R. 4683</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210726">July 26, 2021</action-date><action-desc><sponsor name-id="B001299">Mr. Banks</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HVR00">Committee on Veterans' Affairs</committee-name>, and in addition to the Committee on <committee-name committee-id="HAS00">Armed Services</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To establish a process for the testing and evaluation of the Electronic Health Record Modernization Program of the Department of Veterans Affairs by the Director of Operational Test and Evaluation of the Department of Defense.</official-title></form><legis-body id="H78F04F5DEB0C4CEA9C532FC788F68E0C" style="OLC"><section id="H260193A2A45241B4ADB8C4D093BCBA5B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Department of Veterans Affairs Electronic Health Record Testing Improvement Act</short-title></quote>.</text></section><section id="H156CAF5A971847719650AC3C004A2D03" section-type="subsequent-section"><enum>2.</enum><header>Testing and evaluation of Electronic Health Record Modernization Program of the Department of Veterans Affairs</header><subsection id="H653C53A66E88407CB64FC3F882147A7B"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The OTE Director shall test and evaluate the Electronic Health Record Modernization Program—</text><paragraph id="H7D3C9B54551241E3A808A2CF14D54A56"><enum>(1)</enum><text>at the request of the Secretary of Veterans Affairs; and</text></paragraph><paragraph id="HB4566B41D0E648A4881B3725A83D5DB7"><enum>(2)</enum><text display-inline="yes-display-inline">not less frequently than the interval at which the OTE Director tests or evaluates the Defense Healthcare Management System Modernization Program of the Department of Defense.</text></paragraph></subsection><subsection id="H64E004FDDB8A410F99C24BEEA2D7C51C" display-inline="no-display-inline"><enum>(b)</enum><header>Information exchange</header><text>The FEHRM Director shall facilitate the exchange of information between the OTE Director and the Secretary of Veterans Affairs for the purposes of carrying out subsection (a).</text></subsection><subsection id="HE2B01C9DFE44481AA1B1BF03145C23E9"><enum>(c)</enum><header>Reporting</header><text display-inline="yes-display-inline">Not later than 30 days after completing a test or evaluation of the Electronic Health Record Modernization Program, the FEHRM Director shall submit to the Committees on Veterans’ Affairs of the Senate and House of Representatives and the Secretary of Veterans Affairs the test or evaluation report.</text></subsection><subsection id="H31EDB7BD749C49A780B5CF9011F0EFB9"><enum>(d)</enum><header>Reimbursement</header><text display-inline="yes-display-inline">The Secretary of Veterans Affairs shall reimburse the Secretary of Defense for costs necessary to perform such tests and evaluations by the OTE Director.</text></subsection><subsection id="HB9CB603AEBA9491998FF9E1E1373E4C2"><enum>(e)</enum><header>Definitions</header><text>In this Act:</text><paragraph id="HBA6F7C2384684B4297C0876BCBCFCF1E"><enum>(1)</enum><text display-inline="yes-display-inline">The term <quote>Electronic Health Record Modernization Program</quote> has the meaning given that term in section 503 of the Veterans Benefits and Transition Act of 2018 (<external-xref legal-doc="public-law" parsable-cite="pl/115/407">Public Law 115–407</external-xref>; 38 U.S.C. note prec. 5701).</text></paragraph><paragraph id="HD2D8A5337BB84DDD8721C2A8ACDE3F50"><enum>(2)</enum><text display-inline="yes-display-inline">The term <quote>FEHRM Director</quote> means the Director of the Federal Electronic Health Record Modernization Office appointed under section 1635(c) of the Wounded Warrior Act (title XVI of <external-xref legal-doc="public-law" parsable-cite="pl/110/181">Public Law 110–181</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/10/1071">10 U.S.C. 1071</external-xref> note).</text></paragraph><paragraph id="H61A7535FE6B74044BD8C8B5F05421C99"><enum>(3)</enum><text display-inline="yes-display-inline">The term <quote>OTE Director</quote> means the Director of Operational Test and Evaluation of the Department of Defense.</text></paragraph></subsection></section></legis-body></bill>
