which was referred to the <committee-name committee-id="HED00">Committee on Education and Labor</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Fair Labor Standards Act of 1938 to reduce the standard workweek from 40 hours per week to 32 hours per week, and for other purposes.</official-title></form><legis-body id="HAAD7FFB5000B4A65B3C553BCFFD6C8D8" style="OLC"><section id="H03C8C6E52B72483DBCF3DE167D659C33" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Thirty-Two Hour Workweek Act</short-title></quote>.</text></section><section id="H24ECFEBE43844488862E2287727813D3"><enum>2.</enum><header>Fair Labor Standards Act</header><text display-inline="no-display-inline">The Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/201">29 U.S.C. 201 et seq.</external-xref>) is amended—</text><paragraph id="H060BD7A69BE047FE9674567615925036"><enum>(1)</enum><text display-inline="yes-display-inline">in section 7(a) (<external-xref legal-doc="usc" parsable-cite="usc/29/207">29 U.S.C. 207(a)</external-xref>)—</text><subparagraph id="HCCB44DBF34B84EE99CF0AF9B78C80557"><enum>(A)</enum><text>in paragraph (1)—</text><clause id="H9655A862BF6842748D383D1912BFA818"><enum>(i)</enum><text>by striking <quote>commerce, for a workweek longer than forty hours</quote> and all that follows through the period and inserting <quote>commerce—</quote>; and</text></clause><clause id="H348F2FBB24734285B6B77E3F794E8172"><enum>(ii)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="HCC9BE1879FE04BDD98E678A8B6CBEB48" display-inline="no-display-inline"><subparagraph id="H481767A53D0E46438660F7617AD29C61"><enum>(A)</enum><text display-inline="yes-display-inline">for a workweek longer than thirty-two hours unless such employee receives compensation for his employment in excess of the hours above specified at a rate not less than one and one-half times the regular rate at which he is employed; and</text></subparagraph><subparagraph id="H941589DDBFB3425EA677AE6E15CD4483"><enum>(B)</enum><text display-inline="yes-display-inline">for a workday longer than—</text><clause id="HDDDEEFCE80784E10BD022C5F6C5FB84B"><enum>(i)</enum><text>eight hours unless such employee receives compensation for his employment in excess of the hours above specified at a rate not less than one and one-half times the regular rate at which he is employed; and</text></clause><clause id="H22BBF2E2F74143FA847E87441BACB395"><enum>(ii)</enum><text display-inline="yes-display-inline">twelve hours unless such employee receives compensation for his employment in excess of the hours above specified at a rate not less than double times the regular rate at which he is employed.</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="HB86CCFC7DF8647FDA6C8B7BD98D698BC"><enum>(B)</enum><text>in paragraph (2)—</text><clause id="H7C2C7B8B4DAA4CD7A9A6D58EA7D6D418"><enum>(i)</enum><text>in the matter that precedes subparagraph (A), by striking <quote>Fair Labor Standards Amendments of 1966</quote> and inserting <quote>Thirty-Two Hour Workweek Act</quote>; and</text></clause><clause id="H1D6E589BB86A48109CB051F00C91B0BB"><enum>(ii)</enum><text>by striking subparagraphs (A) through (C) and inserting the following:</text><quoted-block style="OLC" id="H5E2630E6F8B44841B92A8049DB1D5226" display-inline="no-display-inline"><subparagraph id="HF7280DE86BCC4801BFC60671BDF130A5"><enum>(A)</enum><text display-inline="yes-display-inline">for a workweek longer than thirty-eight hours during the 1-year period beginning not less than 180 days after the date of the enactment of the Thirty-Two Hour Workweek Act,</text></subparagraph><subparagraph id="H644262B076A44E7FBE933D77B5D906DE"><enum>(B)</enum><text display-inline="yes-display-inline">for a workweek longer than thirty-six hours during the second year after the first day of such period,</text></subparagraph><subparagraph id="HE29F0A4B8178489684F65A8DB1D64A66"><enum>(C)</enum><text display-inline="yes-display-inline">for a workweek longer than thirty-four hours during the third year after the first day of such period, or</text></subparagraph><subparagraph id="H9E96727B611545EC8A54A1F8621FF285"><enum>(D)</enum><text display-inline="yes-display-inline">for a workweek longer than thirty-two hours after the expiration of the third year after the first day of such period,</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph></paragraph><paragraph id="HEFBD1BDD6EC749BCBFB9BEAFFB927353"><enum>(2)</enum><text display-inline="yes-display-inline">in section 18(a) (<external-xref legal-doc="usc" parsable-cite="usc/29/218">29 U.S.C. 218(a)</external-xref>) by inserting <quote>or workday</quote> after <quote>workweek</quote> in each place it occurs.</text></paragraph></section></legis-body></bill>
