which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Administrator of the Environmental Protection Agency to establish a program to make grants to States to assist local educational agencies in voluntary installation and maintenance of filtration stations at schools and child care programs, and for other purposes.</official-title></form><legis-body id="H0CA7E783C3F64B4696571A09F0182B52" style="OLC"><section id="H374E7852D2A1453E9B909FC7AF13549F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Safe School Drinking Water Act</short-title></quote>. </text></section><section id="H7CDFBC4FDD724DF7A81043012605E641"><enum>2.</enum><header>Grant program for installation of filtration stations at schools and child care programs</header><text display-inline="no-display-inline">Section 1464 of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j-24">42 U.S.C. 300j–24</external-xref>) is amended by adding at the end the following: </text><quoted-block style="OLC" id="H8EF8058E11A343278CFD1F787D22C0FF" display-inline="no-display-inline"><subsection id="HC0A99764399B47CFB9EE58D5C22A70B5"><enum>(e)</enum><header>Grant program for installation and maintenance of filtration stations</header><paragraph id="H2EE137303FB34D8DB6F847BD5EFB63E8"><enum>(1)</enum><header>Program</header><text display-inline="yes-display-inline">The Administrator shall establish a program to make grants to States to assist local educational agencies in voluntary installation and maintenance of filtration stations at schools and child care programs under the jurisdiction of the local educational agencies.</text></paragraph><paragraph id="HF8C3895EA8F948DC987CB35A1689AEBC" commented="no"><enum>(2)</enum><header>Direct grants to local educational agencies</header><text display-inline="yes-display-inline">The Administrator may make a grant described in paragraph (1) directly available to—</text><subparagraph id="HCF0ADA08651642D2A925667BB5BB2B5D" commented="no"><enum>(A)</enum><text>any local educational agency described in clause (i) or (iii) of subsection (d)(1)(B) located in a State that does not participate in the program established under paragraph (1); or </text></subparagraph><subparagraph id="H10D1D9809D744AB5B060D03B1DFEA5CB" commented="no"><enum>(B)</enum><text>any local educational agency described in clause (ii) of subsection (d)(1)(B). </text></subparagraph></paragraph><paragraph id="H26AB0F7657334340AB7DDB5D114E0D25"><enum>(3)</enum><header>Use of funds</header><text>Grants made under the program established under this subsection may be used to pay the costs of—</text><subparagraph id="HC50A9E0D27D2443EAC23F6D3E7B06B34"><enum>(A)</enum><text display-inline="yes-display-inline">installation and maintenance of filtration stations at schools and child care programs; and</text></subparagraph><subparagraph id="HD4360EC3BD8F498D8C087AD1295F35A3"><enum>(B)</enum><text display-inline="yes-display-inline">annual testing of drinking water at such schools and child care programs following the installation of filtration stations.</text></subparagraph></paragraph><paragraph id="HE4031F93213C4EA5BCCDA43D0F57750E"><enum>(4)</enum><header>Priority</header><text display-inline="yes-display-inline">In making grants under the program established under this subsection, the Administrator shall give priority to States and local educational agencies that will assist in voluntary installation and maintenance of filtration stations at schools and child care programs that are in low-income areas.</text></paragraph><paragraph id="H5CB18C6F59DF43C490720C55BBF41AA2"><enum>(5)</enum><header>Guidance</header><text>Not later than 180 days after the date of enactment of this subsection, the Administrator shall establish guidance to carry out the program established under this subsection.</text></paragraph><paragraph id="HEF7DAD9B24A34ABD812DB8B13F94CC6D"><enum>(6)</enum><header>No prior testing required</header><text display-inline="yes-display-inline">The program established under this subsection shall not require testing for lead contamination in drinking water at schools and child care programs prior to participation in such program.</text></paragraph><paragraph id="H4DFF8043CF5B4D9981918C35264EE575"><enum>(7)</enum><header>Definitions</header><text>In this subsection:</text><subparagraph id="H44A0087C789D41F3BCCA3CE7967AFE54"><enum>(A)</enum><header>Child care program and local educational agency</header><text>The terms <term>child care program</term> and <term>local educational agency</term> have the meaning given such terms in subsection (d).</text></subparagraph><subparagraph id="HDEC61A1C8C0549C995B07D1A2E70A5E0"><enum>(B)</enum><header>Filtration station</header><text>The term <term>filtration station</term> means an apparatus that—</text><clause id="HC33468ECCBB34311AEB090272BF4A1F4"><enum>(i)</enum><text>is connected to building plumbing;</text></clause><clause id="H706236807D354FB58FD4924186F8AEB9"><enum>(ii)</enum><text>is certified to the latest version of NSF/ANSI 53 for lead reduction and NSF/ANSI 42 for particulate reduction (Class I) by a certification body accredited by the American National Standards Institute National Accreditation Board;</text></clause><clause id="HFC63ABB2B6834194A930737AF70BD749"><enum>(iii)</enum><text>has an indicator to show filter performance;</text></clause><clause id="H881E276AD7BB405784992A2AFF7624D9"><enum>(iv)</enum><text>can fill bottles or containers for water consumption; and</text></clause><clause id="HE08E2F788CA0466CB46BB14FE24FBC5C"><enum>(v)</enum><text>allows users to drink directly from a stream of flowing water.</text></clause></subparagraph></paragraph><paragraph id="HC05BC17A25C54B9C86AB3058CF977541"><enum>(8)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this subsection $100,000,000 for each of fiscal years 2022 through 2031.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
