R. 4788</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210729">July 29, 2021</action-date><action-desc><sponsor name-id="L000595">Ms. Letlow</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HWM00">Committee on Ways and Means</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title II of the Social Security Act to restrict the application of the windfall elimination provision to individuals whose combined monthly income from benefits under such title and other monthly periodic payments exceeds a minimum wage-indexed amount of $5,500 and to provide for a graduated implementation of such provision on amounts above such minimum amount.</official-title></form><legis-body id="HC35C5370E8AA4740915A9E9CEE58267C" style="OLC"><section display-inline="no-display-inline" id="H9E5964AD92FF43FCB1C41A43F3499118" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Wellbeing for Every Public Servant Act of 2021</short-title></quote>.</text></section><section display-inline="no-display-inline" id="H483E35DFAB344E76833312F658D21F8D"><enum>2.</enum><header>Windfall elimination provision restricted to total monthly amounts in excess of COLA-adjusted amount of $5,500</header><text display-inline="no-display-inline">Section 215(a)(7) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/415">42 U.S.C. 415(a)(7)</external-xref>) is amended—</text><paragraph id="HCB39A034D10C44249AB9C7DEB04C5616"><enum>(1)</enum><text>in subparagraph (A), by inserting after <quote>service’),</quote> the following: <quote>if the sum of the individual’s primary insurance amount under paragraph (1) of this subsection and the portion of the monthly periodic payment which is attributable to noncovered service performed after 1956 (with such attribution being based on the proportionate number of years of such noncovered service) is greater than <fraction>1/12</fraction> of the amount established for purposes of subparagraph (B)(iii)(I) under subparagraph (B)(iv), then</quote>;</text></paragraph><paragraph id="H12205536748647209E9B02358342AE09"><enum>(2)</enum><text>in the second sentence of subparagraph (B)(i), by striking <quote>(with such attribution being based on the proportionate number of years of such noncovered service)</quote> and inserting <quote>(as determined under subparagraph (A))</quote>;</text></paragraph><paragraph id="H95E311C50EB148D3958F029D02147E6C"><enum>(3)</enum><text>in the last sentence of subparagraph (B)(i), by striking <quote>the larger of</quote> and all that follows through <quote>subsection (i))</quote> and inserting the following: <quote>the primary insurance amount determined under paragraph (1), reduced (before the application of subsection (i)) by the applicable percentage determined under clause (iii) of the excess of such amount over the larger of the two amounts computed under the preceding two sentences,</quote>; and</text></paragraph><paragraph id="H5F8E3B989D99415EA6B1C98777897974"><enum>(4)</enum><text>by adding at the end of subparagraph (B) the following new clauses:</text><quoted-block id="H8E504C4064A14CB6AEBEF02F10C7E681"><clause id="H956446373AE842AF9AB1B2AD39667F73" indent="up3"><enum>(iii)</enum><text>For purposes of clause (i), the applicable percentage in connection with any individual is the product (not greater than 100 percent) derived by multiplying 2.5 percentage points by the quotient determined under this clause. The quotient determined under this clause is the quotient derived by dividing—</text><subclause id="HA0F08220D01E4DD6B8725CA688214278"><enum>(I)</enum><text>the excess of the sum referred to in subparagraph (A) over <fraction>1/12</fraction> of the amount established for purposes of this subclause under clause (iv), by</text></subclause><subclause id="HA2D3BEA4C949433AADC62F7EABD012F4"><enum>(II)</enum><text><fraction>1/480</fraction> of the excess of the dollar amount established for purposes of this subclause under clause (iv) over the dollar amount established for purposes of subclause (I) under clause (iv),</text></subclause><continuation-text continuation-text-level="clause">rounded to the next higher multiple of 1 where such amount is a multiple of 0.5 and to the nearest multiple of 1 in any other case. </continuation-text></clause><clause id="HF743433FEE18478BA0DA95D743B07A35" indent="up3"><enum>(iv)</enum><text display-inline="yes-display-inline">For individuals whose concurrent entitlement described in subparagraph (A) commences in calendar year 2021, the dollar amounts established for purposes of subclauses (I) and (II) of clause (iii) shall be $66,000 and $76,000, respectively. For individuals whose concurrent entitlement described in subparagraph (A) commences in any calendar year after 2021, each of the amounts so established shall equal the product derived by multiplying the corresponding amount established with respect to calendar year 2021 by the quotient obtained by dividing—</text><subclause id="H18357D19C1DC4F5CBD94AAFC194A81B1"><enum>(I)</enum><text>the national average wage index (as defined in section 209(k)(1)) for the first of the 2 calendar years preceding the calendar year for which the determination is made, by</text></subclause><subclause id="HF47B4D8DBF2E48C3A28231DE938BEBAA"><enum>(II)</enum><text>the national average wage index (as so defined) for 2019.</text></subclause><continuation-text continuation-text-level="clause">Each amount established by this clause for any calendar year shall be rounded to the nearest multiple of $1, except that any amount so established which is a multiple of $0.50 but not of $1 shall be rounded to the next higher multiple of $1.</continuation-text></clause><after-quoted-block>. </after-quoted-block></quoted-block></paragraph></section><section id="H0A76C0D91EFB413087332EBF54E660C2"><enum>3.</enum><header>Effective date</header><text display-inline="no-display-inline">The amendments made by section 2 shall apply with respect to benefits for months after the date of the enactment of this Act. Notwithstanding section 215(f)(1) of the <act-name parsable-cite="SSA">Social Security Act</act-name>, the Commissioner of Social Security shall recompute primary insurance amounts to the extent necessary to carry out the amendments made by section 2.</text></section></legis-body></bill>
