which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To provide assistance to Afghan nationals who have suffered persecution based on their occupation, and for other purposes.</official-title></form><legis-body id="H36C459E9B60A4EF986F479CC57E24B49" style="OLC"><section id="H7CB371DF42A54661B72CE7E40863507D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Improving Access for Afghan Refugees Act</short-title></quote>.</text></section><section id="HDDF59269F9BF4FD9B3CB5B0782999F78"><enum>2.</enum><header>Afghan refugees of special humanitarian concern</header><subsection id="H432E3D81B4AE4941B58B7A060E0C79B2"><enum>(a)</enum><header>In general</header><text>The Secretary of State, in consultation with the Secretary of Homeland Security, shall designate as Priority 2 refugees of special humanitarian concern the following individuals:</text><paragraph id="H50CD7289A51A4303B3FA0B6068F7583D"><enum>(1)</enum><text display-inline="yes-display-inline">Individuals who—</text><subparagraph id="H8D5ED67608F84354B1851576970B991F"><enum>(A)</enum><text>are or were habitual residents of Afghanistan;</text></subparagraph><subparagraph id="HF94E82A3A71F4BD4AC0C2E483A9CD542"><enum>(B)</enum><text>are nationals of Afghanistan or stateless persons;</text></subparagraph><subparagraph id="HAE226711BAEF4A92A22C9D6E715D00C2"><enum>(C)</enum><text>have suffered persecution or have a well-founded fear of persecution; and</text></subparagraph><subparagraph id="HBBEDA6A24DD8420E9306DABD795C8E4D"><enum>(D)</enum><text>share common occupational characteristics that identify them as targets of persecution in Afghanistan on account of race, religion, nationality, membership in a particular social group, or political opinion, as determined by the Secretary of State, including the following:</text><clause id="H63A3A887D0C045FCB1C4C35C5A672ECC"><enum>(i)</enum><text>Civil servants.</text></clause><clause id="HEE3F93B5CC9042C1B285E0DE67A2F97C"><enum>(ii)</enum><text display-inline="yes-display-inline">Public officials and government personnel, including members of the peace negotiation team.</text></clause><clause id="H8696FE17C2AF415586429A635731532F"><enum>(iii)</enum><text>Human rights defenders.</text></clause><clause id="HABB88CA667234F45ABC9AF6D815B3996"><enum>(iv)</enum><text>Women’s rights defenders.</text></clause><clause id="H272D9168F38B4364BE7A0DBB65BD530E"><enum>(v)</enum><text>Journalists and media personnel.</text></clause><clause id="H74D2F755356644B1BC281A0FDFB73120"><enum>(vi)</enum><text>Legal professionals.</text></clause></subparagraph></paragraph><paragraph id="HB8D140357ECA4A5697CCA631477F0DF3"><enum>(2)</enum><text display-inline="yes-display-inline">Individuals who—</text><subparagraph id="HD0A4D131234E4D18B55F3F577E80073C"><enum>(A)</enum><text>are or were habitual residents of Afghanistan;</text></subparagraph><subparagraph id="HCAC4E4B98593455798307CB71429E0F0"><enum>(B)</enum><text>are nationals of Afghanistan or stateless persons; and</text></subparagraph><subparagraph id="H4AFE7C1E8F78415088B820C45F0B0D19"><enum>(C)</enum><text>were employed in Afghanistan for an aggregate period of not less than 1 year by—</text><clause id="HE2A0EBEF59BD4349B990C7CD3B41335E"><enum>(i)</enum><text>a media or nongovernmental organization based in the United States; or</text></clause><clause id="HEA63A54410D44E84A3BD8E8C2930D1CA"><enum>(ii)</enum><text>an organization or entity that has received a grant from, or entered into a cooperative agreement or contract with, the United States Government.</text></clause></subparagraph></paragraph><paragraph id="HE595C13EDF0645E3866C0367D1A16CCA"><enum>(3)</enum><text display-inline="yes-display-inline">Individuals who—</text><subparagraph id="H21BC6334582D42359082AD14619D6C2C"><enum>(A)</enum><text>are or were habitual residents of Afghanistan;</text></subparagraph><subparagraph id="HA7CE7C5A6066457E9DEC2A057949FFF7"><enum>(B)</enum><text>are nationals of Afghanistan or stateless persons; and</text></subparagraph><subparagraph id="H3B2ADA35EB4C420EA25F4FA88B8D89D7"><enum>(C)</enum><text>are beneficiaries of an approved I–130 Petition for Alien Relative.</text></subparagraph></paragraph></subsection><subsection id="H39E6703C06A44CF88D640106C60B13A6"><enum>(b)</enum><header>Processing of Afghan refugees</header><text display-inline="yes-display-inline">The processing of individuals who are or were habitual residents of Afghanistan, are nationals of Afghanistan or stateless persons, and have suffered persecution, or have a well-founded fear of persecution, for classification as refugees may occur in Afghanistan or in a third country.</text></subsection><subsection id="H843487C0A07B43D3BDDA11EFB441E04E"><enum>(c)</enum><header>Eligibility for admission as a refugee</header><text>An alien may not be denied the opportunity to apply for admission as a refugee under this section solely because such alien qualifies as an immediate relative of a national of the United States or is eligible for admission to the United States under any other immigrant classification.</text></subsection><subsection id="H5F37ED86362B4E839C6DCACFA46173CE"><enum>(d)</enum><header>Identification of other persecuted groups</header><text display-inline="yes-display-inline">The Secretary of State, or the designee of the Secretary, is authorized to classify other groups of individuals who are or were nationals and residents of Afghanistan as Priority 2 refugees of special humanitarian concern.</text></subsection><subsection id="HA204FEAEC400499DB19E3DC9F48D9E67"><enum>(e)</enum><header>Satisfaction of other requirements</header><text>Aliens designated as Priority 2 refugees of special humanitarian concern under this section shall be deemed to satisfy the requirements under section 207 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1157">8 U.S.C. 1157</external-xref>) for admission to the United States.</text></subsection><subsection id="HE17CBFBF8D60481CB42763F4730DC9AE"><enum>(f)</enum><header>Timeline for processing applications</header><paragraph id="HFC81E56053FD485A80A5A216053D4952"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of State and the Secretary of Homeland Security shall ensure that all steps under the control of the United States Government incidental to the approval of such applications, including required screenings and background checks, are completed not later than 6 months after the date on which an eligible applicant submits an application under subsection (a).</text></paragraph><paragraph id="H0E40BDDE16FF4851875E4C5AE698E251"><enum>(2)</enum><header>Exception</header><text display-inline="yes-display-inline">Notwithstanding paragraph (1), the United States Refugee Admission Program may take additional time to process applications described in paragraph (1) if satisfaction of national security concerns requires such additional time, if the Secretary of Homeland Security, or the designee of the Secretary, has determined that the applicant meets the requirements for status as a refugee of special humanitarian concern under this section and has so notified the applicant.</text></paragraph></subsection><subsection id="HC2A8EBC25AE146FE9EE343C45A2EFC72"><enum>(g)</enum><header>Additional forms of immigration relief</header><text display-inline="yes-display-inline">The Secretary of State shall consider additional forms of immigration relief available to Afghans and coordinate with embassies, nongovernmental organizations, and the United Nations High Commissioner for Refugees to receive referrals for individuals who—</text><paragraph id="HC1B6B76AD7924B9184293114C9DB90EB"><enum>(1)</enum><text>are or were habitual residents of Afghanistan;</text></paragraph><paragraph id="HD42A6D0B34DF4E0383900AB5D6508A02"><enum>(2)</enum><text>are nationals of Afghanistan or stateless persons; and</text></paragraph><paragraph id="HD886A8CEC6EF46D1B13E9DE57267FDA2"><enum>(3)</enum><text>are described in subsection (a) or otherwise face humanitarian concerns.</text></paragraph></subsection></section></legis-body></bill>
