which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Federal Food, Drug, and Cosmetic Act to establish the Office of Food Safety Reassessment, and for other purposes.</official-title></form><legis-body id="H1D156FF061B94407B323D00E7FC8D97C" style="OLC"><section id="HFF26490A087A4FC98BA13188C657B8FE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Food Chemical Reassessment Act of 2021</short-title></quote>. </text></section><section id="H40823D1E6B3448DB8DB2AE1E1EFBD3C7"><enum>2.</enum><header>Office of Food Safety Reassessment</header><text display-inline="no-display-inline">Chapter X of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/391">21 U.S.C. 391</external-xref>) is amended by adding at the end the following: </text><quoted-block style="OLC" id="H2F7197EDD43D475C9B7D530436DC4D0A" display-inline="no-display-inline"><section id="H023FCBA7BAEA4467AEF21866BEE31BCF"><enum>1015.</enum><header>Office of Food Safety Reassessment</header><subsection id="H1B0CE9F09DC64D329D3C80CAA86F8CDF"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than one year after the date of the enactment of the Food Chemical Reassessment Act of 2021, the Secretary shall establish within the Center for Food Safety and Applied Nutrition, an office to be known as the Office of Food Safety Reassessment (referred to in this section as the <quote>Office</quote>), to conduct, for purposes of ensuring that food additives, food contact substances, substances generally recognized as safe for use in food<italic></italic>, and prior-sanctioned substances<italic></italic> or classes thereof are safe within the meaning of section 409, reassessments of the safety of such substances.</text></subsection><subsection id="HF754548A3A82418DB0BB7F73EC22C4F2"><enum>(b)</enum><header>Safety reassessments</header><text display-inline="yes-display-inline">Not less frequently than once every three years <italic></italic>beginning with 2022, the Office shall—</text><paragraph id="H76D52345D2B94875A7F7E1F9430190C6"><enum>(1)</enum><text>reassess the safety of not less than ten of the food additives, substances, or classes of substances referred to in subsection (a); and</text></paragraph><paragraph id="HFAFF41768DF34DE0B40F50D8C1279750"><enum>(2)</enum><text>issue final regulations—</text><subparagraph id="H6D7351CB9892438B9ACC64EFA189B42D"><enum>(A)</enum><text display-inline="yes-display-inline">determining that any such substance or class of substance is safe within the meaning of section 409 and establishing the conditions of use, if any, under which any such substance or class of substances can be used safely within the meaning of such section; or</text></subparagraph><subparagraph id="HA6F78B1F38EA46AD8F56DB0545C288B3"><enum>(B)</enum><text>determining that any such substance or class of substances is unsafe within the meaning of such section.</text></subparagraph></paragraph></subsection><subsection id="HA0616D7CA64C4AEEA157524F39EA5B17"><enum>(c)</enum><header>First substances subject to reassessment</header><text display-inline="yes-display-inline">The first ten substances or classes of substances reassessed by the Secretary under subsection (b) are the following:</text><paragraph id="H90011A5B3E884C208544A9415ADA9232"><enum>(1)</enum><text display-inline="yes-display-inline">Perfluoroalkyl substances and polyfluoroalkyl substances.</text></paragraph><paragraph id="HF8837D78EE7A472DAB7121BE3A0F75E8"><enum>(2)</enum><text display-inline="yes-display-inline">Ortho-phthalates.</text></paragraph><paragraph id="H00F38CD7B9454200981323EBE05A1C0D"><enum>(3)</enum><text>Tert-butylhydroquinone.</text></paragraph><paragraph id="H2E986F74E71C49A48E8D4789611323B1"><enum>(4)</enum><text>Titanium dioxide.</text></paragraph><paragraph id="H8577CEE4A2AC4EBCB4F1C2F77EC10421"><enum>(5)</enum><text>Potassium bromate.</text></paragraph><paragraph id="HD187694151E14AEAAC347545A6AC9DAB"><enum>(6)</enum><text>Perchlorate.</text></paragraph><paragraph id="HB7724B09ECE94984884D8C797DB11D40"><enum>(7)</enum><text>Butylated hydroxyanisole (BHA).</text></paragraph><paragraph id="HBEE8C6E2486D4F2EBECD80E89A56257A"><enum>(8)</enum><text>Butylated hydroxytoluene (BHT).</text></paragraph><paragraph id="H82FC017E75424553A9AD9DA55D931B51"><enum>(9)</enum><text>Brominated vegetable oil (BVO).</text></paragraph><paragraph id="H22DD2F71FF8B484899D926AF4DEA3C30"><enum>(10)</enum><text>Propyl paraben.</text></paragraph></subsection><subsection id="HB8C1D87375884DF4A3425BA560DB0684"><enum>(d)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing in this section alters the authority or duties of the Secretary with respect to the administration and enforcement of section 409.</text></subsection><subsection id="HF218D6F451D1413185B6A28B6366ABE3"><enum>(e)</enum><header>Food advisory committee</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of the Food Chemical Reassessment Act of 2021, the Secretary shall re-establish the Food Advisory Committee to advise the Secretary with respect to—</text><paragraph id="HE645747E8B404A12B6485C02672189E5"><enum>(1)</enum><text>the standards for reassessments conducted under this section; and </text></paragraph><paragraph id="H7F156520471B400F8A9A02370209E724"><enum>(2)</enum><text>the process and methods necessary to complete the work of the Office.</text></paragraph></subsection><subsection id="H4E66E985EADC4046A2B886DF582DC79A"><enum>(f)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H0344A81744E442F19D0E70233D39E066"><enum>(1)</enum><text display-inline="yes-display-inline">The term <quote>food contact substance</quote> has the meaning given such term in section 409(h)(6). </text></paragraph><paragraph id="HA55A1B1F9DEE41DC82CB9F33EBEE1A16"><enum>(2)</enum><text>The term <quote>generally recognized as safe for use in food</quote> means, with respect to a substance used in food, that the substance is generally recognized, among experts qualified by scientific training and experience to evaluate its safety, as having been adequately shown through scientific procedures (or, in the case of a substance used in food prior to January 1, 1958, through either scientific procedures or experience based on common use in food) to be safe under the conditions of its intended use, as described in section 201(s).</text></paragraph><paragraph id="HCE781AA8D3D5479098BE3DEFEBEF3589"><enum>(3)</enum><text>The term <quote>prior-sanctioned substance</quote> means a substance described in paragraph (4) of section 201(s). </text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
