R. 464</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210125">January 25, 2021</action-date><action-desc><sponsor name-id="F000454">Mr. Foster</sponsor> (for himself and <cosponsor name-id="F000449">Mr. Fortenberry</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name>, and in addition to the Committees on <committee-name committee-id="HAS00">Armed Services</committee-name>, <committee-name committee-id="HHM00">Homeland Security</committee-name>, and <committee-name committee-id="HFA00">Foreign Affairs</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To realign the nuclear forensics and attribution activities of the Federal Government from the Department of Homeland Security to the National Nuclear Security Administration.</official-title></form><legis-body id="HA928A4489D2C4AFC933B6AE264BA2E03" style="OLC"><section id="HBD19851E6C46414FB4A9E507C2ADDD67" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Nuclear Forensics Authority Realignment Act</short-title></quote>. </text></section><section id="HD4674970203146959230C0BB8E8A1C65"><enum>2.</enum><header>Establishment of National Nuclear Forensics Center</header><subsection id="H13C76648FD9041D293588EC7A74DADFD"><enum>(a)</enum><header>Establishment</header><paragraph id="HB76B7859FD3641E3BC132B9279E010E3"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The National Nuclear Security Administration Act (<external-xref legal-doc="usc" parsable-cite="usc/50/2401">50 U.S.C. 2401</external-xref> et seq.) is amended by inserting after section 3221 the following new section:</text><quoted-block style="OLC" id="H9C1E4DA9BCCB4A0B960C86DCA8C6EF7B" display-inline="no-display-inline"><section id="H0E0F2062A97F41E0900D3C9712DD8A87"><enum>3222.</enum><header>National Nuclear Forensics Center</header><subsection id="H71270D0359FB412F842B2663CA2E707F"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">There is within the Administration a National Nuclear Forensics Center (in this section referred to as the <quote>Center</quote>).</text></subsection><subsection id="HAB8E35A729834C8FB23F1E6E003C4297"><enum>(b)</enum><header>Mission</header><text display-inline="yes-display-inline">The mission of the Center shall be to coordinate stewardship, planning, assessment, gap analysis, exercises, improvement, including operational improvements and research, development, testing, and evaluation, and integration for all Federal nuclear forensics and attribution activities to ensure an enduring national technical nuclear forensics capability to strengthen the collective response of the United States to nuclear terrorism or other nuclear attacks.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="HA37574EFBC734FD78800AF6E8382C9CA"><enum>(2)</enum><header>Clerical amendment</header><text>The table of contents at the beginning of such Act is amended by inserting after the item relating to section 3221 the following new item:</text><quoted-block style="OLC" id="H68B2053991974A64BF2E48D3478E01C2" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">Sec. 3222. National Nuclear Forensics Center.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="HFB10EEAB31624E38AB49CF7B69BBEFE9"><enum>(3)</enum><header>Nuclear forensics expertise</header><text display-inline="yes-display-inline">Not later than one year after the date of the enactment of this Act, the Administrator for Nuclear Security shall develop and implement a plan to modify the university program of the National Nuclear Security Administration established under section 4814 of the Atomic Energy Defense Act (<external-xref legal-doc="usc" parsable-cite="usc/50/2795">50 U.S.C. 2795</external-xref>) to include the development of expertise in nuclear forensics in supporting scientific and engineering advancement in key Department of Energy defense and national security program areas.</text></paragraph></subsection><subsection id="H874CDE95FE6640739083E590C4116C5F" commented="no"><enum>(b)</enum><header>Conforming Repeals</header><paragraph id="H538603EBBC95492580BE9061A4260A4F" commented="no"><enum>(1)</enum><header>In general</header><text>The Nuclear Forensics and Attribution Act (<external-xref legal-doc="public-law" parsable-cite="pl/111/140">Public Law 111–140</external-xref>) is hereby repealed.</text></paragraph><paragraph id="H049F11A6AF3F4235A6233DDE5D4B166D" commented="no"><enum>(2)</enum><header>Homeland Security Act of 2002</header><text display-inline="yes-display-inline">Title XIX of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/590">6 U.S.C. 590</external-xref> et seq.) is amended as follows:</text><subparagraph id="HBEDCAF5BEBC542BFAF5D89059C1607B0"><enum>(A)</enum><text>In section 1923—</text><clause id="H85D12055C5B64ED38EA7D743FDAFA8AA"><enum>(i)</enum><text>in subsection (a)—</text><subclause id="H6457112BEA3E47F19671E66AEAF7F52F"><enum>(I)</enum><text>by striking <quote>(a) <header-in-text level="subsection" style="OLC">Mission.—</header-in-text></quote>; </text></subclause><subclause id="H490792F8EAE342BEB2A8215EE4E950D9"><enum>(II)</enum><text>in paragraph (9), by striking the semicolon and inserting <quote>; and</quote>;</text></subclause><subclause id="H88F12C982CE8487CB38D70ABBE194FCD"><enum>(III)</enum><text>by striking paragraphs (10), (11), (12), and (13); and</text></subclause><subclause id="HB2692DF8C78546ADA334BC2E8148998B"><enum>(IV)</enum><text>by redesignating paragraph (14) as paragraph (10); and</text></subclause></clause><clause id="HA6F93D90946B471BA95628085BE15401"><enum>(ii)</enum><text>by striking subsection (b).</text></clause></subparagraph><subparagraph id="H5752CD912B30439DAA7D38BD19A461EE"><enum>(B)</enum><text>In section 1927(a)(1) (<external-xref legal-doc="usc" parsable-cite="usc/6/596a">6 U.S.C. 596a(a)(1)</external-xref>)—</text><clause id="H12F416524A2E4561BF81722B317D0D90"><enum>(i)</enum><text display-inline="yes-display-inline">in subparagraph (A)(ii), by striking the semicolon and inserting <quote>; and</quote>; </text></clause><clause id="HBD4FA08339AC4401BF8DBEE50F5D7817"><enum>(ii)</enum><text>in subparagraph (B)(iii), by striking <quote>; and</quote> and inserting a period; and</text></clause><clause id="H78008F9843B84A5AA69EA65714ACBDC2"><enum>(iii)</enum><text>by striking subparagraph (C).</text></clause></subparagraph></paragraph></subsection><subsection id="HEA000EC376F74F80B387146B7EDE5F1F"><enum>(c)</enum><header>References and construction</header><text display-inline="yes-display-inline">Any reference in any law, regulation, document, paper, or other record of the United States to the National Technical Nuclear Forensics Center established within the Countering Weapons of Mass Destruction Office of the Department of Homeland Security, formerly the Domestic Nuclear Detection Office, shall be deemed to be a reference to the National Nuclear Forensics Center established by section 3222 of the National Nuclear Security Administration Act, as added by subsection (a).</text></subsection></section></legis-body></bill>
