R. 4751</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210728">July 28, 2021</action-date><action-desc><sponsor name-id="C001101">Ms. Clark of Massachusetts</sponsor> (for herself, <cosponsor name-id="P000614">Mr. Pappas</cosponsor>, <cosponsor name-id="D000629">Ms. Davids of Kansas</cosponsor>, and <cosponsor name-id="J000306">Mr. Jones</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HED00">Committee on Education and Labor</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Department of Education Organization Act and the Higher Education Act of 1965 to require publication of information relating to religious exemptions to the requirements of title IX of the Education Amendments of 1972, and for other purposes.</official-title></form><legis-body id="H9486CA0F0F494FFA8DBBF551A22EAA08" style="OLC"><section commented="no" id="H8955F5726B714ADD99B3E35CB34B9113" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Exposing Discrimination in Higher Education Act</short-title></quote>.</text></section><section id="H8E2D49AB38964ABBBE97FB7F2D07BFEF"><enum>2.</enum><header>Publication on website of the Department of Education</header><text display-inline="no-display-inline">Section 203 of the Department of Education Organization Act (<external-xref legal-doc="usc" parsable-cite="usc/20/3413">20 U.S.C. 3413</external-xref>) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H5A5A79A8C4AE41A2A971092F0B44324B" style="OLC"><subsection id="HB89C723BCC4A4C868F1FF7172CE4F488"><enum>(d)</enum><text display-inline="yes-display-inline">The Assistant Secretary for Civil Rights shall publish, on the Department’s website, in a prominent location, information regarding religious exemptions to the requirements of title IX of the Education Amendments of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/20/1681">20 U.S.C. 1681 et seq.</external-xref>) in accord with this paragraph. Such information shall include a list naming each institution of higher education that requests such an exemption, the name of each such institution that has received an exemption, and the nature and scope of that exemption (including each program or activity covered by the exemption and the personal characteristics or behaviors to which the exemption applies).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H3DDE1B36147F4707A98FFB2431A448EB"><enum>3.</enum><header>Publication on website of each institution of higher education</header><text display-inline="no-display-inline">Section 485 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1092">20 U.S.C. 1092</external-xref>) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H796A26466EFB4FA1A7AC96F31FB5D93A" style="OLC"><subsection id="H7C038F47A4044C928A9E1ED26E3F4CB5"><enum>(n)</enum><header>Disclosure of religious exemptions to title IX of the Education Amendments of 1972</header><text display-inline="yes-display-inline">Each institution of higher education participating in any program under this title that requests, receives, or exercises or intends to exercise a religious exemption to the requirements of title IX of the Education Amendments of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/20/1681">20 U.S.C. 1681 et seq.</external-xref>) shall submit in writing to the Assistant Secretary a statement by the highest ranking official of the institution, identifying the provisions of part 106 of title 34 of the Code of Federal Regulations that conflict with a specific tenet of the religious organization and shall publish on its website, in a prominent location, the following:</text><paragraph id="H16B640877DEA4E0FBB246C11BA37E697"><enum>(1)</enum><header>Request letter</header><text display-inline="yes-display-inline">Each letter submitted by the educational institution to the Department to request such an exemption.</text></paragraph><paragraph id="HCBFD9DCB3CEA4D00BD5F712DA1C4C0E3"><enum>(2)</enum><header>Exemption letter</header><text display-inline="yes-display-inline">Each letter from the Department to the educational institution that grants or denies such an exemption.</text></paragraph><paragraph commented="no" id="HD051FBDA96B94E7E91866BAC489F05D5"><enum>(3)</enum><header>Notice of request</header><text display-inline="yes-display-inline">Notice that the educational institution has requested an exemption under section 901(a)(3) of the Education Amendments of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/20/1681">20 U.S.C. 1681(a)(3)</external-xref>).</text></paragraph><paragraph commented="no" id="H0307E017E9874F7E83CF13EADDD280A4"><enum>(4)</enum><header>Notice of exemption</header><text display-inline="yes-display-inline">If applicable, notice that the educational institution has received an exemption under section 901(a)(3) of the Education Amendments of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/20/1681">20 U.S.C. 1681(a)(3)</external-xref>).</text></paragraph><paragraph commented="no" id="H5F01C65BFC4B4DC0B1E866A8EA4E9C6E"><enum>(5)</enum><header>Covered personal characteristics or behaviors</header><text display-inline="yes-display-inline">A list of the personal characteristics or behaviors to which each requested or granted exemption applies.</text></paragraph><paragraph commented="no" id="H9DBD62239D7F4AB0907DEAC01F98D934"><enum>(6)</enum><header>Covered activities or programs</header><text display-inline="yes-display-inline">A list of the activities or programs to which each exemption applies.</text></paragraph><paragraph id="H69826226939949AAA880C02A78E26354"><enum>(7)</enum><header>Statement of rights</header><text display-inline="yes-display-inline">The statement <quote>Students continue to have rights under title IX of the Education Amendments of 1972. Any student who experiences discrimination may contact the Office for Civil Rights at the United States Department of Education at _____ or _____.</quote>, with the first blank space being filled with a link to the website of the Office for Civil Rights and the second blank space being filled with the telephone number of the Office for Civil Rights.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
