which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the American Rescue Plan Act of 2021 to provide additional funding for E-rate support for emergency educational connections and devices, and for other purposes.</official-title></form><legis-body id="H3303F80ACC4449C0912A2D2AB56827E5" style="OLC"><section id="HC3BC7AA70C2F4DE8BAC2C163466EE47A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Securing Universal Communications Connectivity to Ensure Students Succeed Act</short-title></quote> or the <quote><short-title>SUCCESS Act</short-title></quote>.</text></section><section id="H38D7B83DE21B4B97A6E320B5FA5976A0"><enum>2.</enum><header>Support for emergency educational connections and devices</header><subsection id="HBD54464229C34B81A9372848B05211E7"><enum>(a)</enum><header>In general</header><text>Section 7402 of the American Rescue Plan Act of 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/117/2">Public Law 117–2</external-xref>) is amended— </text><paragraph id="HDCB21F687A0F403EBC3C202CF84B0C3E"><enum>(1)</enum><text>in subsection (a), in the matter preceding paragraph (1), by inserting <quote>(except as provided in subsection (c)(2)(B))</quote> after <quote>during a COVID–19 emergency period</quote>; and</text></paragraph><paragraph id="H8AE5D66A53C84D3E9582CCA41B537E55"><enum>(2)</enum><text>in subsection (c)—</text><subparagraph id="HAF909FC470AD4149B9D4A4A4DD7CA915"><enum>(A)</enum><text>by striking paragraph (2) and inserting the following:</text><quoted-block id="H6D42F748511D45A190249D5C1F27A8AE" style="OLC" act-name=""><paragraph id="H0F2261EE2A524930910B43AD8D3D6114"><enum>(2)</enum><header>Appropriation</header><text>In addition to amounts otherwise available, there is appropriated to the Emergency Connectivity Fund, out of any money in the Treasury not otherwise appropriated—</text><subparagraph id="H1D2BDC80170743A3B521886B3DB1B891"><enum>(A)</enum><text>for fiscal year 2021—</text><clause id="H2B08306ED33C4F859758C6A50626A86B"><enum>(i)</enum><text>$7,171,000,000, to remain available until September 30, 2030, for—</text><subclause id="H09E88DF17DCD47688C3ECD7E60C1F11F"><enum>(I)</enum><text>the provision of support under the covered regulations; and</text></subclause><subclause id="HE57CC615FDE544E1AE3C5CC1E300E530"><enum>(II)</enum><text>the Commission to adopt, and the Commission and the Universal Service Administrative Company to administer, the covered regulations; and</text></subclause></clause><clause id="H9C32C288CFAA45D996AAA079C0A4FA0D"><enum>(ii)</enum><text>$1,000,000, to remain available until September 30, 2030, for the Inspector General of the Commission to conduct oversight of support provided under the covered regulations; and</text></clause></subparagraph><subparagraph id="H20FD3E2611FC457E81D1C37D18896FBC"><enum>(B)</enum><text>for each of fiscal years 2022 through 2026, $8,000,000,000, to remain available until expended, for the provision of support under the covered regulations, without regard to when— </text><clause id="HC2DB35342B324CB6B737BDDDE93A8821"><enum>(i)</enum><text>that support is provided; or </text></clause><clause id="H471BDF294D014ABEB413130837DE8DC4"><enum>(ii)</enum><text>any purchase described in subsection (a) occurs.</text></clause></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="HED760662B31A4E4D93F54215030D6871"><enum>(B)</enum><text>in paragraph (3), by striking <quote>under paragraph (2)(A) may be used for the purposes described in clause (ii) of such paragraph</quote> and inserting <quote>under paragraph (2)(A)(i) may be used for the purposes described in subclause (II) of such paragraph</quote>.</text></subparagraph></paragraph></subsection><subsection id="HFA96AB9B68CB40669933321269DB5EC7"><enum>(b)</enum><header>Updates to regulations</header><text>The Federal Communications Commission may make any updates to the regulations promulgated under section 7402(a) of the American Rescue Plan Act of 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/117/2">Public Law 117–2</external-xref>), as in effect before the date of enactment of this Act, that may be necessary as a result of the amendments made by subsection (a) of this section.</text></subsection></section></legis-body></bill>
