<official-title display="yes">To prohibit the Secretary of Homeland Security from operating or procuring certain foreign-made unmanned aircraft systems, and for other purposes.</official-title>

<section id="H5DC1694881D0457A9C08344765013208" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Unmanned Aerial Security Act</short-title></quote> or the <quote><short-title>UAS Act</short-title></quote>. </text></section> <section id="HD68899309C41493285EF5A4E67E97CDD"><enum>2.</enum><header>Prohibition on operation or procurement of certain foreign-made unmanned aircraft systems</header> <subsection id="HE846AE4D7A4D4B0B92E9B1613481016E"><enum>(a)</enum><header>Prohibition on agency operation or procurement</header><text display-inline="yes-display-inline">Except as provided in subsection (b) and subsection (c)(3), the Secretary of Homeland Security may not operate, provide financial assistance for, or enter into or renew a contract for the procurement of—</text> 
<paragraph id="H4A890314274C499E988278775A393E0C"><enum>(1)</enum><text>an unmanned aircraft system (UAS) that—</text> <subparagraph id="H64F56EA2BFF248AD888A9410D3EECD8F"><enum>(A)</enum><text>is manufactured in a covered foreign country or by a corporation domiciled in a covered foreign country;</text></subparagraph> 
<subparagraph id="H95956A7C12E2430B9B668BC5CA9C58C8"><enum>(B)</enum><text>uses flight controllers, radios, data transmission devices, cameras, or gimbals manufactured in a covered foreign country or by a corporation domiciled in a covered foreign country;</text></subparagraph> <subparagraph id="H31DD55626D0342499BE472F2506B6907"><enum>(C)</enum><text>uses a ground control system or operating software developed in a covered foreign country or by a corporation domiciled in a covered foreign country; or</text></subparagraph> 
<subparagraph id="HA4CDDECA7A054C07A0D8550C90DC3E06"><enum>(D)</enum><text display-inline="yes-display-inline">uses network connectivity or data storage located in a covered foreign country or administered by a corporation domiciled in a covered foreign country;</text></subparagraph></paragraph> <paragraph id="HEF6BF81C63B04925865B0E47B2CFF56A"><enum>(2)</enum><text display-inline="yes-display-inline">a software operating system associated with a UAS that uses network connectivity or data storage located in a covered foreign country or administered by a corporation domiciled in a covered foreign country; or</text></paragraph> 
<paragraph id="H06186C6739EA49C1A1E25EF555C49599"><enum>(3)</enum><text display-inline="yes-display-inline">a system for the detection or identification of a UAS, which system is manufactured in a covered foreign country or by a corporation domiciled in a covered foreign country.</text></paragraph></subsection> <subsection id="H9221BF16D81E444FAB92294C460A34AB"><enum>(b)</enum><header>Waiver</header> <paragraph id="H9FAED00B3BFA4E4A9ECE88E0506C5C61"><enum>(1)</enum><header>In general</header><text>The Secretary of Homeland Security is authorized to waive the prohibition under subsection (a) if the Secretary certifies in writing to the Committee on Homeland Security of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate that a UAS, a software operating system associated with a UAS, or a system for the detection or identification of a UAS referred to in any of subparagraphs (A) through (C) of such subsection that is the subject of such a waiver is required—</text> 
<subparagraph id="H19279A0A88384846BD2D010411A14085"><enum>(A)</enum><text>in the national interest of the United States;</text></subparagraph> <subparagraph id="HBF8BD446AF8D42A1BAE5E96E59F079C9"><enum>(B)</enum><text display-inline="yes-display-inline">for counter-UAS surrogate research, testing, development, evaluation, or training; or</text></subparagraph> 
<subparagraph id="H26D07D64D04A40FD959E92F866B2C3B9"><enum>(C)</enum><text>for intelligence, electronic warfare, or information warfare operations, testing, analysis, and or training.</text></subparagraph></paragraph> <paragraph id="H0841BDD67C674609833E75475A517CC5"><enum>(2)</enum><header>Notice</header><text>The certification described in paragraph (1) shall be submitted to the Committees specified in such paragraph by not later than the date that is 14 days after the date on which a waiver is issued under such paragraph.</text></paragraph></subsection> 
<subsection id="HDE638FA8B8984CCC97314118F3819655"><enum>(c)</enum><header>Effective dates</header> 
<paragraph id="HB7AF715217A94E6FB182DDFA7F067F92"><enum>(1)</enum><header>In general</header><text>This Act shall take effect on the date that is 120 days after the date of the enactment of this Act.</text></paragraph> <paragraph id="H481F025B6FA347C3ABC444AB88AE86C3"><enum>(2)</enum><header>Waiver process</header><text display-inline="yes-display-inline">Not later than 60 days after the date of the enactment of this Act, the Secretary of Homeland Security shall establish a process by which the head of an office or component of the Department of Homeland Security may request a waiver under subsection (b).</text></paragraph> 
<paragraph id="HF1AF810E9DB54303B14D3D225A786EFB"><enum>(3)</enum><header>Exception</header><text display-inline="yes-display-inline">Notwithstanding the prohibition under subsection (a), the head of an office or component of the Department of Homeland Security may continue to operate a UAS, a software operating system associated with a UAS, or a system for the detection or identification of a UAS described in any of subparagraphs (1) through (3) of such subsection that was in the inventory of such office or component on the day before the effective date of this Act until—</text> <subparagraph id="HFF890E37EAB949DCA7480E079688BF1D"><enum>(A)</enum><text>such time as the Secretary of Homeland Security has—</text> 
<clause id="HE10C12C869114AD28085833058914385"><enum>(i)</enum><text>granted a waiver relating thereto under subsection (b), or</text></clause> <clause id="H7AA195113E784A3883B574E9CF3EC903"><enum>(ii)</enum><text>declined to grant such a waiver, or</text></clause></subparagraph> 
<subparagraph id="H60B41DBCD3284E87BD796D510F04FD70"><enum>(B)</enum><text>one year after the date of the enactment of this Act, </text></subparagraph><continuation-text continuation-text-level="paragraph">whichever is later. </continuation-text></paragraph></subsection> <subsection id="H53FAFAA1E129453EB3CFA630B480CC6C"><enum>(d)</enum><header>Drone origin security report to Congress</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Secretary of Homeland Security shall submit to the Committee on Homeland Security of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate a terrorism threat assessment and report that contains information relating to the following:</text> 
<paragraph id="H4D81FA39CA8149FEB2928B196DDA624C"><enum>(1)</enum><text display-inline="yes-display-inline">The extent to which the Department of Homeland Security has previously analyzed the threat that a UAS, a software operating system associated with a UAS, or a system for the detection or identification of a UAS from a covered foreign country operating in the United States poses, and the results of such analysis.</text></paragraph> <paragraph id="H8591A0366AA24FFE8D0CD592E47D7CD6"><enum>(2)</enum><text display-inline="yes-display-inline">The number of UAS, software operating systems associated with a UAS, or systems for the detection or identification of a UAS from a covered foreign country in operation by the Department, including an identification of the component or office of the Department at issue, as of such date.</text></paragraph> 
<paragraph id="HF026587015D34A9FB6D23E2525C69932"><enum>(3)</enum><text display-inline="yes-display-inline">The extent to which information gathered by such a UAS, a software operating system associated with a UAS, or a system for the detection or identification of a UAS from a covered foreign country could be employed to harm the national or economic security of the United States.</text></paragraph></subsection> <subsection id="H9353D1774D1C4944BB2624696521085A"><enum>(e)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="H3B60F72768E74C04A1DBF3A58E52901E"><enum>(1)</enum><header>Covered foreign country</header><text display-inline="yes-display-inline">The term <quote>covered foreign country</quote> means a country that—</text> <subparagraph id="HD3AC0D244DEC40328F17263B0E5E4A03"><enum>(A)</enum><text>the intelligence community has identified as a foreign adversary in its most recent Annual Threat Assessment; or</text></subparagraph> 
<subparagraph id="H76215B1923E54FBAA1B9F5FECCF418DB"><enum>(B)</enum><text>the Secretary of Homeland Security, in coordination with the Director of National Intelligence, has identified as a foreign adversary that is not included in such Annual Threat Assessment.</text></subparagraph></paragraph> <paragraph id="HCE2EDC78E29D479BA85892D178B1E14C"><enum>(2)</enum><header>Intelligence community</header><text>The term <quote>intelligence community</quote> has the meaning given such term in section 3(4) of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3003">50 U.S.C. 3003(4)</external-xref>).</text></paragraph> 
<paragraph id="H7791EDB9E7E840FA8F76ADFA177E9DAB"><enum>(3)</enum><header>Unmanned aircraft system; UAS</header><text display-inline="yes-display-inline">The terms <quote>unmanned aircraft system</quote> and <quote>UAS</quote> have the meaning given the term <quote>unmanned aircraft system</quote> in section 331 of the FAA Modernization and Reform Act of 2012 (<external-xref legal-doc="public-law" parsable-cite="pl/112/95">Public Law 112–95</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/49/44802">49 U.S.C. 44802</external-xref> note).</text></paragraph></subsection></section> </legis-body> <attestation><attestation-group><attestation-date date="20210929" chamber="House">Passed the House of Representatives September 29, 2021.</attestation-date><attestor display="no">Cheryl L.
