which was referred to the <committee-name committee-id="HII00">Committee on Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Energy Policy Act of 2005 to reauthorize a program to address orphaned, abandoned, or idled wells on Federal land, to establish a program to provide grants to States and Tribes to address orphaned wells, and for other purposes.</official-title></form><legis-body id="H2A383421E32043AD8DB57C5AC2CB3AD9" style="OLC"><section id="HB9411446CE90446DBE76EBE107C73004" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Plugging Orphan Wells and Environmental Restoration Act of 2021</short-title></quote> or the <quote><short-title>POWER Act of 2021</short-title></quote>. </text></section><section id="HECF86BA1183D4B45AB5BEA98CCFD5BDD"><enum>2.</enum><header>Federal lands</header><text display-inline="no-display-inline">Section 349(h)(1) of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/15907">42 U.S.C. 15907(h)(1)</external-xref>) is amended by striking <quote>$25,000,000 for each of fiscal years 2006 through 2010</quote> and inserting <quote>$50,000,000 for each of fiscal years 2022 through 2026</quote>. </text></section><section id="H53F2AAF8B0D841D8B696956764CB5DAA" section-type="subsequent-section"><enum>3.</enum><header>State and Tribal lands</header><subsection id="HEC645E55A5714871BF7D254EF5113988"><enum>(a)</enum><header>State and Tribal orphaned wells</header><paragraph id="HFF2FC33796BA4BBE858D3E12A34203BF"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 90 days after the date of enactment of this Act, the Secretary of the Interior shall establish a program to provide grants to States and Indian Tribes to remediate, reclaim, and close orphaned oil and gas wells located on State, Tribal, or private lands.</text></paragraph><paragraph id="HE3FB43F97BCF4DE6BBA76CA71380C708"><enum>(2)</enum><header>Activities</header><text>Funds distributed under this subsection may be used by States and Indian Tribes for—</text><subparagraph id="H283533E964E442C387ECF735A2DDBB60"><enum>(A)</enum><text>reclaiming, remediating, and closing orphaned wells;</text></subparagraph><subparagraph id="H68E49CA42FBF455ABB6F82722FE82257"><enum>(B)</enum><text>reclaiming and remediating well pads and access roads associated with orphaned wells;</text></subparagraph><subparagraph id="HA1B9CCE787F0483095A687BEBCCD9400"><enum>(C)</enum><text>restoring native species habitat that has been degraded due to the presence of orphaned wells;</text></subparagraph><subparagraph id="H11D1562E9FB4409694F5626FA69E8A9E"><enum>(D)</enum><text>seeking to determine the identities of potentially responsible parties associated with the orphaned well sites, or their sureties or guarantors, to the extent such information can be ascertained, and make efforts to obtain reimbursement for expenditures to the extent practicable;</text></subparagraph><subparagraph id="H4EFD952F06394FB38773E7EC943C9742"><enum>(E)</enum><text>identification and characterization of undocumented orphaned wells on State, Tribal, and private lands;</text></subparagraph><subparagraph id="HAB6907A9B2504441A81982D40519AC3B"><enum>(F)</enum><text>ranking orphaned or abandoned well sites based on factors such as public health and safety, potential environmental harm, and other land use priorities;</text></subparagraph><subparagraph id="HE1C9745D874744F08EA99E50D6B6B56E"><enum>(G)</enum><text>administration of a State or Tribal orphaned well closure program, provided that no more than 10 percent of the funds received by a State or Indian Tribe under this subsection may be used for this purpose; and</text></subparagraph><subparagraph id="HCE23B9AF5D3746A8A1E6977193ADF4A2"><enum>(H)</enum><text>making information regarding the use of funds under this subsection available to the public.</text></subparagraph></paragraph><paragraph id="H9B164FDFBDC44938BBE448463A55B20C"><enum>(3)</enum><header>Priority</header><text>In providing grants under this subsection, the Secretary shall give priority to States and Indian Tribes that have an established State or Tribal program for the remediation, reclamation, or closure of abandoned, idled, or orphaned oil and gas wells.</text></paragraph><paragraph id="H1424E77351FD4B03961DA1F0F9DE8649" commented="no"><enum>(4)</enum><header>Restrictions and requirements</header><subparagraph id="H1C8016C99169492EA78B59FD9867B82D" commented="no"><enum>(A)</enum><header>No new obligations related to the bonding, plugging, or transfer of stripper wells</header><text>No State or Indian Tribe receiving a grant under this subsection may use such grant funds to impose new obligations related to the bonding, plugging, or transfer of stripper wells.</text></subparagraph><subparagraph id="HFB7CCC6C454F48F7AD7EBF24C85BF47D" commented="no"><enum>(B)</enum><header>Procedures for the protection of small businesses</header><text display-inline="yes-display-inline">A State or Indian Tribe receiving a grant under this subsection shall be required to adhere to measures and procedures for the protection of small businesses comparable to those required by the Small Business Regulatory Enforcement Fairness Act of 1996.</text></subparagraph></paragraph><paragraph id="H69A6E060C2C64D1AA4F1D7A0897ABC54"><enum>(5)</enum><header>Application</header><text>States and Indian Tribes shall be eligible for grants under this subsection upon application to the Secretary of the Interior. Such application shall include—</text><subparagraph id="H89CEF4D549164CC49EBACCB9E4EFBAC2"><enum>(A)</enum><text>a prioritized list of the wells, well sites, and affected areas that will be remediated, reclaimed, or closed;</text></subparagraph><subparagraph id="H760B4812788249EC95AF431F5ECBAC07"><enum>(B)</enum><text>a description of the activities to be carried out with the grant, including an identification of the estimated health, safety, habitat, and environmental benefits of remediating, reclaiming, or closing each well, well site, or affected area;</text></subparagraph><subparagraph id="HB181282E8B2941088221E17424779C98"><enum>(C)</enum><text>an estimate of the cost of each proposed project;</text></subparagraph><subparagraph id="H0A6629FC50CE4DC09C8E8F159E8FA42D"><enum>(D)</enum><text>an estimate of the number of jobs that will be created or saved through the projects to be funded under this subsection;</text></subparagraph><subparagraph id="H4BBA14A4536E45408BF7DEB2B7DD3A35"><enum>(E)</enum><text>an estimate of the funds to be spent on administrative costs; and</text></subparagraph><subparagraph id="H6CCBCC934B604D5B9E30D1D23ADAC4FB"><enum>(F)</enum><text>a description of how the information regarding the State’s or Indian Tribe’s activities under this subsection will be made available to the public.</text></subparagraph></paragraph><paragraph id="HA946B0E1651C4B3AB78569547288BBC2"><enum>(6)</enum><header>Allocation</header><text>The Secretary shall, in consultation with States, affected Indian Tribes, and the Interstate Oil and Gas Compact Commission, develop a formula for the amount of grant funding each State or Indian Tribe is eligible for under this subsection, taking into account—</text><subparagraph id="HEE2C5CB08EBD439893B41389A17A827E"><enum>(A)</enum><text>the number of documented orphaned wells within the State or on each Indian Tribe’s lands;</text></subparagraph><subparagraph id="H6FEABCA948034EEFB68737C3E9621153"><enum>(B)</enum><text>the amount of oil and gas activity within the State or on Tribal lands in the previous 10 years; and</text></subparagraph><subparagraph id="HFAB08FC72E134E1998A6F56E5C237298"><enum>(C)</enum><text>the number of jobs lost in the oil and gas sector since March 1, 2020.</text></subparagraph></paragraph></subsection><subsection id="H669EA4EFC8004579A8EC095E59D3AD90"><enum>(b)</enum><header>Technical assistance</header><paragraph id="H920EBCF9EB614B759B1F428B448A8CCC"><enum>(1)</enum><header>In general</header><text>The Secretary of Energy, in cooperation with the Secretary, shall establish a program to provide technical assistance to oil and gas producing States and Indian Tribes to ensure practical and economical remedies for environmental problems caused by orphaned or abandoned oil and gas well sites on State, Tribal, or private land.</text></paragraph><paragraph id="HBE118C3D801847D0A4E387FD5C7D151A"><enum>(2)</enum><header>Assistance</header><text>The Secretary of Energy shall work with the States, through the Interstate Oil and Gas Compact Commission, to assist the States in quantifying and mitigating environmental risks of onshore orphaned or abandoned oil or gas wells on State, Tribal, and private land.</text></paragraph><paragraph id="HF0DAD28EF51E4BEC9F924106D98948DE"><enum>(3)</enum><header>Activities</header><text>The program under paragraph (1) shall include—</text><subparagraph id="H9D810D26AA0E4ADEBBD26FB9F739052C"><enum>(A)</enum><text>mechanisms to facilitate identification, if feasible, of the persons currently providing a bond or other form of financial assurance required under State or Federal law for an oil or gas well that is orphaned or abandoned;</text></subparagraph><subparagraph id="H23CEB6613F984FA7B5087599054FC792"><enum>(B)</enum><text>criteria for ranking orphaned or abandoned well sites based on factors such as public health and safety, potential environmental harm, and other land use priorities;</text></subparagraph><subparagraph id="H0B6DF5DDB9D74460B42771543862E67E"><enum>(C)</enum><text>information and training programs on best practices for remediation of different types of sites; and</text></subparagraph><subparagraph id="HFFA250DDA66F4939ACE79FBEACDCE506"><enum>(D)</enum><text>funding of State mitigation efforts on a cost-shared basis.</text></subparagraph></paragraph></subsection><subsection id="H90F5AF8BFAB34FBF86CA21604412EFC8"><enum>(c)</enum><header>Report to Congress</header><text>Not later than one year after the date of enactment of this section, and every year thereafter, the Secretary shall submit to Congress a report on the programs established under this section, including the number of jobs created and the number of orphaned wells reclaimed.</text></subsection><subsection id="HA30D98CF370142A58118DA87217B36A6"><enum>(d)</enum><header>Liability protection</header><text display-inline="yes-display-inline">A person who provides equipment, materials, or services to plug, or attempt to plug, an orphaned well pursuant to a grant awarded to a State or Indian Tribe under this Act shall be immune from civil liability in any legal proceeding brought to enforce an environmental law or otherwise impose liability for such conduct.</text></subsection><subsection id="HB1661FA667494F82918794EE22EEBAB6"><enum>(e)</enum><header>Definitions</header><text>In this section, the following definitions apply:</text><paragraph id="HDE46E1CC69914AE4B8002EB6E4E3B74F"><enum>(1)</enum><header>Orphaned well</header><text>The term <term>orphaned well</term> means any well not in operation for which there is no responsible party known to the Secretary to reclaim and remediate or close the well site.</text></paragraph><paragraph id="HBAFF58E4F5064AC69777E35CE31E67FD"><enum>(2)</enum><header>Responsible party</header><text>The term <term>responsible party</term> has the meaning given to it by the relevant State, or if the relevant State does not provide a definition, means any person, association, corporation, subsidiary, or affiliate that directly or indirectly, controls, manages, directs, or undertakes the activities with respect to an oil and gas lease or any person or entity controlled by, or under common control with, such person or entity.</text></paragraph><paragraph id="H357E7907B8A741B6B76F18C0D6F5AB61"><enum>(3)</enum><header>Stripper well</header><text display-inline="yes-display-inline">The term <term>stripper well</term> means an onshore facility that produces, in a 12-month consecutive time period—</text><subparagraph id="H822B9458F2F94669BAE0CB4BC24B26A4"><enum>(A)</enum><text>15 barrels per well or less per calendar day of crude oil; or</text></subparagraph><subparagraph id="H76477C6EE408477EB046BE2186B8B6CB"><enum>(B)</enum><text>90,000 cubic feet per calendar day or less of natural gas. </text></subparagraph></paragraph></subsection><subsection id="H64801FBB6CB24EBFAE284DD674D1751E" commented="no"><enum>(f)</enum><header>Appropriations</header><text>There are authorized to be appropriated to the Secretary of the Interior $400,000,000 for each of fiscal years 2021 through 2025 to carry out this section.</text></subsection></section></legis-body></bill>
