which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name>, and in addition to the Committees on <committee-name committee-id="HWM00">Ways and Means</committee-name>, and <committee-name committee-id="HVR00">Veterans' Affairs</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title XVIII of the Social Security Act to protect coverage for screening mammography, and for other purposes.</official-title></form><legis-body id="H3471556E5CBC49F1AEBF824AAD92060B" style="OLC"><section id="H82A73052854B4BD4AA6FE8B75394E47B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Access to Lifesaving Screenings Act of 2021</short-title></quote> or the <quote><short-title>PALS Act</short-title></quote>.</text></section><section id="H7BF677B6E7E14970A8FBAD8A93B84FC2"><enum>2.</enum><header>Protecting coverage for screening mammography</header><subsection id="HF3C9F5FD7FE848478E21C57BEFAFB749"><enum>(a)</enum><header>In General</header><text>Effective during the period beginning on the date of the enactment of this Act and ending January 1, 2028, any provision of law that refers (including through cross-reference to another provision of law) to the current recommendations of the United States Preventive Services Task Force with respect to breast cancer screening mammography shall be administered as if—</text><paragraph id="HB862D3558F3D4255AA0C8BD844B7DCFA"><enum>(1)</enum><text>such reference to such current recommendations were a reference to the recommendations of such Task Force with respect to breast cancer screening mammography last issued before 2009; and</text></paragraph><paragraph id="H5F5E0C839CEF47E0B9446604D0D8593F"><enum>(2)</enum><text>such recommendations last issued before 2009 applied to any screening mammography modality under section 1861(jj) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(jj)</external-xref>).</text></paragraph></subsection><subsection id="H48B9B2D5CA5F44228E61B8CCFFB647BE"><enum>(b)</enum><header>Continuing medicare coverage without coinsurance</header><text>Section 1833(a)(1)(Y) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395l">42 U.S.C. 1395l(a)(1)(Y)</external-xref>) is amended by inserting after <quote>in the case of such services described in subparagraph (A)</quote> the following: <quote>(other than screening mammography)</quote>.</text></subsection><subsection id="H2A650B4ED21E4AFE9DCE26E4BB46051C"><enum>(c)</enum><header>Maintaining frequency of medicare coverage</header><text>Section 1834(c)(2)(B)(ii) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(c)(2)(B)(ii)</external-xref>) is amended by inserting before the period at the end the following: <quote>, except that in the case of a woman over 39 years of age, such revision may not decrease such frequency</quote>.</text></subsection><subsection id="H5B58F9F5488649B98BE8EF61B6127A4C"><enum>(d)</enum><header>Clarifying the definition of screening mammography</header><text>Section 1861(jj) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(jj)</external-xref>) is amended by inserting <quote>, including any digital modality (such as screening breast tomosynthesis) of such a procedure,</quote> after <quote>radiologic procedure</quote>.</text></subsection><subsection id="H90DB0FB98938404E957FD57D6238985E"><enum>(e)</enum><header>Application to services furnished through Department of Veterans Affairs</header><text>Section 7322(b) of title 38, United States Code, is amended to read as follows:</text><quoted-block display-inline="no-display-inline" id="H820329A24B3A4519887DB8FF2E5C3184" style="USC"><subsection commented="no" id="HE7AA515FF8BF47F789733CE1E0AC0B56"><enum>(b)</enum><text display-inline="yes-display-inline">The policy developed under subsection (a), and any other policy of the Department of Veterans Affairs relating to mammography screening, shall—</text><paragraph commented="no" id="H2C6B88A4EECD43A28E04A931A08CB65A"><enum>(1)</enum><text display-inline="yes-display-inline">specify standards of mammography screening that ensure that the frequency of such screenings is not less than the frequency of such screenings provided pursuant to section 2(a) of the <short-title>Protecting Access to Lifesaving Screenings Act of 2021</short-title>;</text></paragraph><paragraph commented="no" id="HC3736F2326574DD8979847217E2AB191"><enum>(2)</enum><text display-inline="yes-display-inline">provide recommendations, consistent with paragraph (1), with respect to screening, and the frequency of screening, for veterans, without regard to age, who have clinical symptoms, risk factors, or family history of breast cancer; and</text></paragraph><paragraph commented="no" id="HFCE8B25C83BB496ABFC13B9260312517"><enum>(3)</enum><text display-inline="yes-display-inline">provide for clinician discretion in individual cases.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
