<section id="H585A0AC13DB948E2A83B53415623C1EF" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Forest Improvements through Research and Emergency Stewardship for Healthy Ecosystem Development and Sustainability Act</short-title></quote> or the <quote><short-title>FIRESHEDS Act</short-title></quote>.</text></section> <section id="H3AEA2E59874A4ADE8356961E35D58642"><enum>2.</enum><header>Emergency fireshed management</header><text display-inline="no-display-inline">Title VI of the Healthy Forests Restoration Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/16/6591">16 U.S.C. 6591 et seq.</external-xref>) is amended by adding at the end the following:</text>

<section id="H8312C18FB296439F9C7680C8F4749B47"><enum>607.</enum><header>Emergency fireshed management</header>
<subsection id="HE7BBDCC4686E437187D5EDC9C8AE554E"><enum>(a)</enum><header>Establishment of fireshed management areas</header>
<paragraph id="H2C606035032A4C12B973327935C23621"><enum>(1)</enum><header>In general</header>
<subparagraph id="HFAA15EBB920D4DF1BB3AA0BE1B688501"><enum>(A)</enum><header>Joint agreements</header><text>Not later than 90 days after receiving a request from a Governor of a State, the Secretary shall enter into an agreement with such Governor to jointly—</text> <clause id="H44B810589F9E45F3BD8A3D2AC4CB75AB"><enum>(i)</enum><text>designate 1 or more fireshed management areas within such State; and</text></clause>
<clause id="H48CF5A32291644CBB964EC4F8A73FCAC"><enum>(ii)</enum><text>conduct fireshed management projects in accordance with subsection (c) on such fireshed management areas.</text></clause></subparagraph> <subparagraph id="HDFA4EECB30A94E4FA4986C68DD25A297"><enum>(B)</enum><header>Additional fireshed management areas</header><text>With respect to an agreement with a Governor of a State under subparagraph (A), the Secretary, if requested by such Governor, may—</text>
<clause id="H06DFA464EB924528B7771695E228A90B"><enum>(i)</enum><text>designate additional fireshed management areas under such agreement; and</text></clause> <clause id="H6DB00BEB2BA845A7884A73D012B4B57F"><enum>(ii)</enum><text>update such agreement to address new wildfire threats.</text></clause></subparagraph>
<subparagraph id="HC49B60A7D7784136AD7B140EED229684"><enum>(C)</enum><header>Shared stewardship</header><text>A previously signed shared stewardship agreement between a Governor of a State and the Secretary (or an update or successor agreement to such shared stewardship agreement) may be treated as an agreement under subparagraph (A) if such Governor approves such treatment.</text></subparagraph></paragraph> <paragraph id="H307D0111B45B4152ACA8EBA68BA0C20C"><enum>(2)</enum><header>Designation of fireshed management areas</header> <subparagraph id="HC6C714DFFEC5488E823E95B0F63B9DBF"><enum>(A)</enum><header>In general</header><text>A fireshed management area designated under an agreement under paragraph (1)—</text>
<clause id="H7C667FF1BA53449A9E120B3F653B362F"><enum>(i)</enum><text>shall be—</text> <subclause id="HFE51B1B9B5B14BBE97C51CE90CE9E337"><enum>(I)</enum><text>a landscape-scale area; and</text></subclause>
<subclause id="HD19E85BB2EF241969A0116A9F4CF1E94"><enum>(II)</enum><text>identified on the date of such designation as a fireshed ranked in the top 10 percent of wildfire exposure, as determined by the most recently published models of fireshed risk exposure published by the Forest Service; </text></subclause></clause> <clause id="H94E7A5593B3C4FD7AE818D8FDFF27485"><enum>(ii)</enum><text>may not overlap with any other fireshed management area; and</text></clause>
<clause id="HDAC8A992520E4224855BF1DFCECB3FCA"><enum>(iii)</enum><text>may contain Federal and non-Federal land.</text></clause></subparagraph> <subparagraph id="HBE598136BEE44E25AA4AE668F0F54C69"><enum>(B)</enum><header>Applicability of NEPA</header><text>The designation of a fireshed management area under an agreement under paragraph (1) shall not be subject to the requirements of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>).</text></subparagraph></paragraph></subsection>
<subsection id="HA6B8BC3FFE0C490DB75B825FC1BAEAEB" commented="no"><enum>(b)</enum><header>Stewardship and fireshed assessments</header>
<paragraph id="H416ADBD8494A4741801FD912DB783EF8"><enum>(1)</enum><header>In general</header><text>Not later than 90 days after entering into an agreement with a Governor of a State under subsection (a)(1), the Secretary and such Governor shall, with respect to the fireshed management areas designated under such agreement, jointly conduct a stewardship and fireshed assessment that—</text> <subparagraph id="HE78A894A56334A65AA8BFFA0550498CB" commented="no"><enum>(A)</enum><text>identifies—</text>
<clause id="H38577A75A6494FB69551F4BD4CCD2C41" commented="no"><enum>(i)</enum><text>using the best available data, wildfire exposure risks within each such fireshed management area, including scenario planning and wildfire hazard mapping and models; and</text></clause> <clause id="H478CD92706B54AD7A7A216F245A872A9" commented="no"><enum>(ii)</enum><text>each at-risk community within each fireshed management area;</text></clause></subparagraph>
<subparagraph id="H5D86B2A599844DDBAE6798C0EAEE4B88" commented="no"><enum>(B)</enum><text>identifies potential fireshed management projects to be carried out in such fireshed management areas, giving priority—</text> <clause id="H347227CB13F548DAB29185D3E9F424C2"><enum>(i)</enum><text>primarily, to projects with the purpose of reducing threats to public health and safety from catastrophic wildfire; and</text></clause>
<clause id="HB63A2B2D33564CBC98C4E1AD390FC2C3"><enum>(ii)</enum><text>secondarily, to projects with the purpose of protecting—</text> <subclause id="H7BD2E43C4AF441E3A28B629455AEB6F0"><enum>(I)</enum><text>critical infrastructure;</text></subclause>
<subclause id="H2A95DA00E13C46BF9F4DA2AD1FEDF804"><enum>(II)</enum><text>wildlife habitats;</text></subclause> <subclause id="H7FA38013FEBC42F7B31299AA944FE9E9"><enum>(III)</enum><text>watersheds or improving water yield; or</text></subclause>
<subclause id="HA6A546B783DB4F128E9F1DA71336557C"><enum>(IV)</enum><text>any combination of purposes described in subclauses (I) through (III); </text></subclause></clause></subparagraph> <subparagraph id="HA1B0B0C6C6DE487CBF5ED497F95D88A7" commented="no"><enum>(C)</enum><text>includes—</text>
<clause id="H58BB9A1AF6874C8DA22B74C2D633DED2" commented="no"><enum>(i)</enum><text>a strategy for reducing the threat of wildfire to at-risk communities in the wildland-urban interface;</text></clause> <clause id="HCD109CFBBC6745B8944BA4DC0F1616C9" commented="no"><enum>(ii)</enum><text>recommended fireshed management project size limitations based on the best available data; </text></clause>
<clause id="HA6883D8E2BBC431192C51EBB6C3029C0" commented="no"><enum>(iii)</enum><text>a timeline for the implementation of fireshed management projects; and</text></clause> <clause id="H25EDC22ABADB4617AA51EB658CE29115"><enum>(iv)</enum><text>long-term benchmark goals for the completion of fireshed management projects in the highest wildfire exposure areas; and</text></clause></subparagraph>
<subparagraph id="H80D74415938649E8BAFB42DE177B25EA" commented="no"><enum>(D)</enum><text>shall be regularly updated based on the best available data, as determined by the Secretary. </text></subparagraph></paragraph> <paragraph id="H1B74A41DED5940149DE19C2A1EBF5D63"><enum>(2)</enum><header>Information improvement</header> <subparagraph id="H47E54248CC274F7DB0F6FD80EEC5DD72"><enum>(A)</enum><header>Memorandums of understanding</header><text display-inline="yes-display-inline">In carrying out a stewardship and fireshed assessment under this subsection, the Secretary may enter into memorandums of understanding with other Federal agencies or departments, States, private entities, or research or educational institutions to improve, with respect to such assessment, the use and integration of—</text>
<clause id="H3D0CFC3927124E7094056A02B706753F"><enum>(i)</enum><text>advanced remote sensing and geospatial technologies; </text></clause> <clause id="H65E36031200C4141BA28081720BC990D"><enum>(ii)</enum><text>statistical modeling and analysis; or</text></clause>
<clause id="H7AA0959F6D884F2397CEF36197265DD5"><enum>(iii)</enum><text>any other technology the Secretary determines will benefit the quality of information of such an assessment.</text></clause></subparagraph> <subparagraph id="H5B34DD522E184D7C9C07CD5700184A84"><enum>(B)</enum><header>State information</header><text>To the maximum extent practicable, the Secretary shall incorporate data from State forest action plans, State wildfire risk assessments, and other State sources in conducting an assessment under paragraph (1). </text></subparagraph></paragraph></subsection>
<subsection id="H7EB3745126234AF987872CF7382E4852"><enum>(c)</enum><header>Fireshed management projects</header>
<paragraph id="HE4D1B8C35A234F17986473C3E515E57F"><enum>(1)</enum><header>In general</header><text>The Secretary shall carry out fireshed management projects in fireshed management areas designated under an agreement under subsection (a)(1) in accordance with the timeline and project size limitations included in the stewardship and fireshed assessment relating to such areas under subsection (b)(1)(C).</text></paragraph> <paragraph id="H5AD445068D0B49C89E696B2BCC9A504C"><enum>(2)</enum><header>Requirements</header><text>A fireshed management project shall—</text>
<subparagraph id="H243F1460DF6642D4A7626BA405635CAC"><enum>(A)</enum><text>be carried out—</text> <clause id="H047EDC65EC904127A9AD58ADF45DBF04"><enum>(i)</enum><text>in accordance with paragraph (3); </text></clause>
<clause id="HD50670EEDCF740F6B67F68D050F66AC8"><enum>(ii)</enum><text>in accordance with the applicable forest management plan; and</text></clause> <clause id="HA69A8C34EBFF4DEEAF5D395AD0BBA5D2"><enum>(iii)</enum><text display-inline="yes-display-inline">in a manner that maximizes the retention of old-growth and large trees, to the extent that the trees promote stands that are resilient to wildfire; and</text></clause></subparagraph>
<subparagraph id="HB818A86AAFBF45ADB17985ABF114F297"><enum>(B)</enum><text>be—</text> <clause id="HBF1AD4E5E6A74BD6818BA469810D909B"><enum>(i)</enum><text>developed through a collaborative process;</text></clause>
<clause id="H28CE511D9619497FADCAF64E977B8921"><enum>(ii)</enum><text display-inline="yes-display-inline">proposed by a resource advisory committee (as defined in section 201 of the Secure Rural Schools and Community Self-Determination Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/16/7121">16 U.S.C. 7121</external-xref>)); or</text></clause> <clause id="H03973EDED9184FB28D706EEE3FA727F6"><enum>(iii)</enum><text>covered by a community wildfire protection plan.</text></clause></subparagraph></paragraph>
<paragraph id="H161EA0D87061487FA384835A4563C25B"><enum>(3)</enum><header>Authorized activities</header><text>A fireshed management project shall have the primary purpose of—</text> <subparagraph id="H31C8783203B3437580FFA500AAFF01EC"><enum>(A)</enum><text>creating fuel breaks and fire breaks;</text></subparagraph>
<subparagraph id="H5E613F2F5F0742EBBCCB6B869B22CF5C"><enum>(B)</enum><text>conducting hazardous fuels management;</text></subparagraph> <subparagraph id="HF29EB0EACAD9489C9C8FA2F3455F1B7B"><enum>(C)</enum><text>conducting prescribed burns;</text></subparagraph>
<subparagraph id="H88831A315ACB47248CB74B42BDB915C5"><enum>(D)</enum><text>removing dead trees, dying trees, or trees at high-risk of dying; or</text></subparagraph> <subparagraph id="H377BDFF074724036BBFB5CAECAAFD162"><enum>(E)</enum><text>carrying out any combination of the activities described in subparagraphs (A) through (D).</text></subparagraph></paragraph>
<paragraph id="HB2E9C5E8318647D8AA2C92BBDF0038AE" display-inline="no-display-inline"><enum>(4)</enum><header>Categorical exclusion for fireshed management projects</header><text>Fireshed management projects under this subsection shall be— </text> <subparagraph id="H2856222E0D6449518CEE770862C6E60C"><enum>(A)</enum><text>considered an action categorically excluded from the from the preparation of an environmental assessment or an environmental impact statement under section 102 of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4332">42 U.S.C. 4332</external-xref>); and</text></subparagraph>
<subparagraph id="HE40A4BA11B534F3DBC0CA3368304A5FA"><enum>(B)</enum><text>exempt from the special administrative review process under section 105.</text></subparagraph></paragraph> <paragraph id="H30DD878BBDAA4A3BB5B6478259804C7F"><enum>(5)</enum><header>Exclusions</header><text>A fireshed management project may not be carried out on lands—</text>
<subparagraph id="H82E953BEBE804273ACE007F060BC7115"><enum>(A)</enum><text>that are included in the National Wilderness Preservation System;</text></subparagraph> <subparagraph id="HCDECCB458CD040AE8F9B5AB71DB50C95"><enum>(B)</enum><text>that are located within a national or State-specific inventoried roadless area established by the Secretary of Agriculture through regulation, unless—</text>
<clause id="H668EF84A6E5649BE9058DFE36218D252"><enum>(i)</enum><text>the forest management activity to be carried out under such authority is consistent with the forest plan applicable to the area; or</text></clause> <clause id="H5004E51EB2514B9188F57E6902903474"><enum>(ii)</enum><text>the activity is allowed under the applicable roadless rule governing such lands, including—</text>
<subclause id="HDAFB6F3EC5184FCDBF234EB922D00116"><enum>(I)</enum><text>the Idaho roadless rule under subpart C of part 294 or title 36, Code of Federal Regulations;</text></subclause> <subclause id="HD95E2A5C97A34D8BBFBA0EAF02097D47"><enum>(II)</enum><text>the Colorado roadless rule under subpart D of part 294 of title 36, Code of Federal Regulations; or</text></subclause>
<subclause id="HBAAE76317C4C465E8EA3FC46AA4886FE"><enum>(III)</enum><text>any other roadless rule developed after the date of the enactment of this section by the Secretary with respect to a specific State; or</text></subclause></clause></subparagraph> <subparagraph id="H125AAF50932D4160843491E3A8E3474F"><enum>(C)</enum><text>on which timber harvesting for any purpose is prohibited by Federal statute.</text></subparagraph></paragraph>
<paragraph id="H05B0128E9BCB47C78211D67A96C0FC93"><enum>(6)</enum><header>Rule of construction for certain roadless rules</header><text>Nothing in this section shall be construed to affect the roadless rules described in subclauses (I) and (II) of paragraph (5)(B)(ii). </text></paragraph> <paragraph id="H4BEE7B8676DE4766BA10C9673366D790"><enum>(7)</enum><header>Use of other authorities</header><text>To the maximum extent practicable, the Secretary shall use existing statutory and administrative authorities, including a good neighbor agreement entered into under section 8206 of the Agricultural Act of 2014 (<external-xref legal-doc="usc" parsable-cite="usc/16/2113a">16 U.S.C. 2113a</external-xref>), to carry out each fireshed management project.</text></paragraph></subsection>
<subsection id="H847A3881485B41BA8800DA1F4484E31C"><enum>(d)</enum><header>Judicial review</header><text display-inline="yes-display-inline">Section 106 shall apply to fireshed management projects conducted under this section in the same manner as such section applies to an authorized hazardous fuels reduction project conducted under title I, except that no restraining order, preliminary injunction, or injunction pending appeal shall be issued by any court of the United States with respect to any decision to prepare or conduct a fireshed management project in the wildland-urban interface.</text></subsection> <subsection id="H554FF8CB34BE4D7DADDCE487A83FEB07"><enum>(e)</enum><header>Report required</header><text>Not later than 2 years after the date of the enactment of this section and annually thereafter, the Secretary shall submit to Congress a report evaluating the progress and implementation of fireshed management projects under this section.</text></subsection>
<subsection id="H1A02588F1CA944FFB4AB61E805389BAA"><enum>(f)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="H71E1DB3B77EF4B7495B8FB09F0FD174E" display-inline="no-display-inline"><enum>(1)</enum><header>Collaborative process</header><text>The term <term>collaborative process</term> means a process relating to the management of National Forest System lands or public lands by which a project or forest management activity is developed and implemented by the Secretary through collaboration with interested persons, as described in section 603(b)(1)(C).</text></paragraph>
<paragraph id="H45EA8A16AFB64516BE3FFB1D739D91AA"><enum>(2)</enum><header>Fireshed</header><text>The term <term>fireshed</term> means a landscape-scale area that faces similar wildfire threat where a response strategy could influence the wildfire outcome.</text></paragraph> <paragraph id="HD02A0026FC4E49E69B031F223AF2FD77"><enum>(3)</enum><header>Forest plan</header><text>The term <term>forest plan</term> means—</text>
<subparagraph id="H2ED6A2956E3C4ECDB061FB44BA69749D"><enum>(A)</enum><text>a land use plan prepared by the Bureau of Land Management for public lands pursuant to section 202 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1712">43 U.S.C. 1712</external-xref>); or</text></subparagraph> <subparagraph id="HAE49CEDD3D1D455A8248A08D0C5931A2"><enum>(B)</enum><text>a land and resource management plan prepared by the Forest Service for a unit of the National Forest System pursuant to section 6 of the Forest and Rangeland Renewable Resources Planning Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/16/1604">16 U.S.C. 1604</external-xref>).</text></subparagraph></paragraph>
<paragraph id="HF90704CD9F8D4032BE58BDDEA138FE77"><enum>(4)</enum><header>Hazardous fuels management</header><text>The term <term>hazardous fuels management</term> means any vegetation management activities that reduce the risk of wildfire, including mechanical treatments and livestock grazing.</text></paragraph> <paragraph id="H4BB6A1EDFE344CB38DD30963A544EF0A"><enum>(5)</enum><header>Public lands</header><text>The term <term>public lands</term> has the meaning given that term in section 103 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1702">43 U.S.C. 1702</external-xref>), except that the term includes Coos Bay Wagon Road Grant lands and Oregon and California Railroad Grant lands.</text></paragraph>
<paragraph id="H43C7D9F1C8DD4F939F5F561174A64AB5"><enum>(6)</enum><header>Resource advisory committee</header><text>The term <term>resource advisory committee</term> has the meaning given that term in section 201 of the Secure Rural Schools and Community Self-Determination Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/16/7121">16 U.S.C. 7121</external-xref>).</text></paragraph> <paragraph id="H9F099336C648404495BC1C92F506AF84"><enum>(7)</enum><header>Secretary</header><text>The term <term>Secretary</term> means—</text>
<subparagraph id="HDB842B26E17347BCB05883ACE1331F3A"><enum>(A)</enum><text>the Secretary of Agriculture, with respect to National Forest System lands; and</text></subparagraph> <subparagraph id="H963C19E8BEA94EABA0CD737001196738"><enum>(B)</enum><text>the Secretary of the Interior, with respect to public lands.</text></subparagraph></paragraph>
<paragraph id="H3341EA879AA648E397270FB0CC54457A"><enum>(8)</enum><header>Section 101 terms</header><text>The terms <term>at-risk community</term>, <term>community wildfire protection plan</term>, and <term>wildland-urban interface</term> have the meanings given such terms, respectively, in section 101. </text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section> <section id="H38E29C3CA4A1482087D874BF4D715AF9" display-inline="no-display-inline" section-type="subsequent-section"><enum>3.</enum><header>Good neighbor authority</header><text display-inline="no-display-inline">Section 8206 of the Agricultural Act of 2014 (<external-xref legal-doc="usc" parsable-cite="usc/16/2113a">16 U.S.C. 2113a</external-xref>) is amended—</text>
<paragraph id="H7CF0BCBFE00D428DBDAD4A26AAD0020F"><enum>(1)</enum><text>in subsection (a)(4)(A)—</text> <subparagraph id="HFED8E3F3F5594865A582E61880A01E92"><enum>(A)</enum><text>in clause (ii), by striking <quote>and</quote> at the end;</text></subparagraph>
<subparagraph id="HBBCB2EC4D98D4D869CE1432CC20EBC2F"><enum>(B)</enum><text>by redesignating clause (iii) as clause (iv);</text></subparagraph> <subparagraph id="HD254C885B682484BB17440FD0F62383A"><enum>(C)</enum><text>by inserting after clause (ii) the following:</text>

<paragraph id="HD02D777824AA4009AF63B5F4745781B7"><enum>(2)</enum><text>in subsection (b)(2), by amending subparagraph (C) to read as follows:</text> <quoted-block id="H975498ED2FBE432DB4C6CCEEE78596F9" style="OLC"> <subparagraph id="HDC2E7346529942D6B33F3FEC87DBFC7F"><enum>(C)</enum><header>Treatment of revenue</header><text>Funds received from the sale of timber by a Governor of a State under a good neighbor agreement shall be retained and used by the Governor—</text>
<clause id="HBAA266D5518045868CBDC46DAFCF0E21"><enum>(i)</enum><text>to carry out authorized restoration services under such good neighbor agreement; and</text></clause> <clause id="HEB6F6FD0CD2C480CB84BF37F2162C710"><enum>(ii)</enum><text>if funds are remaining after carrying out the services under clause (i), to carry out authorized restoration services within the State under other good neighbor agreements.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>
