R. 4746</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210728">July 28, 2021</action-date><action-desc><sponsor name-id="C001117">Mr. Casten</sponsor> (for himself and <cosponsor name-id="M001203">Mr. Malinowski</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Federal Power Act with respect to the rehearing process, and for other purposes.</official-title></form><legis-body id="H7B2A2463DD884EADBD8D6BBD05FACC8A" style="OLC"><section id="H1BA917A59AFC4FD1AF6B2F7B4317B3D4" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Right to Timely Rehearings at FERC Act of 2021</short-title></quote>.</text></section><section id="H3B9E6A15AAA045E5AB57F66AF5C1B9F7"><enum>2.</enum><header>Federal Power Act rehearings</header><text display-inline="no-display-inline">Section 313(a) of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/825l">16 U.S.C. 825l(a)</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" id="HB26BB873F1DE4DB8BAF50DC6084D335A" display-inline="no-display-inline"><subsection id="H8BF47ECC9EC94FDD97B885251889AF05"><enum>(a)</enum><header>Rehearings</header><paragraph id="HBAB2B343103F4452B996B1A92AB059E8"><enum>(1)</enum><header>In general</header><text>Any person, electric utility, State, municipality, or State commission aggrieved by an order issued by the Commission in a proceeding under this Act to which such person, electric utility, State, municipality, or State commission is a party may apply for a rehearing within 30 days after the issuance of such order. The application for rehearing shall set forth specifically the ground or grounds upon which such application is based. Upon such application the Commission shall have power to grant or deny rehearing or to abrogate or modify its order without further hearing. No proceeding to review any orders of the Commission shall be brought by any entity unless such entity shall have made application to the Commission for a rehearing thereon. Until the record in a proceeding shall have been filed in a court of appeals, as provided in subsection (b), the Commission may at any time, upon reasonable notice and in such manner as it shall deem proper, modify or set aside, in whole or in part, any finding or order made or issued by it under the provisions of this act.</text></paragraph><paragraph id="H86629164FD5943A698A73B957483BDDA"><enum>(2)</enum><header>Deadline</header><subparagraph id="HB563E78902944ED48F7401551FFADA0C"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in subparagraph (B), the Commission shall act on the merits of an application filed under paragraph (1) by the date that is 120 days after the date on which the applicable order is issued.</text></subparagraph><subparagraph id="HC7F4FA933542485EAF1E8FF47941F637"><enum>(B)</enum><header>Exceptions</header><clause id="H642D7CDA6AD44F12ACE2C55EB499ECC5"><enum>(i)</enum><header>Finding</header><text display-inline="yes-display-inline">If, by the date that is 120 days after the date on which the applicable order is issued, the Commission issues a finding that additional time for consideration of an application filed under paragraph (1) is necessary, the Commission shall act on the merits of the application by the date that is 210 days after the date on which the applicable order is issued. The Commission may not delegate the authority to issue a finding under this clause.</text></clause><clause id="H54D8E6143B9D462DB7EE27DE4E9E523F"><enum>(ii)</enum><header>Lack of quorum</header><text display-inline="yes-display-inline">If the Commission fails to act on the merits of an application filed under paragraph (1) by the applicable deadline under clause (i) or subparagraph (A) because the Commission lacks a quorum on such date, the Commission shall act on the merits of the application by the date that is 30 days after the date on which the Commission establishes a quorum.</text></clause></subparagraph><subparagraph id="H6843D70737D84FD097654D806BFF2714"><enum>(C)</enum><header>Failure to act</header><text display-inline="yes-display-inline">If the Commission fails to act on the merits of an application filed under paragraph (1) by the applicable deadline under subparagraph (A) or (B), the application shall be deemed to be denied.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
