which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To deem certain voyages transporting passengers between ports or places within the United States in compliance with certain requirements upon calling on a port owned by an Indian Tribe, and for other purposes.</official-title></form><legis-body id="HFEA226EF349048B29B8834BEB99E4B15" style="OLC"><section id="HAA573F881D7E4BD49005ABBB4A9D10C5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Tribal Tourism Sovereignty Act</short-title></quote>.</text></section><section id="H48A7E08F93A94979A2AA056EF52CA7EB"><enum>2.</enum><header>Designation of ports and port calls on Indian lands</header><subsection id="H8A55150C1C9E425EADB3ECA360FE70FC"><enum>(a)</enum><header>Criteria</header><text>For the purposes of complying with section 55103 of title 46, United States Code, voyages transporting passengers between ports or places in the United States shall be deemed in compliance with such section upon calling on a port or place owned by an Indian Tribe, if the voyage—</text><paragraph id="HCCB55023868A4966A18E8E0AC7B5DF6D"><enum>(1)</enum><text>is made by a covered passenger vessel to which sections 3507 and 3508 of title 46, United States Code, apply; and</text></paragraph><paragraph id="HBC9874B22F5448D9A7F7B0F0056C614D"><enum>(2)</enum><text>employs alien crewman issued nonimmigrant visas pursuant to subparagraph (C) of (D) of section 101(a)(15) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)</external-xref>).</text></paragraph></subsection><subsection id="H507518787B364557A08F57EEFEB1A0AE"><enum>(b)</enum><header>Applicability</header><paragraph id="HED3BE7FEF03C49DE94AE9F1742B9EB1B"><enum>(1)</enum><header>In general</header><text>Voyages conducted under subsection (a) shall originate in a port or place in the United States and terminate in a port or place in the United States.</text></paragraph><paragraph id="H715B95922CA1444F8AF2871F0B893488"><enum>(2)</enum><header>Compliance</header><text>For purposes of complying with subsection (a), a covered passenger vessel performing voyages under subsection (a) shall comply with the following:</text><subparagraph id="H1E9BCD8F0BC94316B22854878E11E989"><enum>(A)</enum><text>Receive permission through a tribal resolution or formal agreement from the applicable Indian Tribe to dock at a port or place owned by such Indian Tribe and disembark passengers on the tribal lands of such Tribe.</text></subparagraph><subparagraph id="HF0AE1BCA24E242FF912DFB8BE51B8CBF" commented="no"><enum>(B)</enum><text>The agreement—</text><clause id="HD7C0FC70A1FF4CF1A8959316DDDA8308" commented="no"><enum>(i)</enum><text>shall grant such covered passenger vessels access to such port; and</text></clause><clause id="HA5F61C60F7D54580AC5135BC79D502A8" commented="no"><enum>(ii)</enum><text>may provide authority to disembark passengers and crew on such lands and describe permissible activities for such passengers and crew. </text></clause></subparagraph><subparagraph id="HA9B90FD1B26549C8B34DF8D71783D619" commented="no"><enum>(C)</enum><text>Such covered passenger vessels, crews, and passengers shall comply with all applicable Tribal laws and regulations, including health and safety laws and regulations for the duration of such vessels, crews, and passenger’s time on Tribal land.</text></subparagraph></paragraph></subsection><subsection id="H4671E0028F904C09AB55933038610E6D"><enum>(c)</enum><header>Tribal powers and privileges</header><text>For voyages and port calls described in subsections (a) and (b), Tribes—</text><paragraph id="H48BF84E090E34684962A3010FCC5BFEB"><enum>(1)</enum><text>shall have the sole authority to make or terminate agreements described in subsection (b) at any time;</text></paragraph><paragraph id="H3D04D347B9CC47EBB1CC98B14F086DEB"><enum>(2)</enum><text>shall have the authority to levy and collect fees from port calls made by covered passenger vessels performed under subsection (a); and</text></paragraph><paragraph id="H09250BEBC50F43A8B617479A40152F4D"><enum>(3)</enum><text>shall receive the right of first refusal to provide contracts and services to covered passenger vessels described in subsection (a) for the duration of the port call.</text></paragraph></subsection><subsection id="H1D8CEFB3361E4CE7B43A7809BD46883D"><enum>(d)</enum><header>Rule of Construction</header><text>For purposes of complying with subsection (a), ports owned by Indian Tribes located on land adjacent to navigable coastal waters shall be considered a foreign port for purposes of section 55103 of title 46, United States Code.</text></subsection><subsection id="H463BEA95688E4278B555448198DFD13F"><enum>(e)</enum><header>Definitions</header><text>In this Act:</text><paragraph id="HAF90A7C3298C46A5A531E24027D513E1"><enum>(1)</enum><header>Covered passenger vessel</header><text>The term <term>covered passenger vessel</term> means a passenger vessel to which sections 3507 and 3508 of title 46 United States Code apply.</text></paragraph><paragraph id="H36C46DCAD2B74B96BA7B141F5333F70F"><enum>(2)</enum><header>Indian tribe</header><text>The term <term>Indian Tribe</term> means—</text><subparagraph id="HCE64FC1BBD1541C199F3AE61E791D021"><enum>(A)</enum><text display-inline="yes-display-inline">any federally recognized Indian tribe, band, nation, village, or other organized group or community; and</text></subparagraph><subparagraph id="H3C07F94FE9E54FA4A207A63E5D1368B0"><enum>(B)</enum><text display-inline="yes-display-inline">any Alaska Native village or regional or village corporation as defined in or established pursuant to the Alaska Native Claims Settlement Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1601">43 U.S.C. 1601 et seq.</external-xref>).</text></subparagraph></paragraph><paragraph id="H637A1732086E4170AADA7D4B794E45E2"><enum>(3)</enum><header>Port call</header><text>The term <term>port call</term> means the docking of a covered passenger vessel described in subsection (a)(1) at a port controlled by an Indian Tribe, regardless of the act of embarking or disembarking passengers.</text></paragraph><paragraph id="H5DDDC2DB429044A899A61B514102FB8D"><enum>(4)</enum><header>Port owned by an Indian Tribe</header><text>The term <term>port owned by an Indian Tribe</term> means a port that is owned and controlled by an Indian Tribe and located on land owned and controlled by such Tribe.</text></paragraph></subsection></section></legis-body></bill>
