which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To prohibit the unauthorized possession of a firearm at a Federal election site.</official-title></form><legis-body id="H2BA4BB9C50564808A9EC2AFFB65E94DC" style="OLC"><section id="H3722F01093EF47FDAC738004099253A0" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Vote Without Fear Act</short-title></quote>.</text></section><section id="H7CD0CE0F670C4D3EA6F6E7781EB40FB1"><enum>2.</enum><header>Prohibition on unauthorized firearm possession at a Federal election site</header><subsection id="HF54C2DF93D0D48CFAA4A21A9562F9309"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/44">Chapter 44</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" id="HE8DB0137D25342DBB8648B0B45E01013" display-inline="no-display-inline"><section id="HCDA7842E1F87411A8C91EF3B70CC2AEB"><enum>932.</enum><header>Prohibition on unauthorized firearm possession at a Federal election site</header><subsection id="H3AFDF65F7E2A4C6E9060E45924BF6B00"><enum>(a)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H7500C5FC07A34A5BB3D813E853EF11D5"><enum>(1)</enum><text display-inline="yes-display-inline">Except as provided in paragraph (2), whoever knowingly possesses or causes to be present a firearm in, or within 100 yards of an entrance to, a place that the individual knows, or has reasonable cause to believe, is a Federal election site, or attempts to do so, shall be fined under this title, imprisoned not more than 1 year, or both.</text></paragraph><paragraph id="HCC9F19727F1543D293E5934C366246E5" indent="up1"><enum>(2)</enum><text>Paragraph (1) shall not apply to—</text><subparagraph id="H7D20C27163B743AD8F923690A07E1A27"><enum>(A)</enum><text display-inline="yes-display-inline">the possession of a firearm by a law enforcement officer employed by the United States, a State, or a political subdivision thereof, or a private security guard hired or arranged for by the owner or manager of a building in which there is a Federal election site, who is authorized by law to possess a firearm and who is on duty;</text></subparagraph><subparagraph id="HB8C50F0CF18C4C21A93B5FD8627B5E8F"><enum>(B)</enum><text display-inline="yes-display-inline">the possession of a firearm in a vehicle within 100 yards of an entrance to a Federal election site, if the firearm is not removed from the vehicle or brandished while the vehicle is in, or within 100 yards of the entrance to, a Federal election site; or</text></subparagraph><subparagraph id="H3B24873A5A884DCC951267223F54F608"><enum>(C)</enum><text>the otherwise lawful possession of a firearm in a place of residence, in a place of business, or on private property, in or within 100 yards of an entrance to a Federal election site.</text></subparagraph></paragraph></subsection><subsection id="HFAB77D775BFF47068973009E6677A195"><enum>(b)</enum><text display-inline="yes-display-inline">Whoever, with intent that a firearm be used in the commission of a crime, knowingly possesses or causes to be present the firearm in, or within 100 yards of an entrance to, a place that the individual knows, or has reasonable cause to believe, is a Federal election site, or attempts to do so, shall be fined under this title, imprisoned not more than 5 years, or both.</text></subsection><subsection id="H39A4A108C57C43609B39265F0E2E249B"><enum>(c)</enum><text>A person who kills any person in the course of a violation of subsection (a) or (b), or in the course of an attack on a Federal election site, involving the use of a firearm, or attempts or conspires to do so, shall be punished as provided in sections 1111, 1112, 1113, and 1117.</text></subsection><subsection id="HB6209376BF634C6087FC8227C26D512B"><enum>(d)</enum><text>In this section, the term <quote>Federal election site</quote> means a building or any part thereof at which an employee of the United States, a State, or a political subdivision thereof is engaged in—</text><paragraph id="H880CE9D164B84BE8A50E9C0DA253EE78"><enum>(1)</enum><text>the administration of a polling place in an election for Federal office; or</text></paragraph><paragraph id="H355799B5904C47509AB330C58DF1E611"><enum>(2)</enum><text>the processing or counting of ballots cast in such an election.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H23C9820161F3448ABA94B53790673254"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections for such chapter is amended by adding at the end the following new item:</text><quoted-block style="OLC" id="HB06C0B2FAF124150A5D772B8A7168CE4" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">932.
