which was referred to the <committee-name committee-id="HED00">Committee on Education and Labor</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Rehabilitation Act of 1973 to clarify the definition of competitive integrated employment.</official-title></form><legis-body id="HA4817D9FA1ED40A4ADC045D5A2F400AA" style="OLC"><section id="HD36EF87A3A5C4E2B89D43F543C969858" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Workplace Choice and Flexibility for Individuals with Disabilities Act</short-title></quote>.</text></section><section id="H80CC4E00E6AA49E8A536C66B21DD03FF"><enum>2.</enum><header>Clarification of definition of competitive integrated employment</header><text display-inline="no-display-inline">Section 7(5) of the Rehabilitation Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/29/705">29 U.S.C. 705</external-xref>) is amended—</text><paragraph id="H04D1D247253F486BAC11FB3D68FE4D53"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (B)—</text><subparagraph id="HC7E6753492394B8787769B80F536B164"><enum>(A)</enum><text>by striking <quote>not including</quote> and inserting <quote>including social and interpersonal interactions with colleagues, vendors, customers, superiors, or other such persons who the employee may come into contact with during the work day and across workplace settings, other than</quote>;</text></subparagraph><subparagraph id="HA8C6D3DD3EC04804A6ED4F155ABA46FF"><enum>(B)</enum><text>by inserting before the semicolon at the end the following: <quote>, except that such interactions shall not be considered solely at the work unit level</quote>; and</text></subparagraph><subparagraph id="HD5AA5B3C9EE14325BE1571D4CDBAB48F"><enum>(C)</enum><text>by striking <quote>and</quote> at the end;</text></subparagraph></paragraph><paragraph id="H93DB38C6B9544EC5866825E54B507D09"><enum>(2)</enum><text>by striking the period at the end of subparagraph (C) and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="HD3B75C5D65E746D18E9885A5F71D8FE8"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H2BAF658E87B3491C95C23A8D28C709CF" style="OLC"><subparagraph id="HA2D08EC2322B403CB52D5DE01586ED9D"><enum>(D)</enum><text display-inline="yes-display-inline">for which an individual may have been paid—</text><clause id="H6010C7D598A848C9926DAB465A1C914B"><enum>(i)</enum><text>by a contractor—</text><subclause id="HFBD7E96231794B859F629D1754483665"><enum>(I)</enum><text>of the Federal Government under a contract with the Federal Government for which priority was given to the contractor on the basis of the bid of the contractor involving supporting employment for individuals with disabilities; or </text></subclause><subclause id="H36C998508CFC47ECA42A0F9B3DA49C23"><enum>(II)</enum><text display-inline="yes-display-inline">of a State government under a contract with the State government for which priority was given to the contractor on the basis of the bid of the contractor involving supporting employment for individuals with disabilities; </text></subclause></clause><clause id="H2B1CDB9232214373B0B3CD1295ED2C0F"><enum>(ii)</enum><text display-inline="yes-display-inline">by a subcontractor at any tier of a contractor—</text><subclause id="H8E44B9C5FEB445118682E527E04043F8"><enum>(I)</enum><text display-inline="yes-display-inline">of the Federal Government under a subcontract for which priority was given to the subcontractor on the basis of the bid of the subcontractor involving supporting employment for individuals with disabilities; or</text></subclause><subclause id="HC6B516D383BC4B6F82D8B6F5380E74AA"><enum>(II)</enum><text display-inline="yes-display-inline">of a State government under a subcontract for which priority was given to the subcontractor on the basis of the bid of the subcontractor involving supporting employment for individuals with disabilities; or </text></subclause></clause><clause id="H24D9B6883DD84C8EA0319B1EFDA2FBE8"><enum>(iii)</enum><text display-inline="yes-display-inline">under a contract mandating direct labor-hour ratio of individuals with disabilities.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section commented="no" id="H04C0BD4718F3483C8781890C4D24CD6B"><enum>3.</enum><header>Rule of construction</header><text display-inline="no-display-inline">Nothing in the amendments made by this Act shall be construed to reduce the number of jobs available for referral by a State agency or other entity.</text></section><section commented="no" id="H75C9308D595541ACBA9A6C6A2644E948"><enum>4.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that jobs meeting the definition in section 7(5)(B) of the Rehabilitation Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/29/705">29 U.S.C. 705</external-xref>), and which derive from Federal or State contracts managed by community rehabilitation programs for the purposes of supporting employment for people with disabilities, shall be eligible to be considered—</text><paragraph id="HB673B11484CC4EFD8602D80B7A6DFCA8"><enum>(1)</enum><text>part of the competitive labor market; and</text></paragraph><paragraph id="H5CD96B5BCD3240E6A70BE9712414156F"><enum>(2)</enum><text>an employment outcome for State vocational rehabilitation purposes.</text></paragraph></section></legis-body></bill>
