which was referred to the <committee-name committee-id="HED00">Committee on Education and Labor</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Secretary of Labor to recognize employers with a commitment to helping employees balance workplace responsibilities and family obligations.</official-title></form><legis-body id="H50C301292D29424E9CAD11A10368794C" style="OLC"><section id="HCEE65E4350ED4E77A41DECBBC097BBDA" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Honoring Family-Friendly Workplaces Act</short-title></quote>.</text></section><section id="H681EB4AF869B455586368AF2AFEBE21F"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="H813582A971CA4B40A21591560D1D2D01"><enum>(1)</enum><header>Employee; employer</header><text>The terms <term>employee</term> and <term>employer</term> have the meanings given such terms in section 3 of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/203">29 U.S.C. 203</external-xref>).</text></paragraph><paragraph id="HD9B7F013673E45ACB044E1256CC8C798"><enum>(2)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Labor.</text></paragraph></section><section id="H999D3CFBF1D44407B636F087306F49DC"><enum>3.</enum><header>Certification program established</header><subsection id="H02746848FC854865A7AF455CB885C8AC"><enum>(a)</enum><header>In general</header><text>The Secretary shall establish a national certification program to award certifications to recognize employers that have a commitment to helping employees balance employment responsibilities and family obligations (referred to in this section as <quote>family-friendly certifications</quote>).</text></subsection><subsection id="H4EF6F858B09A4E658402853A24C8E49E"><enum>(b)</enum><header>Criteria for certification</header><text>In order to be eligible to receive a family-friendly certification, an employer must carry out each of the following family-friendly employment policies and benefits:</text><paragraph id="HFEBC20DAFB5140E28E65725E820AD869"><enum>(1)</enum><text>Assistance paying for, or referring employees to, fertility or adoption services.</text></paragraph><paragraph id="H7520EFF7F06640D6BDF145EB1B2C2646"><enum>(2)</enum><text>Paid family leave of not less than 12 weeks per year, including the option to use leave for any of the following reasons:</text><subparagraph id="HCD4C44FADBE0496F9909C9CF404CD3F5"><enum>(A)</enum><text>The birth of a child of the employee and in order to care for such child.</text></subparagraph><subparagraph id="HC345AB54330147919374A3637CE10D20"><enum>(B)</enum><text display-inline="yes-display-inline">The placement of a child with the employee for adoption or foster care.</text></subparagraph><subparagraph id="HDFC34B450FBD4FC188D6174B327F684A"><enum>(C)</enum><text>To address the employee's own serious health condition, including pregnancy, childbirth, or pregnancy loss.</text></subparagraph><subparagraph id="H7F75482FE99746C480E7A764F9F528E7"><enum>(D)</enum><text>To address the serious health condition (as defined in section 101 of the Family and Medical Leave Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/29/2611">29 U.S.C. 2611</external-xref>)) of a family member.</text></subparagraph><subparagraph id="H784284D379D0452598235D7BEFF3AAC0"><enum>(E)</enum><text>For specific military caregiving and leave.</text></subparagraph></paragraph><paragraph id="H9C0E7D5D9C1B472CB07F97F167458FEF"><enum>(3)</enum><text>Paid sick days for employees that are separate from time accrued as part of a paid time off policy.</text></paragraph><paragraph id="H3CCD9710025F4AE386A0BF9F30676E71"><enum>(4)</enum><text>A subsidy for child care or policies that allow parents to work alongside their infants in safe settings.</text></paragraph><paragraph id="H3372D51FBE1B4C35BE5099A5F8FF6739"><enum>(5)</enum><text>Policies that allow for flexible hours once a parent returns to work after a birth, adoption, or foster care placement.</text></paragraph><paragraph id="H817C1F182DEE43E78F4E0302C1DA2DAE"><enum>(6)</enum><text>If feasible, policies that allow employees to work remotely as needed for reasons related to the care of a child.</text></paragraph><paragraph id="H04EFBD94982D4C3881E9CF36E9AC4654"><enum>(7)</enum><text>Lactation support, such as reimbursement of expressed breastmilk delivery while on travel, access to pumps, kits, and other lactation supplies and amenities, and access to lactation consultants and support.</text></paragraph></subsection><subsection id="H1527F35C67ED4FB5BD3693AAF63987AF"><enum>(c)</enum><header>Application</header><text>An employer who desires to receive a family-friendly certification from the Secretary under this section shall submit an application to the Secretary at such time, containing such information, and in such manner as the Secretary may require.</text></subsection><subsection id="HEBFAC062CB614B3EBC91F7BB70E58643"><enum>(d)</enum><header>Award of certification</header><text>The Secretary shall review applications submitted under subparagraph (c) and award a family-friendly certification to an employer whose application demonstrates that the employer has met the requirements established under subsection (b) regarding family-friendly policies and benefits.</text></subsection><subsection id="HF2B4299E41454F9F809D1CCD6BB9885D"><enum>(e)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to carry out this Act such sums as may be necessary.</text></subsection></section></legis-body></bill>
