Davis of Illinois</cosponsor>, <cosponsor name-id="P000614">Mr. Pappas</cosponsor>, and <cosponsor name-id="B001285">Ms. Brownley</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HVR00">Committee on Veterans' Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 38, United States Code, to codify the authority of the Secretary of Veterans Affairs to assign a disability rating of total to a veteran by reason of unemployability, and for other purposes.</official-title></form><legis-body id="H8C33CC70D5E545CE84201CFFCEAA4D9D" style="OLC"><section id="H9B19FE2324D84E3288F510A5E1300D98" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Benefits for Disabled Veterans Act of 2021</short-title></quote>.</text></section><section id="HE71B3680327C458FB83433418D312578" section-type="subsequent-section"><enum>2.</enum><header>Codification of individual unemployability</header><subsection id="HF6E6F1B760674F9F90E534F28D71AA02"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/11">Chapter 11</external-xref> of title 38, United States Code, as amended by the Johnny Isakson and David P. Roe, M.D. Veterans Health Care and Benefits Improvement Act of 2020 (<external-xref legal-doc="public-law" parsable-cite="pl/116/315">Public Law 116–315</external-xref>), is amended by inserting after section 1165 the following:</text><quoted-block display-inline="no-display-inline" id="H1DB0DF47542D401AA94997F8C869D6EB" style="USC"><section id="HB09B156F4F3F492F8C0116E357767C6A"><enum>1166.</enum><header>Determination of total disability by reason of unemployability</header><subsection id="HD5A9297AF4DA43EDA539B0E23710FE76"><enum>(a)</enum><header>Authority</header><text display-inline="yes-display-inline">Subject to subsections (b) and (c), for the purposes of this chapter, in the case of a veteran who has a service-connected disability, or service-connected disabilities, not rated as total, the Secretary may assign a disability rating of total to the veteran if the Secretary determines the veteran—</text><paragraph id="HB85B5392EA71450391FFCFB2B31A9687"><enum>(1)</enum><text>is unable to secure or maintain substantially gainful employment as a result of, in part or in whole, a service-connected disability; and</text></paragraph><paragraph id="H99ADF5A890F04B4284BC9A6E5E6945B2"><enum>(2)</enum><text display-inline="yes-display-inline">has—</text><subparagraph id="HD0E910A6521546679C6EF75DC309D030"><enum>(A)</enum><text>a service-connected disability rated at least 60 percent; or</text></subparagraph><subparagraph commented="no" id="HCAE9F411EF2A4DF3B9589E78EFFA7053"><enum>(B)</enum><text display-inline="yes-display-inline">two or more service-connected disabilities—</text><clause commented="no" id="H42A4E578F93042B1BAA060867DEF68BB"><enum>(i)</enum><text>at least one of which is rated at least 40 percent; and</text></clause><clause commented="no" id="H0D6F044EACEF4D588F74C8C10BC45E13"><enum>(ii)</enum><text>that, combined, are rated at least 70 percent.</text></clause></subparagraph></paragraph></subsection><subsection id="HC2CFBB0E4DA140CD850DCE637C6221C0"><enum>(b)</enum><header>Determination of certain disabilities</header><text display-inline="yes-display-inline">For the above purpose of service-connected disabilities described in subsection (a)(2), the Secretary shall consider as one disability the following:</text><paragraph id="H789ECA88CD8C49AE9228F1A63DD0FDF6"><enum>(1)</enum><text>Disabilities of one or both upper extremities, or of one or both lower extremities, including the bilateral factor, if applicable.</text></paragraph><paragraph id="HDCED7EADBC324303AFB3811C912D158F"><enum>(2)</enum><text>Disabilities resulting from common etiology or a single accident.</text></paragraph><paragraph id="H1D82F985EE0D431BA8A2039C92E25451"><enum>(3)</enum><text>Disabilities affecting a single body system (including orthopedic, digestive, respiratory, cardiovascular-renal, and neuropsychiatric).</text></paragraph><paragraph id="H282B8B1C7FFE4F8C80FD07D24094325D"><enum>(4)</enum><text>Disabilities incurred or aggravated as a prisoner of war.</text></paragraph></subsection><subsection commented="no" id="H515BE57FAB3F47E8BAE2DAEFF045905B"><enum>(c)</enum><header>Additional authority of the Secretary To assign a disability rating of total</header><text display-inline="yes-display-inline">The Secretary may assign a disability rating of total to a veteran who has a service-connected disability or disabilities described in subsection (a)(2)—</text><paragraph commented="no" id="H6C7BDBC02411496283E1462AA69D831D"><enum>(1)</enum><text>if the veteran maintains marginal employment; or</text></paragraph><paragraph commented="no" id="HB10C7D76FA8349D1AC61EBA44D152208"><enum>(2)</enum><text>if—</text><subparagraph commented="no" id="H596A28E1C3F14B31959485B8EEE2B85C"><enum>(A)</enum><text display-inline="yes-display-inline">the veteran maintains substantially gainful employment; and</text></subparagraph><subparagraph commented="no" id="H07CFECF80E8C49D183839EBECECE8E0A"><enum>(B)</enum><text>the Secretary, considering the totality of circumstances (including total household medical expenses and the cost of living in the area in which the veteran resides), determines that such assignation is appropriate.</text></subparagraph></paragraph></subsection><subsection commented="no" id="H6315873448BD47D9BCD3EEE000BEF7FF"><enum>(d)</enum><header>Prohibition on the consideration of certain factors</header><text display-inline="yes-display-inline">In making any determination under subsection (a) or (c), the Secretary may not consider the following:</text><paragraph commented="no" id="H12B9BBFAF8C444AFA57115F30E706930"><enum>(1)</enum><text>The age of a veteran.</text></paragraph><paragraph commented="no" id="HEE995242086E459C9550FABB15C7EDF5"><enum>(2)</enum><text>The eligibility of a veteran for any retirement benefit, including any benefit under title II of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/401">42 U.S.C. 401 et seq.</external-xref>).</text></paragraph></subsection><subsection id="HA3E7E023C5B84B21A318736982A73CB3"><enum>(e)</enum><header>Definitions</header><text>In this section:</text><paragraph commented="no" id="HAA2AB23959E945EFA00435F0CD7FF563"><enum>(1)</enum><text display-inline="yes-display-inline">The term <quote>marginal employment</quote> means employment for which the earned annual income is less than 100 percent of the official poverty threshold for an individual established by the United States Census Bureau.</text></paragraph><paragraph id="H9CF317A097904F9B897A41E06BEA4887"><enum>(2)</enum><text display-inline="yes-display-inline">The term <quote>substantially gainful employment</quote> means employment for which the earned annual income equals or exceeds 100 percent of the official poverty threshold for an individual established by the United States Census Bureau.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HE6A866A780F4435A84D972A2ABBD97F0"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of such chapter is amended by adding after the item relating to section 1165 the following:</text><quoted-block display-inline="no-display-inline" id="H5F3775F72C114F2EACACBB5DCA8377BE" style="USC"><toc regeneration="no-regeneration"><toc-entry level="section">1166. Determination of total disability by reason of unemployability.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H71F96CEEDFFE4FA985779DA1D560D605"><enum>(c)</enum><header>Regulations</header><text display-inline="yes-display-inline">Not later than 180 days after the effective date of this Act, the Secretary of Veterans Affairs shall prescribe such regulations as may be necessary to carry out this section.</text></subsection></section></legis-body></bill>
