R. 4764</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210728">July 28, 2021</action-date><action-desc><sponsor name-id="H001053">Mrs. Hartzler</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HAS00">Committee on Armed Services</committee-name>, and in addition to the Committee on <committee-name committee-id="HED00">Education and Labor</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To prohibit the teaching of critical race theory in schools operated by the Department of Defense Education Activity, and for other purposes.</official-title></form><legis-body id="HC888108B7F9A4DDD893EF5E9E313ED46" style="OLC"><section id="HFBC811205FB94602AC600EF69F55F017" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>No CRT for our Military Kids Act</short-title></quote>.</text></section><section id="HB7A3E9A0730C45D78DE004DA5F8F9491"><enum>2.</enum><header>Prohibition on availability of funds for teaching critical race theory in schools operated by the Department of Defense Education Activity</header><subsection id="H6B5C57785BF34FB9AAEB5BF4AA1092D7"><enum>(a)</enum><header>Prohibition</header><text display-inline="yes-display-inline">None of the funds authorized to be appropriated or otherwise made available for any fiscal year for the Department of Defense Education Activity may be obligated or expended—</text><paragraph id="H2686E8EBA1704E7A8D40D77026B312B5"><enum>(1)</enum><text>to teach critical race theory in any school operated by the Activity; or</text></paragraph><paragraph id="HD5BB3694F9214333A34151F79C97A177"><enum>(2)</enum><text>to develop or distribute any curriculum that incorporates critical race theory.</text></paragraph></subsection><subsection id="H9370071DE46B498FBA774FDA3C6D456F"><enum>(b)</enum><header>Critical race theory defined</header><text>In this Act, the term <term>critical race theory</term> means any theory that promotes one or more of the following:</text><paragraph id="H9F659489EC6F45E9BE5B1E236F41F31F"><enum>(1)</enum><text>That one race is inherently superior to another race.</text></paragraph><paragraph id="H4B75A91A4B32474BBFC8AB0173EDE2B8"><enum>(2)</enum><text>That the United States of America is fundamentally or systemically racist.</text></paragraph><paragraph id="HD21091790CB04413B2E9987BC8B1117E"><enum>(3)</enum><text>That an individual, solely because of the individual’s race, is inherently racist or oppressive, whether consciously or unconsciously.</text></paragraph><paragraph id="H7139EB48A37F49DDB63465AFA8016619"><enum>(4)</enum><text>That an individual should be discriminated against or receive adverse treatment solely or partly because of the individual’s race.</text></paragraph><paragraph id="HA714475B09304AFE8956B06AFF22EFD1"><enum>(5)</enum><text>That members of one race cannot and should not attempt to treat others without respect to race.</text></paragraph><paragraph id="HEB7DCA7F257C4D499B9A985FBCC603BA"><enum>(6)</enum><text>That an individual’s moral character is necessarily determined by the individual’s race.</text></paragraph><paragraph id="H4AFDFE0562064EE1BD3E9FE61608D6F6"><enum>(7)</enum><text>That an individual, by virtue of the individual’s race, bears responsibility for actions committed in the past by other members of the same race.</text></paragraph><paragraph id="H1F5D0F7700E84FCE96C707AA3CBF99CD"><enum>(8)</enum><text>That any individual should feel discomfort, guilt, anguish, or any other form of psychological distress on account of that individual’s race.</text></paragraph><paragraph id="H72DF4876595E4543AB9BFFF22E41FA03"><enum>(9)</enum><text>That meritocracy or traits such as a hard work ethic are racist, or were created by a particular race to oppress another race.</text></paragraph><paragraph id="HB9E69E4C0DA44FA5B3B11F05523B7736"><enum>(10)</enum><text>That any of the founding documents to include the Declaration of Independence, Constitution, or Bill of Rights is inherently racist.</text></paragraph><paragraph id="H95F2C7D25AB14FD79710608E529BD15B"><enum>(11)</enum><text>Any other form of racial scapegoating or racial stereotyping.</text></paragraph></subsection></section></legis-body></bill>
