which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To extend the deadline for eligible health care providers to use certain funds received from the COVID–19 Provider Relief Fund, and for other purposes.</official-title></form><legis-body id="H2614366F4DA34EB8B91BCA63432AD550" style="OLC"><section id="H73D313BBD76A4374B391C4FA6C41AABE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Provider Relief Fund Deadline Extension Act</short-title></quote>.</text></section><section id="HA7F86A5BBD97499C8896CF073DB5C781"><enum>2.</enum><header>Extension of deadline for eligible health care providers to use certain funds received from the COVID–19 Provider Relief Fund</header><subsection id="HAF04A593DA1D491A979C4EC71922F3D3"><enum>(a)</enum><header>Extension of deadline</header><paragraph id="HF7142238C88348C0828247F4B9C89D20"><enum>(1)</enum><header>Payment received period 1</header><text>Effective June 29, 2021, the deadline by which an eligible health care provider is required to use reimbursements from the Provider Relief Fund received by such provider during the covered payment received period shall be extended until the later of—</text><subparagraph id="H2B4293B51D014606ACE69A0B40D0E6D9"><enum>(A)</enum><text>the end of the COVID–19 public health emergency period; or</text></subparagraph><subparagraph id="HB4660FB82F604B5D9FE3FA1D75CA0AF9"><enum>(B)</enum><text>December 31, 2021.</text></subparagraph></paragraph><paragraph id="HBC0A7D86541544FE82B7439AA7818E84"><enum>(2)</enum><header>Adjustment of reporting time period</header><text>The Secretary of Health and Human Services shall make appropriate adjustments to the reporting time period established by the Secretary that is applicable to eligible health care providers with respect to the use of reimbursements from the Provider Relief Fund received during the payment received period to reflect the deadline established in paragraph (1) for the use of such reimbursements received during such payment received period.</text></paragraph></subsection><subsection id="H55F5B7B7F65E4A14B858D4063DCAE634"><enum>(b)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H4AE2BA44952A4ABB9342133ACFC96EA1"><enum>(1)</enum><header>Covered payment received period</header><text>The term <quote>covered payment received period</quote> means, with respect to the Payment Received Periods referred to in the Provider Relief Fund Guidance, the payments beginning on April 10, 2020, and ending on June 30, 2020.</text></paragraph><paragraph id="H1EB89F73E6B841C0B97820010AA1E2EE"><enum>(2)</enum><header>COVID–19 public health emergency period</header><text>The term <quote>COVID–19 public health emergency period</quote> means the emergency period described in section 1135(g)(1)(B) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1320b-5">42 U.S.C. 1320b–5(g)(1)(B)</external-xref>).</text></paragraph><paragraph id="H9C4541DDCFDF433F9ED67DB317EFE9E3"><enum>(3)</enum><header>Eligible health care provider</header><text>The term <quote>eligible health care provider</quote> has the meaning given such term in the third proviso of the third paragraph under the heading <quote>Department of Health and Human Services—Office of the Secretary—Public Health and Social Services Emergency Fund</quote> in division B of the CARES Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/136">Public Law 116–136</external-xref>).</text></paragraph><paragraph id="HF16BEF2530E54EC8B1D385C8A55181BE"><enum>(4)</enum><header>Provider relief fund</header><text>The term <quote>Provider Relief Fund</quote> means the program to prevent, prepare for, and respond to COVID–19, domestically or internationally, for necessary expenses to reimburse, through grants or other mechanisms, eligible health care providers for health care related expenses or lost revenues that are attributable to COVID–19 for which appropriations are made—</text><subparagraph id="HAB10F580397C47139DBDC7BCDBA413E4"><enum>(A)</enum><text>under the heading <quote>Department of Health and Human Services—Office of the Secretary—Public Health and Social Services Emergency Fund</quote> in title VIII of division B of the CARES Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/136">Public Law 116–136</external-xref>); and</text></subparagraph><subparagraph id="H88BA2D2F0A6B4B7D9DCC674C8D456D71"><enum>(B)</enum><text>under the heading <quote>Department of Health and Human Services—Office of the Secretary—Public Health and Social Services Emergency Fund</quote> in title I of division B of the Paycheck Protection Program and Health Care Enhancement Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/139">Public Law 116–139</external-xref>).</text></subparagraph></paragraph><paragraph id="HB75BC64C54994E3F9AF092E431D32EC8"><enum>(5)</enum><header>Provider relief fund guidance</header><text>The term <quote>Provider Relief Fund Guidance</quote> refers to the guidance entitled <quote>Provider Relief Fund General and Targeted Distribution Post-Payment Notice of Reporting Requirement</quote> and issued by the Secretary of Health and Human Services on June 11, 2021.</text></paragraph></subsection></section></legis-body></bill>
