<section id="H92EBEE97510F4DDAB3FE272D2061ED06" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Mature Technology Node Resiliency and Manufacturing Act of 2021</short-title></quote>.</text></section> <section id="H7B02C13EF15C4F4CA99351855B237CF5"><enum>2.</enum><header>Assistance for mature technology nodes</header> <paragraph id="HC28DB90A2A264595B28CF2ED20008E14"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">There is appropriated $2,000,000,000 for fiscal year 2022 to implement section 9902 of <external-xref legal-doc="public-law" parsable-cite="pl/116/283">Public Law 116–283</external-xref> to provide Federal financial assistance to covered entities to incentivize investment in facilities and equipment in the United States for the fabrication, assembly, testing, or advanced packaging of semiconductors at mature technology nodes.</text></paragraph>
<paragraph id="H73B50EB8B9D9412FA33171FB7100BEDD"><enum>(2)</enum><header>Criteria for assistance</header><text>In addition to the procedures, eligibility, and considerations for review specified in subsection (a)(2) of <external-xref legal-doc="public-law" parsable-cite="pl/116/283">Public Law 116–283</external-xref>, in order for an entity to qualify to receive Federal financial assistance under this section, the covered entity shall—</text> <subparagraph id="H161882A3194843C78C2067FDCF325DAD"><enum>(A)</enum> <clause commented="no" display-inline="yes-display-inline" id="H2B0392159E9644DB8981B4ACF9BEC1FB"><enum>(i)</enum><text>provide equipment or materials for the fabrication, assembly, testing, or advanced packaging of semiconductors at mature technology nodes in the United States; or</text></clause>
<clause id="H5938A82642B84233BD6C67F80DACCADC" indent="up1"><enum>(ii)</enum><text>fabricate, assemble using advanced packaging, or test semiconductors at mature technology nodes in the United States; and</text></clause></subparagraph> <subparagraph id="H58DC689EA0964823ADB698ECC714A6A1"><enum>(B)</enum><text>commit to using any Federal financial assistance received under this section to increase the production of semiconductors at mature technology nodes.</text></subparagraph></paragraph>
<paragraph id="H2789EB31A36F4BD68455B25D351EC504"><enum>(3)</enum><header>Additional criteria</header><text>In addition to the considerations described in subsection 9902(a)(2)(C) of <external-xref legal-doc="public-law" parsable-cite="pl/116/283">Public Law 116–283</external-xref>, in granting Federal financial assistance under this section, the Secretary may consider whether a covered entity produces or supplies equipment or materials used in the fabrication, assembly, testing, or advanced packaging of semiconductors at mature technology nodes that are necessary to support a critical manufacturing industry.</text></paragraph> <paragraph id="H3DB1EEEBAFB04A0D8EF317A463142D7F"><enum>(4)</enum><header>Priority</header><text>In awarding Federal financial assistance to covered entities under this section, the Secretary shall give priority to covered entities that support the resiliency of semiconductor supply chains for critical manufacturing industries in the United States.</text></paragraph>
<paragraph id="H48B4C572B67D4B11AF4BBE02C80C7CFC"><enum>(5)</enum><header>Definition of critical manufacturing industry</header><text>In this section, the term <quote>critical manufacturing industry</quote>—</text> <subparagraph id="H680F20EE8C1C49B9806305A6AD511DAD"><enum>(A)</enum><text>means an industry that is assigned a North American Industry Classification System code beginning with 31, 32, or 33, and for which the industry components that are assigned a North American Industry Classification System code beginning with the same 4 digits as the industry—</text>
<clause id="HC32C9174E6BB49F2802A726AC6CDF4C4"><enum>(i)</enum><text>manufacture primary products and parts, the sum of which account for not less than 5 percent of the manufacturing value added by industry gross domestic product of the United States; and</text></clause> <clause id="H10CA32BB8360461C99E658B0B3CE9ECC"><enum>(ii)</enum><text>employ individuals for primary products and parts manufacturing activities that, combined, account for not less than 5 percent of manufacturing employment in the United States; and</text></clause></subparagraph>
<subparagraph id="HCBF199BB00EA436B8ADEB87AF7B47B49"><enum>(B)</enum><text>may include any other manufacturing industry designated by the Secretary based on the relevance of the manufacturing industry to the national and economic security of the United States, including the impacts of job losses.</text></subparagraph></paragraph> <paragraph id="H8A16E3AB1D0241ABB427A6FA8DFE560C"><enum>(6)</enum><header>Definition of mature technology node</header><text>In this section, the term <quote>mature technology node</quote> has the meaning given the term by the Secretary of Commerce.</text></paragraph></section>
