which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Omnibus Crime Control and Safe Streets Act of 1968 to make reforms to the benefits for Public Service Officers, and for other purposes.</official-title></form><legis-body id="H53C9F4F3C93F44A090E5E543F1EB333A" style="OLC"><section id="HA4DB1BE529BB402885291FC4473B9B28" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Heroes Lesley Zerebny and Gilbert Vega First Responders Survivors Support Act of 2021</short-title></quote>.</text></section><section id="H9D54D2FB7F8E40D3B0E7C28DA48B79CA"><enum>2.</enum><header>Amount of benefit increased</header><text display-inline="no-display-inline">Section 1201(a) of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10281">34 U.S.C. 10281(a)</external-xref>) is amended in the matter preceding paragraph (1) by striking <quote>$250,000</quote> and inserting <quote>$550,000</quote>.</text></section><section id="H3BFA71BBEF1B4E898FD8B5855E7A24D7"><enum>3.</enum><header>Date of determination of amount of benefit</header><subsection id="H8625B9B82ED248CFBFA29474C814947A"><enum>(a)</enum><header>Disability benefit</header><text display-inline="yes-display-inline">Section 1201(b) of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10281">34 U.S.C. 10281(b)</external-xref>) is amended by striking <quote>with respect to the date on which the catastrophic injury occurred</quote> and inserting <quote>with respect to the date that a determination is made to make such payment</quote>.</text></subsection><subsection id="H1EC1E96EFB1444E2B488E0B3C6F6026E"><enum>(b)</enum><header>Death benefit</header><text display-inline="yes-display-inline">Section 1201(i) of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10281">34 U.S.C. 10281(i)</external-xref>) is amended by striking <quote>as of the date of death of such officer</quote> and inserting <quote>as of the date that a determination is made to make such payment subsequent to an application</quote>.</text></subsection></section><section id="HEE8FFBCD213C4083AB15C4C326A8B582"><enum>4.</enum><header>Amount of educational assistance</header><text display-inline="no-display-inline">Section 1212(a)(2) of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10302">34 U.S.C. 10302(a)(2)</external-xref>) is amended by striking <quote>shall be computed on the basis set forth in section 3532 of title 38, United States Code</quote> and inserting <quote>shall be computed on the basis set forth in section 1219</quote>.</text></section><section id="H643B7199E2194C29A4746F2E841437C4"><enum>5.</enum><header>Computation of educational assistance allowance</header><text display-inline="no-display-inline">Subpart 2 of part L of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10301">34 U.S.C. 10301</external-xref> et seq.) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H9FD5B9D61D8F4E52A24A6E747247714D" style="OLC"><section id="H091FC4E51FCC409A8B8976B7152DC5FF"><enum>1219.</enum><header>Computation of educational assistance allowance</header><subsection id="HA972BEF020244C3D9B856FFADF303A49"><enum>(a)</enum><header>In general</header><paragraph display-inline="no-display-inline" id="HD14A77EA329742DC96FD17A55667551F"><enum>(1)</enum><header>Monthly rates</header><text>The financial assistance to be paid on behalf of an eligible person who is pursuing a program of education consisting of institutional courses shall be computed at the rate of—</text><subparagraph display-inline="no-display-inline" id="H98DEF49B74154F0D91C459084C606CCB"><enum>(A)</enum><text>$2,200 per month for full-time pursuit;</text></subparagraph><subparagraph display-inline="no-display-inline" id="H5132425C72DE4F90999F07568430CF29"><enum>(B)</enum><text>$1,700 per month for three-quarter-time pursuit; or</text></subparagraph><subparagraph display-inline="no-display-inline" id="H0D4680EBB1ED413E97DB3C0059DAD05C"><enum>(C)</enum><text>$1,250 per month for half-time pursuit.</text></subparagraph></paragraph><paragraph id="H983D928F78F54CE9AD6CEB6EEE26009E"><enum>(2)</enum><header>Less than half-time basis</header><text display-inline="yes-display-inline">The financial assistance to be paid on behalf of an eligible person pursuing a program of education on less than a half-time basis shall be computed at the rate of the lesser of—</text><subparagraph id="H0230C16255C44490B1C511AA5ADC6000"><enum>(A)</enum><text>the established charges for tuition and fees that the eligible educational institution involved requires to be paid by similarly circumstanced noneligible persons enrolled in the same program; or</text></subparagraph><subparagraph id="H422997AE26524788A98D5438861BC33D"><enum>(B)</enum><text>$2,200 per month for a full-time course.</text></subparagraph></paragraph></subsection><subsection id="H9FA06E1BF1BA43CABECA76BBC6B6F0E5"><enum>(b)</enum><header>Training</header><text display-inline="yes-display-inline">The financial assistance to be paid on behalf of an eligible person who is pursuing a full-time program of education which consists of institutional courses and alternate phases of training in a business or industrial establishment under which the training in the business or industrial establishment is strictly supplemental to the institutional portion, shall be computed at the rate of $2,200 per month.</text></subsection><subsection id="HD9B070DA2DAD4A3DA281A8EE80A56B1D"><enum>(c)</enum><header>Farm cooperative</header><paragraph display-inline="no-display-inline" id="H969969AFCB4845749DD84AEDF501A025"><enum>(1)</enum><header>Definition</header><text>In this subsection, the term <term>enrolled in a farm cooperative program</term>, relating to an eligible person, means that the eligible person—</text><subparagraph display-inline="no-display-inline" id="H7D1AF8050712469AB9B13292A55BF77E"><enum>(A)</enum><text>is enrolled in an eligible educational institution for a farm cooperative program consisting of institutional agricultural courses prescheduled to fall within 44 weeks of any period of 12 consecutive months;</text></subparagraph><subparagraph display-inline="no-display-inline" id="HE2A91AF04FC2417C96F4872AACEAAF21"><enum>(B)</enum><text>pursues such program on—</text><clause id="HCC1F2A71DA7F4CE9937D8548799A1ED7"><enum>(i)</enum><text>a full-time basis (consisting of a minimum of 10 clock hours per week or 440 clock hours per year prescheduled to provide not less than 80 clock hours in any 3-month period);</text></clause><clause id="H5560F0059AB9414FBEA55F3D78D1FAB8"><enum>(ii)</enum><text>a three-quarter-time basis (consisting of a minimum of 7 clock hours per week); or</text></clause><clause id="H06EEFC662C344DDCB46FC699E851F506"><enum>(iii)</enum><text display-inline="yes-display-inline">a half-time basis (consisting of a minimum of 5 clock hours per week); and</text></clause></subparagraph><subparagraph id="H620A65BCC967446F9D1378FBC543BCBF"><enum>(C)</enum><text>is concurrently engaged in agricultural employment which is relevant to such institutional agricultural courses, as determined under standards prescribed by the Attorney General.</text></subparagraph></paragraph><paragraph id="H82087347A61A49638D397A17A4ECB9D7"><enum>(2)</enum><header>Computation</header><text>The financial assistance to be paid on behalf of an eligible person who is enrolled in a farm cooperative program shall be computed at the rate of—</text><subparagraph id="HE02D63CFAFFC482EAAEFED71A1229A2D"><enum>(A)</enum><text>$690 per month for full-time pursuit;</text></subparagraph><subparagraph id="H35C2662922D04679A7A71F04691A124B"><enum>(B)</enum><text>$517 per month for three-quarter-time pursuit; or</text></subparagraph><subparagraph id="HB08DEB578DD14BFAA854627E3A0ABF0D"><enum>(C)</enum><text>$345 per month for half-time pursuit.</text></subparagraph></paragraph><paragraph id="HB35F93A70D21421EB83697F07EFD61CB"><enum>(3)</enum><header>Calculation of hours</header><text>In calculating the number of clock hours for purposes of paragraph (1), the Attorney General shall include the time involved in field trips and individual and group instruction sponsored and conducted by the eligible educational institution through a duly authorized instructor of such institution in which the eligible person is enrolled.</text></paragraph></subsection><subsection id="HD09F534C61DA4295B9B479E39FFEADD7"><enum>(d)</enum><header>Programs in Republic of Philippines</header><text display-inline="yes-display-inline">The financial assistance to be paid on behalf of an eligible person who is enrolled in a program of education at an eligible educational institution located in the Republic of the Philippines, shall be computed at the rate of $0.50 for each $1.00 otherwise payable under this subpart.</text></subsection><subsection id="HE4F4724BB48E4273A4A61C8472CC126A"><enum>(e)</enum><header>Licensing or certification</header><paragraph id="H61878D5ED6164331B4FB5CA7486523E1"><enum>(1)</enum><header>Definition</header><text>In this subsection, the term <term>licensing or certification test</term> means a licensing or certification test described in section 3501(a)(5) of title 38, United States Code.</text></paragraph><paragraph display-inline="no-display-inline" id="H4352E633B6D544919E2982731547B0DC"><enum>(2)</enum><header>Computation</header><text display-inline="yes-display-inline">Subject to paragraph (4), the amount of financial assistance payable under this subpart for a licensing or certification test is the lesser of $2,000 or the fee charged for the licensing or certification test.</text></paragraph><paragraph id="H252B74123AEB40308F96BEE85D476125"><enum>(3)</enum><header>Number of months</header><text display-inline="yes-display-inline">The number of months of entitlement charged in the case of an eligible person for a licensing or certification test is equal to the quotient (including any fraction) obtained by dividing—</text><subparagraph id="HD7010A06766A4EA69D2497B56E733023"><enum>(A)</enum><text display-inline="yes-display-inline">the total amount paid to the eligible person for the licensing or certification test; by</text></subparagraph><subparagraph id="HAAABFFE9943348B09BCC23B6B5D60C6E"><enum>(B)</enum><text display-inline="yes-display-inline">the full-time monthly institutional rate of the financial assistance which, but for paragraph (2), the eligible person would otherwise be paid under this subpart.</text></subparagraph></paragraph><paragraph id="HD07B803B63184B1C9A145735CCFDBAED"><enum>(4)</enum><header>Limitation</header><text>In no event shall payment of financial assistance under this subsection for a licensing or certification test exceed the amount of the amount to which an eligible individual is entitled under this subpart.</text></paragraph></subsection><subsection id="H1163C5EF764A4F2280047774B847C367"><enum>(f)</enum><header>National tests for admission or opportunity</header><paragraph id="HE52EBFF3A3A549BC88633C7B455730A6"><enum>(1)</enum><header>Definition</header><text>In this subsection, the term <term>national test</term> means a national test for admission or national test providing an opportunity for course credit at institutions of higher learning described in section 3501(a)(5) of title 38, United States Code.</text></paragraph><paragraph display-inline="no-display-inline" id="H3B47C0859F7B405F8FC589270615089B"><enum>(2)</enum><header>National tests</header><text>Subject to paragraph (4), the amount of financial assistance payable under this subpart for a national test is the amount of the fee charged for the national test.</text></paragraph><paragraph id="H871D4512AC234C0A87DE8E7FB4B769E0"><enum>(3)</enum><header>Number of months</header><text>The number of months of entitlement charged in the case of an eligible person for a national test is equal to the quotient (including any fraction) obtained by dividing—</text><subparagraph id="H07B655B0072E4E939696BB881DF69A3B"><enum>(A)</enum><text>the total amount of financial assistance paid to the eligible person for the national test; by</text></subparagraph><subparagraph id="H7B1CD3B165CE4DDBA9DF60799A76D85E"><enum>(B)</enum><text>the full-time monthly institutional rate of financial assistance which, but for paragraph (2), the eligible person would otherwise be paid under this subpart.</text></subparagraph></paragraph><paragraph id="HA2235DCFFED540688E9F6052744E9B44"><enum>(4)</enum><header>Limitation</header><text>In no event shall payment of financial assistance under this subsection for a national test exceed the amount of the amount to which an eligible individual is entitled under this subpart.</text></paragraph></subsection><subsection id="HBFD58DCBED3D4DA8B6369FC8DC0228CD"><enum>(g)</enum><header>Adjustment for inflation</header><text display-inline="yes-display-inline">Amounts under this section shall be indexed annually to the college tuition and fees component of the Consumer Price Index for All Urban Consumers.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H1C859761D3A5449ABC6C2147CA61CAB1"><enum>6.</enum><header>GAO study</header><subsection id="H477046136DF94B6994344C8D86F533FC"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 3 years after the date of enactment of this Act, the Comptroller General of the United States shall submit a report examining and identifying ways to improve access to and the processing of claims under the Public Safety Officers’ Benefit program under part L of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10281">34 U.S.C. 10281</external-xref> et seq.) to—</text><paragraph id="HD8B08501902847F9A8AFE7B72919D046"><enum>(1)</enum><text display-inline="yes-display-inline">the Committee on the Judiciary and the Committee on Health, Education, Labor, and Pensions of the Senate; and</text></paragraph><paragraph id="HF79CE9A4905D45868C5F0DF293BEB77E"><enum>(2)</enum><text display-inline="yes-display-inline">the Committee on the Judiciary and the Committee on Education and the Workforce of the House of Representatives.</text></paragraph></subsection><subsection id="H1858F01093154353A1775D736A023122"><enum>(b)</enum><header>Contents</header><text display-inline="yes-display-inline">The report submitted under subsection (a) shall examine—</text><paragraph id="HA67D4F02506D4F1EA0646E3DD23EFAF9"><enum>(1)</enum><text>factors that may hinder access to the education assistance benefit under subpart 2 of part L of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10301">34 U.S.C. 10301</external-xref> et seq.), such as lack of awareness, delays in the application process, or the timely processing of deaths and disability claims; and</text></paragraph><paragraph id="H589B8FD795C94D4D99939AFF6C013E15"><enum>(2)</enum><text>the extent to which eligibility for benefits and assistance under the Public Safety Officers’ Benefit program under part L of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10281">34 U.S.C. 10281</external-xref> et seq.) is communicated to officers upon employment and to eligible family members following the loss of a public safety officer.</text></paragraph></subsection></section></legis-body></bill>
