which was referred to the <committee-name committee-id="HBA00">Committee on Financial Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Housing and Community Development Act of 1974 to set aside community development block grant amounts in each fiscal year for grants to local chapters of veterans service organizations for the renovation, rehabilitation, and modernization of local chapter facilities.</official-title></form><legis-body id="H136B3F63003244B080B00311FB49614E" style="OLC"><section id="H704496B5867047BC8EC3314A72104F31" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Veterans Service Organization Modernization Act of 2021</short-title></quote>.</text></section><section id="HA058C4D73CE94C4AB2FE7370160A91B2"><enum>2.</enum><header>Competitive grants to veterans service organizations for facility rehabilitation and modernization</header><subsection id="H2B6DB1B6EB664064951A3594A86C1290"><enum>(a)</enum><header>Grants</header><text display-inline="yes-display-inline">Section 107 of the Housing and Community Development Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5307">42 U.S.C. 5307</external-xref>) is amended by adding at the end the following new subsection:</text><quoted-block style="OLC" id="HDAF403D5A38843E68C87F34ABAD4776D" display-inline="no-display-inline"><subsection id="H941568A0B6D04D439EF132C85BACDA4E"><enum>(g)</enum><header>Competitive grants to veterans service organizations for facility rehabilitation and upgrading technology</header><paragraph id="HD581E27B8B9647E3A782216B6DA6F7D4"><enum>(1)</enum><header>Authority; eligible activities and uses</header><text display-inline="yes-display-inline">Using the amounts made available under section 106(a)(4) in each fiscal year for grants under this subsection, the Secretary shall make grants, on a competitive basis, to eligible veterans service organizations, which grant amounts shall be available for use only for—</text><subparagraph id="H153295FA80134E55A456CB51F5E0B468"><enum>(A)</enum><text>repairs or rehabilitation of existing facilities of such organizations; and</text></subparagraph><subparagraph id="H03F54A92683643DDBBC333D0B75EB8DB"><enum>(B)</enum><text>modernization of technologies used by such organizations.</text></subparagraph></paragraph><paragraph id="H0E25FE4C5903439EBA6AF2C5F8E95C16"><enum>(2)</enum><header>Eligible veterans service organizations</header><text>For purposes of this subsection, the term <quote>eligible veterans service organization</quote> means—</text><subparagraph id="HFFB83BF84FB74C3E9A938121707FDB9C"><enum>(A)</enum><text display-inline="yes-display-inline">an entity that—</text><clause id="HCD482F2D81CB4465A34C2EF86CBDFB8E"><enum>(i)</enum><text>is organized on a local or area basis; and</text></clause><clause id="HA516D6D4506940A7BFEF570C62AD4DB7"><enum>(ii)</enum><text>is—</text><subclause id="H81A7B197C88F4893A3794BC4BA80F76B"><enum>(I)</enum><text>exempt from taxation pursuant to <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)(19)</external-xref> of the Internal Revenue Code of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/26/501">26 U.S.C. 501(c)(19)</external-xref>); or</text></subclause><subclause id="H62FD67A4CA0B4FE483BBE710B037E900"><enum>(II)</enum><text display-inline="yes-display-inline">an organization of past or present members of the Armed Forces of the United States that is chartered under title 36, United States Code; and</text></subclause></clause></subparagraph><subparagraph id="H5C8E73F24DED40BD94C93531F163CB98"><enum>(B)</enum><text>a local or area chapter, post, or other unit of a national, regional, Statewide, or other larger entity of which local or area chapters, posts, or units are members—</text><clause id="HEA01B11B029A4F728110D24371B5511E"><enum>(i)</enum><text>that is exempt from taxation pursuant to <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)(19)</external-xref> of the Internal Revenue Code of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/26/501">26 U.S.C. 501(c)(19)</external-xref>); or</text></clause><clause id="H100803178FBB44CDB68F373E5C0EF5BA"><enum>(ii)</enum><text display-inline="yes-display-inline">which larger entity is an organization of past or present members of the Armed Forces of the United States that is chartered under title 36, United States Code.</text></clause></subparagraph></paragraph><paragraph id="H2DFC80A926A44C789338AD9F62F07532"><enum>(3)</enum><header>Limitations</header><subparagraph id="H3E16FB09A67B41B4A2C273F60D35531A"><enum>(A)</enum><header>Amount</header><text display-inline="yes-display-inline">No eligible veterans service organization may receive grant amounts under this subsection, from the amounts made available for any single fiscal year, in an amount exceeding the lesser of—</text><clause id="H32CFC02DAFA749768D3D57BF41EE4A9E"><enum>(i)</enum><text>the aggregate cost of the proposed activities and uses under paragraph (1) for which the grant amounts will be used; or</text></clause><clause id="H6E35B89C363C40D4AFABFA2C533A55C0"><enum>(ii)</enum><text>$100,000.</text></clause></subparagraph><subparagraph id="H472CC5B32DC444FF88B208DF62675DF6"><enum>(B)</enum><header>Timing</header><text>Any eligible veterans service organization that receives grant amounts under this subsection from amounts made available for a fiscal year shall be ineligible for any grant from any amounts made available for such grants for any of the succeeding three fiscal years.</text></subparagraph></paragraph><paragraph id="H0637EB7D95D24AEABCBEC7E6B2E01394"><enum>(4)</enum><header>Applications</header><text>Applications for assistance under this subsection may be submitted only by eligible veterans service organizations, and shall be in such form and in accordance with such procedures as the Secretary shall establish. Such applications shall include a plan for the proposed repair or rehabilitation activities to be conducted using grant amounts under this subsection.</text></paragraph><paragraph id="HC446FB99DA42430FAC225536352EA274"><enum>(5)</enum><header>Selection; criteria</header><text>The Secretary shall select applications to receive grants under this subsection pursuant to a competition and based on criteria for such selection, which shall include—</text><subparagraph id="HFDE8584521CF41A9903D8BCBA072094D"><enum>(A)</enum><text>the extent of need for such assistance;</text></subparagraph><subparagraph id="H3C293002A7D840D0AAA597201FFE021A"><enum>(B)</enum><text>the quality of the plan proposed for repair or rehabilitation of the facility involved;</text></subparagraph><subparagraph id="HD473D51520C24ED191E4D07AB686DCF3"><enum>(C)</enum><text>the capacity or potential capacity of the applicant to successfully carry out the plan; and</text></subparagraph><subparagraph id="HE1DA0571D83B44AFA8B372A76323E243"><enum>(D)</enum><text>such other factors as the Secretary determines to be appropriate.</text></subparagraph></paragraph><paragraph id="HA0B94644D045460486168270A1F32548"><enum>(6)</enum><header>Prohibition of construction or acquisition</header><text>No amounts from a grant under this subsection may be used for the construction or acquisition of a new facility.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H69D7FBD212FA40D9859D10B28D42D635"><enum>(b)</enum><header>Funding</header><text display-inline="yes-display-inline">Subsection (a) of section 106 of the Housing and Community Development Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5306">42 U.S.C. 5306(a)</external-xref>) is amended—</text><paragraph id="H0AAF99BC74244F62A2620ECEB27795B3"><enum>(1)</enum><text>in paragraph (4), by striking <quote>and (3)</quote>' and inserting <quote>(3), and (4)</quote>;</text></paragraph><paragraph id="HC054E3C4D5634485B4F85AB8A57DE3E4"><enum>(2)</enum><text>by redesignating paragraph (4) as paragraph (5); and</text></paragraph><paragraph id="H9180C0C4692E4B83A1713558F153E901"><enum>(3)</enum><text>by inserting after paragraph (3) the following new paragraph:</text><quoted-block style="OLC" id="H0EF6160CB5774097BF39CA1E39D2AC54" display-inline="no-display-inline"><paragraph id="H34094B8BB6144056A789D2F06C213921"><enum>(4)</enum><text display-inline="yes-display-inline">For each fiscal year, after reserving amounts under paragraphs (1) and (2) and allocating amounts under paragraph (3), the Secretary shall allocate $10,000,000 (subject to sufficient amounts remaining after such reservations and allocation) for grants under section 107(g).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H988396A00BF24AB184217536AB9796C8"><enum>(c)</enum><header>Regulations</header><text display-inline="yes-display-inline">The Secretary of Housing and Urban Development shall issue any regulations necessary to carry out sections 106(a)(4) and 107(g) of the Housing and Community Development Act of 1974, as added by the amendments made by this section, not later than the expiration of the 90-day period beginning on the date of the enactment of this Act.</text></subsection></section></legis-body></bill>
