R. 4763</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210728">July 28, 2021</action-date><action-desc><sponsor name-id="H001090">Mr. Harder of California</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HAG00">Committee on Agriculture</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Secretary of Agriculture to carry out a program to award grants to eligible entities to carry out projects that further agricultural resiliency and modernization, and for other purposes.</official-title></form><legis-body id="H05ACE7E6376348BD87AA14FA9595EA90" style="OLC"><section id="H9D119ED8B7484CD7A028FA2736787EB3" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Future of Agricultural Resiliency And Modernization Act</short-title></quote>.</text></section><section id="HB130F2D55709464F8AE11403AB5CB542"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph id="H2A638FA5DCF14FA3A2AC22609725CFB0"><enum>(1)</enum><text>The evidence for human-induced climate change is undeniable and our agricultural communities are increasingly experiencing the impacts of climate change.</text></paragraph><paragraph id="HA46BFDB66E9A4B5D9B67ADFF3D4C6AD6"><enum>(2)</enum><text>The volatility of weather patterns, ranging from more frequent and severe droughts, floods, and wildfires can negatively impact agricultural productivity.</text></paragraph><paragraph id="HDA26BFD84335454A92D2903012CA6BEC"><enum>(3)</enum><text>Rural communities, that often lack Federal and State resources, are especially vulnerable to the impacts of climate change, such as revenue losses, hours lost at work, and infrastructure damages.</text></paragraph><paragraph id="H234EACC7FC12409EA5A319DA9566797A"><enum>(4)</enum><text>Climate resilient practices and technologies are needed to help save Federal, State, and local taxpayers money. These technologies include manure resource recovery systems, which recover the nutrients contained in organic matter from their source help protect water quality.</text></paragraph><paragraph id="HCCA5A0FCFB4B49C4B97405AB6E9712CB"><enum>(5)</enum><text>The need for measures that promote energy and water use efficiency, conservation, and renewable energy will greatly reduce the adverse impacts of climate change.</text></paragraph><paragraph id="HD8A704D9B46A4A6E85FE44A4EA303532"><enum>(6)</enum><text>Many farmers and agricultural producers are currently utilizing environmentally beneficial practices that also better their production costs.</text></paragraph><paragraph id="HD025ED3753134B5C9DAB408327022747"><enum>(7)</enum><text display-inline="yes-display-inline">Excessive heat exposure poses a direct threat to farm workers and the economy. Climate change increases this danger, as 18 of the 19 hottest years on record have occurred since 2001. Rising temperatures are projected to cause an increase in heat-related workplace injuries, illnesses, loss in labor capacity, and decreased productivity. In light of these findings, the Federal Government has an obligation to protect farmworkers, outdoor workers, and employers in the United States from climate change.</text></paragraph><paragraph id="HE551CCCA991E4D91B33FAB18F878D7B8"><enum>(8)</enum><text display-inline="yes-display-inline">The Department of Agriculture should use research and development programs to make dairy digesters more affordable while mitigating environmental effects. Further, the Department should provide technical assistance, community support, and financial incentives and grants for farmers to partner together to build cooperative digester models. The Department should use cross-agency collaborative models and utilize existing Federal programs, such as the Environmental Protection Agency’s AgSTAR program to increase farmer access and engagement in these efforts. </text></paragraph><paragraph id="HA62DAC9F5D3343E8AE0714724B992CC6"><enum>(9)</enum><text>The Department should engage in partnerships with other Federal agencies to control invasive species, in a manner that protects the environment, infrastructure, and agricultural lands in the United States. </text></paragraph><paragraph id="HD2CAA01319FD4BD2A447A9816D740C2A"><enum>(10)</enum><text>Federal assistance is needed to help farming practices become more resilient and sustainable for the long-term.</text></paragraph></section><section id="H50E83938408744E9BF75168D32B9D34E"><enum>3.</enum><header>Future of Agricultural Resiliency and Modernization fund</header><subsection id="H80EB9B8155F1439BA6FFB1F2D4B0611B"><enum>(a)</enum><header>Establishment</header><text>The Secretary of Agriculture (referred to in this Act as the <quote>Secretary</quote>) shall carry out a program to award grants to eligible entities to carry out projects for a qualified purpose.</text></subsection><subsection id="H502A859803F04925B6EBE46BF7056E00"><enum>(b)</enum><header>Eligible entities</header><text>An entity eligible to receive a grant under this section is—</text><paragraph id="H6AE147B044E14876B893846D2ECC6702"><enum>(1)</enum><text display-inline="yes-display-inline">a Federal agency;</text></paragraph><paragraph id="H84631E79E7A740718943B2D6F2AFB22C"><enum>(2)</enum><text>a State or a group of States;</text></paragraph><paragraph id="H6C28A32B7A3B4383B036760EA8161E8E"><enum>(3)</enum><text>a unit of local government or a group of local governments;</text></paragraph><paragraph id="HFE7EC9A499DD4E86BC45092DEC28F16E"><enum>(4)</enum><text>an irrigation district;</text></paragraph><paragraph id="HC7E2A2B422104622BD3E0D64DB313ADF"><enum>(5)</enum><text>a Tribal government or a consortium of Tribal governments;</text></paragraph><paragraph id="H4942726A915947F4AFF48D55678BDFB6"><enum>(6)</enum><text>a State or regional transit agency or a group of State or regional transit agencies;</text></paragraph><paragraph id="H0419A1EAAC4E4AE8B6847403F936B80F"><enum>(7)</enum><text>a nonprofit organization;</text></paragraph><paragraph id="H3B7D1A75DD934615B98998646BD9BD47"><enum>(8)</enum><text>a special purpose district or public authority; </text></paragraph><paragraph id="H843646DFDD1044D58AFE89C526E7AC10"><enum>(9)</enum><text>a third-party private entity, the primary business of which is related to agriculture (as determined by the Secretary); and </text></paragraph><paragraph id="H871FC56D2BE64DA9B158862B70594ECB"><enum>(10)</enum><text>any other entity, as determined by the Secretary.</text></paragraph></subsection><subsection id="H1EB74E7FD25A458E803B1B5B8E688BED"><enum>(c)</enum><header>Use of funds</header><text>An eligible entity selected to receive a grant under this section may use funds received through the grant to carry out projects that further agricultural resiliency and modernization through—</text><paragraph id="H169CA99B6C9C4C2896EEFEE1E94D8AAE"><enum>(1)</enum><text>reducing greenhouse gas emissions and increasing resilience in the agricultural sector;</text></paragraph><paragraph id="HBDF563195C704BEB82E8788D4152435B"><enum>(2)</enum><text>increasing carbon sequestration;</text></paragraph><paragraph id="HAE168DC632C648718627C52488887C9B"><enum>(3)</enum><text>improving soil health;</text></paragraph><paragraph id="H1DC668D71C5841DFAEC898E3CC74B23F"><enum>(4)</enum><text>providing multiple benefits, including water supply reliability, ecosystem preservation, groundwater management and enhancements, and water quality improvements;</text></paragraph><paragraph id="HD2BF649E8894426EB8E181A655266967"><enum>(5)</enum><text>in accordance with State and Federal law, expediting projects with a focus in renewable energy, including biofuels;</text></paragraph><paragraph id="HD34A894A27A4422EA79FA554A30C3B4F"><enum>(6)</enum><text>incorporating collaborative partnerships that involve local communities in project planning on economic and social benefits of sustainable agricultural production;</text></paragraph><paragraph id="H98A7D14CE078469AA8D4C1995264F0A2"><enum>(7)</enum><text>investing in climate-resilient infrastructure and technology;</text></paragraph><paragraph id="HBA7A19C67ECB498CBAB39736F21D023F"><enum>(8)</enum><text>converting plant wastes into higher value biocarbon products, including practices like pyrolysis;</text></paragraph><paragraph id="HC3A3A8978E31438EBC3EC577025E8D05"><enum>(9)</enum><text display-inline="yes-display-inline">improving air and water quality, including pollutants and odors, with dairy digesters and non-digester manure management practices and technologies; </text></paragraph><paragraph id="H116E530ED7CA4F10929C0457515AF5F7"><enum>(10)</enum><text>supporting clean air, water, climate, and a sustainable environment helping develop local and national resilience strategies against droughts, wildfires, and floods;</text></paragraph><paragraph id="HA4ACBB6291E54EA096AEF0EFD9D3889C"><enum>(11)</enum><text display-inline="yes-display-inline">supporting and funding purchases of cleaner and lower or zero emission agriculture-related equipment like harvesting equipment, heavy-duty trucks, agricultural pump engines, tractors, and other equipment used in agricultural operations; and</text></paragraph><paragraph id="H0FA0A45E68ED4F57AFF471F1186542F8"><enum>(12)</enum><text display-inline="yes-display-inline">increasing research on the most effective methods of eradicating and controlling invasive species and pests, such as nutria and spotted lantern fly.</text></paragraph></subsection><subsection id="HC4586D91CC944D17BF5F474F51D11F61"><enum>(d)</enum><header>Authorization of appropriations</header><text>To carry out this section, there is authorized to be appropriated $500,000,000 for each of fiscal years 2022 through 2026.</text></subsection></section><section id="H17B37E25B590423D8F95BD8D51C62D89"><enum>4.</enum><header>Pyrolysis innovation fund grant program</header><subsection id="H0A268C86BEA64F0697A53A30CE81DC7C"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Agriculture shall establish a program under which the Secretary will award grants to eligible entities to carry out not fewer than 10 pilot projects, with the potential to reduce or sequester greenhouse emissions that convert and valorize tree nut harvest by-products into multiple higher value biocarbon products, including sustainable industrial applications, agrochemicals, repurposing process heat, energy and construction materials.</text></subsection><subsection id="H652AAE9E54B44601B631DCC6071236B2" commented="no"><enum>(b)</enum><header>Eligible entity defined</header><text>The term <quote>eligible entity</quote> means— </text><paragraph id="H5414A06BA8AB4F76BE58517BFCEF3C7D" commented="no"><enum>(1)</enum><text>a third-party private entity, the primary business of which is related to agriculture (as determined by the Secretary);</text></paragraph><paragraph id="HD07C66F7950B45DD85CB611BFA4518A8" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">a nongovernmental organization with experience working with agricultural producers (as determined by the Secretary); and</text></paragraph><paragraph id="H0A9428F4B66041E2941C6C71771CDBE5" commented="no"><enum>(3)</enum><text>a governmental organization.</text></paragraph></subsection><subsection id="HAC4982B839CA43F0A5757243410F7A61"><enum>(c)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than two years after the date on which the first grant is awarded under subsection (a), the Secretary shall submit to the Committee on Agriculture of the House of Representatives and the Committee on Agriculture, Nutrition, and Forestry of the Senate a report on—</text><paragraph id="HA20396E55B6B4E11A6FD1D39C9FE2824"><enum>(1)</enum><text>the activities carried out using grants awarded under such subsection;</text></paragraph><paragraph id="H9726C697FF18473C8BC61909D1298F27"><enum>(2)</enum><text>best practices used to leverage the investment of the Federal Government for the purposes specified in subsection (a); and</text></paragraph><paragraph id="HC91DA46AC0734BA2BF3AF68549DBDCDF"><enum>(3)</enum><text>an assessment of the results achieved by the program established under this section. </text></paragraph></subsection><subsection id="HB4D272E861754343BBCF33DF10EFA90A"><enum>(d)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated to carry out this section $5,000,000 for each of fiscal years 2022 through 2026<italic></italic>.</text></subsection></section></legis-body></bill>
