of understanding for carrying out activities on Federal land under this section.</text></subsection><subsection id="H0B0E1A5DF32A4F7BA5EC0B630C04C3C8"><enum>(d)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Secretaries to carry out this section $10,000,000 for fiscal year 2022, to remain available until September 30, 2026.</text></subsection></section><section id="H84F4B9DE5BFA47FB84A0D00AAAF59B92"><enum>3.</enum><header>Updates to safety guidelines and training protocols</header><text display-inline="no-display-inline">Not later than 90 days after the date of enactment of this Act, the Secretaries shall, where appropriate, update safety guidelines and training protocols to include the awareness, detection, identification, and mitigation of tree spiking devices.</text></section><section id="HCD9AAF618574494EB96D7DEC2D3F6477"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="HC973B9D1FE5D4D94A2F5CA1DCF857061"><enum>(1)</enum><header>Federal land</header><text>The term <term>Federal land</term> means—</text><subparagraph id="H662697A6BCB74F22A0E10DC47C59423D"><enum>(A)</enum><text>land of the National Forest System (as defined in section 11(a) of the Forest and Rangeland Renewable Resources Planning Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/16/1609">16 U.S.C. 1609(a)</external-xref>)), except—</text><clause id="HD3894ADFD20C4A1B8A3DF822C28FBDE5"><enum>(i)</enum><text>the national grasslands and land utilization projects administered under title III of the Bankhead-Jones Farm Tenant Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1010">7 U.S.C. 1010 et seq.</external-xref>); or</text></clause><clause id="HC07653BF931B43A4B9583C85FBFC4933"><enum>(ii)</enum><text>National Forest System land east of the 100th meridian; and</text></clause></subparagraph><subparagraph id="H7DE70DA04CB94620A0C5E10AF0A0ED4A"><enum>(B)</enum><text>land under the jurisdiction of the Secretary of the Interior, acting through the Director of the Bureau of Land Management.</text></subparagraph></paragraph><paragraph id="HD5DF6F2995744759BCDD716DC6D27CBC"><enum>(2)</enum><header>Secretaries</header><text>The term <term>Secretaries</term> means each of—</text><subparagraph id="HDAE6EFD863C24B8DBA8FC52E490226D0"><enum>(A)</enum><text>the Secretary of Agriculture, acting through the Chief of the Forest Service; and</text></subparagraph><subparagraph id="HF777A1DABE344744BB6F1C8EFFF2B44E"><enum>(B)</enum><text>the Secretary of the Interior, acting through the Director of the Bureau of Land Management.</text></subparagraph></paragraph><paragraph id="HC10D694F0B1D44ECA9FD1F244D142CF0"><enum>(3)</enum><header>Tree spiking device</header><text>The term <term>tree spiking device</term> means any tree spiking device described in section 1864(d)(3) of title 18, United States Code.</text></paragraph></section></legis-body></bill>
