R. 4655</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210722">July 22, 2021</action-date><action-desc><sponsor name-id="L000560">Mr. Larsen of Washington</sponsor> (for himself, <cosponsor name-id="K000381">Mr. Kilmer</cosponsor>, <cosponsor name-id="S000510">Mr. Smith of Washington</cosponsor>, and <cosponsor name-id="L000559">Mr. Langevin</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HED00">Committee on Education and Labor</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To establish a pilot program to promote public-private partnerships among apprenticeships or other job training programs, local educational agencies or area career and technical education schools, and community colleges, and for other purposes.</official-title></form><legis-body id="HB539B37B86384E28937BEF0988E42595" style="OLC"><section id="HE95CB8487AC64345BC46611FBC24385A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>American Workforce Investment in Next Generation of Students Act</short-title></quote> .</text></section><section id="H09F743C54DD64B96BFD4FF7C0BB38425"><enum>2.</enum><header>2–2–2 Pilot Program</header><subsection id="H61D469C9DA4E429BBF7C8FD06EF0190E"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">From the amounts appropriated to carry out this Act, the Secretary of Education, in consultation with the Secretary of Labor, shall award grants to not less than 10 eligible entities to carry a program described in subsection (c) for eligible students.</text></subsection><subsection id="HD0BB75D716484A03AF9B74EFD5572371"><enum>(b)</enum><header>Application requirements</header><text>An eligible entity that desires to receive a grant under this section shall submit an application to the Secretary as such time, in such manner, and containing such information as the Secretary may require.</text></subsection><subsection id="H593EA70CEB5249B489C06DEFBA8C3873"><enum>(c)</enum><header>Uses of funds</header><paragraph id="HCDAF03223BA14BEF99B0FE6E34066671"><enum>(1)</enum><header>In general</header><text>An eligible entity that receives a grant under this section shall use such grant to carry out a program under which each eligible student participating in the program—</text><subparagraph id="HCCA3EC51CDBB48DBB6046DD832633F31"><enum>(A)</enum><text display-inline="yes-display-inline">during grades 11 and 12 at a high school served by a local educational agency partner of the eligible entity, enrolls in and completes—</text><clause id="H41910612182E4F5C97FB332C0FB484A9"><enum>(i)</enum><text>STEM and STEM-focused career and technical education courses; and</text></clause><clause id="HAE97B5CCD04C40409CF08B01221D67B8"><enum>(ii)</enum><text display-inline="yes-display-inline">courses that prepare such student for community college and a career in a State-identified high-skill, high-wage, or in-demand industry sector or occupation (within the meaning of such phrase in the Carl D. Perkins Career and Technical Education Act of 2006), or the manufacturing field or other vocational or career and technical education field, or a conservation, sustainability and environmentally focused jobs;</text></clause></subparagraph><subparagraph id="HC1C3CC7FA1844139AA00988ECB1C4536"><enum>(B)</enum><text display-inline="yes-display-inline">upon graduating from the high school, enrolls, at a community college partner of the eligible entity—</text><clause id="H2D8A72E676BE45369A837192419C8DA6"><enum>(i)</enum><text display-inline="yes-display-inline">in a course of study related to a career pathway described in subparagraph (A)(ii); or</text></clause><clause id="HE3716921DF4045DF90FF98C42AE15EFE"><enum>(ii)</enum><text>in a youth apprenticeship program; </text></clause></subparagraph><subparagraph id="HC853FA016C104FF2A9CB09B1D2DE8291"><enum>(C)</enum><text display-inline="yes-display-inline">upon receiving an associate’s degree from the community college, in the case of a student who has not completed the youth apprenticeship program or joint labor-management training program of the eligible entity, enrolls and participates, for at least a 2-year period, in such youth apprenticeship program or joint labor-management training program; </text></subparagraph><subparagraph id="HE055AFFDD2F4464BBF3547EDF2178AB1" commented="no"><enum>(D)</enum><text display-inline="yes-display-inline">receives assistance, on a regular basis throughout the student’s participation in the program at the student’s request and through regular annual meetings, from a student career workforce navigator who—</text><clause id="HA810AF5CFAE74D58AD59518C33698887" commented="no"><enum>(i)</enum><text>assists the student in making decisions to ensure long-term success and eligibility in the program, and evaluating eligible career pathways; and</text></clause><clause id="H39F76AD675DE443EBCC90EED13506F0E" commented="no"><enum>(ii)</enum><text>provides guidance on how to access other Federal benefits (such as nutrition assistance, housing support, and Federal student aid); and</text></clause></subparagraph><subparagraph id="HE1C8A8D08F7D4867A8F6153D30C6A872"><enum>(E)</enum><text>receives work training and job placement through a general or industry specific workforce development consortium employer established under paragraph (2). </text></subparagraph></paragraph><paragraph id="HE8FADC9B324C45B88FF34AB250B2577E"><enum>(2)</enum><header>Workforce development consortium employer</header><subparagraph id="H3C374D588C064A2484B6563442B3667A"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">An eligible entity that receives a grant under this section shall use not less than 10 percent of the grant to establish a workforce development employer consortium described in subparagraph (B) that partners with the local educational agency and community college partners of the eligible entity to provide eligible students participating in the program described in paragraph (1) with work training and job placement.</text></subparagraph><subparagraph id="HF63E17AC8D6B4A52A16E6EE965A9CA44"><enum>(B)</enum><header>Workforce development consortium employer</header><text>For purposes of this paragraph, the <quote>workforce development employer consortium</quote> means—</text><clause id="H1839D0F172E14A29884DACF65B3ADB5F"><enum>(i)</enum><text>a general workforce consortium employer that—</text><subclause id="HF1041B0BEEA84D3498CEDE9975A4A4B2"><enum>(I)</enum><text>focuses on assessing and identifying the common workforce need for the geographic area or community served by the eligible entity; and</text></subclause><subclause id="HC73D696E63CD4C4992D6A86122C06BEB"><enum>(II)</enum><text>is composed of partnering employers, spanning multiple industries or sectors; or</text></subclause></clause><clause id="HC842636B9D6A4248B7C1BDA4768DB757"><enum>(ii)</enum><text>an industry specific workforce development employer consortium that—</text><subclause id="H1D95B73BE70546A6AA4B221FF19CB308"><enum>(I)</enum><text>focuses on assessing and identifying the common workforce need for industries; and</text></subclause><subclause id="HE68411062E504B118F7B14617FE57822"><enum>(II)</enum><text display-inline="yes-display-inline">is composed of partnering employers within a single industry or sector.</text></subclause></clause></subparagraph></paragraph></subsection><subsection id="H00F0D5384E4E4644A6E8245576B87E7B"><enum>(d)</enum><header>Eligible students</header><text display-inline="yes-display-inline">To be eligible to participate in a program described in subsection (c), a student shall, prior to participating in the program, demonstrate academic ability and a commitment to pursue a career pathway described in subsection (c)(1)(A)(ii).</text></subsection><subsection id="H43DCC4A9BCEE4AA798A1375965BC2DF1"><enum>(e)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H364987A532B64D84B21CA395387FA001"><enum>(1)</enum><header>Apprenticeship</header><text display-inline="yes-display-inline">The term <term>apprenticeship</term> means an apprenticeship registered under the Act of August 16, 1937 (commonly known as the <quote>National Apprenticeship Act</quote>; 50 Stat. 664, chapter 663; <external-xref legal-doc="usc" parsable-cite="usc/29/50">29 U.S.C. 50 et seq.</external-xref>).</text></paragraph><paragraph id="H10CFB5B446FB4EB98EAD5308B6C32564"><enum>(2)</enum><header>Area career and technical education school</header><text display-inline="yes-display-inline">The term <term>area career and technical education school</term> has the meaning given the term in section 3 of the Carl D. Perkins Career and Technical Education Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/20/2302">20 U.S.C. 2302</external-xref>).</text></paragraph><paragraph id="H1220BABF03FA49A295B5D374090D9415"><enum>(3)</enum><header>Career and technical education</header><text display-inline="yes-display-inline">The term <term>career and technical education</term> has the meaning given the term in section 3 of the Carl D. Perkins Career and Technical Education Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/20/2302">20 U.S.C. 2302</external-xref>).</text></paragraph><paragraph id="HC7F988CBEA4044A088A6458F97F7A928"><enum>(4)</enum><header>Community college</header><text display-inline="yes-display-inline">The term <term>community college</term> has the meaning given the term <term>junior or community college</term> in section 312(f) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1058">20 U.S.C. 1058(f)</external-xref>).</text></paragraph><paragraph id="HDF9DFFED235048389EF3B62D5E744F29"><enum>(5)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means a partnership—</text><subparagraph id="HAAA00CAC5DBB4D37B12753F057B8732A"><enum>(A)</enum><text>among—</text><clause id="H10C4634EBE6F441A980FCFC109C3E4E7"><enum>(i)</enum><text display-inline="yes-display-inline">at least one local educational agency or area career and technical education school;</text></clause><clause id="H65781D9F0245477B9B94345467446C6F"><enum>(ii)</enum><text>at least one community college; and</text></clause><clause id="HADCEED1A54D14371BB8C3CD44C341E63"><enum>(iii)</enum><text>at least one youth apprenticeship program or joint labor-management training program; and</text></clause></subparagraph><subparagraph id="H89174F16328C44F1B30B190ECCE345A7"><enum>(B)</enum><text display-inline="yes-display-inline">that works with an employer in a State-identified high-skill, high-wage, or in-demand industry sector or occupation described in subsection (c)(1)(A)(ii) that is serving, or seeking to expand its capacity to serve, youth apprenticeship programs. </text></subparagraph></paragraph><paragraph id="H766909EB30E9426BA20E43CF73BEE81B"><enum>(6)</enum><header>ESEA terms</header><text>The terms <term>local educational agency</term>, <term>high school</term>, and <term>State</term> have the meanings given the terms in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>).</text></paragraph><paragraph id="H6B67AB4039EE491A97A4E2324DB7460E"><enum>(7)</enum><header>Joint labor-management training program</header><text display-inline="yes-display-inline">The term <term>joint labor-management training program</term> means a program that—</text><subparagraph id="H7C7DA5E993E2407FA48DF3E7F8884419"><enum>(A)</enum><text display-inline="yes-display-inline">is carried out by a committee that is composed of an equal number of representatives of employers and representatives of employees represented by a bona fide collective bargaining agent; and</text></subparagraph><subparagraph id="HA799CF9A3EA1417ABB886CDF5089240F"><enum>(B)</enum><text>has been established to conduct, operate, or administer an youth apprenticeship program and enter into apprenticeship agreements with apprentices.</text></subparagraph></paragraph><paragraph id="H785C57B90F6A45C49446BAF2B5DC41EC"><enum>(8)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Education.</text></paragraph><paragraph id="HB228AF9F3366432384F0BEDDE2107574"><enum>(9)</enum><header>STEM</header><text display-inline="yes-display-inline">The term <term>STEM</term> means—</text><subparagraph id="HED3C8AF681E144B2A3D3E404E5038192"><enum>(A)</enum><text>science, technology, engineering, and mathematics; and</text></subparagraph><subparagraph id="H02A45F265ECC46B380126B9B6B93F096"><enum>(B)</enum><text>other career and technical education subjects that build on the subjects described in subparagraph (A).</text></subparagraph></paragraph><paragraph id="HF9BD803D95CC490890C85CF2891F1AF1"><enum>(10)</enum><header>Youth apprenticeship program</header><text display-inline="yes-display-inline">The term <term>youth apprenticeship program</term> means an apprenticeship program that is a partner of the eligible entity that—</text><subparagraph id="H5320CDC6B2044E8FA6087B323F92A816"><enum>(A)</enum><text>is designed for an eligible student who at the start of the program is eligible to be enrolled in high school; and</text></subparagraph><subparagraph id="HA794B57CF31246C1ABFB4C0B807C53DB"><enum>(B)</enum><text>incorporates the following:</text><clause id="HF4FF467B24004BF8A064836DE3E324C7"><enum>(i)</enum><text display-inline="yes-display-inline">Paid, on-the-job learning under the supervision of skilled employee mentors. </text></clause><clause id="H4C6485D7F5514C6B9C6BA8BACF738C93"><enum>(ii)</enum><text display-inline="yes-display-inline">Related classroom-based instruction at a local educational agency or community college partner of the eligible entity aligned with a career pathway described in subsection (c)(1)(A)(ii).</text></clause><clause id="H5E2CDDBF456045AFA257D206F3999399"><enum>(iii)</enum><text>Ongoing assessment against established skill and competency standards. </text></clause><clause id="H400914BEF8BD4A268506CC8B9173E9F6"><enum>(iv)</enum><text>Culmination in a recognized postsecondary credential, with the quality of the training leading to the credential reviewed by the eligible entity.</text></clause><clause id="H9F4E539574E04167AC9CB8F231FF6112"><enum>(v)</enum><text>Leads to placement in further education, employment, or an apprenticeship program.</text></clause></subparagraph></paragraph></subsection></section></legis-body></bill>
