R. 4598</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210721">July 21, 2021</action-date><action-desc><sponsor name-id="G000586">Mr. García of Illinois</sponsor> (for himself, <cosponsor name-id="F000466">Mr. Fitzpatrick</cosponsor>, <cosponsor name-id="C001072">Mr. Carson</cosponsor>, and <cosponsor name-id="S001145">Ms. Schakowsky</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 49, United States Code, to require all-cargo aircraft to be equipped with cockpit doors that meet certain safety requirements, and for other purposes.</official-title></form><legis-body id="HF51AF5F7B41D41ED9AE739B4692C550C" style="OLC"><section id="HB76B74C57A83496DB13770B170B6B7E5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Cargo Flight Deck Security Act of 2021</short-title></quote>.</text></section><section id="H7F967FD1B8604759B54067CB21D4BB01"><enum>2.</enum><header>Improved all-cargo flight deck integrity measures</header><subsection id="H0E47B66227BF4A31A6C900B68491365B"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/447">Chapter 447</external-xref> of title 49, United States Code, is amended by adding at the end the following:</text><quoted-block id="H78A974E113F64039836CD3EE4578E6BA" style="USC"><section id="H081552AA281F4D4D8102360B1080B7F3"><enum>44741.</enum><header>All-cargo flight deck integrity measures</header><subsection id="HF483EEBF455D4BB3A4A4425B5CC66239"><enum>(a)</enum><header>In general</header><text>It shall be unlawful for an air carrier to operate a covered aircraft after January 1, 2023, regardless of the date of such aircraft’s type certification, in a covered operation unless such aircraft is equipped with a cockpit door that—</text><paragraph id="H51F6B11817A64D009883918B98861DFB"><enum>(1)</enum><text>meets the requirements of section 25.795(a) of title 14, Code of Federal Regulations, with respect to intrusion resistance; and</text></paragraph><paragraph id="HF99947C0D25A4EA3ACE7BDB1062FD683"><enum>(2)</enum><text>remains locked while the aircraft is in flight, as directed by the pilot in command of such aircraft.</text></paragraph></subsection><subsection id="HBD2D4CD6AC82444A954B252FCC44FE42"><enum>(b)</enum><header>Effect of rulemaking</header><text>The requirement of subsection (a) shall take effect on January 1, 2023, regardless of whether the Administrator of the Federal Aviation Administration has issued regulations to implement such requirement.</text></subsection><subsection id="HB744CC226FC840ECA9C06C23A9D8B752"><enum>(c)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H1F13905B35A54055A08C4C8A8FF014D1"><enum>(1)</enum><header>Covered aircraft</header><text>The term <quote>covered aircraft</quote> means an aircraft used in all-cargo air transportation with a maximum certificated payload capacity that exceeds 6,500 pounds.</text></paragraph><paragraph id="H301B4E4F2A78405D9F8ADB3BCCD45444"><enum>(2)</enum><header>Covered operation</header><text>The term <quote>covered operation</quote> means an operation in all-cargo air transportation under the provisions of part 121 of title 14, Code of Federal Regulations.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HEC04523A0EEC4F7CB6C06C6B2506FCF2"><enum>(b)</enum><header>Clerical amendment</header><text>The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/447">chapter 447</external-xref> of title 49, United States Code, is amended by adding at the end the following:</text><quoted-block id="H9F760375F36C487EB9A1F3166CE9E5EE" style="USC"><toc regeneration="no-regeneration"><toc-entry level="section">44741. All-cargo flight deck integrity measures.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H7828D9A1C44A4B559D8B1BE0BF3C0349"><enum>3.</enum><header>Technical corrections</header><subsection id="HAB8750B91F264055A3E5059079740376"><enum>(a)</enum><header>Section 44737</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/447">Chapter 447</external-xref> of title 49, United States Code, is amending by redesignating the second section 44737 (as added by section 581 of the FAA Reauthorization Act of 2018) as section 44740.</text></subsection><subsection id="H7E1915DAB2C8492684659021338F8A56"><enum>(b)</enum><header>Analysis</header><text display-inline="yes-display-inline">The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/447">chapter 447</external-xref> of title 49, United States Code, is amended—</text><paragraph id="H14F0324BFB894F5A96C774669163C7EE"><enum>(1)</enum><text display-inline="yes-display-inline">by striking the item relating to the second section 44737 (as added by section 581 of the FAA Reauthorization Act of 2018); and</text></paragraph><paragraph id="HC03F58C08F154C2F80DD281F98395BCB"><enum>(2)</enum><text>by inserting after the item relating to section 44739 the following new item:</text><quoted-block style="USC" id="H00DCB4E458BD4568A467BA4C4D5F6410" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">44740. Special rule for certain aircraft operations.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H1EEA14422F2F499B96238D12A08456DE"><enum>(c)</enum><header>Special rule for certain aircraft operations</header><text display-inline="yes-display-inline">Section 44740 of title 49, United States Code, (as redesignated by subsection (a)) is amended—</text><paragraph id="H3D7ED6FA09C741698900E13B8BE67BA2"><enum>(1)</enum><text>in the heading, by striking the period at the end;</text></paragraph><paragraph id="H30D8D81BADDB4F7F976D0460018E5B88"><enum>(2)</enum><text>in subsection (b)(1), by striking <quote>(1)</quote> the second time it appears; and </text></paragraph><paragraph id="H02A271A1F11E4FA49B22D31A0C0954D9"><enum>(3)</enum><text>in subsection (c)(2), by adding a period at the end.</text></paragraph></subsection></section></legis-body></bill>
