R. 4627</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210722">July 22, 2021</action-date><action-desc><sponsor name-id="B001303">Ms. Blunt Rochester</sponsor> (for herself, <cosponsor name-id="B001257">Mr. Bilirakis</cosponsor>, and <cosponsor name-id="L000593">Mr. Levin of California</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HVR00">Committee on Veterans' Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require the Secretary of Veterans Affairs to establish standards and requirements for non-Department mental health care providers participating in the Department of Veterans Affairs Community Care program, and for other purposes.</official-title></form><legis-body id="H131C348C6CD947BBAB62B071F746E4D1" style="OLC"><section id="H607F79F43FD7416688C6EE8AB2865BDC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Veterans’ Culturally Competent Care Act</short-title></quote>.</text></section><section id="H5FF515C3796F4BE98BE45D1CA85F679E"><enum>2.</enum><header>Standards and requirements for non-Department mental health care providers participating in Department of Veterans Affairs Community Care program</header><subsection id="HBC0D500E964E413E8220D35C6243C048"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Veterans Affairs shall establish standards and requirements for the provision of mental health care by non-Department of Veterans Affairs health care providers under the Community Care program of the Department under section 1703 of title 38, United States Code. Such standards shall be the same as the standards and requirements applicable to Department employees who provide such mental health care.</text></subsection><subsection id="H4F027B3A7316491BBD486AACA5358BB3"><enum>(b)</enum><header>Training requirement</header><text>Not later than the date that is 180 days after the date on which a provider of mental health care becomes an approved provider under the Community Care program of the Department under section 1703 of title 38, United States Code, the Secretary shall require the provider to complete—</text><paragraph id="HD123B8D8F27E4B0BA5F7829E5F2D4EBA"><enum>(1)</enum><text>the basic course described in subsection (c)(1); and</text></paragraph><paragraph id="H6343407A5D27453DA4FB17F3C5339B53"><enum>(2)</enum><text>each of the four clinical domain courses described in subsection (c)(2).</text></paragraph></subsection><subsection id="HEAA69CDE10E94F4BA0E069C6E43A8B29"><enum>(c)</enum><header>Courses described</header><paragraph id="H23A02DDBEA804613AC1416FAAA410022"><enum>(1)</enum><header>Basic course</header><text>The course described in this paragraph is—</text><subparagraph id="H1A1F28A89889402AA7DE4BEF437D8B7E"><enum>(A)</enum><text>a free, four-module course, made available online, that is developed by the Department of Veterans Affairs about military culture and core competencies for health care professionals; or</text></subparagraph><subparagraph id="H210C7F95528B4FA7824038B6B68C8091"><enum>(B)</enum><text>a successor course or other course the Secretary determines is comparable to the course described in subparagraph (A).</text></subparagraph></paragraph><paragraph id="HC965E8B445994108934EF3E347F57F51"><enum>(2)</enum><header>Clinical domain courses</header><text>The courses described in this paragraph are free courses, made available online, in each of the following clinical domains:</text><subparagraph id="H78E3040A5DFB459FBEFFDD5E5DC83388"><enum>(A)</enum><text display-inline="yes-display-inline">Evaluation and management of suicide.</text></subparagraph><subparagraph id="H26D02A66E2B0408CBD368D52A8EABE43"><enum>(B)</enum><text>Post-traumatic stress disorder.</text></subparagraph><subparagraph id="H8B7ED1E8BE14471DBD10A66F5A612562"><enum>(C)</enum><text>Traumatic brain injury.</text></subparagraph><subparagraph id="H6678BE0357844D0BAEA277F732C070C7"><enum>(D)</enum><text>Military sexual trauma.</text></subparagraph></paragraph><paragraph id="H5E8CBFBEA6FF4D4692290625C1BB9802"><enum>(3)</enum><header>Continuing education</header><text>Each course described in this subsection shall be designed to meet continuing education requirements for mental health care providers.</text></paragraph></subsection><subsection id="H1C1D4A7FC8D54DC49673B14AEF273B2B"><enum>(d)</enum><header>Additional training</header><paragraph id="H3288BCE0A6FF41E99F10F93BF6BF864C"><enum>(1)</enum><header>Identification of training areas</header><text display-inline="yes-display-inline">Not later than two years after the date of the enactment of this Act, the Secretary shall identify at least three clinical domains for which the need for care among veterans is high and shall develop training courses in those clinical domains.</text></paragraph><paragraph id="H88C0943F9B264AEBBD32408D267702C0"><enum>(2)</enum><header>Requirement</header><text display-inline="yes-display-inline">Not later than 60 days after the training courses developed pursuant to paragraph (1) are made available, the Secretary shall require all non-Department mental health care providers approved under the Community Care program of the Department under section 1703 of title 38, United States Code, to complete the courses.</text></paragraph></subsection><subsection id="HBE439EAB73EC4EBC8C99C99646E697E4"><enum>(e)</enum><header>Annual report</header><text>The Secretary shall submit to the Committees on Veterans’ Affairs of the Senate and House of Representatives an annual report on the requirements of this section. Each such report shall include, for the year covered by the report, the number of non-Department mental health care providers who have completed the requirements under this section.</text></subsection></section></legis-body></bill>
